Beyond my expectations

I had a bad car accident and looked for attorneys. I found Brian Breiter and the reviews were great almost beyond belief. I hired him to represent me and the great reviews just scratched the surface of how good he was. Brian didnt hand off my case to an associate, he handled it himself. Brian spent a... lot of time with my wife and I going over step by step the litigation procedure. He also showed great concern about me and that meant the world to us. Brian really cared about what I was going through and sincerely wanted the best for me. He went up against a tough insurance company that stalls and hates to part with a penny. Brian and his team never stopped pursing them and getting them to cooperate expeditiously. It was great that he was so accessible. I never had to leave endless messages for him to call me back and he never passed me off to an associate. He always took my calls and dealt with me personally. My case wasnt a rain maker but he handled it as if it were. When he told me what the claim was settled for, I couldnt believe it. I never thought it was going to be so much. It was very refreshing dealing with a man as caring and professional as he was. I wish I could have given him a higher rating than 5 stars.

Brian Breiter Delivered

The headline is that Brian Breiter got us the maximum payout from the two insurance companies involved in our case. For me, that was the most important criteria in rating Mr. Breiter, and he certainly delivered. I also found Brian to be honest, sympathetic, and ultimately, true to his word. I ...was in a serious car accident with my wife, our friend (who was 5 months pregnant), and our friend's 2-year-old son. We were t-boned by a confused elderly man driving a large van. The four of us had varying degrees of injuries, the most serious of which was a traumatic brain injury suffered by my wife. Unfortunately, the driver's coverage maxed out at $30K. Thankfully, our friend had uninsured motorist coverage of $100K (total, so $70K plus the other driver's $30K.) Considering the extent of our injuries and the relatively low amount to be split between 4 parties, I assumed this case would be a slam dunk. But insurance companies don't like to part with their money - and they'll do whatever they can to pay out as little as possible. That's why you need a lawyer like Brian who is capable of negotiating with them, and who is also ready to call their bluff and take them to court if need be. When the 2nd insurance company was considering paying out less than the max amount (which again, was mind-boggling to me), Brian suggested that the insurance rep come sit down with the three injured adults, so that we could tell him how our life was affected by the car accident. It was a smart move which gave the insurance rep a little preview of what he might be up against in court (though it wasn't the most enjoyable hour of my life to be sure). A few hours later, Brian called and told us that we'd be receiving the max amount. Brian was also able to negotiate with our individual health insurance companies to come down on the medical bills we owed them by about a third. (You see, when there's another party involved in the accident, with a potential settlement down the line, your health insurance company will put a lien on the amount that they covered, and demand to be paid back out of your settlement.) Finally, the general fee that a personal injury lawyer usually takes is 33.33% of the total settlement. If your case goes to court, the fee will be closer to 40% (38% in Brian's case, if memory serves correct). I personally believe that this is exorbitantly high, but it's the industry standard and such is life. (That's not a knock on Brian, but more on the industry itself.) That stated, I would strongly advise against trying to do this on your own. Brian Breiter was a steady guide through turbulent legal waters. This isn't just about knowing the law, it's about having the right relationships - and I believe Brian excels in that department. What might be par-for-the-course for Brian, would have most assuredly been a nightmare for me. And since our total max settlement payout was going to be relatively low, considering the severity of our accident, Brian initially said that he would probably lower his fee when it was all said and done. He stayed true to his word, coming down to about 31% respectively. (To be honest, I was hoping he'd come down more, but the truth is, he had no legal obligation to come down at all.) Ultimately, a personal injury lawyer's cut is steep, but well worth it if you hire the right one. As you can see from these reviews, Brian Breiter is clearly one of the good ones. I am very grateful that we can now put this difficult episode behind us knowing that we hired the right man for the job.

The person you want in your corner!

If you are reading this I hope it is not because you were injured and need help navigating the treacherous waters of the legal system. It is not an easy road to travel down and I do not wish it for anyone. However, if you or a family member are injured and have not been treated fairly, the Law Offic...es of Brian Breiter should be your next call. My only regret in the whole process was that I waited a couple months after my accident before I called Mr. Breiter. Calling him earlier would have made the whole process so much easier. I was involved in a hit-and-run accident in March of 2012 while riding my bike. The car hit me while I was riding my bike across a crosswalk with a walk sign on. I went to the emergency room that day but it took me a few weeks to realize that my injuries were permanent. I was angry, depressed, and in great deal of pain. By the time I got a copy of the police report and realized that a witness had identified the driver, months had passed by. I knew Brian in a social capacity at that point but was well aware that he came highly recommended as a trial litigator and true advocate for victims. I kept expecting the other side (AKA the driver and his insurance carrier Wawanesa insurance) to "do the right thing" and I was disappointed by their actions over and over. I was disappointed that the driver hit me and drove off, I was disappointed that he lied about hitting me and I was most disappointed that Wawanesa Insurance would refuse to reimburse me for my medical expenses until they were legally forced to. After dealing with lawyers that represent Wawanesa insurance for years, one thing is clear: they will use every dirty trick in the book to make you give up the fight. I knew that was I was telling the truth but that doesn't matter unless you have a lawyer that is ready to step up and be a true advocate for you. Mr. Breiter was there with me every step of the way. He never pressured me but he also never let me feel that I was alone in this fight. He made himself available to answer my questions and work through my fears. He is very funny and he knew the exact right moment to get me to laugh so that I could diffuse some of my fear and stress. Last week my case went to trial at long last. This is first time that I have ever been in a courtroom, much less as the plaintiff. Walking into that courtroom, I felt like a stranger in a strange land. Brian and his partner Max Draitser saw to it that I was well prepared for what was about to happen but I was still very nervous. Nerves aside, I knew that Brian and Max were excellent at what they do and they would do everything they could to help me win. Brian and Max's courtroom styles complement each other perfectly. Brian has the confidence and charisma that gives you feeling that everything will work out fine and Max has a calm and assured energy that lets you know that he is aware of everything that is happening has your back no matter what. My case was not an easy one but Brian and Max were well prepared and fought for me with every ounce of their being. I was continually amazed at how they anticipated what was needed at each critical moment. I am not exaggerating when I say that Brian's closing remarks were so powerful that they brought me to tears. I am happy to say that we won and justice was finally served. I was able to get damages and I am grateful. I think equally important to me was the fact that a jury found the driver responsible for causing all this heartache and pain and I was so relieved when they did. I can never thank Brian enough for being my guide and protector throughout this entire process. I will never hesitate to recommend him and his firm to anyone that needs help with a personal injury matter. I will never be able to repay Brian, Max, Mark and everyone else that helped bring this matter to a successful close.

Brian Breiter gets an A+

Brian Breiter was my legal counsel and he did an excellent job. He explained EVERYTHING to me, he helped me with patience and he got me a settlement that I am happy with. I have never retained counsel before and was never involved in any type of litigation. When I first talked to him I was unable to... walk and had just had surgery. Three holes were drilled in my kneecap so that my quad tendon could be sewed back on. Ah, such a fond memory of mine. Imagine trying to straighten your leg and it wont move... only to have your quad bunch up like a pomelo on your hip. Brian wisely suggested from the onset keep a journal of my experiences resulting from the injury. He stressed that this is not an overnight event; a marathon not a sprint if you will excuse the cliché. The case was complex with multiple defendants all of whom had different takes on my situation as to who was at fault. He was able to navigate through the different defendants like Han Solo flying the Millennium Falcon through an asteroid field! Anyhow, I can get nervous in stressful situations and Brian helped me keep my cool. He gave me good tips as to how to present myself in deposition and reiterated something that should be obvious "just tell the truth." It is clear that his chief concern is the well-being and the satisfaction of his clients. A former colleague of mine from UC Berkeley referred me to Mr. Breiter and I could tell by the lack of reservations about the recommendation that I would be in good hands. Initially I felt trepidation about the fact that Brian's office is in LA and I live in the SF bay area. I soon realized that Brian was able to provide excellent service even from afar. The travel expenses I paid for Mr. Breiter were reasonable and well worth the cost. His office is staffed by highly qualified individuals who made me feel like I was just down the street. if I was unable to talk to Brian, Mark Rubashkin always was up to date on the status of my case and got information to me on demand. Likewise, Rita Dawley was an integral part of Brian's team and helped me whenever I had questions. Brian's style of communication mixes professionalism with a human side that makes one feel that he knows what he is doing and will get what he requests. This made him easy to work and also imbued within me a sense of much needed confidence that helped my case. There were times during this experience where I felt that our adversaries were well aware that they were going up against a strong force. If he was Han Solo, I guess that made me Chewy. The defense made the right choice and let the Wookie win. In all seriousness, Brian Breiter fought hard for me; for this I owe him my gratitude, my respect and a healthy portion of my settlement.

A solid choice

Brian really helped me. I recommend him highly and am very grateful for his insight and tenacity. I had been involved in a serious car accident and what was the scariest time in my life became more manageable because of his calm and efficient demeanor. I'm grateful for him and look forward to putting... this terrible accident behind me.
