Dear Anonymous, Thank you so very much for taking the time to share your experience with the folks, especially considering the extremely personal nature of your situation. For the benefit of those who may read this, you had asked a question about the statute of limitations (SOL) on sexual battery (rape) cases in FL, which I answered online, prompting a follow-up telephone call from across the pond. While we spoke for quite a while the bulk of our conversation had little to do with the SOL and much more to do with the practical realities of what you could expect if you report a sexual battery (initially from the police and, if a charge was levied, then also from the State Attorney, the defense lawyer and possibly even the press), and we discussed some very personal issues, including familial concerns. I was able to have this conversation with you because for 26+ years I have not only served as a criminal defense lawyer in hundreds and hundreds of cases (including a variety of sex related offenses) but I have also represented many crime victims in the capacity of a "Victim's Rights Advocate". In FL victims of crime have both Constitutional and statutory rights and, sometimes, when the police, the prosecutor and / or the Court just won't listen, a given victim wants a lawyer to make sure that their thoughts, feelings and wishes are heard and given due consideration (in short - making sure that the victim's rights are not trampled by a sometimes cold and oftentimes impersonal system). I know that you have much more information after speaking with me and, whatever decision you make, I am confident that it will be the right decision for you and yours. Dear Anonymous, Some clients need a little more hand holding than others, and I'm usually willing to put in the extra effort. A collateral consequence to my doing so is that my ancillary dedication usually forges a closer bond than that which would naturally occur in the average attorney-client relationship. And so it was in your case. Still, I find it kind of ironic that I am " so on top of" the client "with getting things done and making sure to keep me very updates minute by minute", yet I apply no pressure whatsoever to compel a client review at the conclusion of the case (ergo some 4 months having passed since your case concluded and your client review was submitted)... but there is a reason. Each of my client reviews are 100% genuine, are authored in the client's own words and are submitted because the client chose to do so (and naturally also because I have "earned" it). Dear Brendan, Yes, that "Byzantine process"... I love the reference. Not only its the term underused but it's wholly appropriate. (For the benefit of others who may not know, "Byzantine complexity" refers to anything that is so overly and unnecessarily complex as to be beyond understanding, and that is an oftentimes apt description of the criminal court process... sometimes even for counsel but especially from the perspective of a lay-person.) With that slight aside, apart from achieving the agreed litigation objective on behalf of the Client it is always my personal goal to to earn a positive client review at the conclusion of the case (and I always tell the client as much right from the very first conversation, knowing that I will do all in my power to in fact have earned it when the case closes), and I am delighted to have earned your rave client review (# 144 for #HaberPA on AVVO). But you also need to give yourself some props... I may have steered the ship but you were the proverbial crew. Dear Kethia, So that the folks understand (a little context), you had contacted me from several hundred miles away to help you with your significant other (who is an already convicted felon) who was in custody in Miami, having just been arrested on 2 new serious felony charges and 2 new criminal traffic misdemeanors, all of which violated his existing felony probation, which had a "no bond" provision, as well as an already pending felony probation warrant (also having a no bond provision for a series of prior probation violations) as well as 2 other bench warrants from 2015 criminal traffic cases. Your S/O was going no where (not quickly anyhow) and you and I had a communication's roller-coaster in regards to the reality of his situation (those being that the evidence in the new cases - both felony and criminal traffic - was rock solid and the fact that the probation violations were a veritable slam dunk for the State, subjecting your S/O to 10 years in state prison in a literal matter of moments, and that not even beginning to address the many years that he faced on the new substantive charges) versus your expectations and wishes. But I had a plan, a solid plan, your S/O was on board and to your credit you (not without a few highly contentious moments) ultimately kept taking those necessary leaps of faith forward with me. Long story short, less than 6 weeks later we reached a global resolution with the State, closing all of your S/O's matters (everything), and we did so by beating the litigation objective that I had set (which itself would have been considered a "victory" by any criminal defense lawyer's standards) by a solid 25%. In the end your S/O will be home by the start of summer, with neither any obligation nor tie to the system and with every option to live his life with his family without worrying about probation, parole, police or prosecutors. From day one I promised you that I would never blow sunshine up your skirt, that I would always shoot straight with you, that if you had some faith and patience it would all work out (as best it possibly could) and that my secondary goal (the primary being to do the best job that I could do for your S/O) was to earn ("earn") your positive client review. Reading your review (and my reply) the folks now know that I kept my promise (as I always do). Thank you again for your direct and succinct review. This is one that I am particularly proud of.
