My Lawyer The Hero!

I called Mike Haber, P.A. after getting in some trouble (unfortunately) that could have seriously changed the course of my life as well as future business endeavors. I will refrain from naming the legal issue; but, Mike handled my case with the upmost professionalism, never allowing me to feel defeat...ed, and always had a positive but realistic outlook on the outcome of my case. Needless to say, with Mike's vast legal knowledge and being a highly respected member of Miami's legal community my case was dismissed and expunged much sooner than we had thought. I Made the Right Call!

When his daughter Jean died Mark Twain wrote, “Possibly I know now what the soldier feels when a bullet crashes through his heart.” Sadly, as a parent I too can now relate. Late last year I received a call from a police officer friend who told me that my son had rear ended a stopped police car, i...njuring a police Sergeant in the police car and critically injuring his girlfriend who was the passenger in my son’s car. She was trapped inside of the vehicle and while it was on fire she was carried out of the driver’s side. The firey car crash was clearly captured on police dash cam video, my son’s blood was taken and it turned out that he was very intoxicated at the time. Not knowing what to do I turned to a trusted attorney friend who strongly recommended me to Mike Haber. I called Mike and the very next morning he and I met, and then together we went to the hospital to see my son. Mike interviewed my son with a surprising amount of knowledge and empathy. He understood our shock, emotions and also the immediate need to address the underlying issue of alcohol abuse. (Sadly, this disease runs in my family, having gotten me too, although I’ve been sober for more than 40 years.) To simultaneously help my son with both his substance abuse and psychological and emotional issues (and as it turned out it was also a strategic tool for the case) Mike recommended inpatient treatment immediately after discharge from the hospital at a dual diagnosis facility. He explained that my son would spend 3 months inpatient, then step down to a halfway house and finally would come home and participate in intensive outpatient treatment. By structuring a plan to help my son on both personal and professional levels it was apparent that Mike genuinely cared about my son’s interests both outside and inside of the courtroom. But Mike’s strategy didn’t end there. As the case progressed we brought on experts to help build a defense (a forensic toxicologist for blood evidence issues, an accident reconstructionist for crash evidence and a forensic psychologist for mitigation). I honestly wasn’t sure why Mike insisted on all of this but I quickly found out the why of it. The State Attorney had no empathy at all for my son. Because of my son’s high blood alcohol content, the injury to the police Sergeant and the severe injury to my son’s girlfriend they refused to offer anything less than nearly 6 years in prison, and this is when the fight started in court. Mike and his partner started filing motions and set our experts loose to challenge the State’s evidence, and then I finally understood that our experts - the team that had Mike created - were really important to the motions that Mike was filing. Because of Mike’s strategy and his relentless efforts, after 8 grueling months my son was able to avoid a trial and a possible 7 year prison sentence by agreeing to serve 364 days in jail. Mike’s efforts got the State to make this offer, and now that it’s all said and done I honestly believe that Mike Haber saved my son’s life. I don’t wish it upon anyone but if at some future time you have one of Twain’s “bullet in the heart” life experiences that leaves you in a legal conundrum then let me pass on the recommendation that worked so well for my family: Call Mike Haber. (I should also mention that Mike always - ALWAYS - responded to our calls, texts, emails, etc., even when he was out of the country on vacation with his family.)

Dear Michael, Yours, (#HaberPA's 170th Client Review) is the most well-written, comprehensive and flattering client review that I recall receiving, so much so that I really have nothing to add (which, if you look at my historical comments is, I think, a first). I hate to see a client serve time but, as you pointed out, the evidence in this case was simply overwhelming, and, in the end, I too believe that we (yes, you and your wife helped me greatly) might well have saved your son's life. Your boy is fortunate to be alive, he is very lucky that his girlfriend is alive and also that the Sergeant was not also seriously injured. There is life after jail, we have given him the tools that he needs to carry on and now I only hope that he has the strength of character that his father has to be able to maintain his sobriety. I shopped around for a lawyer but the first time i called Mike Haber and we spoke on the phone for 50 minutes i figured he would be the best choice and i'm glad i found him. In the initial phone conversation he was able to tell me off the top of his head everything i needed to know where 2 other firm...s said they need to check and to call them back. He knows his stuff and how it works. He cc'd me on emails with the state attorney's representative and his negotiation was a one way road, in our favor. He helped me close the case quickly without a trial and just a small fine. Thank you very much

Dear Anonymous, Thank you for sharing your experience with #HaberPA with the folks, especially in regard to our commitment to communication (both initially and throughout the course of the case) and our command over the law and procedure. Just to give some context, your case was a BUI (Boating Under the Influence). You were stopped for "plowing" outside of the channel (an infraction) and rather than helping you a rookie FWC officer proceeded to use his authority to give you a hard time, and then his inexperience to arrest you for a crime with no proof (because it did not occur). We relentlessly pounded the State with discovery demands and with reciprocal discovery (including listing defense witnesses, tendering proof of contemporaneous repairs on your vessel that comported with the basis for the stop and certified NWS weather reports corroborating your version of events as to how and why you flagged down FWC for help), we never took a continuance, because the State couldn't keep up and comply in a timely fashion we were able to run out the speedy trial clock and just days before trial the State offered you a breakdown to "careless boating" (an infraction), with a conviction, DUI school, a fine and court costs. The kicker: When we told the State to pound sand and asked the Court to get our jury panel the State made you an offer that you couldn't, and didn't refuse (a withhold to careless boating and a $500 contribution to "The Everglades Project"). This is what happens when #HaberPA aggressively, relentlessly, tenacious and zealously advocates for you (it also helps that you made yourself available to assist by arming me with the information that I needed, like the proof of trim tab repairs and paying for the NWS weather reports). Your plea was akin to a DUI being broken down to careless driving, with a withhold and a fine... no other penalties (which is a virtually unheard of result). We could have tried this case and clobbered the State (and not doing so cost me trial fees), but I respect your decision to take that deal at my expense (Hell, I would have taken that deal or even counseled my own kid to take it), because it's not about me it's about you. I am glad that you are happy and I am grateful for you authoring #HaberPA's AVVO Client Review #168. Wising you all the best and thanking you again. Oh, and by the way, Anonymous was not lying when he titled his Client Review... his Judge (who will remain nameless) did in fact state on the record in open court that in his case there was "Some damn good Lawyering here"! --> Fondly, MAH/Esq

Don’t look elsewhere!

While on vacation in Miami, I was arrested and charged with a felony battery over a dispute with my soon to be ex wife. Not knowing anyone in Miami I started looking for an attorney and hired one. His name was Jonathan Meltz. I initially paid him $5000 to represent me. We had about two conversations ...over the phone (I was back in Boston then). After three months and a struggle to reach out to him (he would not answer his phone, nor would he return the calls!) I was desperate to find a knowledgeable attorney who could represent me and defend me. My case was not a simple case. It was a felony battery in which the state attorney had secured evidence! I started browsing avvo.com and searches for an other attorney. There I found Michael Haber. I called him on a Saturday evening (around 6pm) and left a voicemail. My call was returned within 30 minutes. After briefly explaining my case, he told me he needed to review the case online and would call me back within the hour. Exactly an hour later, it seemed that he had memorized my case already. My previous attorney had filed absolutely nothing on my behalf. It became evident we needed to act fast as the next hearing was approaching. Since his reviews were all 5 stars I decided to trust him. This was probably the BEST decision I had ever made! He sent all the motions in a timely manner, defended me so aggressively that the district attorney struggled keeping this case going the way they wanted it to. He strategically asked for extensions to give us more time to prepare the case. He threatened to subpoena my ex wife as they were refusing to fly her in to Miami. Yesterday, finally after over a year of struggle, the case was dismissed! I’ll never thank him enough for everything he did!

Dear Jay, Thank you for authoring #HaberPA's 169th Client Review on AVVO. It's not uncommon for me to get calls from people who are (as you were) represented by counsel, yet are sufficiently unhappy with their lawyer that they are shopping for a new legal advocate. When this happens, regardless of my own personal thoughts, I remain neutral on the quality of anyone else's representation. I accept these cases as a clean slate, identifying my own litigation objective from a fixed point in time (regardless of what did or did not transpire before my involvement in the case), strategizing my own path forward and sallying forth independent of any prior action by any prior lawyer. So while I am grateful for your praise, and while I understand that this is your review and that you can (and did) say whatever you wish, I wish that you had not called out your prior lawyer by name. I know Mr. Meltz to be a fine and respected lawyer, and while you and he may have had a bad experience what happened was between you two and really has no place here. That said, I am proud to have earned your praise (equally relieved not to have earned your ire) but I must correct one item from your proffer. I did not strategically ask for extensions in your case. I strategically filed motion after motion which caused the State to seek extension ("continuance") after extension, and that went on for nearly a year until our Judge finally had enough of their shenanigans and forced the State to fish or cut bait (... which resulted in a dismissal of your felony case on the morning of trial). The only regret that I have in your case is that I did not get to fly up to Boston to take any depositions (because I missed out on my beloved namesake - Mike's Pastries - and my absolute favorite pizza at Reginas). Great Defense lawyer

I had the pleasure of hiring Michael Haber PA for my boyfriend’s case. The consideration he took when he decided to pick up his office phone at 8 o’clock on a Friday night speaks volumes, and from that first day before I even decided to hire Mr. Haber he was already diagnosing the case and figuring o...ut what angles to take in the case. With Mr. Haber’s dedication and diligence the case was dropped down from 37 year sentence to a one year sentence. Even though the case was not taken trial I have no doubt in my mind that Mr. Haber and his team were ready to take the task on if necessary.

Dear Anonymous, Thank you very much for your kind words. For the benefit of the folks: Your Beau was habitualized (the State enhanced him as a HVFO - a Habitual Violent Felony Offender, subjecting him to 30, instead of 15, years with a 10 year minimum mandatory, day-for-day sentence) for possession of a firearm by a convicted felon, and he also had 3 narcotics charges to defend (tacking on another potential 7 years). When #HaberPA was retained your Beau was back in custody (having posted bond, having been appointed a PD at Arraignment and having been taken back into custody that morning after the Judge had him drug tested in open court - he had +++ urine and Her Honor revoked his bond). While we were unsuccessful in our immediate attempt at persuading the Court to reinstate his bond we were thereafter relentless with the State Attorney's Office, pounding them with discovery requests, motions (including severance of charges, which effectively required 2 separate trials - 1 for the gun charge and another for the narcotics), forcing multiple State charged continuances and running the natural speedy trial clock to the very end (we were at day 173 of 175 on the day of trial). The State never went below the 10 year min/mand as a bottom of the guidelines plea offer but, with a jury waiting outside of the courtroom on the [damn near] drop dead date for trial they made your Beau an offer that he simply couldn't refuse (1 year, with credit for the 6 months that he had already served, with no probation on the back end...). We really wanted to try this case (baited breath) but your Beau wanted to be home asap, sans risk, and because it's not about what we want (it's about the client), the 1 year offer (with credit for time served) was accepted. Your Beau and you now have finality with no risk on the back end (no probation). Knowing how eager you are to have him home I am happy for you both (and I am grateful for both your faith in hiring #HaberPA and for your kind client review... # 167!). Please know that while we are no longer "attorney-client" we are now friends. :-) Take care, stay in touch and please let me know when he gets home so that we can meet for a celebratory reunion on the outside.
