Dear Anonymous, I am elated that you chose to author #HaberPA's 259th 5-Star Client Review on AVVO "incognito" as I'm eager to share 3 detailed facts (to wit: informed choice, remote representation & early intervention) about your case with the folks & I couldn't've done so (not with any level of detail anyhow) had you ID'd yourself. That said let's get to it! INFORMED CHOICE: There are only a few ways that a Criminal Case can resolve (i.e. The State can "No Action" at Arraignment, the defense can levy a successful "Dispositive Pretrial Motion" - e.g. a Motion to Dismiss, Motion to Suppress or Motion for Statutory Immunity pursuant to Florida's Stand Your Ground Law - an agreed Plea Bargain can be brokered, Pretrial Diversion can be offered & successfully completed or the case can proceed to Verdict after either a Bench Trial or a Jury Trial) & it's incumbent on every Criminal Defense Lawyer to explain these options to potential clients. But, so as to offer responsible advise, a responsible Defense Lawyer must know the facts & circumstances, understand the State's case, identify the relative strengths & weaknesses, develop potential Defense Evidence, consider the various "free radicals" / variables in order to present viable paths & if asked then suggest the most prudent path to the Client in light of the Client's unique situation. In your case you reside in The 954 & were stopped by FHP in St. Lucie County for Speeding. The Trooper claimed to smell weed, ordered you out of the car, searched inside & located "leaf" marijuana, a grinder, a "vape pen" & rolling papers in a backpack which was in passenger seat area. The search of the car is at least arguably unlawful (some Florida Courts have held that humans are physically incapable of differentiating illegal THC from lawful hemp via smell & could find that what happened here was an illegal search & seizure, but other Courts look at it differently) & there was a definite legal question about the warrantless search of the backpack. We discussed these facts & you decided that the risks & costs associated with litigating a Motion to Suppress wasn't worth the ease & certainty of securing a dismissal via Diversion. Meantime I directed you to secure a Medical Marijuana Card (both because it's safer to use THC in The Sunshine State with a MMC & also as I expected that I could use it as a bargaining tool) & in the interim we kept our options open. REMOTE REPRESENTATION: Each Florida jurisdiction has it's own idiosyncrasies & as I don't routinely practice in St. Lucie County I'm unfamiliar with their proclivities. As such I suggested that if you wanted to litigate (as opposed to mitigate) then you'd likely be better served by hiring local counsel (who's familiar with the Judge, the Prosecutor & their policies and protocols), but you were adamant that you wanted PTD. As you had no priors & non-violent charges I was relatively sure that you'd qualify & so I opened a dialogue with the local State Attorney's Office, inquiring as to your eligibility & my ability to offer "remote representation". EARLY INTERVENTION: As you came to me within 24 hours of your Arrest (you were not taken into custody, rather you were given a PTA / Promise to Appear / Notice to Appear) I had a large window within which to maneuver, which gave us a strategic advantage (i.e. had you come to me with but a few days before Arraignment then we'd be playing defense instead of offense). It took just over 3 weeks for your file to be uploaded into the Clerk's system & for the State to open their file & during that window 2 critical things happened. First you in fact secured your MMC & second I learned both that you were PTD eligible & that we could navigate the process remotely. That said when I provided The State with your MMC they opted to file "No Information" / administratively dismiss your case (so you won quick, cheap & entirely). Boutique Lawfirm - true empathy and attention to every detail! Doesn’t miss a beat!

Mr. Haber stepped in at a point where I had spent the whole of 2022 and 2023 waiting for justice and freedom to move on from a case where I was the victim. He made sure my case as a victim was resolved at my satisfaction whilst simultaneously helping resolve a case where I was the defendant... I a...m eternally grateful to this man who treated me with respect and like a sister at a time when previous lawyer and prosecution had failed me as a victim. I believe the prosecution succeeded in showing me how weak the US criminal justice system is in this case and how pointless it can be to seek justice post crime. Prosecution takes long and is painful unless you report a crime fresh - and many women do not do this. I had been deserted by my previous lawyer that had, amongst other mistakes, missed emails from prosecution but did a great job getting an arrest made of the perpetrator initially. Beyond the arrest I was asked for money by previous lawyer to help with case post-arrest but was never represented after an arrest had been made; as technically victims do not need representation. This had been misleading and left me completely alone in the process, where I still wanted insight and support in understanding the process. I have no family in US and was alone at the time. It was at that point Michael Haber stepped in and made miracles happen. He helped explain what had happened to the case and where it was going, and ending. He explained every question mark I had been walking around with that previous lawyer and prosecution had refused to help me with as they treated me, the victim, as a burden. Lastly, in the midst of this chaotic case my mental health deteriorated and I managed to get myself an arrest whilst driving with a larger amount of cannabis from Miami to Key west, whilst only speeding few miles over speed limit. Michael agreed to take on my new felony case where I was the defendant. Mind you, I don't have a record anywhere in the world and was only distraught and attracting problems. MR HABER stepped in a made sure I was always well-informed of all dangers in my case and how to get it resolved, dismissed or simply moving forward towards right direction. I followed all his prompts and he managed to get it dismissed within a few months. Within that time-frame I never felt alone in the process. I still cannot believe the level of boutique legal help and quality at the competitive price. Dear Anonymous, Thank you for your fantastic & generous words in the form of #HaberPA's 246th AVVO Client Review! You provided me with an opportunity to speak to the folks about how #HaberPA can serve not only in our traditional role as Criminal Defense Lawyer but also a a Victim Rights Advocate / VRA. As to the latter, per "Marsy's Law", a/k/a "The Florida Crime Victims' Bill of Rights", both constitutionally (s. 16, Art. I of the Florida's State Constitution) & by statute (see: Chapter 960 Florida Statutes) in Florida Crime Victims enjoy a bevvy of rights. The law empowering crime victims came into effect after Marsalee (Marsy) Ann Nicholas, then 21, had been stalked & murdered by her ex boyfriend in CA, triggering nationwide attention & a call to action. More specifically, 1 week after her murder & while on their way home from the funeral service, Marsy’s family stopped at a local supermarket & while in the checkout line Marsy’s mother was confronted by her daughter’s murderer. Marsy's mother, Marcella, was utterly shocked as she hadn't received any notification from either the Court or the State Attorney that her daughter's killer had been released on Bail just a few days after his booking. Marsy's Law protections vary from State to State but, & sans diving too deeply into it, suffice it to say that here in Florida Marsy's Law effectively “giv[es crime] victims constitutional standing equal to that of the accused and convicted.” That observed, when #HaberPA is retained to serve as a VRA we do so with the same tenacity, zealously & comprehensive care and concern for the victim as we do for the accused in our more traditional role as Criminal Defense Counsel. In your case, while you were initially pleased with your first VRA after a while you felt that his commitment had waned, your were entirely certain that the Assistant State Attorney was not advocating on your behalf & you essentially felt both abandoned & helpless. Your passion for justice led you to seek new counsel, your research led you to #HaberPA, your impression after reading many of our Client Reviews led you to retain me & I happily took over. I will close this aspect of my response by stating that my heart is swollen with pride because of your selflessly telling others that "I am eternally grateful to this man who treated me with respect and like a sister at a time when previous lawyer and prosecution had failed me as a victim." I simply can't imagine anyone penning more meaningful, wonderful words. As to "Act 2" of your saga & as you are Anonymous I can go into some detail. You were stopped for speeding in The Florida Keys (a proverbial capital offense down there, especially as you were in a "Key Deer" area) & upon smelling marijuana a search of your vehicle turned up a felony amount of plant and gummy based THC as well as paraphernalia. You were taken into custody, given both Felony and Misdemeanor Possession charges and detained overnight until your Initial Appearance and Bond Hearing. Because we already had a relationship you contacted me upon release (pro-tip for the folks: you wisely used "your phone call" to contact someone to post bond) & I quickly mapped out and put into place a plan to quash everything. I immediately contacted the Felony Prosecutor & agreed to Waive your Speedy Trial right so as to afford you sufficient time to secure a Medical Marijuana Card / MMC, upon which the State agreed to abandon the felony and instead file a misdemeanor for which you'd be eligible for Diversion / PTI / PTD. Once I provided the State with proof of your MMC they honored their agreement, filed the MM charge at your belated Arraignment (you were never charged with a felony) & agreed to Pretrial Diversion. You successfully completed, we're in the Expungement process now &, amazingly, I got your speeding ticket dismissed. Best defense attorney I could’ve asked for

I am so fortunate to have such an amazing, intelligent, dedicated, kind, caring and professional attorney to help me with my case. Since it was a very complex case, Michael was able to manage to get my privilege to drive for business because he knew it is very important for me to work. Also helped me... with his Doctors who made me realize I had a problem with substances and showing that he really cares….. He is very honest and reliable! Dear Carolina, Thank you so much for your kind words and heartfelt Client Review (#HaberPA's 224th on AVVO). Noting that your choice of adjectives is "blush-worthy" and that you've not identified yourself I'll take a few moments to elaborate on the complexity of your case, how we approached it and why we accomplished our litigation objective. You were arrested for DUI and Felony Drug Possession. The DUI was predicated upon a traffic crash where you had rear-ended another vehicle and in which you blew more than twice (double) the legal limit. The felony charge was based upon the police having located controlled substances within your wingspan (on the ground immediately beside your driver side door) and for which they claim that you verbally admitted both knowledge and ownership. Compounding this was the unavoidable driver license suspension and necessity to navigate DMV's protocols and painstaking processes. Noting the complexities I put together a team to assist you in complying with requirements (be them DMV, bond or otherwise), to both proactively work toward potential mitigation and to ease the unavoidable stress associated with a potential loss, I advised and assisted you to do all that was required to secure a BPO from DMV and then embarked up on the fact finding process. The initial plan was to review everything, cede nothing and look for a way to beat everything, but that was an ideal which had to be tweaked after we had fully vetted the evidence in the case. Once I realized that your breath reading was unavoidably coming in as evidence (there was no basis to suppress it) and that the civilian witness was both available and cooperating with the government we switched tactics and steeled ourselves toward a plan to secure a dismissal of the felony charges (with neither any factual, legal, procedural nor substantive basis upon which to do so), even though that would require you to suffer the DUI, and after much effort we accomplished the same. (I note that, in my opinion anyhow, having incorporated separate treating clinical and forensic psychologists into your orbit from the outset was a "personal plus" for you in that they not only proved to be pivotal in accomplishing our litigation objectives but they, most particularly your treating therapist, helped you to understand your own behavior, maintain sobriety and live a happier life. However I also must note that none of this could possibly have been accomplished without your complete, unbridled and faithful cooperation and proactivity.) And so here we are, while you have a DUI on your record you are NOT a felon (and, as an unexpected bonus, we even got your DUI penalties reduced to the lowest possible levels of 6 - as opposed to 12 - months of supervision and suspension, with no additional or gratuitous conditions, e.g. no Ignition Interlock Device or mandatory participation in AA/NA meetings, etcetera). So, while I appreciate that you "can’t thank [me] enough for all [my] excellent performance" the truth is that you deserve every bit as much, if not more, credit than do I as, restated, I talked the talk but you walked the walk (diligently, faithfully and sans any slip-ups). As to "and advises to be proactive along the process making everything much easier at the end" I will take credit, but I will qualify this by stating that as a "boutique" law firm #HaberPA makes it a priority to be easily reachable by phone, email or on the internet, to engage in open, honest, direct and frequent communication as we come to understand the Client and her/his situation, so as to identify and secure realistic litigation objectives we adopt the Client's interests as our own, quote and honor reasonable fees (in writing), rapidly investigate and prepare cases and then effort at moving Heaven and Earth to relentlessly challenge State witnesses, State evidence, achieve goals and secure acquittals. Excellent attorney

Hi. My husband was convicted of drug trafficking in FL in 2012. After he got out of prison we moved to a different State. He got his driver license and we were all fine up until a few weeks ago when they wouldn't renew his license because Fl had a $38,000 hold against him from fines and costs from... his old FL case. I called the court and the DMV and then started looking for a Miami, FL lawyer to help. I found Michael Haber on google. I called him because we needed an attorney whom could do excactly just like his reviews said he would do, sure enough Mr. Haber immediately took my call. I told Mr. Haber that my husband needed his driver license now so while we were on the phone he looked up my husband's driver license and court case information and then he told me how long it would take and what it would cost to try to get it done. In just a few days Mr. Haber got the court's file (he emailed me copies of everything that he needed from the file), that same day he wrote a motion (he sent me a copy of that too) and then he was in front of the Judge 3 days later. Because of Mr. Haber the Judge removed the case from collections and reduced the money from $38,000 to the original $27,000 that was court ordered back in 2012. That very same day Mr. Haber not only got my husband on a $50 per month payment plan and got paperwork from the Clerk to clear the FL driver license suspension but he also went to DMV and reinstated my husband's FL driver license (and he emailed us copies of all of that paperwork too). So, in less than 2 weeks time my husband now has his driver license in our home State and we never even had to step foot in FL. Dear Anonymous, Thank you so much for your detailed and heartfelt Client Review (#HaberPA's 158th on AVVO). I don't pat myself on the back too often but as it turned out your husband's was a challenging case that wound up with an excellent result. It was difficult in that you had a dead line (needing immediate relief) and that I therefore had to rely upon my ability to juggle, work with and to some degree manipulate 3 separate entities: A) the Clerk of Court's Office - which I needed to be amenable, competent and cooperative, B) the Court - which I needed to display good will by invoking and using it's discretionary power for rapid equitable relief and C) FL-DMV - a traditionally impersonal and rigid entity with an unfriendly maze of endless bureaucracy. In the end (which was less than 2 weeks from the time of your initial contact) we were successful. Your family saved nearly 30%, your husband got his driver license back and my faith in the system "doing the right thing" was reinvigorated (believe me, when you do what I do daily, sadly you don't see this sort of result often enough). In this case Harvey Ruvin's Office (our Clerk of Court) was spectacular in it's assistance and efficiency, Judge Martin Zilber was exceptional in his understanding and willingness to ease your family's suffering and even DMV cut us great slack in letting me sneak into a line without an appointment to clear your hold and reinstate your driving privilege (so that your home State could be notified that FL was satisfied and you could get the DL that you sought). When my son was younger he used to watch a cartoon called "The Wonder Pets" and their theme was "what's gonna work... teamwork"; well that's what happened here. And as you now know there's plenty of thanks to go around, the greatest of which come from me to you; first for your leap of faith in hiring #HaberPA and permitting me the privilege of being of service and second for your awesome review. My son's legal battle was over once Michael got involved

My son was arrested and charged with Possession with Intent to Distribute Marijuana, a serious felony, and I had no idea who to hire to represent him. There are so many criminal lawyers on the internet but after seeing all of the positive reviews on AVVO for Michael Haber we looked at his website an...d then at his YouTube channel. Actually being able to watch and listen to him explain things convinced us that he was going to be our guy, and now that it's all done we are so happy that we went with him.
