Dear Ryan, Thank you for your kind words in the form of #HaberPA's 271st 5-Star Client Review on AVVO. As of 2024 Ryan was the 87th most popular name for boys (& the 702nd for girls) in the USA but more importantly as no one can identify you & as yours is an excellent learning opportunity for anyone who reads this response I'm quite comfortable in sharing more about your situation with the folks. You got pulled over on 09/17 & were issued a citation for driving a vehicle with an expired registration. (Aside alert: You weren't stopped for a moving violation; rather your Traffic Stop occurred because your license plate was surreptitiously scanned by an Automated License Plate Reader - i.e. a high-speed camera system that automatically captures & transmits license plate data - which was mounted on a Police Squad Car & which alerted Officer Friendly that your vehicle registration was expired. Note that ALPRs can also be stationary but in either event they "red flag" vehicles for any of many reasons - e.g. an expired tag, a suspended Driver License, a Warrant for the registered owner, a Stolen Vehicle Report, an Amber Alert, etcetera - they provide Law Enforcement with Probable Cause to stop the flagged vehicle & anything that happens thereafter is usually fair game - e.g. a DUI arrest.) You read the citation, did a little internet research, took matters into your own hands & attempted to provide timely Proof of Compliance to the Clerk of Court counting on an automatic dismissal. Unfortunately you were woefully unsuccessful, both in terms of complying & in providing proof the thereof. That said you didn't become aware of your “double-fail” until 10/04 when you were once again red flagged by another ALPR, stopped & received yet another citation for driving a vehicle with an expired registration. As a bonus this time your "Stop Cop" was "Officer Unfriendly" & he slapped you with two more Traffic Tickets, one for having no Proof of Insurance & the other for failure to change your address on your driver license. (Aside alert: As to Proof of Insurance you claimed to have digital proof on your phone but that the Cop refused to look, insisting on a physical insurance card & as to the failure to change your address the only reason that you got that ticket was because when the Officer asked you if the address on your DL was correct you said "no".) 10/17 was the 30th day after your first citation was issued & as you hadn't either paid the citation, elected Driver Improvement School or pled "Not Guilty" & requested a Trial you received a notice of suspension of your Driver License for the first ticket at which time you contacted me to figure out what happened & to get you righteous with the Court & DMV. I researched your Driver History, pieced together what had happened, entered appearances as your lawyer in both cases, filed a "Motion for Relief" seeking to have the "D-6 Suspension" that was issued on 10/17 rescinded, set-aside & otherwise vacated, provided instructions making it easy for you to reregister your vehicle & to change the address on your FL-DL & once you provided me with documentation I prepared & properly electronically filed effective compliance notifications & as of today (11/26) all of your citations have been dismissed. The lessons here are: 1) Defending traffic tickets isn't rocket science but it's still legal work, everything lawyers do involve rules, procedures, policies, protocols & deadlines & so even for "minor" matters instead of playing lawyer hire one (i.e. your choice to "pro se" represent wound up costing you far more than it would've had you lawyered-up in September, plus you may not have been cited in October); & 2) the less that you say to The PoPo is usually for the better (i.e. you didn't need to "confess" to another infraction & a lawyer could've helped you to resolve the issue). What every attorney should be!

I had the absolute pleasure of speaking with attorney Michael Haber this evening about a civil demand letter I received from Macy's Department Store. Although this was not a call I was looking forward to having, Mr. Haber immediately put me at ease. Mr. Haber is incredibly intelligent, non-judgmental..., and straightforward. Dear Lisa, Thank you so much for taking the time & expending the effort to submit your 5-Star Client Review (#HaberPA's 265th on AVVO) after our recent conversations. As no one can possibly identify you I'm quite comfortable in providing detail as to "the how, what & why" of our contact / consultation. You recently experienced an issue at a retail establishment where you were stopped by a Loss Prevention Officer, detained & then accused of having committed Retail Theft. You were taken into a "back room" where, upon "interrogation" you stated that you hadn't stolen anything, in fact that you were still inside of the store (i.e. you had not "tak[en] possession of or carr[ied] away [any] merchandise, property, money, or negotiable documents; alter[ed] or remov[ed] a label, universal product code, or price tag; transferr[ed] merchandise from one container to another; or remov[ed] a shopping cart, with intent to deprive the merchant of possession, use, benefit, or full retail value"), had not passed any "last point of payment" & therefore had been irresponsibly & unlawfully accused & detained. Management responded, pulled & reviewed the surveillance footage which, unlike most folks in this situation, substantiated your claim, resulting in both an apology & your immediate release. Fast forward a few weeks & you received a "Civil Demand Letter" in the mail from a Law Firm representing the retailer & demanding payment of $200.00 for your Civil Theft. (Aside alert: Per F. S. 772.11 Florida retailers are statutorily entitled to seek monetary relief from folks for acts Civil Theft; but, so as to get the penalty either you have to succumb to their demand - i.e. voluntarily pay them - or the retailer has to file a Civil Lawsuit which will cost them hundreds to file, then hundreds or thousands more to prosecute a claim that must ultimately be proven in Court by "Clear and Convincing Evidence" of their injury from your Theft; thus the "Demand Letter" is nothing more than an offer to settle a lawsuit which has not yet & which may never be filed.) You ignored the letter (as many folks do) & shortly thereafter received another, ergo bumping the settlement amount higher & then a 3rd letter (now up to about $600.00) after which you did some research into the subject leading you to #HaberPA on AVVO. You didn't follow the traditional path of asking a public question; rather you opted to contact me directly via email, in which you advised me of the following 2 aggravating factors: First, you had 2 prior Arrests & Prosecutions for Petit Theft, both of which were ultimately dismissed & second that you hold various professional licenses from the State of Florida, none of which were aware of the prior dismissed Misdemeanors. I received & replied in a timely fashion, inviting you to call me as your situation was more complicated than "the usual" / "par" Civil Theft (i.e. I felt that an actual conversation would be quicker & more prudent than what would likely be a prolonged email dialogue) & so it came to pass that we spoke. You initially wanted to retain me to handle this for you but I suggested an alternative tactic designed to both save you money & increase the odds of a swift, acceptable resolution, to wit: That you contact the Law Firm directly, apologize for not responding sooner (perhaps conjuring an excuse like a terminal family member) & humbly & with contrition asking for an accommodation on dollars so that you could pay with haste & close the matter. You followed my advise, got a 20% discount (which is better than nothing), paid it immediately & the matter's now behind you, with your State Licensing Agencies remaining in the dark as to any theft allegations (note that this was key for me as had this somehow been reported, had The State become aware of 3 Theft allegations, then you likely would have lost your licenses). I Know the Difference Between the Right and Wrong Lawyer—Because I Hired Both.

Dear Anonymous, Thank you for your amazing 5-Star Client Review (#HaberPA's 262nd on AVVO). I'm elated that you didn't ID yourself so I can freely discuss your case (although sadly the 4k characters allowed for my response can't capture the gravity of your situation). During the course of more than a year of vicious Family Court litigation your wife sought to remove your twin 6 y/o boys to a distant country. Your wife was a citizen of that country & your boys were dual citizens, having been (shout out to Bruce Springsteen "Born in the USA") although they only had U.S. Passports & she employed all sorts of unethical & even illegal methods of accomplishing her objective. From day 1 she tried to remove the kids to her home country (e.g. she tried to secure foreign passports from her country's Consulate, she secured an Ex Parte Domestic Violence Restraining Order which was later dissolved by the Court and petitioned both Family and DV Judges for permission to relocate) but you were able to parry all such efforts & secure an Injunction preventing her from removing the children from the Court's jurisdiction. She railroaded you with regard to support, custody, visitation, etc. to the point that you were homeless for close to a year, literally crashing on friend's couches. You ultimately got your support obligation cut by almost 85% (from $6k to $1k / month) at which time things radically changed for your wife. Within 3 months she was formally evicted, you secured an apartment outfitted for your kids 1 block from the home that their mother was ordered to vacate & your wife got desperate enough to conjure a bogus, unsubstantiated Criminal Complaint against you for which your then-lawyer agreed to serve you up to the Police (more on that at the end). Fortunately your Divorce Lawyer referred you to me. Via intensive, immediate discussions with you, your lawyer & reviewing the family case Clerk's online docket within a few hours I had a good enough understanding to reach out to the Detective. While I couldn't stave off an arrest I was able to proffer facts sufficient to raise doubt as to your wife's 1-sided statement & thus to radically effect the booking charge (i.e. I convinced the Detective to reduce "Burglary with a Battery", a Felony Punishable by Life in Prison to 2 misdemeanors, i.e. DV-Battery and Trespass). I arranged a prompt surrender, for bond to be posted & when you were released we got to work on piecing together a cogent history of the facts leading to your Arrest, as well as identifying an undeniably provable pattern & practice by your wife which clearly established her motive & tactics (including illegal / unethical acts by her family lawyers). Armed with facts & proof I went to work on the Prosecutor who agreed to "No Action" / dismiss the Trespass charge at Arraignment. Over the course of the next 2 week you & I worked together on specifics, gathering the necessary paper trail & equipping me to prepare a highly detailed proffer to the State Attorney intended to secure a dismissal. (In the interim I "coached" your family lawyer as to strategy that could be employed to both help me to help you in Criminal Court as well as inure to your benefit in Family Court.). It took about 3 weeks to convince the State that your wife (their alleged victim) was entirely lacking in credibility, that they couldn't ethically put her on the Witness Stand & as such the remaining misdemeanor was dismissed. It was about 60 days from your voluntarily surrender to a misinformed Detective for a "PBL Felony" to being booked & released on 2 Misdemeanors to having all charges dismissed & being en route to expungement, not to fail to mention you securing Primary Residential Custody of your boys. I wish I had more time to explain to the folks how badly your 1st Criminal Defense Lawyer almost f*cked you but I must stop here. We could not have asked for a more perfect resolution!!!

My son is a law student at U. of Miami. He is still on my auto insurance policy because he is in school. While stopped in front of a police car at a redlight in Miami, the officer used a scanner to randomly check my son's license plate. The state system erroneously indicated that he was an uninsured... driver and was driving with a suspended license, which nothing could be farther than the truth. Because the charges were for a misdemeanor crime, the officer could have arrested my son right then and there, but believed him when he assured the officer he was fully insured. I, myself, am a lawyer and understand that a matter like this, if not handled properly, could delay or inhibit my son being admitted to the Florida Bar. I was panicked! Attorney Michael Haber, my friend from law school, "saved the day." He easily and quickly analyzed the situation, and diligently and precisely performed everything he represented my son for and got all of the charges TOTALLY DISMISSED. He accomplished this through both his knowledge of criminal and traffic laws. In fact, he disposed the case against my son without my son even having to appear in court. Dear Rob, Thank you for your kind words in the form of #HaberPA's 251st 5-Star Client Review. I'd be remiss were I not to point out that your son, who's both a most responsible young man & thus a tribute to you & his Mom, submitted a prior (#249) 5-Star Client Review, & while he did so anonymously your (kind to me but perhaps not so considerate of your son) inadvertently called him out; but as he did nothing wrong, & in any event his were not the "charges of the century", I suppose that there's no harm & thus no foul. That said you & I met in 1988 as "1Ls" at "Harvard South Campus" (i.e. Nova University Law School) & we've been friends for 35+ years. After law school you moved to central Florida & started a lucrative PI / Personal Injury practice whereas I remained in SoFlo (specifically in The 305) plying my trade as a Criminal Defense Litigator. While we don't get to see one another nearly often enough we've maintained contact & our friendship has blossomed into one which incorporates mutual professional admiration & respect. As I'm sure is the situation whenever a PI client entrusts you with her/his case (& therefore possibly her/his economic future), so too is it a source of pride each time that a client bestows upon me their confidence by affording me the privilege of being responsible for their liberty. That said this holds especially true whenever a parent effectively gives me "custody" over their child's liberty, & even more so when that parent happens to be an attorney. It goes without saying to you but is important for the benefit of the folks who read this to know that it's far easier for a lawyer to locate another lawyer for representation (be it for themselves, a loved one or a client) than it is for civilians, many (if not most) of whom have no base of knowledge from which to select the right attorney. Personal recommendations are always both a welcomed & valued referral source, but back in the day when you & I began our respective professional journeys the most common method for locating a lawyer was to literally "let your fingers do the walking" & peruse the "Yellow Pages". Nowadays the physical aspect has tracked technology & evolved into "type your query, click your mouse & let your eyes peruse the pay-for-click Google hits", which is a far more perilous path than the extinct Yellow Pages. This is so as while legit, honest, ethical, diligent lawyers exist in the digital universe in order to find them you have to parry your way through a relentless stream of phony, manufactured, "would-be" choices, particularly those who either possess tech-talent sufficient to create the persona that they wish to be seen (like a modern day Wizard of Oz) or those who are slick enough to hire some tech-savvy miscreant who'll paint the picture on the lawyer's behalf. In this light that's a main reason why reviews like yours (& your son's) are so meaningful (to wit: They convey to potential clients real world experiences, impressions & valuations which can be considered & factored into the hiring calculus). I suppose that some venal lawyers post "scam" reviews (in fact & without naming names I know for certain that some are that unscrupulous) but anyone who reads enough of a given lawyer's Client Reviews will likely see for themselves which are genuine & which are, well, BS. Before I finish I want to add one more thing: As a lawyer you were absolutely correct to recognize that even an innocent, trivial matter like your son's comes with what we in the Criminal Defense industry refer to as "collateral consequences" (i.e. a "Scarlett Letter"), & that especially when it comes to matters such as professional licensing (be it with The Florida Bar or elsewhere) the "ripple effects" can be damning, ergo the need for competent & comprehensive representation. Reliable, knowledgeable, compassionate, professional Lawyer

I was lucky for being referred to Mr. Haber from the beginning of my defense. The first time we met, it was all about trust, especially in those dark moments of life, when I did not clearly know what was happening to me and how I could get back to normal life. Mr. Haber truly explained things with co...nfidence and at my level of understanding. “Sometimes it’s just like being in a rip current without the need to swim against waves” he well said with a confidence in his plans for defense while I was very worried and stressed at first. Soon I realized my case was in good hands when Mr. Haber was working on it. His reassurance despite the uphill battle was huge and his connection in any steps was a relief. Mr. Haber is approachable and professional. Now by describing the post dismissed case status as a glorious moment, I know a reliable, knowledgeable, and compassionate, professional lawyer, and just like how a patient cured from cancer goes back to their doctor, I go back to him if needed. There are no worries though unless and until the cancer comes back. And even then, Mr. Haber is determined to have solutions for success. As always, he does not leave his clients alone in these stressful moments of life. The best way I can describe a case of a wrongful accusation, being dismissed at hearing is like how a patient that has suffered from cancer and uncertainties around cure and treatments receives the brilliant news of a complete remission. It’s like that moment of life when doctors hear: “You mean I’m cured of an evil cancer? It’s gone?” This is a feeling you cannot easily describe due to being overwhelmed with happiness pursued by fear. The happiness for the success to prove innocence in a position of defense when in reality, I was the victim of a manipulative person. The pursuant fear is like a potential relapse in the mind of a patient that has just recovered from cancer after some inevitably damaging and curing chemotherapy. The fear of continuous harm and reputation damage by this person could be very devastating. We sometimes compare doctors to angels when recovered from a serious illness. But I think lawyers like Mr. Haber who go above and beyond are incomparable to angel or doctors because they can even save doctors when no other doctor can do so. Bottom line, In the darkness and despair when you may wish time would go back, it may be enough for a client to pursue the lights shed on their case by a great lawyer as Mr. Haber, which is the key to go back to a normal life.

Dear Anonymous, I can't thank you enough for your amazing review. As I know that you're literally in "the cancer profession", as you (Mr. / Ms. / Mrs. / Dr.?) are Anonymous & in light of your references to cancer / oncology I'll share what I believe to be a few relevant, interesting anecdotes with the folks. First, many of my would be (& actual) clients either have a preexisting or acquire a base of knowledge about their own legal situation by the time that we first speak. While most understand the limitations of what they either know or think that they know, there are "The Others" (shout out to "Lost") who believe that they either know "better" or more than I, & when that happens it's nothing shy of maddening. The silver-lining to that is that I've both come to recognize & apply this to myself, so, for instance, when I recently consulted an orthopedic surgeon about incessant shoulder pain my research allowed me to both follow much of our discussion & to ask relevant questions without overstepping & effectively being "Dr. Haber" who got his M.D. from "Internet U". That said in discussions with potential clients I often "use" doctors, albeit usually referring to myself as a "would-be Facebook / Internet Doctor" as I imply that while it's a good thing to do research & know something about your own situation there's a solid basis for the adage that "a little knowledge is a dangerous thing" (i.e. regardless of how diligently I may study my own medical concerns in no way does that license me as a doctor). Second, & in a very real legal-to-medical sense, Criminal Defense Lawyers are basically "legal oncologists", proverbially being akin to doctors with specialized training in diagnosing and treating "legal cancer"; & it's not a stretch to make a legit analogy of Criminal Prosecution to Cancer (i.e. both can be a "death sentence", albeit one, mine, usually only in a figurative sense). The point is that precisely like oncologists no one in their right mind wants to "need" to retain Criminal Defense Counsel; rather it's almost always done both in reaction to (as opposed to proactively) & out of a Darwin-esque sense of self-preservation & necessity. Finally, noting that some are "better" at it than others, very much like doctors, lawyers (at least those who actually care about the client & the cause) must develop a "bedside manner", & this takes us to your situation. Not only was this incident you first interaction with the criminal process but, being foreign born, raised & only recently admitted to the US (on a student Visa as a medical researcher) you were also culturally unaware of the nuances of dealing with Police. Thus, after you were physically abused by your ex-boyfriend (who went & filed a police report against you the following day, likely because he feared you doing so first) & the Cops showed up asking questions, rather than explaining to them what had happened (i.e. that you were attacked & acted in self-defense) you chose to clam-up & say nothing, just as you'd've had this occurred in your native Middle Eastern Country, given the cultural & misogynist nature existing there. Naturally the Police Officers who responded to your home had no way to know any of that, you didn't tell them & so they did what they thought was appropriate given the complaint & your lack of any defense thereto. Fortunately you were able to provide me with a great deal of information, not only about you & your mind-set but also about your ex & his mentality (including many social media posts, text messages & other undeniable facts which all but proved that he was a sadistic troglodyte), which I was then able to proffer to your Prosecutor, wield to your advantage & use to ultimately secure a "No Action" / Dismissal at your Arraignment (even over your ex's insistence that he wanted you prosecuted). Not to be an ingrate but, like Gregg Allman "I'm no Angel"; still I care & I'm elated to know that it shows. Wishing you all of the best! MAH/Esq. #HaberPA
