Nolle Pros

Back in June 2019, I had a fight with my ex girlfriend which eventually ended up with the City Of Miami getting involved. To make a long story short, I was arrested and was in custody for less than 24 hours before being bonded out. Everything seemed bad from the beginning because my ex pressed charge...s and she continued to cooperate with the state. She was out for blood and showed no mercy whatsoever. I hired my first private attorney in August 2019, which turned out to be a very bad chess move on my part. This attorney did nothing to advance my case and never showed up to any of the hearings. This was going on up until Nov. 2019. I finally had enough of his games. I took it upon myself to search up on super lawyers in my area. Plenty of litigators popped up in my radar but none grabbed my attention like Mike Haber did. I was impressed by his knowledge of advocacy and his use of the English vocabulary. I knew this was the guy I needed in my corner to fight the big red machine. So in January 2020, to start the new year off right, I hired Mike Haber and it was only going up from here. What started out as a rough journey ended up being in my favor because I had to do some self disciplinary things on my part to weaken the ASA’s blow. Although the pandemic arrived in March, 2020 and shut everything down for a few months, Mike and I stuck to our initial game plan which eventually worked out for us in the long run. Mike made sure that the state(and my ex) were not going to have their way with me. Even though I was wrong for hitting my ex, I couldn’t let the system win this war without me at least putting up a fight. Thanks to Mike Haber for helping me get my freedom back. If you’re even in need of a top notch attorney who doesn’t play games in the courtroom, Mike Haber is the man to call. Trust me when I tell you. I am living proof that this man can make miracles happen.

Dear Marc, Thank you for authoring #HaberPA's 225th Client Review on AVVO. We're blessed to have had some wordsmiths convey their thoughts and yours is right up there with the best of them (again, thank you). As you've not identified yourself (and for the benefit of the folks who read this) I'll expand a bit on your case, after which I'll offer my thoughts on yours, but before I do so it's important to note that the State Attorney's Office takes DV cases particularly seriously, all DV cases. In many of these cases the State simply rubber stamps the cops' calculus, opting to accept every word out of the alleged victim's mouth as being just as righteous as the words etched on tablets by the hand of G_d carried down from atop from Mt. Sinai by Moses, and that is precisely what happened in your case. Like fat, lazy fish seeking an easy meal the cops bought your domestic partner's sob story hook, line and sinker; worse yet the prosecutor never asked a question, opting to target you as evil personified. While that's tragic what's worse is that your first lawyer, so far as I can tell, did nothing more than collect and deposit your checks. There was no fight, no challenge, no investigation and no plan. When you consulted me your frustration was patent, and justified. Yes you had unfortunately made some incriminating statements to law enforcement and no there was no way to "disprove" the allegations, but, as Einstein said, "Imagination is more important than knowledge" and it's from there that I began. On it's face your DV case was far more serious than many others because you were not only charged with misdemeanor DV Battery but also with Domestic Aggravated Assault with a Deadly Weapon (a knife), Strong Arm Robbery and Criminal Mischief. My plan was to concurrently debunk the joke of an investigation allegedly conducted by law enforcement in your case, dig up as much dirt as possible against your accuser and convince you to engage in a methodical course of conduct which would, in a worst case scenario, amount to meaningful mitigation. You understood, agreed, armed me with the requisite tools and embarked upon a painstaking path (which, in hindsight, turned out to be clutch). We (you, I and our PI) managed to navigate our way through the height of CoVid pandemic craziness, accomplishing what I consider to have been an impressive portfolio. As it turned out the pandemic worked to our advantage, affording us sufficient time for you to voluntarily and successfully complete a 6 month intensive anger management program (by secretly enrolling you in the State's own Domestic Intervention Program - DIP - we hornswoggled the system), to build a track record in a meaningful therapeutic relationship and to avoid any trouble while my PI and I had ample time to expose both the cops' and the complaining witness' vulnerabilities. By the time that we were done we had shown the State two critical and game-changing things: First that, at best, their alleged victim had both motive and opportunity to exaggerate and second that the cops screwed up by negligently failing to canvass the scene (which, had they done, would have resulted in several surveillance cameras which were targeted on the scene thus leaving no room for interpretation or supposition as well as several independent witnesses who at a minimum cast doubt upon the complaining witness' version of events). Long story short (if that's possible), while we couldn't disprove the BS story we did expose significant weaknesses in the State's case and simultaneously proved that you are the sort of guy who accepts responsibility and is willing to take proactive measures to be a better person. In the end, after about 20 months (which is far longer than I prefer the shelf life of any of my cases to be), the State dismissed all of your charges. Please believe that as grateful as I am for your review I'm even more so for your having been a model client. Wishing you the best! Fondly, MAH/Esq #HaberPA

Outstanding Attorney

Mr. Haber was GOD sent ( I purposefully wanted to make this as my first statement in his review, as that is ABSOULTELY ( intentional CAPS) true!). I don’t think I can do any justice as I write this review on how grateful I am that I hired him for my legal case. It was in October 2020 when I was wrong...fully arrested for an act that I couldn’t have imagined to do even in my grave. The allegations and accusations that were described by the off-duty officer (who arrested me) were so horrific that he made it impossible for me to assure anyone anything that was said was so away from the truth/reality. He not only misunderstood my situation but then fabricated the event and perjured on the affidavit. It is depressing to see those who are actually responsible to safe guard you, turn around and become a threat to you. I have been a law abiding individual throughout my life and this wrongful arrest took a toll on me. As many are aware that there are vast options of selecting an attorney in this greater Miami- Dade area, it is so difficult to assess who is competent and skilled that you can trust for your life. I on the other hand was not very fortunate to select Mr. Haber immediately after my arrest ( as I didn’t know him). Upon searching for so-called well known attorneys, I selected and appointed my previous counsel ( whose name I am not going to purposefully mention, as that will be inappropriate) as my first choice. It was an absolute wrong choice. Nine months went by with no real progress on my case, and after spending pretty penny on him I was frustrated, nervous and doubtful on a successful outcome. I kept researching online regarding Criminal Justice System and came across avvo and found Mr. Haber. Reviewing all of the fantastic (and more importantly genuine) comments made by his past clients, I decided to give him a call ( to which I am sooo glad I did). It was a 45 minute initial call with him where he not only proposed a plan (with confidence) to achieve my primary litigation objective ( obtaining diversion) but he also eased my mind as I was hopeful that may be I will be able to someday see “light in the tunnel”. He was very thorough in laying out the plan and assisting with reaching my primary litigation objective- Diversion. After nine frustrating months and no progress on the case with my previous counsel, I was switched over to Mr. Haber. As soon he was appointed as my counsel, he immediately started working on the next steps as outlined in the plan. His communication skills were impeccable! He always kept me informed along way as we worked upon our plan. In addition, he made himself always available to answer any questions I had either via text, call or email. Five weeks from retaining him, he was able to successfully execute the plan and secure diversion (think about the happiness and relief he provided, it is like getting a second life). The time line is important to note, because on my initial call he had indicated that within 4-6 weeks from retaining him he would be able to provide a definitive answer if he would be able to secure diversion from the State. He stuck with his indicated turn-around time. Because of working in healthcare industry and having a professional license, I did not want to risk a loss at trial, hence was seeking diversion ( as a best alternative). As I enroll in diversion, I hope that my day nears where I successfully complete and graduate from the program so that we can subsequently follow with expungement. Mr. Haber’s professionalism, skill set, thorough follow -up and follow -through are commendable. I am confident that he can take on any complicated case, craft and execute an excellent plan and achieve a successful outcome. I wish and pray that no one gets entangled with the legal system, as the process is very frustrating and extremely nerve wracking, but if anyone does have to face this oppressive system then be assured that Mr. Haber would be the BEST and RIGHT attorney to defend your c

Dear Anonymous, Apart from a general and heartfelt "thank you so very much" for your incredibly kind and detailed Client Review (#216 for #HaberPA on AVVO) I want to take a moment to comment upon what I consider to be the most salient things that you mentioned. First, you hired me only after having already been thoroughly disappointed by a prior privately retained attorney, and for that I am both sorry (sorry for you in that you wasted time and money, you expended unnecessary worry and incurred needless stress for yourself and your family) and grateful (grateful that after such a horrific experience - with an otherwise and seeming competent lawyer - you took a leap of faith in choosing to retain #HaberPA to competently clean up the mess). Sadly, about 40% of my caseload includes clients such as you, to wit: Victims of what can most aptly be described as "p*ss poor lawyering". Second (although most importantly to my mind), you found and chose to speak with me because of other Client Reviews (Client Reviews which are not unlike this one / yours), which is a tribute not only to my competence, dedication and proven abilities but also to those literally hundreds of folks who, like you, so generously offered their time to express their experience and satisfaction with #HaberPA's legal services. Just as is the case with all who came before you, I am humbled, grateful and indebted to you for doing so here and now. Third, you retained me based upon our detailed discussions which culminated in a realistic, achievable and affordable plan of action, but this did not come to be either flippantly or free. Rather, it came from both a deep and detailed dive into the facts and circumstances of your case (e.g. an exhaustive review of all police reports, victim statements, nearly 2 hours of body-cam footage, your version of events and your supporting documents, including medical records, discussions with supporting and potential defense witnesses, etcetera), which culminated in our agreed strategy and which necessarily included tactics designed to undo the damage that your prior lawyer had inflicted upon your cause (be it intentionally or negligently, it was bad). Fourth, I truly appreciate your acknowledgement of my consistency with regard to availability and communication in general, but even more so as regards both my steadfast commitment to and my unwavering belief in achieving our agreed litigation objective (noting that if I do not believe then how are you to do so, much less how are we to expect either the State, the Judge or a Jury to believe?). Finally, while it is always ("always") crucial for to me to both be entirely honest and transparent with my clients (be it in regard to identifying realistic and achievable litigation objectives or otherwise), I also always ("always") remain attentive to the Client's wishes. In your case you wanted diversion. Period. You made this clear to both your first attorney and to myself. While I can't speak to discussions between you and your initial attorney in my case you maintained your desire for admission into diversion (which was something that the State absolutely refused to offer to you) despite my earnest belief that we would secure an acquittal at trial. Not withstanding our difference of opinion as to the best resolution, you were the client, you wanted what you wanted, it was neither illegal nor unethical and so I steeled myself with determination to make your wish a reality. All of this observed I want to take a moment to remind you of the Golden Rules of diversion (e.g. Do what you are supposed to do, when and how you are expected to do so and do not do anything that you are not supposed to do) and to say that I'm eager to expunge it for you. Thank you again for your most sincere and illustrative client review, congratulations on the successful resolution of your case and please accept my best wishes you and your family all of the best in happiness, health, luck and success. Fondly, MAH/Esq

BUI

Michael was prompt and professional. His approach to my case was just what I needed to get the resuts we wanted, that the State was not giving us. After diligently addressing the case with his expertise, he got my charges lessened and withhold of convictions. His knowledge for the court system, and r...elationships he has developed, was the right guy or my case! I very happy with the outcome as well as how Michael handled it along the way.

Dear Roy. Thank you very much for authoring #HaberPA's AVVO Client Review # 183. For the benefit of the folks "BUI" is a DUI, only it occurs on a boat (Boating Under the Influence). Like any criminal case these are tough, they carry a boatload (sorry, couldn't resist the pun) of potential consequences, they're tricky and have many nuances, but a skilled and experienced criminal litigator should know how to (here comes another pun) navigate them. (If you want to know more about BUI then please check out #HaberPA's VideoFAQs #96) BUI: what is it? - https://youtu.be/QyrijyDnPmo # 97) Do I have to be “Captaining” (at the helm) a boat to get a BUI? - https://youtu.be/kaak9la7dKM # 98) BUI: How does it differ from DUI? - https://youtu.be/6e_psjNWojI # 99) How does Law Enforcement give FST’s on a Boat? - https://youtu.be/We4UHKN5g9w and # 100) What are the penalties for BUI in FL? - https://youtu.be/cIeGCbaCrg8 you may also want to watch # 92) Does the 4 Amendment Apply to me on the Water? - https://youtu.be/0XNnmjAmkMY and # 93) What is a Vessel / Boating Safety Check? - https://youtu.be/EBQ_GLGK12Y ). Your BUI ended in a breakdown to reckless boating with no conviction and no probation (i.e. a slightly better deal but the functional equivalent of a breakdown to "wet reckless" from a DUI) but it could have gone to trial. We were ready. We had the court take Judicial Notice of the weather data from the National Oceanic and Atmospheric Administration, we had four listed civilian witnesses (all of whom provided sworn affidavits supporting the theory of the defense) and we had lined up (although we did not retain) an expert to debunk the marine FSTs (which are even more of a pathetic joke than are roadside FSTs); but you chose to accept the broken-down withhold (at which time I convinced the State to agree to drop probation). I say this not to be critical (not even a little, as I completely respect your decision - and it was entirely your decision to make); rather so the folks understand that #HaberPA worked your case up for, and was prepared for, outright war. Regardless, I am elated that you are "very happy with the outcome as well as how Michael handled it along the way", and I am grateful for your taking the time to share your experience with #HaberPA with the folks. As my old friend Quint would say (sing): "Farewell and adieu to you old Spanish Ladies, farewell and adieu you ladies of Spain, For we received orders to sail to old England but we hope in a short time to see you again." Boat safe and be good brother. Fondly, MAH/Esq.

DUI Case

Life changes literally in seconds. Here I was on my way home from a business dinner one early evening when I came across a DUI check point. My lane was randomly picked. I was asked where did I come from and if I had drank any alcohol. I replied, a business dinner and I had a glass of wine. Well, t...his quickly became the worst night of my life. Someone who never had encountered a problem with the law and always followed the rules. I refused the breathalyzer and therefore was arrested. I knew of Attorney Michael Haber from a close family member who had used his services in the past with a favorable outcome. I still consulted with a couple of attorneys, but quickly made the decision to hire Michael. Not to many attorneys will tell you exactly how it is most say what you want to hear. I didn't necessarily like to hear some things he had to say, but with no doubt you will always know where you stand with Michael and he will not sugar coat your situation. It is rare to see an attorney return your phone calls timely, respond to a text and or e-mail and Michael does just that. Everything he told me would happen did and his guidance was exactly on point. He is an experienced, knowledgeable and professional attorney. One that will always get back to you as quickly as possible to answer your questions and/or concerns. I highly recommend Michael Haber as I know you will not be disappointed.

Thank you very much for your positive review. Not that I do not laud my experience and knowledge, but I do take particular pride in being a lawyer who "will always get back to you as quickly as possible to answer your questions and/or concerns" and who will "return your phone calls timely, respond to a text and or e-mail". Communication (honest communication) is one of the keys to any successful relationship, and attorney-client is no different than any other. So no, I will not "not sugar coat your situation" (or, as I like to say, "I won't blow sunshine up your skirt / pant leg")... What I will do is take a comprehensive look at the facts and the circumstances of the case, then apply my experience and the law to lay out the options as I see them, help you to choose a reasonable litigation objective and then make every reasonable effort at securing a dismissal, suppression of evidence or an acquittal by any possible factual, legal, procedural or substantive means or mechanism. Thank you again for your kind review and for your heartfelt recommendation of my services,

Better than the rest...

As a juvenile I was one of many clients misrepresented by a lawyer named Roach; I learned to be cautious of the power and trust I gave to so called professionals. So I obviously had my reservations and questions for the next one. I'm glad that I found Michael Haber by researching peer reviews, becaus...e he did not let me down. I spoke to two other lawyer and got a cheaper price, but Michael stood apart from the others in three ways. 1. Positive - Michael's work ethic is clear by the depth of consideration for me and my case, often drawing from his master level experience to demonstrate good faith in the course of action recommended. 2. Time - He's extremely prompt responding to email or phone calls during the day when I reached out and spent numerous hours answering my questions. He won't leave you with any question unanswered or try to sidestep your concerns because he already knows the answer. Instead he takes a teachers approach and makes sure you comprehend the situation and his actions as a partner. 3. Results - He maintained a no hassle and lively attitude that was a big help in overcoming the fear of what if. I always felt he was giving me 100% effort and kept it real. I feel Michael Haber is an excellent defense attorney and you can call him directly at no charge to find out yourself. Although I was arrested and bailed out, the prosecutors failed to bring proper evidence and witnesses to pursue the charges; disposition "nol pros". Michael Haber, treated me like an honest human being and represented me how I wanted to be; I now consider him my law bodyguard.

"I endorse this lawyer. I first met Mike about 20 years ago when I was a Special Prosecutor in the Narcotics Unit at the Miami Dade State Attorney's Office. He was and still is a hard working and knowledgable attorney, who fought for his client then and still does today. He has always been honest, fair and ethical. He is always fighting to achieve the best possible results for his clients. When I left the Miami Dade State Attorney's Office to start my private practice, I maintained my relationship with him and he and I would consult each other on some of our individual cases. He is a wealth of information and our friendship has grown over the years. "I endorse this lawyer. Attorney Haber in my opinion is an attorney that is truly for the people. I have followed him for a few years now, and remain inestimably impressed with both the amount of knowledge he has in criminal law and also the amount of knowledge he gives to anyone in need of legal guidance. Attorney Haber has a way of breaking down complex legal concepts into very understandable pieces that can be easily digested by someone not so familiar with legal phrases and wording. To have the career he has and the number of years he has dedicated to this craft and still be willing to help out the community at large at a second's notice is what I feel makes him a continual asset and resource to both the legal community and the state of Florida."

Avvo Rating

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.

What determines Avvo Rating?
  • Experience & background Years licensed, work experience, education
  • Legal community recognition Peer endorsements, associations, awards
  • Legal thought leadership Publications, speaking engagements
  • Discipline Disciplinary information may not be comprehensive, or updated. We recommend that you always check a lawyer's disciplinary status with their respective state bar association before hiring them.
