Dear JP, You are most welcome and thank you for authoring #HaberPA's 186th AVVO Client Review. Normally I don't take any pride in securing diversion for a client. Why? Because the sad truth ("sad" for my industry - the criminal defense business - not sad at all for those clients who want diversion) is that in a growing number circumstances prosecutors are offering diversion to more and more people right out of the gate. On my end there is usually no "skill" involved (the client either qualifies or does not) and there is no "talent" required to secure diversion (in fact the State sometimes "extends" the offer directly to the client by snail-mail in advance of Arraignment and before court). That said there are other times where skill and talent are required (as proved to be the case in your situation) and when that happens then I can pat myself on the back for securing diversion in a case where my client should not have been offered the opportunity to earn a dismissal by jumping through a few proverbial hoops. While both your past criminal history disqualified you from entry into diversion and your present charge was a non-eligible offense, thanks to absolutely p*ss poor policing (and our ability to prove it beyond any doubt) we managed to beat the State down so badly that they effectively made you an offer that you simply could not refuse. After that, and over the course of 6 months, you did everything that you were supposed to do, nothing that you were not supposed to do and accordingly you earned your dismissal. So congratulations on beating the odds (not to fail to mention the case) and thank you for sharing your experience with #HaberPA with the folks. Take care my friend. Gratefully, MAH/Esq.

Dear Anonymous, Thank you for both praising #HaberPA's diligence and professionalism and for authoring #HaberPA's 185th Client Review. Although you chose not to use your name I know who you are (based upon timing and your head's up to me about submitting the review) and so I can give the folks some context. You came to me with a criminal history (nothing "horrible", but several prior felony convictions) and facing a slew of new charges (including 5 felony narcotics offenses, 2 narcotics misdemeanors and a gratuitous count of resisting arrest without violence). Although you wisely made no statements and ultimately invoked your rights, much of the incident was captured on police body cams (4 of them to be exact), presenting quite the challenge. Because of the overwhelming evidence against you (most particularly the Spielberg-quality footage) and your undeniable (and scorable) past, the odds were heavily stacked against you; however, with age comes experience, and after 28 years in this business I know that there are almost always options. Long story short it took a while but we were able to dodge all but 1 felony and 1 misdemeanor (everything else was dismissed) and you walked out of the courtroom with 1 year probation and 50 community service hours. You "thought I was certainly going to be put in prison", and in other hands you may well have, but early on you and I agreed upon a litigation objective, I identified a path forward, you did your job while I did mine and in the end, for you, given your particular circumstances, we were victorious. I am thankful for your Client Review, I hope that you're not bothered that I provided context and that I must correct you on one thing (you didn't merely consult with... you actually hired #HaberPA), I wish you the best of luck with probation (you know the potential consequences of a VOP so please be extra-careful) and for you I too "[h]ope [that] I never need him again". Dear Alex, Thank you very much for your kind words (and for authoring #HaberPA's 184th AVVO Client Review). So that the folks understand you reside in Slovenia and while vacationing on Miami Beach and driving a scooter you received 2 criminal traffic citations and 2 traffic infractions. Although you had paid the 2 traffic infractions you had no time to deal with the criminal component of the case until after you had returned overseas. From Slovenia you and I had a detailed WhatsApp discussion. I prepared, emailed to you and then you returned to me the documents that I needed, including verified pleadings permitting me to appear and resolve your misdemeanor cases in your absence. In short order I was able to get both of your criminal traffic citations dismissed and, as icing (and because I had the foresight to have filed a Motion for Relief) I was able to convince the court to reopen and to dismiss the 2 previously paid and closed traffic infractions, resulting in your being 100% righteous with FL-DMV. Tourists are most welcome here but they should know that coming to FL subjects them to laws and rules, including being properly licensed (if you're in FL for more than 30 days then you need a FL driver license and if you are going to drive a 2 or 3 wheel vehicle with 50+ ccs then you need either a motorcycle endorsement on your license or a motorcycle license). Dear Roy. Thank you very much for authoring #HaberPA's AVVO Client Review # 183. For the benefit of the folks "BUI" is a DUI, only it occurs on a boat (Boating Under the Influence). Like any criminal case these are tough, they carry a boatload (sorry, couldn't resist the pun) of potential consequences, they're tricky and have many nuances, but a skilled and experienced criminal litigator should know how to (here comes another pun) navigate them. Your BUI ended in a breakdown to reckless boating with no conviction and no probation (i.e. a slightly better deal but the functional equivalent of a breakdown to "wet reckless" from a DUI) but it could have gone to trial. We were ready. We had the court take Judicial Notice of the weather data from the National Oceanic and Atmospheric Administration, we had four listed civilian witnesses (all of whom provided sworn affidavits supporting the theory of the defense) and we had lined up (although we did not retain) an expert to debunk the marine FSTs (which are even more of a pathetic joke than are roadside FSTs); but you chose to accept the broken-down withhold (at which time I convinced the State to agree to drop probation). I say this not to be critical (not even a little, as I completely respect your decision - and it was entirely your decision to make); rather so the folks understand that #HaberPA worked your case up for, and was prepared for, outright war. Regardless, I am elated that you are "very happy with the outcome as well as how Michael handled it along the way", and I am grateful for your taking the time to share your experience with #HaberPA with the folks. As my old friend Quint would say (sing): "Farewell and adieu to you old Spanish Ladies, farewell and adieu you ladies of Spain, For we received orders to sail to old England but we hope in a short time to see you again." Dear Ali, Thank you so very much for your kind words (in the form of #HaberPA's 182nd Client Review). When I consult with a potential client I do my best to come up with both a realistic goal (a "litigation objective") and a fair price to accomplish the mission. I get there by initially examining any and all available police reports (affidavits, etc.) - so as to understand law enforcement's probable cause for having made the arrest - and afterward (I always want to know the cops' version of events first) I thoroughly vet the "worst case scenario" with the potential client. I also learn as much as I can about the client, especially any prior criminal history and any potentially relevant unique circumstances (i.e. health, medical, psychological, etc.). When I have a client who's particularities suggest that I may need more than one litigation objective (such as you) then I contemplate secondary and even tertiary goals, just as we did in your case. I took a global view of the case and the client (you), considering and planning for the reasonably foreseeable possibilities. Louis Pasteur (and Travis Dane) said that "chance favors the prepared mind", and that is an operating principal at #HaberPA (along with quoting and honoring fair fees, always being available & responsive, keeping the client fully informed and by doing so earning positive client reviews at the conclusion of the case). We plan, as best we can, for everything, including expecting the unexpected... and we always welcome a dismissal.
