Dear Tori, As an initial matter I want to "especially" thank you for your Client Review (which is #HaberPA's 260th here on AVVO). Why the "special" gratitude? What makes yours exceptional? (Note: These are neither rhetoric questions nor are they meant to diminish any of #HaberPA's other Client Reviews; rather it's simply an honest assessment after more than 41,000+questions answered on AVVO - 41,287 to be precise - & reflecting on my many interactions with Askers such as yourself.) However they may come to me (e.g. referral, the internet, etc.) most (meaning nearly all... likely 98-99%) of #HaberPA's AVVO Client Reviews are submitted by people who hired me to represent them & for whom I provided some legal service. Every now and then someone like you, a person who simply asked a question & received an answer, will take a moment to chime in & share their experience with the rest of the folks. This is rare, & it's even scarcer for the review to be positive, much less a 5-Star Review. Why (note: this question is also rhetoric...) you ask? Observing both that most things in life are neither necessarily "black or white" nor do many things necessarily fit into "cookie-cutter" categories, still in my AVVO experience there are essentially 3 types of "Askers", to wit: The overwhelming majority of Askers who make no comment one way or the other (e.g. they may agree or disagree, like or dislike, be pleased or angry with a given response to their question but in any event you'd never know it because there is no feedback, be it by way of the Asker commenting on a lawyer's response, by their sending an email, following up with a phone call or otherwise providing any indicia of their thought process), an unhealthy chunk (were I to guess then I'd speculate it to be in the 20% arena... yes it is likely that high) provide feedback (in one form or another) which is hostile & outright nasty even (note that a percentage of this faction are incessant & relentless in their baseless rage - it is "baseless" as the responses given are what they are, to wit: mere thoughts & views based upon limited, one-sided proffers without having a complete understanding of the situation & are therefore either blanket statements of the law, circumscribed, albeit educated, conjecture or a statement that the Asker should seek "real world" advise from a fully informed, local lawyer - & some of these unbalanced sorts go so far as to absurdly, inappropriately & maliciously author a negative review - be it on AVVO, Google or elsewhere - or even to file a Bar Complaint) & then there is the opposite end of the spectrum (where you fall) of those who are truly grateful that a professional (oftentimes one who charges $500+/hour) took the time to read, review & reply to their question pro bono (free of charge), whether there's follow-up conversation or not (note that I estimate this group to be far smaller than it's antithesis, roughly 10%, & that those who, like you, actually take the time to author a positive review are few & far between). With that extended explanation you had asked a question which I answered. As I always strive to do I addressed your concerns, provided the rules, pointed you to an on-point YouTube VideoFAQ, suggested a course of action & even outlined the language that, in my estimation & given your situation, I recommended that you should reduce to writing to protect yourself. Dear Ashley, Thank you very much for your kind words in the form of #HaberPA's 247th Client Review on AVVO. Since you didn't fully identify yourself, & as, per "MyNameStats" dot com, "Ashley" is the 172nd most popular given name in the USA (estimated at 373,715), I'm confident in my ability to share something about your case without violating client confidence & privilege. But before I do so, & not withstanding your legitimate criticism of the PD(s) who initially represented you, I want to be clear that I have the greatest respect for Public Defenders, most especially those here in The 305. Contrary to popular opinion it's not easy to get hired, much less to remain employed as a PD. It's an oftentimes thankless job that takes brains, ethics & effort, & attorney's who aren't fully committed to the cause simply don't last (not under The Honorable Carlos J. Martinez's watch anyhow). While it's inexcusable that you were never sent copies of the discovery / evidence in your case (which is truly as simple as forwarding to you emails sent to your lawyer by a Prosecutor), much less ever consulted about any of it, I'm sad to report that there are far too many privately retained Criminal Defense Lawyers out there who not only routinely epically fail in that precise way (aside alert: a lawyer's failure to keep a client informed about the status of the case is one of the most frequent grounds for attorney discipline by The Florida Bar), but in some ways it's arguably more painful when you're essentially paying someone to violate The Rules of Professional Conduct ("lawyer ethics") & to effectively commit legal malpractice at your expense (both financially & in actual point of fact). I know this to be true as a good portion of my clients come to me just as you did, after having been superficially "represented" by snake oil salesmen who took their money & then proceeded to recklessly botch the case, ergo my ability to quickly instruct you as to "how to receive my documents". Getting back to you & your case, once you were in possession of your discovery you forwarded it to me & from there we quickly got to work, together, as a team & just as the attorney-client relationship is intended to perform. Once I understood the State's theory of it's case against you (you were charged with Trespass & Battery) & the plea offer that had been extended (to wit: a "withhold of adjudication" with probation & a bevvy of special conditions) I outlined the various alternative paths forward & of those I identified you chose as "Plan A" beating down the State in an effort at securing Pretrial Diversion / PTD which you weren't offered as the victim refused ("Plan B" was a Trial, wherein we would - bad pun warning - proverbially beat your victim into submission & expose him for the lying crybaby that he was). I began to pound your Misdemeanor Prosecutor with Motions to Compel missing materials (which turned out to include several surveillance video & audio files) which we received & reviewed & which disclosed that we had no defense to the Trespass but that there was a good, triable case for the Battery (aside alert: reviewing discovery is critical as had those videos not been tendered then we would not have know the strength of the most damaging charge against you). Armed with that information I began plea negotiations which started well (we had a conscientious young ASA on the case) but which quickly broke down when that ASA was reassigned & we got a new disinterested Prosecutor. I ran the case up the flagpole, making it an issue with the State Attorney's Office & over the course of 6 or so weeks I ultimately convinced the Chief of County Court Prosecutions to agree to PTD, & even to throw in "Early Termination" as a bonus. In the end it took less than 4 (not 5, sorry) months, start to finish, to get you the resolution that you hoped for & have now secured. This is one that I am particularly proud of having earned as it was complicated, interesting and triumphantly scored. For the benefit of the folks here are a few observations: 1) I met you and your family on a Saturday afternoon and into the evening not only as a courtesy to our mutual friend but also because that is what I do (this is one of many reasons that #HaberPA is known as a "boutique" law firm); 2) I took a global view of your situation (no priors, 2 drug related arrests within 2 weeks - the 2nd being way more serious than the 1st - plus a disciplinary suspension and possible expulsion from college based upon the 2nd arrest) and stitched together a long term plan to resolve everything; 3) you trusted my advise, doing what you were tasked to do, with neither error nor fail, and you did not do anything that you were not supposed to do, thus enabling me to do my job; 4) you were patient with me as I dissected the administrative disciplinary process and painstakingly stitched together that which we were already and anyhow accomplishing for court purposes into it's academic counterpart; and 5) you not only heeded my advise but you trusted in my ability to deliver, and in the end we - "we" - pulled off a minor miracle (I could not have done this without you and your family). With a little help / pressure from a fantastic Judge, and after several months of a provable track record upon which we could rely, the State Attorney agreed to consolidate 2 completely separate and distinct cases - and more importantly to allow for a nontraditional resolution to the newly consolidated case - and the icing was that your college's disciplinary panel hopped on board, agreeing to honor all that we had done forensically, to apply it academically and ultimately to reinstate you as a student. All that is left now is for us to convince FDLE to authorize the expungement of 2 different cases, initiated by 2 different police agencies, which have 2 different police case numbers and which generated 2 different corresponding court case numbers (even though they were later consolidated into one). Just as I was when we first met, I remain equally confident that we will accomplish this goal. Again, I cannot thank you enough for your kind and heartfelt words. You brought a smile to my face. People usually get stressed and confused very easily. Between the costs of defense and dragging out cases for their own personal wealth and the lingo no-one but officers of the court understand puts a bad taste in people's mouths when the hear the word attorney. Dear Joseph, First, please accept my most heartfelt "you're welcome" and "thank you". Over the course of 4 or so years I have answered some 19,000 questions on AVVO. I don't know if that sounds like a lot, or not, but I assure you (and everyone else) that this has taken a significant deal of time, effort and energy. I answer questions throughout the day, on weekends and while on vacation. I also necessarily field follow-up to AVVO questions in the form of relentless telephone calls and emails (98% of the time from people who's problem is no where near my practice area and with whom I will never work). In the end I usually hear nothing further from the Asker (nor do I ever expect to) but I also receive plenty of "nasty-grams" (from, people who either did not like what I had to say or how I chose to say it, and also from people who feel that they are entitled to more than my free of charge internet answer).
