Dear Alex, Right out of the gate I want to thank you for 3 things: 1) For your kind Client Review (#HaberPA's 278th 5-Star Client Review on AVVO); 2) for not identifying yourself (i.e. "Alex" alone is such a common name that I can comfortably explain the facts & circumstances of your case to the folks without violating either Client Confidentiality or Attorney-Client Privilege); add 3) for the timing of your review which immediately follows the one submitted by your father (# 277) to which the last sentence of my reply was "Hopefully your son will submit his own review so I can explain "the why" of it", thus allowing me to make good on that promise. I also want to make an initial observation about this comment to the folks, to wit: Kinda' like a PSA (Public Service Announcement) this reply is both instructional to the reader & complimentary to Alex as it demonstrates how an otherwise "good kid" (or adult) can make a bad decision(s) that lead(s) to bad things but, if handled properly, it can still work out well. You received a Criminal Traffic Citation for Reckless Driving which simply alleged that you were operating an E-Bike with "one wheel up" on a public road & you were cited for Refusal to Obey a Lawful Command, specifically to stop / pull over when The PoPo lit you up with lights & sirens. For reasons I'll explain below you weren't taken to Jail; rather you were issued a Promise to Appear / Notice to Appear & released from the scene, so no Probable Cause Affidavit / Arrest Report was ever authored. I know the Police version of events because I watched the Body Worn Camera footage which began with you & your E-Bike crashed on the pavement & concluded with the Cops letting you walk away with written citations. The lesson here is that in many (not all) Misdemeanors Police Officers have discretion to either PTA / NTA you or haul your ass off to Jail & in 99 of 100 times the difference maker will be your attitude (be it actual or as perceived by your "Stop Cop"). The BWC in this case clearly showed that while you didn't stop as fast as the Cops would've liked (in fact your stop was a consequence of your having wiped out while trying to get away) once contact was made the Cops were none to happy. Still at all times you were polite, respectful, contrite & deferential to authority. Had you been antagonistic, had a proverbial chip on your shoulder or otherwise been contrary then you likely would've been held in "Contempt of Cop", taken to Jail & suffered all of the indignity, discomfort & costly Collateral Consequences attendant thereto. Another lesson is that by willfully failing to stop after being lit up Alex technically committed the Felony Crime of "Fleeing and Eluding" (which would've mandated booking) but the choice to be mannerly & polite resulted in the exercise of Police Discretion thus avoiding a Felony Arrest, as well as any "Gratuitous Charges" (e.g. Resisting Arrest). The BWC gave me insight into Law Enforcement's mindset (plus the fact that Alex was the only one in a group of E-Bikers who 'd got got) but I also needed to know something about my client, which I learned by speaking with Alex & his father & which was supplemented by providing me with his final Report Card (which reflected a 3.922 GPA), a Certified Funded Trader Certificate which he'd earned during his senior year in High School, "Safe Driver" status with DMV & a lack of Criminal History. That, combined with a proffer that the other E-Bikers were local kids & it wasn't a "Wheels Up Guns Down" street takeover (which everyone but the participants abhor & have no sympathy for), allowed me to prove that Alex didn't deserve the Scarlett Letter associated with a Criminal Traffic Offense for his isolated dumb choice to "Pop Wheelies" with his pals rather than to Day Trade indoors. Being a provably good person pays off, as does following The Golden Rule (i.e. "Do unto others..."). Thank you again & I wish you all the best in life Alex. Fondly, MAH/Esq. #HaberPA

Dear Happy Parent, Thank you for your very kind words (which now constitute #HaberPA's 277th 5-Star Client Review). I want to let the folks know that I recently authored a reply to another person who'd hired me o/b/o a family member (in that case it was a "Significant Other" not a child) which took a deep dive into the ethics of "Third Party Representation" so I'll avoid that here, instead focus on some of the salient points that you mentioned & ask that anyone who's interested in the Legal Ethics aspect of Third Party representation please read #HaberPA's 273rd Five-Star Client Review below. That said I'll start with a philosophical observation: Regardless of race, religion, socioeconomic status or other measure all humans share the same "cycle of life" (i.e. we're all born, ultimately die & if we're true to our own cultures then we share common societal experiences.) At age 60 (soon to be 61) I look back at a time where my life was all birthday parties, then it was "coming of age" events (e.g. Bar Mitzvah / Bat Mitzvah / Quinceañera / Confirmations / etc), then it was weddings, then it was celebrations of birth (e.g. a Bris / Brit Bat / Christening / Baptism) & now it's funerals (welcome to reality). With that in mind it shouldn't be surprising that my professional career (which will turn 35 in October, 2026) has seen the same sort of "social evolution". On the day that I was set loose on society by The Florida Bar I "hung my shingle" as a private Criminal Defense Lawyer & in order to learn how to do what I had dreamed of doing I began by serving as a Special Appointed Public Defender. My early career was spent in Juvenile Court & Misdemeanor Court & when I was sufficiently skilled I tackled Felony Court. It wasn't long before I was Court Appointed as a SAPD to more serious crimes (e.g. Burglary, Robbery, etc) & inside of 10 years it was mostly Drug Trafficking & various Homicide cases. As I gained more experience & exposure I developed a private practice which allowed me to transition to "a better class" of clientele (e.g. folks who could afford to actually pay for the substantial justice that I facilitated), say "Adiós" to serving as Court Appointed Counsel & create a truly boutique Criminal Defense Litigation Law Firm. Apropos of my "cycle of life" observation there came a time where I began routinely representing the kids of my own friends & contemporaries (usually for [bad pun warning] "minor crimes"). Having a 21 year old son of my own for the past 2 decades each time that I've done do so I've silently thought to myself "but for the grace of God there go I" & while I treat all of my clients in a "boutique fashion" (e.g. like an old school family doctor) I'm especially attentive when a parent entrusts me with their child's Criminal Record (& possibly their liberty). In your son's case this was doubly true as you were referred to me by a mutual friend who happens to be a Police Officer & whenever a Cop refers my services to someone whom s/he cares about (as here) it's even more meaningful. (Aside alert: I met our mutual friend about 25 years ago in a Cocaine Trafficking Case where I accused his Police Department of negligently vetting & supervising a Confidential Informant which resulted in my client's legal Entrapment & after peppering them in a Motion to Suppress he & I forged a close, personal friendship which continues to date, proving that Defense Lawyers both battle with Police & Prosecutors & can concurrently forge respectful relationships outside of a Criminal Courtroom.) In your son's case Cops wrongly equated him with other "Wheels Up Guns Down" asshats & treated him accordingly; but when we proved that he had a 3.9 GPA, earned a Funded Trader certificate & was an otherwise "Safe Driver" (to their credit) they quickly came around & gave him a pass. Dear Ryan, Thank you for your kind words in the form of #HaberPA's 271st 5-Star Client Review on AVVO. As of 2024 Ryan was the 87th most popular name for boys (& the 702nd for girls) in the USA but more importantly as no one can identify you & as yours is an excellent learning opportunity for anyone who reads this response I'm quite comfortable in sharing more about your situation with the folks. You got pulled over on 09/17 & were issued a citation for driving a vehicle with an expired registration. (Aside alert: You weren't stopped for a moving violation; rather your Traffic Stop occurred because your license plate was surreptitiously scanned by an Automated License Plate Reader - i.e. a high-speed camera system that automatically captures & transmits license plate data - which was mounted on a Police Squad Car & which alerted Officer Friendly that your vehicle registration was expired. Note that ALPRs can also be stationary but in either event they "red flag" vehicles for any of many reasons - e.g. an expired tag, a suspended Driver License, a Warrant for the registered owner, a Stolen Vehicle Report, an Amber Alert, etcetera - they provide Law Enforcement with Probable Cause to stop the flagged vehicle & anything that happens thereafter is usually fair game - e.g. a DUI arrest.) You read the citation, did a little internet research, took matters into your own hands & attempted to provide timely Proof of Compliance to the Clerk of Court counting on an automatic dismissal. Unfortunately you were woefully unsuccessful, both in terms of complying & in providing proof the thereof. That said you didn't become aware of your “double-fail” until 10/04 when you were once again red flagged by another ALPR, stopped & received yet another citation for driving a vehicle with an expired registration. As a bonus this time your "Stop Cop" was "Officer Unfriendly" & he slapped you with two more Traffic Tickets, one for having no Proof of Insurance & the other for failure to change your address on your driver license. (Aside alert: As to Proof of Insurance you claimed to have digital proof on your phone but that the Cop refused to look, insisting on a physical insurance card & as to the failure to change your address the only reason that you got that ticket was because when the Officer asked you if the address on your DL was correct you said "no".) 10/17 was the 30th day after your first citation was issued & as you hadn't either paid the citation, elected Driver Improvement School or pled "Not Guilty" & requested a Trial you received a notice of suspension of your Driver License for the first ticket at which time you contacted me to figure out what happened & to get you righteous with the Court & DMV. I researched your Driver History, pieced together what had happened, entered appearances as your lawyer in both cases, filed a "Motion for Relief" seeking to have the "D-6 Suspension" that was issued on 10/17 rescinded, set-aside & otherwise vacated, provided instructions making it easy for you to reregister your vehicle & to change the address on your FL-DL & once you provided me with documentation I prepared & properly electronically filed effective compliance notifications & as of today (11/26) all of your citations have been dismissed. The lessons here are: 1) Defending traffic tickets isn't rocket science but it's still legal work, everything lawyers do involve rules, procedures, policies, protocols & deadlines & so even for "minor" matters instead of playing lawyer hire one (i.e. your choice to "pro se" represent wound up costing you far more than it would've had you lawyered-up in September, plus you may not have been cited in October); & 2) the less that you say to The PoPo is usually for the better (i.e. you didn't need to "confess" to another infraction & a lawyer could've helped you to resolve the issue). Dear Anonymous, Thank you for your thoughtful words in the form of #HaberPA's 270th AVVO Client Review. As you didn't identify yourself I can safely expand on your situation & in so doing hopefully help the folks who read this to better understand both your situation & how I approached it. In fact I'll start with my approach as, while it's unique in every case & custom tailored for each client in practice my protocol is ironically identical for all situations. I approach each case by first reviewing the Police version of events, scouring the Probable Cause Affidavit for any patent factual, legal, procedural or substantive screw-up, loophole or technicality upon which I can capitalize. Once I have an understanding of the client's worst case scenario I go through it with the client, listening to her/his account, asking questions & getting a more complete picture of the facts & circumstances of the case. Once I have that more complete picture I then turn to client specific matters that the State is unlikely to know (not from the client's perspective anyhow) & which can be game changers for the case. Key among them, especially in Domestic Violence cases like this, is my client's history with the complaining witness (aside alert: just as the Prosecutor is certain to refer to my client as "the Defendant" I intentionally use the term "complaining witness" instead of, as the Assistant State Attorney will say, the "victim", & I do so with the intent to dehumanize what is usually the State's most important witness while I concurrently humanize my own client, e.g. "Billy" or "Susie", upon who's shoulder I consistently place my hand), & in this case the history was brutal. Neither you nor your ex wife are U.S. citizens but your child was born here & so he has dual citizenship. When he was 3 years old your wife took him to her home country, refused to return to the States & for 3 years (your son was 6 at the time of the alleged incident) she kept him from you, allowing telephonic visitation as it suited her & allowing you to visit your son in her home country (which is also yours) albeit under the supervision of her & her family. For whatever reasons she came Stateside with your son, agreed to meet you &, unsurprisingly, an argument ensued (aside alert: her rendition to the Police did not comport with yours) leading to her calling the Cops & claiming that you had shoved & slapped her (aside alert: Law Enforcement noted that there were no visible injuries). We scoured the Body Worn Camera footage, went though every Police Report with a fine tooth comb but in the end there was no magic motion work to be performed in your case. With no physical evidence to support her claim yours was an actual "he said she said" case, albeit one in which the State refused to question the integrity of it's complaining witness, adopted the position that if she was lying then it was up to a Jury to decide & thus left you with a binary choice of going to Trial and risking a Jail sentence or accepting a plea & guaranteeing no Jail time (although suffering "collateral consequences", which suck, just not as badly as a cage). Even though this was your first foray into the system & you were otherwise eligible, because your child's mother refused to approve it Diversion wasn't offered, again leaving you with the same binary choice. I became a Trial Lawyer to take cases to Trial (aside alert: as I know that most folks in your situation won't risk losing at Trial I bifurcate my fees, charging a flat pretrial fee & then a per diem / daily Trial fee only if my client allows me to pick a Jury) so on a personal level I never like throwing in the towel (& on a business level it literally costs me money not to go to Trial) but my job is to offer advise so that you, the client, can make the best, most informed decision in your interests.
