Dear Anonymous, Thank you so much² (² as 1, your exceptionally well-written, heartfelt words are heartwarmingly accepted & 2, as you didn't ID yourself I can share more about your case than I could if your identity were known). You were arrested on Felony Shoplifting charges while visiting The 305. With neither a clue as to how to navigate the Criminal Justice System nor whom to hire you did that which so many others in your situation do, to wit: you turned to the internet for direction & found me amongst untold numbers of other lawyers. As you explained it to me, it was my literal hundreds of 5-Star Client Reviews (yours now being # 257, thank you again) coupled with my detailed responses to each & every one of those Reviews (precisely as I am doing here & now) that prompted you to reach out. After that (& noting that you spoke with several other Miami based criminal defense lawyers) it was the fact that I "engaged in numerous discussions with me via phone, text, Zoom, and email" (which we did, as you were arguably overly concerned) coupled with my follow-through by having "always taking the time to patiently and thoroughly address my questions" which proved to you that I was the "right" attorney to assist you (& also that at #HaberPA we not only "talk the talk" but we "walk the walk"). Because of this during our initial consultation we discussed your immigration status, your prospective intentions & how your arrest & case resolution may significantly effect the same. You advised that you were legally in the US on a Visa & that you had a pending application for Canadian citizenship for which you had hired a Canadian immigration lawyer. As #HaberPA is a "boutique" Criminal Defense Litigation Law Firm (aside alert: to us "boutique" means that we make ourselves easily reachable by phone, email or on the internet, we practice open, honest, direct & frequent communication & we take a "global" view and approach toward representation - e.g. we take the time to consider the client's unique personal circumstances by coming to understand you & your situation, adopting your interests as our own, identifying & securing realistic litigation objectives, quoting & honoring reasonable fees in writing & thereafter rapidly investigating & preparing your case for whatever resolution may come, preferably the 1 that we identify as our "primary litigation objective" but if not then our secondary or even tertiary goals) I offered to assist as I may, suggesting that you put your Canadian Immigration Lawyer and I in touch sooner than later. I suggested that you do so in writing (in 1 email to both of us) so that it'd be clear that you'd knowingly waived the otherwise sacrosanct confidentiality of your Attorney-Client Privilege & authorized your lawyers to freely speak with one another about our respective cases in your common interest. In your particular instance I wound up spending nearly as much time with your Immigration Lawyer as I did in working on your criminal case (a fact that I didn't predict beforehand), still that was a courtesy which I was happy to provide without any additional cost (& is yet another example of #HaberPA's boutique nature). Dear Anonymous, Yours (which is #HaberPA's 243rd Client Review on AVVO) is now one of my hands-down favorite explanations by a client as to why I was hired & how I performed as an "advisor, advocate, negotiator & evaluator" (those being the "roles" delineated by The Florida Bar as to "A Lawyer's Responsibilities" in the Preamble to Chapter 4 of the Rules of Professional Conduct) on your behalf. Noting that you've perhaps provided the folks with the best, most heartfelt explanation that I could've ever imagined, still I'll chime in, point by point, as best I can, although recognizing that I won't compare to your categorical & civilian, real-world analysis. When I answer a cold-call from a potential client I explain that before we discuss the case I need, at a minimum, to review the Probable Cause / Arrest Affidavit (that way I know the client's "worst case scenario" before I hear the accused's version of events). Once I've digested the Arresting Officer's justification then I eagerly listen to the potential client, asking relevant questions with a design to identify possibilities & probabilities, offer options & suggestions &, of course, to be able to quote a fair fee for anticipated services. I'm not the least bit surprised that other lawyers with whom you spoke didn't offer that sort of time, effort & analysis; in fact one could argue that I count on my colleagues being short, terse & "blowing sunshine" (as opposed to my approach, i.e. taking a "leap of faith", calculating that my taking the time & offering honest analysis is well worth the while). In fact I'm so certain that most - not all but the far larger percent - of my colleagues will be short, pithy & unrealistically rosy that I encourage potential clients to speak with other lawyers before making a hiring decision. That said, once I'm hired it's "game on", & in DUI cases (yours was an accident with both property damage & injuries, albeit minor injuries) that includes expediting services in light of the unavoidable & imminent DMV component. In fairness to me (& given the rare exception where I believe that intentional delay is a sage tactic), I don't dilly-dally in any aspect of any case, instead opting to operate with a "SOP" of preferring to work quickly so as to try to simultaneously catch the State off guard & to get the client closure sooner as opposed to later; but in your case (given the DL suspension, your need to drive & the brief window within which to act) a rapid response was absolutely necessary & so it pressingly came to pass. This mentality (of getting things done, stat) pervades all aspects of #HaberPA's representation, which is why I do my absolute best to field client's calls, texts & emails as close to immediately as is humanly possible. While I enjoy my life as best I can I also empathize with my clients, who themselves need answers, guidance, information & feedback in real time, & so I also do my best to be accessible, available & responsive. After 32+ years in this industry I've leaned many things but perhaps the most fundamental is that each case & each client is sentient, unique & must be addressed & treated accordingly. Having inquired about your legal status in the US I knew that immigration concerns existed & when you advised that you had an immigration lawyer I suggested a waiver of confidentiality such that I could bring her into the loop & thus ensure comprehensive action with regard to both criminal & immigration concerns, without compromising one at the other's expense. I won't presume to either consider myself to be "a legend" or to have written "the book on DUI law" (although anyone who follows #HaberPA's #PSAOfTheDay on Facebook, X, YouTube & MeWe might disagree, arguing that I author a "book du jour") but I will both gratefully accept your perception of me as such & defer to your impression as you explain it to others. Dear Anonymous, Thank you for the awesome and detailed review. I have found that there are 2 types of criminal defense lawyers: There are those who blindly quote fees and then there are lawyers like myself, who take the time to fully (as fully as possible anyhow) A) understand the facts and circumstances of the case - both as alleged by the government and by the client, B) envision the various paths that are available to the client, C) come to understand the client's personal needs and position, D) educate the client so that a realistic objective - in light of both the government's case and the client's situation - can be targeted, E) formulate a plan to achieve the litigation objective and F) only then quote a legal fee which has been fairly tailored to the work to be performed in light of the client's chosen path. In 25+ years of criminal defense practice I have found that the key to a successful attorney-client relationship (actually I suppose that it is key to all meaningful relationships) is open and honest communication, and, as such, discourse is necessarily a 2-way street. So, not only do I keep my client fully informed, but I also listen to what my client has to say (for A) I do not presume to know everything, B) I recognize that the client looks at things through a different prism than I and C) no one is more vested in the outcome of the case than the client). I go into every case telling potential clients (just as I did with you) that the reviews they read online were all - each and every one - earned, that my end game is to earn their review at the conclusion of their case and that the decision-maker - the Judge of my legal services - is the client (meaning, if I do not deliver "as advertised" then you won't deliver a heartfelt and positive client review).
