Dear Mr. Smith, Let me offer tripartite congratulations: First for the successful resolution of your case; second for your clever use of a moniker that can't be traced back to you (thus allowing me to speak freely with the folks about your case); & finally for your heartfelt words in the form of #HaberPA's 263rd 5-Star Client Review on AVVO. Your familial situation was bad yet you & your wife were cohabitating in the same apartment (in different rooms) while you were litigating a Dissolution of Marriage in Family Court. Arguments were frequent , albeit verbal, & you did your best to avoid the same by leaving early & returning late. Still, after a heated early morning incident & after you had left the house your wife called the Police, accusing you of committing Domestic Violence Battery. You became aware of this when a Detective called you, asking you to respond to the Police Station to discuss the matter. Certain that you'd done nothing wrong you went, met with Detectives, were read Miranda Warnings, gave a statement in which you wholly denied your wife's allegations, explained your marital situation, offered explanation / motive for your wife's claim of DV Battery & you did all of this without the benefit of a Criminal Defense Lawyer. (Aside alert: Had you "lawyered-up" then your attorney would've likely told you that nothing you say to The PoPo would deter them from arresting you, as almost every such situation - to wit: an after-the-fact voluntary appearance at the Police Department, with or without a statement being made - almost always results in an arrest.) Still you did what you did & then you turned to your Family Lawyer for guidance. Unfortunately you made yet another bad decision by allowing your Family Lawyer to handle all of your legal matters (i.e. the Divorce, the Criminal Case & a civil DVRO / Civil Injunction that your wife secured against you the day after your arrest). Not surprisingly your Family Lawyer was singularly focused on getting the Prosecutor to offer a Diversion Program, which, based upon your aged (1980s) out-of-State prior Criminal History, wasn't forthcoming. After 6 months your Criminal Court Judge said "no more continuances", set the matter for Trial & prompted your Family Lawyer (who had no - nil, nada, zero, zip - Jury Trial experience) to withdraw. The Judge gave you a 4 week reset to find new counsel, indicating no more extensions would be granted. Your Family Lawyer referred you to me, we spoke, arranged a quick meeting & your Family Lawyer sent the Discovery materials to me so that I could be fully versed. When we met we discussed the case, the time frame & agreed upon a strategy to be ready to get to Trial in line with the Judge's schedule. I followed up with your Prosecutor to ensure that we weren't missing anything, secured a few items that hadn't been tendered as well as disclosure of 2 previously unlisted Police witnesses, attended Sounding & announced "ready". Not wanting to disclose anything to the Prosecutor I waited until the morning of Trial (we we were #1) to proffer our Motions in Limine (i.e. State Evidence that I sought to exclude, specifically any testimony from your minor child, any mention of your alleged Criminal Past which the State alleged via a NCIC printout but couldn't "prove" & a demand that the Body Worn Camera footage be redacted as it was rife with unnoticed "William's Rule" Evidence - i.e. allegations of uncharged alleged "bad acts"). The State had a lousy case predicated on a spurious arrest by average-at-best Police who did a lousy job of documenting the scene & who based their Probable Cause calculus upon your wife's unsubstantiated, uncorroborated statement & within minutes they chose to dismiss rather than proceed to Trial. That said: "De nada me alegra que hayas obtenido justicia, me alegra haber podido ayudarte. Dear Marc, Thank you for authoring #HaberPA's 225th Client Review on AVVO. We're blessed to have had some wordsmiths convey their thoughts and yours is right up there with the best of them (again, thank you). As you've not identified yourself (and for the benefit of the folks who read this) I'll expand a bit on your case, after which I'll offer my thoughts on yours, but before I do so it's important to note that the State Attorney's Office takes DV cases particularly seriously, all DV cases. In many of these cases the State simply rubber stamps the cops' calculus, opting to accept every word out of the alleged victim's mouth as being just as righteous as the words etched on tablets by the hand of G_d carried down from atop from Mt. Sinai by Moses, and that is precisely what happened in your case. Like fat, lazy fish seeking an easy meal the cops bought your domestic partner's sob story hook, line and sinker; worse yet the prosecutor never asked a question, opting to target you as evil personified. While that's tragic what's worse is that your first lawyer, so far as I can tell, did nothing more than collect and deposit your checks. There was no fight, no challenge, no investigation and no plan. When you consulted me your frustration was patent, and justified. Yes you had unfortunately made some incriminating statements to law enforcement and no there was no way to "disprove" the allegations, but, as Einstein said, "Imagination is more important than knowledge" and it's from there that I began. On it's face your DV case was far more serious than many others because you were not only charged with misdemeanor DV Battery but also with Domestic Aggravated Assault with a Deadly Weapon (a knife), Strong Arm Robbery and Criminal Mischief. My plan was to concurrently debunk the joke of an investigation allegedly conducted by law enforcement in your case, dig up as much dirt as possible against your accuser and convince you to engage in a methodical course of conduct which would, in a worst case scenario, amount to meaningful mitigation. You understood, agreed, armed me with the requisite tools and embarked upon a painstaking path (which, in hindsight, turned out to be clutch). We (you, I and our PI) managed to navigate our way through the height of CoVid pandemic craziness, accomplishing what I consider to have been an impressive portfolio. As it turned out the pandemic worked to our advantage, affording us sufficient time for you to voluntarily and successfully complete a 6 month intensive anger management program (by secretly enrolling you in the State's own Domestic Intervention Program - DIP - we hornswoggled the system), to build a track record in a meaningful therapeutic relationship and to avoid any trouble while my PI and I had ample time to expose both the cops' and the complaining witness' vulnerabilities. By the time that we were done we had shown the State two critical and game-changing things: First that, at best, their alleged victim had both motive and opportunity to exaggerate and second that the cops screwed up by negligently failing to canvass the scene (which, had they done, would have resulted in several surveillance cameras which were targeted on the scene thus leaving no room for interpretation or supposition as well as several independent witnesses who at a minimum cast doubt upon the complaining witness' version of events). Long story short (if that's possible), while we couldn't disprove the BS story we did expose significant weaknesses in the State's case and simultaneously proved that you are the sort of guy who accepts responsibility and is willing to take proactive measures to be a better person. In the end, after about 20 months (which is far longer than I prefer the shelf life of any of my cases to be), the State dismissed all of your charges. Dear Anonymous, Thank you for the amazingly articulate and flattering words (in the form of #HaberPA's 222nd Client Review on AVVO). I'm elated by your satisfaction but I'm equally happy that you chose to be unnamed (giving me license to safely expand). Although lawyers must assess, inform and make competent recommendations the ultimate choice as to whether to or not proceed to trial is exclusive to the client. Yours was a misdemeanor domestic battery case punishable in a worst case scenario by 364 days in jail, which, while possible, was also hard to imagine given the fact that you had an exceptionally defendable case (both legally and factually). While taking a plea would have avoided a possible jail sentence after an unsuccessful trial, it came with (among other things) a year of probation, any VOP would subject you to the same 364 days, albeit far easier, far faster (as VOPs have a far lesser burden of proof than substantive criminal cases) and likely with no bond. As you stated, you were not a good candidate for probation; in fact your family would likely have wagered their everything that you'd violate, which would have landed you in jail anyhow. These realities made your decision both wise and relatively simple (fortunately for you this remained true not withstanding your "own self destructive behavior", the substance of which I need not explain here, suffice it to say that had the State become aware then it might have been catastrophic). We announced ready and appeared in court with every intention of selecting a jury and trying your MM-DV case. Taking nothing away from team #HaberPA, the State Attorney was young and inexperienced (rendering it a mismatch as Marc and I have 60+ years of combined criminal defense litigation experience) and paving the path for us "to command the court, [and] rip apart a motion in Liminie". It's all too common (and frankly pathetic) that prosecutors (particularly, albeit not exclusively, the younger, less experienced ones) all but blindly buy into their complaining witness' (victims) and police version of events, failing to vet their own cases and thus be able to see them for what many of them are (e.g. like yours, a "stink bomb"). Sadder still is the fact that when competent defense counsel brings such matters to the State's attention they tend to double down on their blind allegiance to their case, as happened here. Yours was a literal "he said / she said" case as, apart from their victim - your kid's father - claiming that you had "punched him in the face several times with a closed fist" (a claim which was refuted by responding law enforcement officers who saw no sign of any injury) there was a complete and utter lack of any corroborating evidence in their case. We had the Court take Judicial Notice of an existing and in force permanent ("indefinite") DVRO that you had secured a few years earlier against their alleged victim for his prior acts of domestic violence against you, as well as proving to the State that as a result you had been awarded full (100%) custody of the child that you and the victim shared. These things not only provided a very practical basis for reasonable doubt but also motive for the alleged victim to fabricate his story (to wit: to regain custody of his estranged daughter). That said, on the eve of trial, your idiot baby dada called you (again violating the DVRO, which is a crime) and attempted to extort you by stating that if you voluntarily give him access to the kid then he wouldn't show up in court. You recorded that statement (legally), we provided it to the State and still they wanted to proceed. Fortunately the Judge ordered a supervisor to appear and calmer heads prevailed, resulting in a dismissal with the jury standing outside (proving the 1st rule of litigation, to wit: expect the unexpected). Dear Anonymous, Thank you for taking the time to share your second experience with #HaberPA with the folks. When it comes to repeat clients I always have mixed feelings, to wit: On the one hand I'm always honored and proud (kinda like being asked out on a second date) but, conversely, I never want to see someone who's been through the system have to repeat, and your case is an excellent abject lesson as to why. Without delving too far into the potential pitfalls of probation suffice it to say that the last thing a probationer wants or needs thrust upon her/him is a new arrest. (For more info on probation you can read #HaberPA's AVVO Legal Guide on Probation in Florida: "What it is and how to survive it?" @ http://www.avvo.com/legal-guides/ugc/probation-in-florida--what-it-is-and-how-to-survive-it and you can watch my November 1, 2021 podcast, "At Your Service with Haber & Martinez", # 19, "Probation: Palpability, Practicality, Pitfalls & Pro-Tips" @ https://www.youtube.com/watch?v=06ZzUwYJ_ao ) While any probationer who picks up a new substantive case while being supervised is subject to a possible "no Bond" hold (pending resolution of the VOP) in your particular case, because you were arrested for an enumerated violent offense while on felony probation you were automatically classified as a "VFOSC" (a Violent Felony Offender of Special Concern), which comes with a mandatory "No Bond" provision. But for the convergence of luck, skill and timing (plus a little extra luck and skill), and had the prosecutor gotten her way, then that's precisely where you would have been, e.g. in jail, held without bond, likely for several months. Luck: Fortunately for you the entire incident - audio and video - was caught on surveillance cameras. Skill: We knew enough to look for, locate and secure the footage. Timing: Because of the combination of luck and skill we were also able to introduce the footage in your defense at your bond hearing. More luck and skill: The footage showed that you stood in your doorway, using a kitchen knife to defend yourself, your family and your property from a known and unwelcomed trespassing would-be assailant, making a "conditional threat" (e.g. leave or else) to a complaining witness who was aggressive in both behavior and speech and who was on your property, threatening you not withstanding your brandishing a defensive weapon and demanding that he leave. This was a textbook case of Stand Your Ground (so much so that the cops even admitted that had they seen the video footage at the time then they would not have arrested), and that is why after an evidentiary hearing your Judge granted you statutory immunity, the case was dismissed and you were restored to probation. The last thing that I'll mention about your case is that, while the cops get a pass on this one (again, they were not privy to the digital footage at the time of your arrest) the State Attorney's Office does not... not in my book anyhow. When I provided the State with the video files and coupled it with my argument (which included 154 text messages from their alleged "victim" containing unequivocal threats of violence toward you) they doubled down like little prosecutorial robots, absolutely refusing to see anything beyond skewed tunnel-vision toward guilt, and that is inexcusable (and pathetic). That said, I am more than pleased at the outcome of your case, I am appreciative of your praise and I am hopeful that you will conclude the balance of you probationary sentence without incident. Dear Andrea, After 30 years in the criminal defense industry I don't get to experience too manty "firsts", but this (#HaberPA's 215th Client Review on AVVO) is one of those rare, precious moments. You were a crime victim (whom I did not represent in my capacity as a victim's rights advocate; to the contrary I represented your malefactor) who went out of her way to effectively thank me for representing her wrongdoer. If you hadn't so eloquently explained the "why" of this then anyone reading your review (myself included) would likely be perplexed, but you did and for that (and for the review itself) I am grateful. I call #HaberPA a "boutique" law firm because I recognize that each client is an individual, I pay great attention to the details that matter to the client and then I tailor a strategy which I believe to be best suited to accomplishing the client's objective. Sometimes it is purely a "litigation objective" but oftentimes, and surely in this instance, it's more of a global approach, litigation being but one of many components. I do not need to tell you how determined your husband was to preserve his family (to say "at all costs" wouldn't do his passion justice), and, knowing something of him I put my experience to work, called in a support staff, laid out a multi-tiered plan, tasked everyone with their chores and set to work, micromanaging a proverbial ensemble.
