“Dear Anonymous Client, Thank you so much for your kind words (in the form of #HaberPA's 238th Client Review on AVVO) &, more importantly (to me personally), thank you for your service to our great Country as one of "the few, the proud, the Marines". Your wife submitted an anonymous review (#HaberPA's 236th on AVVO - anyone can find it 2 reviews below this one), hers was based upon her unique interaction with me while you were pretrial detained in jail, unable to post bond due to the absolute ineptness of the first lawyer whom your family had hired & my detailed response was tailored to her experience. Your independent review allows me to expound on my reply to her, but with a more in depth discussion of your situation. You are an Honorably Discharged military veteran who served in Iraq & Afghanistan and who was primarily assigned to a "demining squad". Why do I know that & what relevance does it have? I know because I fully vetted your life experience with you so as to both come to understand my client & also in consideration of possible "mitigation of sentence" issues. (At #HaberPA we enter every case with the intent to "win", but "winning" has many definitions & reality dictates that while we "pull all stops" in efforting at securing a Nolle Pros / dismissal / "Not Guilty" verdict / acquittal, we'd be remiss in our duty were we to fail to consider the possibilities of either plea negotiations or an adverse judgment, the latter requiring us to contemplate mitigation strategies - i.e. ways to secure a reduction in sentence - & this is something that we do from the get go & contemporaneous with tearing apart State evidence & building a defense case.) In any event you're diagnosed with PTSD (understandably so after what you experienced in the theater of operations) & while you improve every day you've not been able to hold a job since your discharge, instead caring for your 2 young daughters while you receive VA care & your wife works full & overtime. For a literal period of years two scumbags (people you knew but not that they were Federal Confidential Informants trying to "work off" time from their own federal drug cases by proactively setting up others for arrest) had hounded you to secure cocaine for them. You repeatedly said no but they were incessant, knowing your mental state, your family's financial situation &, as predators do, sensing your weakness. Over time & with repeated promises of booty & security they wore you down, you agreed to secure 2 kilos of cocaine & when you delivered them you were arrested on the spot. As you had no prior criminal history & given the facts (both as alleged by the government & as proffered by you) we put forth a classic Entrapment Defense. We compelled disclosure of the CIs, built our case & when the time was right we filed a Written Demand for Speedy Trial. A mere handful of questions into his direct examination the CI caused a Mistrial & we had to start over. For reasons which I outlined in your wife's review the case was ultimately dismissed, but the important thing is that we skillfully & strategically wielded both the Rules of Criminal Procedure & the Rules of Evidence to take the tactical advantages which resulted in the dismissal, but we also employed a great deal of guile in accomplishing that end. That said, knowing that which you willfully sacrificed & the price that you continue to pay for that sacrifice so that I, the ones whom I love & every other American can live under the umbrella of the freedom that you & your military brethren so selflessly provide, your case was particularly meaningful to me. Noting that demining in Middle East war zones is all but unfathomable to me, still, in light of the villainous scum who simply sought personal profit from their intentional criminal acts off of your selfless service & unwilling penance is deplorable. Dear Anonymous, Thank you very much for your most eloquent expression (in the form of #HaberPA's 213th Client Review on AVVO). Once a criminal case is closed I consider my former client to be a friend, and so, as in your situation, it's always bitter-sweet when a current friend returns as a repeat client (bitter in that the last place where I'd like to see you is again involved with the criminal justice system yet sweet in that a) by hiring me again you have exhibited your complete confidence in my ability and desire to help you and b) as such, I am ever-honored to have earned that privilege). Still, in this existence one of the few certain existential observations is that life is full of unpredictable events (or, more simply put, "sh*t happens"), and so it came to pass that you became a repeat client. Apart from expressing my gratitude (for both re-hiring #HaberPA and for your current Client Review) the only comment that I am compelled to make about your kind review is that I did neither "made" (in terms of applying any force) nor did I "demand" that you do anything; rather, with your input I established and you agreed to commit to a multi-tiered plan which was designed to levy an effective challenge the charges while also paving the path for responsible, objective mitigation, should the same ever be required. But the true beauty of the plan which I set in place was that it had the added benefits of providing a support system which effectively reduced your risk during the process (which, largely due to CoVid, took a full year to resolve) while both educating you as to how to adopt and incorporate more balanced management and coping skills into your life while concurrently taking proactive measures which indisputably demonstrated your earnest and most heartfelt desire to save your family. You are 1,000% correct when you observe that "In the end I know that I did all the heavy lifting", because you did; moreover, you did so in a completely steadfast, determined and unwavering fashion, and you should be incredibly proud of yourself for your total accomplishments and complete success. Had you failed, on any level at any time in any capacity (noting that there were limitless possibilities for any such breakdown) then we likely would not be having this pleasant discourse. All of that said, I am gratified that you are (once again) pleased with both my services and the outcome and I am both proud of you and happy that we are back in "friend" (as opposed to "client") status. “Dear Anonymous, Thank you very much for your incredible and comprehensive summary (i.e. #HaberPA's AVVO Client Review #172). Until today I had thought that #170 was our apogee but then you posted this and, well, I guess that I'm either on a run of representing highly literate clients or I've stepped up my game. :-) In all seriousness, thank you, truly and humbly, but please give yourself (and your mom) credit as well, for I could not possibly have accomplished what I did for your sister without the two of you being actively involved. You came to me the day after arrest / booking and told me that the cops had falsely arrested your sister. Our goal was to convince the State NOT to file charges, and we had a 3 week window before Arraignment to do so (ultimately, working with the State Attorney we extended that window an additional 2 weeks). After arming me with facts that were not contained in the Arrest Affidavit (the arresting officers were operating on partial - about 25% - and entirely -100% - one-sided information) you then equipped me with the tools that I needed (you retained my PI and cooperated by providing sworn affidavits) so as to gather the proof requisite to achieving our objective... and so we did... but it was a group effort. Those 2 beautiful words "No Action" (meaning that the case is dismissed before it is formally filed) will echo for a while. I cannot - no one can - undo the fact that your sister was arrested but, thanks to her family, substantial justice was achieved on her behalf. I don't know that my words are quite as eloquent or meaningful as yours, but I truly and wholeheartedly thank you for your leap of faith, your steadfast assistance and also for #HaberPA's AVVO Client Review #172. Dear Nick, What can I say other than thank you. Your words are heartfelt, sentimental and more meaningful than I can express. So that the folks who are reading this understand, you spent a small fortune on a toothless tiger - a lawyer who took your case, your money and then tried to plead your case out (over a 10 month period while you sat, suspended from work, without pay and while your wife worked double shifts to compensate for your loss of income). You came to me by way of a personal referral on a complete fluke and we quickly determined that you had been wrongfully - and unlawfully - arrested by cops who had manufactured a bogus case against you to cover their own a**es (and for no reason more than that you had the temerity to both - literally - stand your ground and then verbally call them out on their lack of professionalism, training and respect). You were in the right in the moment, and when the State Attorney doubled-down on the officer's BS story, well the Judge formally ruled that you were in the right in the end too, granting you statutory immunity from prosecution and literally booting the case out of her courtroom. Me, I just did my job. I identified the problem, came up with a plan to remedy it and then did so with extreme prejudice (and inside of 3 months). You had the harder job of keeping your cool, coming to truly believe that while you were the Defendant on paper in reality you were the victim (first of unwarranted police aggression and then of a snake-oil salesman in a suit who effectively robbed and falsely imprisoned you), taking the witness stand with complete confidence in your victim-status, offering testimony in your own defense and doing all this knowing that if your lawyer got it wrong then you could be going to prison. It's a very difficult thing to do... to face the police and the prosecution, to put your freedom, your liberty, your very life in another's hands, and while I appreciate your praise and thanks, in this light it is I who should be thanking you. You took several leaps of faith, first in calling me, then in firing your obtuse lawyer "with real showmanship flair" so as to bring me on board and finally in trusting me to get you immunity from prosecution - and for all of that and more I thank you. After the war that we went through together you and your wife (and Bailey - your Labrador Retriever) are family. I just want to add that as much as I want to take credit it must be spread as my partner and my investigator were, as they always are, absolutely invaluable. I wouldn't accomplish 1/2 of what I do with out them (especially my partner). And a special shout out to you wife who was a rock for all of us (most especial you).
