Dear Tori, As an initial matter I want to "especially" thank you for your Client Review (which is #HaberPA's 260th here on AVVO). Why the "special" gratitude? What makes yours exceptional? (Note: These are neither rhetoric questions nor are they meant to diminish any of #HaberPA's other Client Reviews; rather it's simply an honest assessment after more than 41,000+questions answered on AVVO - 41,287 to be precise - & reflecting on my many interactions with Askers such as yourself.) However they may come to me (e.g. referral, the internet, etc.) most (meaning nearly all... likely 98-99%) of #HaberPA's AVVO Client Reviews are submitted by people who hired me to represent them & for whom I provided some legal service. Every now and then someone like you, a person who simply asked a question & received an answer, will take a moment to chime in & share their experience with the rest of the folks. This is rare, & it's even scarcer for the review to be positive, much less a 5-Star Review. Why (note: this question is also rhetoric...) you ask? Observing both that most things in life are neither necessarily "black or white" nor do many things necessarily fit into "cookie-cutter" categories, still in my AVVO experience there are essentially 3 types of "Askers", to wit: The overwhelming majority of Askers who make no comment one way or the other (e.g. they may agree or disagree, like or dislike, be pleased or angry with a given response to their question but in any event you'd never know it because there is no feedback, be it by way of the Asker commenting on a lawyer's response, by their sending an email, following up with a phone call or otherwise providing any indicia of their thought process), an unhealthy chunk (were I to guess then I'd speculate it to be in the 20% arena... yes it is likely that high) provide feedback (in one form or another) which is hostile & outright nasty even (note that a percentage of this faction are incessant & relentless in their baseless rage - it is "baseless" as the responses given are what they are, to wit: mere thoughts & views based upon limited, one-sided proffers without having a complete understanding of the situation & are therefore either blanket statements of the law, circumscribed, albeit educated, conjecture or a statement that the Asker should seek "real world" advise from a fully informed, local lawyer - & some of these unbalanced sorts go so far as to absurdly, inappropriately & maliciously author a negative review - be it on AVVO, Google or elsewhere - or even to file a Bar Complaint) & then there is the opposite end of the spectrum (where you fall) of those who are truly grateful that a professional (oftentimes one who charges $500+/hour) took the time to read, review & reply to their question pro bono (free of charge), whether there's follow-up conversation or not (note that I estimate this group to be far smaller than it's antithesis, roughly 10%, & that those who, like you, actually take the time to author a positive review are few & far between). With that extended explanation you had asked a question which I answered. As I always strive to do I addressed your concerns, provided the rules, pointed you to an on-point YouTube VideoFAQ, suggested a course of action & even outlined the language that, in my estimation & given your situation, I recommended that you should reduce to writing to protect yourself. I provided you with a direct pathway to deal with your predicament & that was followed by your considerately taking the time to author #HaberPA's 260th 5-Star Client Review. Dear Anonymous, I am elated that you chose to author #HaberPA's 259th 5-Star Client Review on AVVO "incognito" as I'm eager to share 3 detailed facts (to wit: informed choice, remote representation & early intervention) about your case with the folks & I couldn't've done so (not with any level of detail anyhow) had you ID'd yourself. That said let's get to it! INFORMED CHOICE: There are only a few ways that a Criminal Case can resolve (i.e. The State can "No Action" at Arraignment, the defense can levy a successful "Dispositive Pretrial Motion" - e.g. a Motion to Dismiss, Motion to Suppress or Motion for Statutory Immunity pursuant to Florida's Stand Your Ground Law - an agreed Plea Bargain can be brokered, Pretrial Diversion can be offered & successfully completed or the case can proceed to Verdict after either a Bench Trial or a Jury Trial) & it's incumbent on every Criminal Defense Lawyer to explain these options to potential clients. But, so as to offer responsible advise, a responsible Defense Lawyer must know the facts & circumstances, understand the State's case, identify the relative strengths & weaknesses, develop potential Defense Evidence, consider the various "free radicals" / variables in order to present viable paths & if asked then suggest the most prudent path to the Client in light of the Client's unique situation. In your case you reside in The 954 & were stopped by FHP in St. Lucie County for Speeding. The Trooper claimed to smell weed, ordered you out of the car, searched inside & located "leaf" marijuana, a grinder, a "vape pen" & rolling papers in a backpack which was in passenger seat area. The search of the car is at least arguably unlawful (some Florida Courts have held that humans are physically incapable of differentiating illegal THC from lawful hemp via smell & could find that what happened here was an illegal search & seizure, but other Courts look at it differently) & there was a definite legal question about the warrantless search of the backpack. We discussed these facts & you decided that the risks & costs associated with litigating a Motion to Suppress wasn't worth the ease & certainty of securing a dismissal via Diversion. Meantime I directed you to secure a Medical Marijuana Card (both because it's safer to use THC in The Sunshine State with a MMC & also as I expected that I could use it as a bargaining tool) & in the interim we kept our options open. REMOTE REPRESENTATION: Each Florida jurisdiction has it's own idiosyncrasies & as I don't routinely practice in St. Lucie County I'm unfamiliar with their proclivities. As such I suggested that if you wanted to litigate (as opposed to mitigate) then you'd likely be better served by hiring local counsel (who's familiar with the Judge, the Prosecutor & their policies and protocols), but you were adamant that you wanted PTD. As you had no priors & non-violent charges I was relatively sure that you'd qualify & so I opened a dialogue with the local State Attorney's Office, inquiring as to your eligibility & my ability to offer "remote representation". EARLY INTERVENTION: As you came to me within 24 hours of your Arrest (you were not taken into custody, rather you were given a PTA / Promise to Appear / Notice to Appear) I had a large window within which to maneuver, which gave us a strategic advantage (i.e. had you come to me with but a few days before Arraignment then we'd be playing defense instead of offense). It took just over 3 weeks for your file to be uploaded into the Clerk's system & for the State to open their file & during that window 2 critical things happened. First you in fact secured your MMC & second I learned both that you were PTD eligible & that we could navigate the process remotely. That said when I provided The State with your MMC they opted to file "No Information" / administratively dismiss your case (so you won quick, cheap & entirely). Dear Anonymous, Thank you very much for your kind words in the form of #HaberPA's 254th 5-Star Client Review on AVVO, & also thank you for having authored it anonymously (as that allows me to both opine as to the generic facts & circumstances of your case as well as to offer up relevant "Pro-Tips" for the folks)! While you were at the Airport with your sister an argument occurred between your sister and an airline employee. The dispute got loud & rapidly resulted in some degree of physicality between the 2 women. You tried to intervene on your sister's behalf, before you knew it Police had quickly inserted themselves into the ensuing melee & you wound up getting arrested for Resisting Arrest without Violence (more specifically your Arresting Officer alleged that "while attempting to place Defendant's sister into custody Defendant placed himself between me and his sister, obstructing my attempt to arrest her"). Naturally you had a different take (e.g. you were unaware of the Cops until they had both literally & physically manhandled you out of the way) but that didn't stop The PoPo from arresting both you & your sister (you for a Misdemeanor & your sister on Felony charges). Having had no prior involvement with the Criminal Justice System you were referred to me for representation (your sister had her own Criminal Defense Lawyer). After I reviewed your Arrest Report you & I engaged in a detailed conversation over the telephone, wherein we discussed the details of your case, your personal situation & your unique needs. This conversation enabled me to identify the possible legal pathways forward & you to select the one which best suited your interests, after which I quoted you a fair fee for the contemplated legal services & we each then went about our lives (me in defending you & you in carrying on with your daily activities without worry while I did my job). During the course of your case (which took less than 2 months from Arrest to Dismissal) I kept you fully informed, provided you with information & documents upon receipt & I was always available to you whenever you emailed, texted or called, either fielding your concerns in real time or within a short window thereafter, but in any event never leaving you hanging. Meantime you were an exemplary client, leaving me to do what I had to do on your behalf & asking relevant questions which staved off potential problems for both of us (e.g. before you planned an international trip, much less bought airline tickets, you asked me about your ability to do so, allowing me to prepare a legally sufficient motion, electronically file & serve it on all relevant parties, calendar it for hearing, litigate it & secure a Court Order which was intended to avoid any potential issue with your surety / bail bondsman & or with ICE upon your return to the U.S.). Far too many clients fail to ask before acting & either complicate their, my or both of our lives so, & for the benefit of folks, know that as your lawyer is your employee you can & should should both feel & be perfectly free to ask questions, seek guidance & expect professionalism & performance. As I was well aware of your Judge's tendencies & the Prosecutor's protocols (specifically that your Judge has Trial settings without "Status Hearings" / "Soundings", that the State almost always fails to tender discovery on time & that the State wouldn't be given any leeway / slack) we chose to demand Discovery & Trial & keep Diversion as a proverbial "Golden Parachute". Your case was set for Trial 58 days after your arrest & as predicted the State failed to provide discovery. I filed a Motion for State Continuance 5 days beforehand, appeared via Zoom (with you on standby but not online) & when your Arresting Officer wasn't online on time the Judge denied the State's request for an extension of time, forcing a "Nolle Pros" / Dismissal in your absence. Dear Rob, Thank you for your kind words in the form of #HaberPA's 251st 5-Star Client Review. I'd be remiss were I not to point out that your son, who's both a most responsible young man & thus a tribute to you & his Mom, submitted a prior (#249) 5-Star Client Review, & while he did so anonymously your (kind to me but perhaps not so considerate of your son) inadvertently called him out; but as he did nothing wrong, & in any event his were not the "charges of the century", I suppose that there's no harm & thus no foul. That said you & I met in 1988 as "1Ls" at "Harvard South Campus" (i.e. Nova University Law School) & we've been friends for 35+ years. After law school you moved to central Florida & started a lucrative PI / Personal Injury practice whereas I remained in SoFlo (specifically in The 305) plying my trade as a Criminal Defense Litigator. While we don't get to see one another nearly often enough we've maintained contact & our friendship has blossomed into one which incorporates mutual professional admiration & respect. As I'm sure is the situation whenever a PI client entrusts you with her/his case (& therefore possibly her/his economic future), so too is it a source of pride each time that a client bestows upon me their confidence by affording me the privilege of being responsible for their liberty. That said this holds especially true whenever a parent effectively gives me "custody" over their child's liberty, & even more so when that parent happens to be an attorney. It goes without saying to you but is important for the benefit of the folks who read this to know that it's far easier for a lawyer to locate another lawyer for representation (be it for themselves, a loved one or a client) than it is for civilians, many (if not most) of whom have no base of knowledge from which to select the right attorney. Personal recommendations are always both a welcomed & valued referral source, but back in the day when you & I began our respective professional journeys the most common method for locating a lawyer was to literally "let your fingers do the walking" & peruse the "Yellow Pages". Nowadays the physical aspect has tracked technology & evolved into "type your query, click your mouse & let your eyes peruse the pay-for-click Google hits", which is a far more perilous path than the extinct Yellow Pages. This is so as while legit, honest, ethical, diligent lawyers exist in the digital universe in order to find them you have to parry your way through a relentless stream of phony, manufactured, "would-be" choices, particularly those who either possess tech-talent sufficient to create the persona that they wish to be seen (like a modern day Wizard of Oz) or those who are slick enough to hire some tech-savvy miscreant who'll paint the picture on the lawyer's behalf. In this light that's a main reason why reviews like yours (& your son's) are so meaningful (to wit: They convey to potential clients real world experiences, impressions & valuations which can be considered & factored into the hiring calculus). I suppose that some venal lawyers post "scam" reviews (in fact & without naming names I know for certain that some are that unscrupulous) but anyone who reads enough of a given lawyer's Client Reviews will likely see for themselves which are genuine & which are, well, BS. Before I finish I want to add one more thing: As a lawyer you were absolutely correct to recognize that even an innocent, trivial matter like your son's comes with what we in the Criminal Defense industry refer to as "collateral consequences" (i.e. a "Scarlett Letter"), & that especially when it comes to matters such as professional licensing (be it with The Florida Bar or elsewhere) the "ripple effects" can be damning, ergo the need for competent & comprehensive representation. Dear Anonymous, I can't thank you enough for your amazing review. As I know that you're literally in "the cancer profession", as you (Mr. / Ms. / Mrs. / Dr.?) are Anonymous & in light of your references to cancer / oncology I'll share what I believe to be a few relevant, interesting anecdotes with the folks. First, many of my would be (& actual) clients either have a preexisting or acquire a base of knowledge about their own legal situation by the time that we first speak. While most understand the limitations of what they either know or think that they know, there are "The Others" (shout out to "Lost") who believe that they either know "better" or more than I, & when that happens it's nothing shy of maddening. The silver-lining to that is that I've both come to recognize & apply this to myself, so, for instance, when I recently consulted an orthopedic surgeon about incessant shoulder pain my research allowed me to both follow much of our discussion & to ask relevant questions without overstepping & effectively being "Dr. Haber" who got his M.D. from "Internet U". That said in discussions with potential clients I often "use" doctors, albeit usually referring to myself as a "would-be Facebook / Internet Doctor" as I imply that while it's a good thing to do research & know something about your own situation there's a solid basis for the adage that "a little knowledge is a dangerous thing" (i.e. regardless of how diligently I may study my own medical concerns in no way does that license me as a doctor). Second, & in a very real legal-to-medical sense, Criminal Defense Lawyers are basically "legal oncologists", proverbially being akin to doctors with specialized training in diagnosing and treating "legal cancer"; & it's not a stretch to make a legit analogy of Criminal Prosecution to Cancer (i.e. both can be a "death sentence", albeit one, mine, usually only in a figurative sense). The point is that precisely like oncologists no one in their right mind wants to "need" to retain Criminal Defense Counsel; rather it's almost always done both in reaction to (as opposed to proactively) & out of a Darwin-esque sense of self-preservation & necessity. Finally, noting that some are "better" at it than others, very much like doctors, lawyers (at least those who actually care about the client & the cause) must develop a "bedside manner", & this takes us to your situation. Not only was this incident you first interaction with the criminal process but, being foreign born, raised & only recently admitted to the US (on a student Visa as a medical researcher) you were also culturally unaware of the nuances of dealing with Police. Thus, after you were physically abused by your ex-boyfriend (who went & filed a police report against you the following day, likely because he feared you doing so first) & the Cops showed up asking questions, rather than explaining to them what had happened (i.e. that you were attacked & acted in self-defense) you chose to clam-up & say nothing, just as you'd've had this occurred in your native Middle Eastern Country, given the cultural & misogynist nature existing there. Naturally the Police Officers who responded to your home had no way to know any of that, you didn't tell them & so they did what they thought was appropriate given the complaint & your lack of any defense thereto. Fortunately you were able to provide me with a great deal of information, not only about you & your mind-set but also about your ex & his mentality (including many social media posts, text messages & other undeniable facts which all but proved that he was a sadistic troglodyte), which I was then able to proffer to your Prosecutor, wield to your advantage & use to ultimately secure a "No Action" / Dismissal at your Arraignment (even over your ex's insistence that he wanted you prosecuted). Not to be an ingrate but, like Gregg Allman "I'm no Angel"; still I care & I'm elated to know that it shows. Wishing you all of the best! MAH/Esq. #HaberPA
