Reckless Sriving
Mike was all over it from the start. He developed a strategy and followed that strategy to the end. A winning strategy and a winning result.
Dear Daniel, Thank you for the props. Since no one knows who you are I'm going to shed some light on the circumstances and strategy that led to the winning result in your case. You were charged with Reckless Driving (please see #HaberPA's VideoFAQ on Reckless Driving at the following link: https://youtu.be/y-0wrIv6ZJE), which is a criminal offense punishable by jail time, but, luckily for you, your arresting officer was lazy. He did not take the time to author a proper Arrest Affidavit, opting instead to simply write you a ticket, and then completely screwing up the citation by failing to provide you with constitutionally acceptable notice of the charge on the document (he had chicken-scratch, scribbled some undecipherable, unintelligible cryptic language on the ticket that was only clear on one front - it was clearly legally defective). We monitored the case and waited until the last possible moment to file a not guilty plea and to demand discovery (eating up more than 1/3 of your speedy trial time) and then when it was predictably set in branch court for trial we filed a jury trial demand (which removed the case to the main courthouse, effectively killing another 1/3 of your speedy trial time). By the time that we got a jury trial date speedies had run and the State had failed to provide discovery. By the time that the government complied with a Motion to Compel Discovery time had ticked, and so we filed our Motion to Dismiss for a Failure of Due Process as well as a Notice of Expiration of Speedy Trial time. Then, at our very 1st Court appearance (which you did not even have to attend) your citation was dismissed. To use your words this was "[a] winning strategy and a winning result", but this was so because A) your cop completed FUBAR'd the State's case and as B) I knew precisely how to take advantage of the situation. Very knowledge in his field of law and a straight shooter
I can't say enough about Attorney Michael Haber. My significant other got in trouble with the law on a weekend and attorney Michael Haber answered my call late at night no less. He got my significant others case dismissed. I could not be more thankful or grateful for everything he has done.
Dear Maura, Thank you for your kind words and for authoring #HaberPA's AVVO client review # 136. As a 305 criminal defense and DUI lawyer (** noting that my partner and I also routinely and proudly serve the 954 and 561) I try to make myself available as close to 24/7 as is possible, and, regardless of when we speak, I do my best to listen, diagnose, provide advise and, if I can responsibly do so, then to propose both a course of action and a reasonable fee for the same. In your S/O's case he was stopped by rookie cops who completely FUBAR'd what could have been - what should have been - a slam dunk felony case. The cops who arrested your S/O were so inexperienced that they couldn't even figure out how to effectively lie on their police report so as to cover up their incompetence. Further, and fortunately for your S/O, they also failed to call in narcotics officers who actually know what they are doing and how to do it. As a private citizen, frankly, I expect much more from the police and I consider this to be a sad (if not pathetic) state of affairs; but as your S/O's lawyer I absolutely and unequivocally crammed these officer's ineptness down their throats, taking the matter to the pre-filing State Attorney and securing a "No Action" ( a dismissal) at Arraignment (which also worked to the benefit of your S/O's co-Defendant, who's case was also dismissed and who, equitably, should probably kick in some dough to help cover your S/O's legal fees). The take away here (for the folks who are reading his) is that sometimes - as in this case - when a skilled and experienced criminal defense lawyer gets involved right after an arrest the filing decision can be effected before Arraignment. This is not limited to poor police work (as in this case) and it holds true in many circumstances (for instance where there is an affirmative defense to the charge or where the credibility of the alleged victim is at issue and the State would never know it unless a defense lawyer walked in with concrete proof). Dear Anonymous, I know precisely who you are and what you did, and without disclosing either any confidences or your identity I am going to use your case as a lesson for the folks who read this (I truly hope that this does not bother or offend you, and if it does then A) I apologize and B) just let me know and I will delete / re-write this reply). After 26 years in this business I reasonably foresee certain avoidable complications - such as risking driving for non-business purposes while you have a pending DUI and a restricted BPO license - and I go to great lengths to make sure that my clients understand these pitfalls. But, as the saying goes, "you can lead a horse to water...", and so all that I can do is to advise, prepare and warn you. I cannot control either your behavior or the consequences of your behavior. In your case you were exceedingly lucky (against all odds) but you could have, you should have in fact, not been so fortunate. So for those of you reading this, be it improperly driving on a BPO license or otherwise, if you have enough confidence to put your life / liberty into a lawyer's hands (not to fail to mention to pay her / him to defend you) then please, pretty please, heed the advise of your counselor at law. That said I am elated that you dodged a bullet, are not in custody and I wish that I could take credit for brilliant lawyering, but the truth is that you avoided a new substantive case and a virtually certain jail sentence by sheer luck. Noting that I've given you numbers 2 & 3 previously, following are some gratuitous final tidbits of advise : 1) Buy some Lotto tickets (hopefully your streak carries over long enough for you to cash in), 2) do what you are supposed to do, when and how you are supposed to do it and 3) DO NOT DO ANYTHING THAT YOU ARE NOT SUPPOSED TO DO (caps intentional).
