Dear Stanford, Thank you for your kind words in the form of #HaberPA's 258th 5-Star Client Review. Noting that when clients ID themselves I generally don't get into facts & circumstances, here I point out that you only used a 1st name (or is it a 1st name?), AVVO allows you to use any name in your review thus there's no way for anyone to know whether that's your real or an assumed name (although I know the truth of the matter), in any event no one can ascertain who you are, what your case number was or otherwise establish your ID & as such I'm comfortable in sharing something about our experience with the folks. You're legally in the US although not a US citizen & you were referred to me by your immigration lawyer (the importance of that will follow). You own a State licensed "smoke shop" which sells legal hemp, CBD & Delta-9 products. Several weeks ago Police executed a Search Warrant on your store, impounded a significant portion of your inventory, arrested 2 of your employees for Sale of Controlled of Substances (the warrant and arrests were allegedly based upon a series of "controlled buys" of Psilocybin, MDMA and illegal THC, reportedly by your employees, not by you) and several days later The PoPo returned to make a Probable Cause Arrest of you on multiple Felony Narcotics Charges. I reviewed your Probable Cause Affidavit (as well as those of both of your employees who'd been arrested a few days before you), we engaged in a detailed conversation over the telephone wherein we discussed the facts & circumstances, identified the possible pathways forward, selected the 1 which best suited your purpose & you retained me to serve as your lawyer. Within 48 hours we met at your shop, you showed me your various professional licenses & explained the nature of your business to me, physically walking me though your purchasing, inventory, presentation & sale processes. As your employees had been arrested prior to you, you had separate Judges & Court dates (yours being later than that of your employees) & your employees had their own legal counsel; still, as their cases either actually or potentially effected yours I monitored all 3 dockets. During the course of your case (which took just about 30 days) I kept you thoroughly informed about both your & your employees cases & I was available to you whenever you emailed, texted or called, either fielding your concerns in real time or with a short window thereafter but in any event never leaving you hanging (which you have thoroughly validated - "answering my calls everytime when I need you" & "thoroughly understand my situation, explained all legal options clearly and fought tirelessly to achieve the best possible outcome"). Apart from fielding your questions & concerns in real time I kept you fully advised along the way & we each went about our lives (me in serving your legal interests & you living your life without worry while I did my job). While we didn't get / have to litigate your case (all charges in your case and those of your employees were "No Actioned" / Dismissed by the State at Arraignment as lab analysis conclusively established that whatever it was that controlled buyers - it's unknown whether the alleged purchasers were Undercover Cops or Confidential Informants / Confidential Sources - thought / claimed to have bought from your employees it was neither Psilocybin, MDMA, illegal THC nor any other controlled substance) I provided exceptional services for a most reasonable fee, especially as I unilaterally chose to waive the balance of your fee upon dismissal (we had agreed to a periodic payment schedule), thus wiping your balance to $0.00 & saving you a good amount of money. Getting back to the immigration aspect, the felony drug charges risked your legal status in the US & so "beating" this case was essential. We won & so you won & with your kind review I won as well. Dear Barbara, Thank you for your kind words in the form of #HaberPA's 256th 5-Star Client Review on AVVO! Because your son chose to identify himself in his equally thoughtful Client Review & as anyone reading this response could likely do the math & figure out his identity for themselves (yes, I know that I just did the math for them but it matters not as...) I can't risk discussing anything that could possibly violate the sacrosanct confidence that your son & I share. I can, however, address non-confidential matters between you & I (i.e. a parent who retained me on behalf of her child & who happened to disagree with my recommended litigation objective / goal) by replying directly to your review. As I explained in my reply to your son, lawyers have an ethical obligation to serve the client in multiple capacities (specifically "as an advisor, advocate, negotiator & evaluator") but sometimes we need to improvise & serve as choreographers who compose the sequence of steps & moves for a performance (in this case litigation), but the key here is that these professional mandates are intended "to serve the client", not the client's parent, spouse, sibling or whomever may happen to foot the bill for legal services . This is something that I made clear to both you & your son from the get go, first via conversation & then again in the retainer agreement that we all signed (your son as the client, you as the guarantor of fees & me as the advisor, advocate, negotiator, evaluator & choreographer). In fact this is the exact language: "Attorney has been retained by Client’s mother. Although Client’s fees are being paid by his mother both Client and his mother expressly understand and agree to the proscriptions as contained in Rule 4-1.8(f), R.R.F.B. (i.e. that although Client consents to a third party paying his fees and costs, such third party is not the Client and cannot in any way interfere with the Attorney-Client relationship). Client and his mother further understand that any and all information relative to the representation of Client remains protected by the rules governing confidentiality - i.e. Rule 4-1.6, R.R.F.B., such that unless Client expressly waives the same and specifically authorizes Attorney to freely communicate with his mother, or anyone else, then the privilege is intact in regard to any and all aspects of the representation. By initialing here Client expressly authorizes Attorney to speak freely with his mother about his case (______)." In this way we were all clear about our rights, roles & responsibilities during the course of the case. That said, to say that your son's case was "challenging" puts it mildly, but it was even more difficult to conjure a way to get the State to agree to allow your son to enter into Diversion, earn a dismissal & effectively guarantee a "win" while running no risk whatsoever. On an irrelevant albeit a personal, selfish level I would have preferred to litigate & Try the case (not only because I became a Criminal Defense Lawyer to be in Court, arguing cases in front of Juries, dissecting the State's cases, cross-examining their witnesses & proverbially dogfighting over the admissibility of evidence but also because above & beyond the flat pretrial fee I charge a separate "per diem" / daily trial fee & so by resolving the case without a Trial I'm effectively costing myself both intellectual pleasure & pecuniary profit) but it was not in your son's interests for me to do so, not if I could manage to structure a path to victory without unnecessary risk & cost. Had diversion proved unattainable then I guess both you & I would've been happier (i.e. you'd've seen "a different approach" and I'd've benefited both professionally & financially) but in the end I was also a de facto parent to your son, serving "In Loco Parentis" & I was looking out for both he and you (his liberty & your money). Dear Rob, Thank you for your kind words in the form of #HaberPA's 251st 5-Star Client Review. I'd be remiss were I not to point out that your son, who's both a most responsible young man & thus a tribute to you & his Mom, submitted a prior (#249) 5-Star Client Review, & while he did so anonymously your (kind to me but perhaps not so considerate of your son) inadvertently called him out; but as he did nothing wrong, & in any event his were not the "charges of the century", I suppose that there's no harm & thus no foul. That said you & I met in 1988 as "1Ls" at "Harvard South Campus" (i.e. Nova University Law School) & we've been friends for 35+ years. After law school you moved to central Florida & started a lucrative PI / Personal Injury practice whereas I remained in SoFlo (specifically in The 305) plying my trade as a Criminal Defense Litigator. While we don't get to see one another nearly often enough we've maintained contact & our friendship has blossomed into one which incorporates mutual professional admiration & respect. As I'm sure is the situation whenever a PI client entrusts you with her/his case (& therefore possibly her/his economic future), so too is it a source of pride each time that a client bestows upon me their confidence by affording me the privilege of being responsible for their liberty. That said this holds especially true whenever a parent effectively gives me "custody" over their child's liberty, & even more so when that parent happens to be an attorney. It goes without saying to you but is important for the benefit of the folks who read this to know that it's far easier for a lawyer to locate another lawyer for representation (be it for themselves, a loved one or a client) than it is for civilians, many (if not most) of whom have no base of knowledge from which to select the right attorney. Personal recommendations are always both a welcomed & valued referral source, but back in the day when you & I began our respective professional journeys the most common method for locating a lawyer was to literally "let your fingers do the walking" & peruse the "Yellow Pages". Nowadays the physical aspect has tracked technology & evolved into "type your query, click your mouse & let your eyes peruse the pay-for-click Google hits", which is a far more perilous path than the extinct Yellow Pages. This is so as while legit, honest, ethical, diligent lawyers exist in the digital universe in order to find them you have to parry your way through a relentless stream of phony, manufactured, "would-be" choices, particularly those who either possess tech-talent sufficient to create the persona that they wish to be seen (like a modern day Wizard of Oz) or those who are slick enough to hire some tech-savvy miscreant who'll paint the picture on the lawyer's behalf. In this light that's a main reason why reviews like yours (& your son's) are so meaningful (to wit: They convey to potential clients real world experiences, impressions & valuations which can be considered & factored into the hiring calculus). I suppose that some venal lawyers post "scam" reviews (in fact & without naming names I know for certain that some are that unscrupulous) but anyone who reads enough of a given lawyer's Client Reviews will likely see for themselves which are genuine & which are, well, BS. Before I finish I want to add one more thing: As a lawyer you were absolutely correct to recognize that even an innocent, trivial matter like your son's comes with what we in the Criminal Defense industry refer to as "collateral consequences" (i.e. a "Scarlett Letter"), & that especially when it comes to matters such as professional licensing (be it with The Florida Bar or elsewhere) the "ripple effects" can be damning, ergo the need for competent & comprehensive representation. Dear Anonymous, I can't thank you enough for your amazing review. As I know that you're literally in "the cancer profession", as you (Mr. / Ms. / Mrs. / Dr.?) are Anonymous & in light of your references to cancer / oncology I'll share what I believe to be a few relevant, interesting anecdotes with the folks. First, many of my would be (& actual) clients either have a preexisting or acquire a base of knowledge about their own legal situation by the time that we first speak. While most understand the limitations of what they either know or think that they know, there are "The Others" (shout out to "Lost") who believe that they either know "better" or more than I, & when that happens it's nothing shy of maddening. The silver-lining to that is that I've both come to recognize & apply this to myself, so, for instance, when I recently consulted an orthopedic surgeon about incessant shoulder pain my research allowed me to both follow much of our discussion & to ask relevant questions without overstepping & effectively being "Dr. Haber" who got his M.D. from "Internet U". That said in discussions with potential clients I often "use" doctors, albeit usually referring to myself as a "would-be Facebook / Internet Doctor" as I imply that while it's a good thing to do research & know something about your own situation there's a solid basis for the adage that "a little knowledge is a dangerous thing" (i.e. regardless of how diligently I may study my own medical concerns in no way does that license me as a doctor). Second, & in a very real legal-to-medical sense, Criminal Defense Lawyers are basically "legal oncologists", proverbially being akin to doctors with specialized training in diagnosing and treating "legal cancer"; & it's not a stretch to make a legit analogy of Criminal Prosecution to Cancer (i.e. both can be a "death sentence", albeit one, mine, usually only in a figurative sense). The point is that precisely like oncologists no one in their right mind wants to "need" to retain Criminal Defense Counsel; rather it's almost always done both in reaction to (as opposed to proactively) & out of a Darwin-esque sense of self-preservation & necessity. Finally, noting that some are "better" at it than others, very much like doctors, lawyers (at least those who actually care about the client & the cause) must develop a "bedside manner", & this takes us to your situation. Not only was this incident you first interaction with the criminal process but, being foreign born, raised & only recently admitted to the US (on a student Visa as a medical researcher) you were also culturally unaware of the nuances of dealing with Police. Thus, after you were physically abused by your ex-boyfriend (who went & filed a police report against you the following day, likely because he feared you doing so first) & the Cops showed up asking questions, rather than explaining to them what had happened (i.e. that you were attacked & acted in self-defense) you chose to clam-up & say nothing, just as you'd've had this occurred in your native Middle Eastern Country, given the cultural & misogynist nature existing there. Naturally the Police Officers who responded to your home had no way to know any of that, you didn't tell them & so they did what they thought was appropriate given the complaint & your lack of any defense thereto. Fortunately you were able to provide me with a great deal of information, not only about you & your mind-set but also about your ex & his mentality (including many social media posts, text messages & other undeniable facts which all but proved that he was a sadistic troglodyte), which I was then able to proffer to your Prosecutor, wield to your advantage & use to ultimately secure a "No Action" / Dismissal at your Arraignment (even over your ex's insistence that he wanted you prosecuted). Not to be an ingrate but, like Gregg Allman "I'm no Angel"; still I care & I'm elated to know that it shows. Wishing you all of the best! MAH/Esq. #HaberPA

Dear Anonymous, Thank you for your fantastic & generous words in the form of #HaberPA's 246th AVVO Client Review! You provided me with an opportunity to speak to the folks about how #HaberPA can serve not only in our traditional role as Criminal Defense Lawyer but also a a Victim Rights Advocate / VRA. As to the latter, per "Marsy's Law", a/k/a "The Florida Crime Victims' Bill of Rights", both constitutionally (s. 16, Art. I of the Florida's State Constitution) & by statute (see: Chapter 960 Florida Statutes) in Florida Crime Victims enjoy a bevvy of rights. The law empowering crime victims came into effect after Marsalee (Marsy) Ann Nicholas, then 21, had been stalked & murdered by her ex boyfriend in CA, triggering nationwide attention & a call to action. More specifically, 1 week after her murder & while on their way home from the funeral service, Marsy’s family stopped at a local supermarket & while in the checkout line Marsy’s mother was confronted by her daughter’s murderer. Marsy's mother, Marcella, was utterly shocked as she hadn't received any notification from either the Court or the State Attorney that her daughter's killer had been released on Bail just a few days after his booking. Marsy's Law protections vary from State to State but, & sans diving too deeply into it, suffice it to say that here in Florida Marsy's Law effectively “giv[es crime] victims constitutional standing equal to that of the accused and convicted.” That observed, when #HaberPA is retained to serve as a VRA we do so with the same tenacity, zealously & comprehensive care and concern for the victim as we do for the accused in our more traditional role as Criminal Defense Counsel. In your case, while you were initially pleased with your first VRA after a while you felt that his commitment had waned, your were entirely certain that the Assistant State Attorney was not advocating on your behalf & you essentially felt both abandoned & helpless. Your passion for justice led you to seek new counsel, your research led you to #HaberPA, your impression after reading many of our Client Reviews led you to retain me & I happily took over. I will close this aspect of my response by stating that my heart is swollen with pride because of your selflessly telling others that "I am eternally grateful to this man who treated me with respect and like a sister at a time when previous lawyer and prosecution had failed me as a victim." I simply can't imagine anyone penning more meaningful, wonderful words. As to "Act 2" of your saga & as you are Anonymous I can go into some detail. You were stopped for speeding in The Florida Keys (a proverbial capital offense down there, especially as you were in a "Key Deer" area) & upon smelling marijuana a search of your vehicle turned up a felony amount of plant and gummy based THC as well as paraphernalia. You were taken into custody, given both Felony and Misdemeanor Possession charges and detained overnight until your Initial Appearance and Bond Hearing. Because we already had a relationship you contacted me upon release (pro-tip for the folks: you wisely used "your phone call" to contact someone to post bond) & I quickly mapped out and put into place a plan to quash everything. I immediately contacted the Felony Prosecutor & agreed to Waive your Speedy Trial right so as to afford you sufficient time to secure a Medical Marijuana Card / MMC, upon which the State agreed to abandon the felony and instead file a misdemeanor for which you'd be eligible for Diversion / PTI / PTD. Once I provided the State with proof of your MMC they honored their agreement, filed the MM charge at your belated Arraignment (you were never charged with a felony) & agreed to Pretrial Diversion. You successfully completed, we're in the Expungement process now &, amazingly, I got your speeding ticket dismissed.
