Richard saved my professional license

It was completely by chance that I stumbled upon Richard’s article about the “tricks and traps” related to the PA state professional boards. I had already been cooperating with the SW Board for 6 months by the time I contacted Richard and without expert representation I was faced with a 3-year monit...oring program for drugs and alcohol despite my full cooperation with the Board and no evidence of any impairment in my professional career. I was completely lost and at the mercy of the SW Board, but thankfully that all changed once I contacted Richard and he started representing me. With his knowledge, experience, and expertise with the PA SW Board, Richard was able to successfully overcome some of the misinformed decisions I had made prior to having representation. Almost immediately communication with the Board’s attorney improved, the process seemed to move smoother, my options were much clearer thanks to Richard’s guidance, and I was no longer at the mercy of the SW Board. Richard’s knowledge of the process and relationships with key decision makers were crucial in getting the best possible outcome in my case. The charges of impairment were dropped and my case closed without further action which is a drastic improvement from the outcome that would have occurred if I would not have had Richard representing me in this process. Any licensed professional who is unfortunately in danger of having action taken against them by a PA licensing board should immediately contact Richard to get the best possible counsel and protect your interest. I promise you will be happy that you did.

Great attorney

Richard is a health care lawyer handling criminal and professional licensing matters. He is an attorney I never expected to need, but I am unbelievably happy I found him. As a medical doctor, I was confronted with extremely challenging clients at the height of the national opioid crisis. With Richa...rd's counsel and help we avoid all federal criminal charges. He adroitly negotiated with the Pennsylvania Medical Board matter, allowing me to maintain my unrestricted license to practice medicine and surgery. He expertly and successfully responded to all inquiries relating to my Board certifications, hospital credentialing, insurance contractor provider agreements, state and federal insurance program participation, and DEA prescription writing authority. Doctors accused of criminal charges must always consider their license. Hiring an experienced professional licensing lawyer who is also competent to represent you in a criminal matters is a must. From my first call, Richard took the time to get to know me as a person and professional. Richard's patience, professionalism, and kindness belies an extremely competent counsel who aggressively represented me and my license to his fullest. He is a mensch of an attorney who at every turn is smart, kind, and very honest. He was fully knowledgeable, prepared for every telephone call, meeting, court filing and hearing. He fought for me and my license. I am truly thankful to him for his help and caring at a time of my greatest need. He could not have done a better job for me and my family.

Criminal investigations affect doctors and all aspects of their medical practice. DEA prescribing authority, hospital admitting and credentialing authority, public and private insurance participation, and and state disciplinary prosecutions will need to be addressed. Dr. A and I worked together and timely organized, plotted, and effectively responded to every consequence of the federal then state investigations. We mapped out and then strategically and successfully attacked each criminal and board case. It was a pleasure to work with such an amazing person. This type of case happens in Pittsburgh, Erie, Scranton, Philadelphia and all suburbs in between. Call me about your case.

Occupational Therapist

I sustained a DUI several months ago and even though I hadn't been charged with it yet I landed in this PHMP monitoring program. I had to go for random drug screens that could be anytime. I am an occupational therapist and don't deal with medications and they were stating that I was a risk to my p...atients! I was panicking and found Attorney Hark online. He saved my license and got the case dismissed. He is a little pricey but totally worth every sent then the hell they were putting me through! Don't hesitate! Michael OT

Michael's case is not unique. A 2nd offense DUI with a high BAC, he was already cooperating with the PHMP. Similar to many nurses, doctors, CRNP's nurse anesthetists, and pharmacists, the PHMP monitoring program case worker did a bait and switch on Michael. They say just got to the eval, you will be fine. The drug and alcohol evaluator gave him an improper diagnosis and recommended the program. The PHMP case worker, even though Michael was not handling any medications, demanded he stop working, go to in patient treatment, and not return to work until she (Candice Queer) said so. This is not proper. Different health care professionals from all over Pennsylvania (Scranton, Pittsburgh, Erie, Altoona, Mechanicsburg, Harrisburg, Philadelphia) are all treated the same. NO ONE CAN AFFORD TO STOP WORKING. Michael withdrew from the PHMP before a formal signed consent order was entered. We prepared for the Mental and Physical Evaluation. A prosecutor look at his case and after the review with all of the information closed the file. Michael started back working right after he hired me (6 months ago), and never looked back. He has a great new job, moved to a better location, and couldn't be happier with his choices -- one of which was hiring me. Thanks for letting me save your license, career, and happiness.

Pitt nurse

Attorney Hark is an amazing lawyer, especially for professionals. I had an issue dealing with The PA board of nursing where they threatened to sanction my nursing license. I went to school for 6+ years for my RN and there was no way I wasn’t going to put up a fight and getting a lawyer that has exper...ience with professional licensing was extremely important also. Attorney Hark prepared me for the nursing board investigation and the assessment that came with it. He called me frequently updating me on the case and calmed my nerves when I needed it. Because I am in Pittsburgh and he is in Philly, we FaceTimed, texted, and spoke on the phone for all our appointments. (He is easy on the eyes so I wouldn’t mind ;) )I didn’t need to make a 6 hour trip to Philly ever! He is smart, kind, and is very honest when it comes to your case and will do everything he can to help you. He was worth every penny and when it comes to your livelihood, you would spend anything to keep your license and in good standing. He is the best and I would use him again in a heartbeat but I don’t ever plan on dealing with the horrid board of nursing. Thanks again Mr. Hark, you are indeed the best!

Kasi had a hard case. She was also in Pittsburgh, during Covid lock downs. The Board's are being very diligent investigating allegations of mental health, drug use, diversion, alcohol abuse, and self-medicating more than every in this medical marijuana and opiate crisis time period. Whether you live in Erie,m Harrisburg, Altoona, Pittsburgh, Scranton (Go JOE), Philadelphia, or any other state and possess a PA health care license, call me to help. Kasi did and she says it all! Constant communication, emails, texts, ZOOM, and the old fashion phone are all means of effective communication. Thanks for letting me help Kasi!

Mr. Hark saved my license.

I was unfortunately involved in a workplace incident that triggered a referral to substance abuse program and even worse, an investigation by one of the state’s administrative boards into my physical and psychological well-being to practice. From my first call, Richard took the time to get to know me... as a person and professional. He explained the entire investigatory process from start to finish and exactly what I needed to do to ensure the best possible outcome. He was able to help me develop a very reasonable payment plan- which was one one of my biggest fears because I was out of work. He and his office staff worked closely with me for months through one of the most trying times of my life. Throughout the process he and his staff would not only check in on me, but helped me get all my necessary documents in order, and personally prepared me for interviews, hearings etc. Richard also personally attended these with me and was able to put my mind at ease. Richard and his staff are incredible at their work. They care about healthcare providers and I would, without reservation, recommend him to anyone facing action against their license.

This was a really hard case. However, an attentive client who understood the complexity of the issues, the exposure to his license, and my game plan made representing him a pleasure. From day one, "Mike" understood my strategy, executed every step to a "T" and we prevailed. My extensive preparation along with Mike's full cooperation and agreement helped us win this case. Thank for letting me help.

Relationship: Fellow lawyer in community

"I have known Richard Hark for years and he is an outstanding attorney. While he handled criminal defense matters for many years, he has shifted his practice focus to administrative law where he assists professionals (nurses, doctors, lawyers, etc) when they are being disciplined by their respective licensing board. This is usually as a result of contacts with the criminal justice system or drug/alcohol problems. Despite the shift in practice, the outcomes are the same. I have seen him successfully fight the most serious criminal charges and I now refer professional clients to him when their criminal case overlaps with their professional license. He has become extremely skilled in a very sensitive area where clients' livelihoods are on the line. This is no easy task but Richard's combination of legal smarts, common sense, and empathy for his client's plight make him a perfect fit. I strongly endorse Mr. Hark."
