Dear Anonymous, Thank you for both praising #HaberPA's diligence and professionalism and for authoring #HaberPA's 185th Client Review. Although you chose not to use your name I know who you are (based upon timing and your head's up to me about submitting the review) and so I can give the folks some context. You came to me with a criminal history (nothing "horrible", but several prior felony convictions) and facing a slew of new charges (including 5 felony narcotics offenses, 2 narcotics misdemeanors and a gratuitous count of resisting arrest without violence). Although you wisely made no statements and ultimately invoked your rights, much of the incident was captured on police body cams (4 of them to be exact), presenting quite the challenge. Because of the overwhelming evidence against you (most particularly the Spielberg-quality footage) and your undeniable (and scorable) past, the odds were heavily stacked against you; however, with age comes experience, and after 28 years in this business I know that there are almost always options. Long story short it took a while but we were able to dodge all but 1 felony and 1 misdemeanor (everything else was dismissed) and you walked out of the courtroom with 1 year probation and 50 community service hours. You "thought I was certainly going to be put in prison", and in other hands you may well have, but early on you and I agreed upon a litigation objective, I identified a path forward, you did your job while I did mine and in the end, for you, given your particular circumstances, we were victorious. I am thankful for your Client Review, I hope that you're not bothered that I provided context and that I must correct you on one thing (you didn't merely consult with... you actually hired #HaberPA), I wish you the best of luck with probation (you know the potential consequences of a VOP so please be extra-careful) and for you I too "[h]ope [that] I never need him again". Dear Marco, Thank you very much for earnestly sharing your thoughts with the folks and for authoring #HaberPA's 181st AVVO Client Review. Unlike many of my responses to client reviews (always in an effort to provide context to the folks) I won't get into the facts and circumstances of your case, except to say that because of both the overwhelming evidence in the case against you and your past (your prior criminal history, which the State and the Court were absolutely entitled to, and surely would have, held against you in this case) we agreed that keeping you out of a jail cell was our most realistic litigation objective, and then we achieved that goal. I say "we" intentionally because I could not have done it on my own. I did plenty - peppering the State with motions, relentlessly forcing them to comply with a never-ending flow of discovery requests, etc. - but all of my efforts surely would have been for naught had you not held up your end by performing, flawlessly, precisely as I instructed, to the "t", and just as you did... for months. So props and kudos must go to you as well. It only takes one bad decision to wind up in the government's cross-hairs, but sometimes "it takes a village" to manage the situation. I'm sorry that you didn't get exonerated in your case but, in the paraphrased famous words of Bones McCoy... "I'm a lawyer not a magician". Dear Elbin, Thank you for your powerful and descriptive Client Review (#HaberPA's 180th on AVVO). So the folks understand, intending visit to your your sister and brother-in-law for a weekend, and so as to save money on airfare, you had hopped a ride with 2 guys (1 of whom you knew) from ATL to the 305. Unbeknownst to you the guy you knew was carrying $28k in cash to purchase a kilo of cocaine from an undercover (U/C) Hialeah cop, the deal (a "reverse sting op") having been brokered by the other person in the vehicle via a confidential informant (CI). The car drove straight into a meet at a gas station, the driver reportedly flashed the cash to the U/C and the passenger agreed to follow the U/C cop to the prearranged (and wired) buy location while you unwittingly remained along for the ride. The 2 guys went inside with the U/C and his partner while you sat in the car, ignorant of the circumstances. Meantime, in a secured location - and entirely beyond your presence - the coke was displayed, opened, tested and the cash was tendered - all on video & audio - and then the fishnet was thrown, the 2 guys on the inside being (properly) arrested and you being (improperly) arrested while you were waiting inside of the vehicle. There was none - zero, nada, nil, zip - evidence of your involvement / knowledge or intent to participate in this drug transaction, the C/I never mentioned your name to law enforcement, they did not expect you, they had no idea who you were or why you were in the car and you were not present during the actual transaction. Still there was bad news, and it was fourfold: 1) It was Hialeah (absolutely no legal scholars there) and so they arrested you for drug trafficking, 2) You were not effectively represented at the bond hearing, the Judge simply rubber stamped your arrest and you were held on a $500,000.00 bond; 3) Even though your family hired #HaberPA within days of your initial appearance you still had to sit in jail more than a month before we could get you an Adversary Preliminary Hearing (APH); and 4) after an evidentiary hearing, and even though your Judge ruled that the cops had NO PROBABLE CAUSE to have arrested you, the State Attorney refused to drop the case, doubled down on his officers' douche-baggery, forced us to file a written demand for speedy trial and kept your stink bomb of a case alive for several more weeks. (In case anyone wants to research it the defense to your case was "mere presence" - meaning that guilt cannot be established either by someone's mere presence at a crime scene or mere association with another person at a crime scene - the law requires more than that so as to establish knowledge and intent to commit a crime.) The good news was that immediately after the APH you were released from custody, without any conditions and, ultimately (and although the State made us work for it) the charges against you were all dismissed. Sadly no one can give you that month+ back but #HaberPA did what we promised, as we always strive to do, to wit: We attacked your case, aggressively and quickly, and exposed it for the stink bomb that it was. I wish that we could give you back the month+ of your life that you lost to p*ss poor policing... sadly we can't. But we did help you to recover your freedom, to restore your good name (you had no prior criminal history) and live up to our commitment of providing "boutique", effective and relentless representation for a fair price and, as you say, "lean" (with no unnecessary fat). Dear Anonymous, Thank you very much for sharing your experience with the folks via #HaberPA's 179th AVVO Client Review. It's true that once we got on board we absolutely peppered the State with motions (not one having been previously filed in your case) and that in so doing - forcing the State Attorney to actually open their file and work - we achieved your litigation objective (it's important to note that because of your prior record you were specifically not seeking an acquittal at trial; rather you wanted to close your case cleanly, sans risk, with straight probation and leave to freely travel throughout the US)... But I feel that I need to give a shout out to PD's (and most especially those here in the 305) and explain that although they generally can't afford to offer up the time and personalized attention that a private lawyer brings to the table, PD's are almost all excellent attorneys, generally being extremely well-versed in both the law and their courtrooms. Contrary to popular belief, it is not easy to either get hired as, or to remain employed as, a PD (again, especially in the 305). It takes brains, ethics, effort and commitment. It is an often times thankless job and attorney's who are not committed to it simply do not last. For those who do, however, their client's usually benefit not only from the day-to-day knowledge of their individual courtrooms (including but not limited to knowing the tendencies of their Judge, their prosecutors and the other instrumental court personnel) but also from the vast resources that the PD brings to the table (investigators, experts, etcetera) without further expense to the client. I have the greatest of respect for those guys and gals who earn a pittance yet generally try so hard and accomplish so much. That said, there is no substitute for privately retained criminal counsel (although - sadly - there are plenty of snake oil salesman / worthless private attorneys out there). As you have so nicely illustrated, when you retain #HaberPA we pledge - and deliver - to: A) provide honest & realistic litigation objectives; B) quote and honor fair fees; C) always be available & responsive; D) keep you fully informed; and by doing so E) earn your positive client review at the conclusion of the case! Mission accomplished! It is obvious that you gained incredible insight, understanding and an appreciation for your situation, and it is equally apparent (as well as most appreciated) that you've given me credit for both having steered you in the right direction and considered your legal and personal needs. As a lawyer I'm ethically bound to perform several functions (see Chapter 4 of the Rules regulating the Florida Bar, specifically Professional Conduct), namely serving as an "adviser, advocate, negotiator and evaluator", and this is what i did in your case.
