A Needle in a Haystack

In a world where you are not familiar with; you need someone to help you out. Nowadays people try to take advantage of you and the lack of knowledge you might have in that particular field. When you finally find an honest, knowledgeable person with a winning mentality; it’s like finding a needle in a... haystack. I found that in Michael Haber and company. My case was a situation where I was beaten up by a few guys. Even though I defended myself I left there with a big gash on my head, a few bruises and a wrongful arrest. The police officer took me to the hospital to get stiches and then to jail. All I could think about was why was I in this situation and the reason that continued to pop into my head was I did not call the police and the other people did and lied to the officers. After 18 hours in TGK I was able to bail out. Then the search began. I spoke to a couple of people that mentioned a few attorneys, but I didn’t feel comfortable with them until my cousin mentioned Michael Haber. He told me that Michael was a strategic person that gets results. I asked him for Michael’s number and I called him right away. I left him a message and within 5 minutes I received a call from Michael himself. I explained my situation and he made sure that my information was accurate. He told me he didn’t want to be blindsided. If everything was like I told him, it was a clear Stand Your Ground case. It felt like right after we hung up the phone he started to work. It also felt like I was his only client. He gave me some homework so I can understand what he was talking about. He asked me to see some videos which really helped me out personally. To make a long story short, I won my case with exactly what Michael said from day one; Stand Your Ground. Michael and company were always extremely easy to reach and when you are nervous about something like this going on it helps to be able to speak to your Lawyer directly. I would not want to be in this situation ever again but if something ever happens to someone in my family or a friend, I would definitely be calling Michael and company right away. I even had to call my cousin (who is also an attorney) and thanked him for referring Michael right after we won the case. My family and I are extremely appreciative for his hard work and more importantly for helping us get the truth out and for helping us see justice prevails.

Dear Anonymous, Thank you so much for your Client Review (#HaberPA's 227th on AVVO), but thanks even more for submitting it as "Anonymous" (as I can now talk freely about your case with the folks). You were wrongfully arrested by inexcusably poorly trained police officers (unsurprisingly from Hialeah, insert rolling-eyes emoji here) and, worse yet, you were disgracefully prosecuted by the Miami-Dade County State Attorney's Office. How do I know this? Three ways: 1) I have sufficient skill, experience & training to recognize a Stand Your Ground / SYG case when I see it, 2) I conducted both a proverbial autopsy of the State's case & my own independent defense investigation and 3) after preparing, filing, calendaring, noticing & litigating a Motion seeking Statutory Immunity your Judge threw out this case faster than last month's garbage. When called to a crime scene police are supposed to inquire, more specifically they're expected to conduct a competent examination of the facts and circumstances & thereafter to draw reasonable conclusions. In your case, as you were already gone from the "Locus in Quo" (the crime scene) when they arrived, the cops simply interviewed the complaining witness (the alleged victim) & called it quits. While we would subsequently document the facts that there were at least 5 other civilian witnesses (eyewitnesses) present & functional video surveillance equipment, the cops interviewed none of them & they didn't even think to look at the digital recording of the actual events, much less to impound and preserve it as evidence. Worse yet is the fact that when the cops get it wrong the State Attorney, a Prosecutor, is expected to conduct a diligent review, quite literally serving as a "check valve" & to "No Action" / "Nolle Pros" / dismiss bad arrests. You retained #HaberPA shortly after arrest, well before Arraignment & we got to work fast. We identified the witnesses &, while we couldn't issue a subpoena for the digital footage we sent a "Spoliation Letter" to the pre-filing Assistant State Attorney as well as serving both the business owner & the the Registered Agent with the same. What was requested was footage starting one hour before & ending one hour after the incident; what was received was 34 seconds, 34 seconds which showed you beating on the aggressor. (As an aside the State was unable to get the video into evidence as we objected on two grounds: First, "The Rule of Completeness" & second "Chain of Custody". The incident both clearly began well before the video started & ended well after the video concluded & thus, the cherry-picked portion was incomplete and misleading. Further, the alleged victim testified that the cops viewed the video when they were on scene & only asked for that limited portion but the cops debunked that by stating that they never saw, much less impounded, any video footage whatsoever.) The bottom line with your case was that you were legitimately on the premises of a business to conduct business, the owner of that company & you have had an ongoing dispute over services, the day before the incident you were there & left as the business owner had literally charged at you & was held back by several of his own employees while you fled. Your return the following day was to collect your property in the hope of avoiding the business owner but he came at you again, this time being held back by no one. As he's got 4-5" and 40-50 lbs. on you, coupled with the fact that the 3 guys who had held him back the day before were now behind him rather than holding him back, you quite literally stood your ground. He took a beating but so did you (you earned 6 stiches in your forehead and a permanent scar). As the footage would have shown, he was the aggressor & you were the victim. The cops & the Prosecutor got it wrong but the Judge got it right & I am proud to have been instrumental in securing immunity for you and restoring your good name. Thank you again! Best lawyer I have ever worked with!

Several months ago my husband was arrested at our home. I was present before, during, and after the incident (which didn't involve me). Despite his asking the police wouldn't let my husband make any calls so, as they were taking him away, he asked me to call Michael Haber. I found the number, cal...led and Mr. Haber answered. I admit that I was a bit panicked but Mr. Haber was patient. He listened, helped me to calm down, and explain to him what had happened. He told me that he was going to call the police himself to try to get more information and that he'd call me right back, which he did. Mr. Haber instructed me how to appear for my husband's bond hearing and the very next morning we were all on Zoom. Mr. Haber appeared, made his argument for bond, and for reasons I really didn't understand the Judge reset the bond hearing for the following morning. The next day we had another Zoom hearing and Mr. Haber was so thorough, knowledgeable and persuasive that the Judge actually released my husband with out any bond at all. I didn't understand the process at all but Mr. Haber took the time to explain everything to me, after which I definitely understood. Mr. Haber answered all of my questions and assured me that everything would be okay. He was always available and polite and respectful and generous and caring to me and my family. It took about a month for Mr. Haber to get my husband's case to trial and when he did the Judge dismissed the case. I am so grateful that Mr. Haber was there for my family because I don't know what I would have done without him.

Dear Susy, Thank you very much for sharing your experience with #HaberPA with the folks. Yours is the second time in recent history that the spouse of a client has taken the time to author and submit a review (in your case #HaberPA's 219th Client Review) so I must be doing something exceptionally correct. That observed, I am well-aware of just how daunting the criminal justice system can be, especially for the uninitiated, and so it's an important part of my job to explain the mechanics to those who need to know, your husband's case being an excellent example. In those initial moments at your home, when your husband was first detained then "cuffed and stuffed", the hands-down most critical thing that you possibly could have done was to call me (a lawyer). You were able to provide me with real time information which I was able to parlay into both a greater understanding of the situation (not only for myself but also so as to be able to explain things to you) as well as into effective, persuasive argument for our impending bond hearing. Your husband had multiple issues. He had picked up a new violent domestic felony, which, on it's own is a significant problem, but, dovetailing it with the fact that he was serving felony probation at the time, the situation was dire. First, anyone on felony probation in FL who gets arrested for a new case is subject to a "No Bond" hold on the prior probation case. While Judges have the discretion to authorize bond for such folks (either at the prosecutor's request or sua sponte) they often deny the same for a variety of reasons (e.g. to sweat the probationer, to make a later plea more likely, to send a message to other probationers, etc.). Still, and although one can theoretically sit in jail for months on end while awaiting a PVH the Judge may, should s/he wish, grant a "Probation Bond". But, when, as was the case with your husband, one is designated as a "VFOSC" (a Violent Felony Offender of Special Concern - which happened in your husband's case simply because he was charged with a felony crime of violence while serving felony probation) then the Judge has no discretion, s/he is statutorily prohibited from granting a bond on the new case and that renders a probation bond meaningless. Fortunately you and I were able to speak and enjoyed free communication over the next 36 hours. My investigative team was able to secure surveillance footage of the actual incident (which was something that the cops either neglected to do or intentionally chose to avoid), you were able to provide me with significant historical context as well as incredible documentary evidence which plainly demonstrated malicious intent on behalf of the "alleged victim" and while your husband had to spend two (2) evenings in jail we were able to convince the Judge to deny VFOSC status and ROR (release on recognizance) your husband. After that the rest was relatively smooth sailing. Even though the prosecutor bought the complaining witness' BS story and filed the bogus new felony domestic charge we had an experienced Judge who gave us the courtesy of a quick "Stand Your Ground" Hearing and within about 6 weeks time your husband was granted statutory immunity, the new case was dismissed and your husband was reinstated to probation. Please believe me when I say to you that I could not possibly have accomplished my job without your generous effort and assistance. In truth your husband has you to thank every nit as much as myself, and I too must thank you (both for your generous client review and for helping me to help your family). Beyond grateful!

While at first, my case appeared to be a fairly straightforward process, I could not have done managed without Michael Haber. Having an extremely busy career that often requires work late into the evening, I knew that delays in communication on my end would likely result in delays or my expungement ...not happening at all. Mr. Haber's expertise and skill in managing an unexpected situation that occurred in this process were hands-down superb. Dear S. Rose, Thank you very much for sharing your experience with #HaberPA and for obviously and intentionally employing such incredibly kind words when publishing what is now our 218th Client Review on AVVO! I'm a firm believer in the idea that open, honest and frequent communication are essential elements to any functional and meaningful relationship, most definitely including attorney-client. That said I'm going to expound on your assessment just a little bit, as yours is a classic example which can benefit other folks. You reside on FL's central west coast and received notice of a criminal prosecution (for a criminal traffic offense) in the NE section of the State. Because you had no connection to that area you had a solid alibi and, because it was a patent error, the police officer requested and the State agreed to dismiss the case; however, you still had an unwarranted criminal record which you wanted to expunge. You found me on the internet. Even though I'm in SE Florida you reached out to and hired me to handle the matter remotely. (One of the few "CoVid Silver Linings" is the ability for lawyers to easily handle their cases in a remote fashion. While not functional for most litigation - and surely tapering off as restrictions are relaxes - when it comes to sealing and expungement, these days lawyers can accomplish the same throughout Florida's 65,758 square miles no matter where we happen to be physically located.) That observed, I was as forthright with you as I am with everyone, explaining that while expungement is not "rocket science" it is a technical process full of potential tripwires and boobytraps, and as it turned out your case is a textbook example of the application of Murphy's Law to "the law". I secured the necessary documents, prepared the mandatory paperwork, emailed it to you with detailed instructions and when I had everything compiled I started the process. The first blunder occurred when the State "misplaced" your application. The second came when the Assistant State Attorney mis-executed the replaced original. An Assistant State Attorney signed it, authorizing FDLE to process the expungement application without objection, but - giving them the benefit of the doubt - they negligently wrote in an incorrect identifier, causing FDLE to reject the application. This led to the third complication, in that the whole process needed a reboot with micromanagement. There's no reason for me to believe that you (or any other "civilian" for that matter) could not have maneuvered through these missteps, but I am absolutely confident in my ability to do so quicker, smoother and with a sum net of zero aggravation to your life, most especially for someone like you, who has "extremely busy career that often requires work late into the evening". Naturally I kept you in the loop, to your credit you were consistently understanding and helpful and, while it took longer than expected, your case was expunged. Outstanding Attorney

Mr. Haber was GOD sent ( I purposefully wanted to make this as my first statement in his review, as that is ABSOULTELY ( intentional CAPS) true!). I don’t think I can do any justice as I write this review on how grateful I am that I hired him for my legal case. It was in October 2020 when I was wrong...fully arrested for an act that I couldn’t have imagined to do even in my grave. The allegations and accusations that were described by the off-duty officer (who arrested me) were so horrific that he made it impossible for me to assure anyone anything that was said was so away from the truth/reality. He not only misunderstood my situation but then fabricated the event and perjured on the affidavit. It is depressing to see those who are actually responsible to safe guard you, turn around and become a threat to you. I have been a law abiding individual throughout my life and this wrongful arrest took a toll on me. As many are aware that there are vast options of selecting an attorney in this greater Miami- Dade area, it is so difficult to assess who is competent and skilled that you can trust for your life. I on the other hand was not very fortunate to select Mr. Haber immediately after my arrest ( as I didn’t know him). Upon searching for so-called well known attorneys, I selected and appointed my previous counsel ( whose name I am not going to purposefully mention, as that will be inappropriate) as my first choice. It was an absolute wrong choice. Nine months went by with no real progress on my case, and after spending pretty penny on him I was frustrated, nervous and doubtful on a successful outcome. I kept researching online regarding Criminal Justice System and came across avvo and found Mr. Haber. Reviewing all of the fantastic (and more importantly genuine) comments made by his past clients, I decided to give him a call ( to which I am sooo glad I did). It was a 45 minute initial call with him where he not only proposed a plan (with confidence) to achieve my primary litigation objective ( obtaining diversion) but he also eased my mind as I was hopeful that may be I will be able to someday see “light in the tunnel”. He was very thorough in laying out the plan and assisting with reaching my primary litigation objective- Diversion. After nine frustrating months and no progress on the case with my previous counsel, I was switched over to Mr. Haber. As soon he was appointed as my counsel, he immediately started working on the next steps as outlined in the plan. His communication skills were impeccable! He always kept me informed along way as we worked upon our plan. In addition, he made himself always available to answer any questions I had either via text, call or email. Five weeks from retaining him, he was able to successfully execute the plan and secure diversion (think about the happiness and relief he provided, it is like getting a second life). The time line is important to note, because on my initial call he had indicated that within 4-6 weeks from retaining him he would be able to provide a definitive answer if he would be able to secure diversion from the State. He stuck with his indicated turn-around time. Because of working in healthcare industry and having a professional license, I did not want to risk a loss at trial, hence was seeking diversion ( as a best alternative). As I enroll in diversion, I hope that my day nears where I successfully complete and graduate from the program so that we can subsequently follow with expungement. Mr. Haber’s professionalism, skill set, thorough follow -up and follow -through are commendable. I am confident that he can take on any complicated case, craft and execute an excellent plan and achieve a successful outcome. I wish and pray that no one gets entangled with the legal system, as the process is very frustrating and extremely nerve wracking, but if anyone does have to face this oppressive system then be assured that Mr. Haber would be the BEST and RIGHT attorney to defend your c

Dear Anonymous, Apart from a general and heartfelt "thank you so very much" for your incredibly kind and detailed Client Review (#216 for #HaberPA on AVVO) I want to take a moment to comment upon what I consider to be the most salient things that you mentioned. First, you hired me only after having already been thoroughly disappointed by a prior privately retained attorney, and for that I am both sorry (sorry for you in that you wasted time and money, you expended unnecessary worry and incurred needless stress for yourself and your family) and grateful (grateful that after such a horrific experience - with an otherwise and seeming competent lawyer - you took a leap of faith in choosing to retain #HaberPA to competently clean up the mess). Sadly, about 40% of my caseload includes clients such as you, to wit: Victims of what can most aptly be described as "p*ss poor lawyering". Second (although most importantly to my mind), you found and chose to speak with me because of other Client Reviews (Client Reviews which are not unlike this one / yours), which is a tribute not only to my competence, dedication and proven abilities but also to those literally hundreds of folks who, like you, so generously offered their time to express their experience and satisfaction with #HaberPA's legal services. Just as is the case with all who came before you, I am humbled, grateful and indebted to you for doing so here and now. Third, you retained me based upon our detailed discussions which culminated in a realistic, achievable and affordable plan of action, but this did not come to be either flippantly or free. In your case you wanted diversion. Period. You made this clear to both your first attorney and to myself. While I can't speak to discussions between you and your initial attorney in my case you maintained your desire for admission into diversion (which was something that the State absolutely refused to offer to you) despite my earnest belief that we would secure an acquittal at trial. Not withstanding our difference of opinion as to the best resolution, you were the client, you wanted what you wanted, it was neither illegal nor unethical and so I steeled myself with determination to make your wish a reality. All of this observed I want to take a moment to remind you of the Golden Rules of diversion (e.g. Do what you are supposed to do, when and how you are expected to do so and do not do anything that you are not supposed to do) and to say that I'm eager to expunge it for you. Domestic violence case

Mr. Haber recently represented husband in a domestic violence case. I’ve never actually met him but I know who his is since he was also my husband's lawyer a few years ago in a case that didn't involve my daughter or I. Because he got my husband's first case dismissed I know that Mr. Haber is a goo...d lawyer, but this time I was a victim and so I was especially concerned for myself and my child. To protect my daughter and I, after my husband's arrest I hired a family lawyer, we got domestic violence restraining orders in place and I spent the next 6 or so months dealing with this horrible situation, hoping to figure out what was best for my family. It was about that time (6 or so months into the case) when I learned that Mr. Haber had been guiding my husband in an effort to reunite our family. My husband had spent all that time in individual and group therapy, he also completed a 26 week anger management course and Mr. Haber organized and insisted on all of those things as conditions of his representation! Before this incident I didn't have any experience with lawyers and I didn't know how they operate but I now know this: It's been more than a year since the incident and if Mr. Haber hadn't taken such a personal interest in my family's safety and well-being then we might not be together now, happier and healthier than ever.

Dear Andrea, After 30 years in the criminal defense industry I don't get to experience too manty "firsts", but this (#HaberPA's 215th Client Review on AVVO) is one of those rare, precious moments. You were a crime victim (whom I did not represent in my capacity as a victim's rights advocate; to the contrary I represented your malefactor) who went out of her way to effectively thank me for representing her wrongdoer. If you hadn't so eloquently explained the "why" of this then anyone reading your review (myself included) would likely be perplexed, but you did and for that (and for the review itself) I am grateful. I call #HaberPA a "boutique" law firm because I recognize that each client is an individual, I pay great attention to the details that matter to the client and then I tailor a strategy which I believe to be best suited to accomplishing the client's objective. Sometimes it is purely a "litigation objective" but oftentimes, and surely in this instance, it's more of a global approach, litigation being but one of many components. I do not need to tell you how determined your husband was to preserve his family (to say "at all costs" wouldn't do his passion justice), and, knowing something of him I put my experience to work, called in a support staff, laid out a multi-tiered plan, tasked everyone with their chores and set to work, micromanaging a proverbial ensemble. Sparing you (and the readers) the details, suffice it to say that without your husband's unwavering commitment, dogged determination and time-proven effort all of that would have been a waste of time, money and brain power. I guess what I'm trying to say is that while I will take credit for being "the man with the plan", in the end I was really "the guy behind the guy", as it was your husband who did all of the heavy lifting.
