Feisty and Mighty Duo against the Mammoth

Can’t say it with enough words on how thankful I am with Attorneys Mike Haber and Marc Morris. I was with the wrong people, at the wrong location, during the wrong time. Everything happened so fast; I ended up in the slammer with charges which could have left me behind bars for about 40 years. I ...knew the only way to prove my innocents and show I have nothing to do with the operation; I had to hire an over the top, above average, bulldog lawyer. I hesitated to call anyone. I knew of lawyers that advertise everywhere, but I was concerned as to hire any lawyer who would want to charge me up endlessly and might not have the experience to duly represent me against a setup which I had not been involved. I started googling legal terminology, and I saw a series of results from this website avvo.com and a couple of these results were answers to questions by Attorney Mike Haber. I was skeptical of both the website and the attorney. I did further research and found the validity of the website, and that Mr. Haber is licensed by the Florida Bar. It helped greatly to see Attorney Haber has much social media presence with numerous YouTube videos, which are very informative. I then felt assured this is the real deal and decided to call up Mike. Mike runs a lean law practice, and therefore there are no runarounds through a receptionist or paralegal. He answers his cell phone, and when he doesn’t, it is because he is in court. Well, going back to the storyline, I called Mike, and from the initial call I was very much impressed how articulated, and knowledgeable this guy is on the matter. Over the phone, he sounded like a tough guy (which was what I was looking for). In person, boy you better be careful not to get a bite. As long, as you are on his side or at least not against him, you will be fine. In the initial call, he mentioned about bringing another lawyer on board, Attorney Marc Morris. Marc has an extensive background as he was a prosecutor. Two amazing lawyers equal much ammunition for the battle to show my innocence against the mammoth which wanted to drag me down. This review is getting longer than expected, well to rush to the conclusion. I was released with no bail set with a ROR; the case still was pending because the prosecution did not want to budge to drop the charges, and right before the start of the speedy trial (which my attorneys requested), the attorneys endlessly dropped motions onto the prosecution. On the morning of the trial, the prosecution threw the towel, and the case was dismissed. Here are some tips: these lawyers are not going to hold your hand, nor babysit you. They are actively defending your best interest and getting things done. Therefore, do not get in their way, and let them do their job. Remember they have a lean law practice, which in turn saves you much money.

Dear Elbin, Thank you for your powerful and descriptive Client Review (#HaberPA's 180th on AVVO). So the folks understand, intending visit to your your sister and brother-in-law for a weekend, and so as to save money on airfare, you had hopped a ride with 2 guys (1 of whom you knew) from ATL to the 305. Unbeknownst to you the guy you knew was carrying $28k in cash to purchase a kilo of cocaine from an undercover (U/C) Hialeah cop, the deal (a "reverse sting op") having been brokered by the other person in the vehicle via a confidential informant (CI). The car drove straight into a meet at a gas station, the driver reportedly flashed the cash to the U/C and the passenger agreed to follow the U/C cop to the prearranged (and wired) buy location while you unwittingly remained along for the ride. The 2 guys went inside with the U/C and his partner while you sat in the car, ignorant of the circumstances. Meantime, in a secured location - and entirely beyond your presence - the coke was displayed, opened, tested and the cash was tendered - all on video & audio - and then the fishnet was thrown, the 2 guys on the inside being (properly) arrested and you being (improperly) arrested while you were waiting inside of the vehicle. There was none - zero, nada, nil, zip - evidence of your involvement / knowledge or intent to participate in this drug transaction, the C/I never mentioned your name to law enforcement, they did not expect you, they had no idea who you were or why you were in the car and you were not present during the actual transaction. Still there was bad news, and it was fourfold: 1) It was Hialeah (absolutely no legal scholars there) and so they arrested you for drug trafficking, 2) You were not effectively represented at the bond hearing, the Judge simply rubber stamped your arrest and you were held on a $500,000.00 bond; 3) Even though your family hired #HaberPA within days of your initial appearance you still had to sit in jail more than a month before we could get you an Adversary Preliminary Hearing (APH); and 4) after an evidentiary hearing, and even though your Judge ruled that the cops had NO PROBABLE CAUSE to have arrested you, the State Attorney refused to drop the case, doubled down on his officers' douche-baggery, forced us to file a written demand for speedy trial and kept your stink bomb of a case alive for several more weeks. (In case anyone wants to research it the defense to your case was "mere presence" - meaning that guilt cannot be established either by someone's mere presence at a crime scene or mere association with another person at a crime scene - the law requires more than that so as to establish knowledge and intent to commit a crime.) The good news was that immediately after the APH you were released from custody, without any conditions and, ultimately (and although the State made us work for it) the charges against you were all dismissed. Sadly no one can give you that month+ back but #HaberPA did what we promised, as we always strive to do, to wit: We attacked your case, aggressively and quickly, and exposed it for the stink bomb that it was. I wish that we could give you back the month+ of your life that you lost to p*ss poor policing... sadly we can't. But we did help you to recover your freedom, to restore your good name (you had no prior criminal history) and live up to our commitment of providing "boutique", effective and relentless representation for a fair price and, as you say, "lean" (with no unnecessary fat). Light at the end of the tunnel...

One drunken night in Miami set me on a collision course with it’s criminal courts and threatened to undo me as a whole. I’d found myself in jail and facing very serious assault charges on a police officer. Needless to say, the outlook was grim at best. My priors from 20 years ago were definitely not ...helping. To be honest, I was scared, alone and facing serious time. My public defender’s performance only served to put me further in the courts hole. I had to do something. That’s when I was referred to Michael Haber. After one conversation with him and Marc, I knew they were the real deal. He asked me the tough questions upfront and set my expectations. I paid my retainer and the following day, they’d filed more motions in 24hrs, than 3 public defenders had done in an entire year! The prosecution now realized, actual work would be required. I finally took a very favorable plea deal for 2 years probation. No special conditions, freedom to travel for work and the ability to complete probation in half the time. This was a big win for me, seeing as my priors did me no favors and the trumped up assault charges on an officer were going to bury me. Money well spent and I’d most certainly recommend Michael Haber to anyone facing bleak circumstances.

Dear Anonymous, Thank you very much for sharing your experience with the folks via #HaberPA's 179th AVVO Client Review. It's true that once we got on board we absolutely peppered the State with motions (not one having been previously filed in your case) and that in so doing - forcing the State Attorney to actually open their file and work - we achieved your litigation objective (it's important to note that because of your prior record you were specifically not seeking an acquittal at trial; rather you wanted to close your case cleanly, sans risk, with straight probation and leave to freely travel throughout the US)... But I feel that I need to give a shout out to PD's (and most especially those here in the 305) and explain that although they generally can't afford to offer up the time and personalized attention that a private lawyer brings to the table, PD's are almost all excellent attorneys, generally being extremely well-versed in both the law and their courtrooms. Contrary to popular belief, it is not easy to either get hired as, or to remain employed as, a PD (again, especially in the 305). It takes brains, ethics, effort and commitment. It is an often times thankless job and attorney's who are not committed to it simply do not last. For those who do, however, their client's usually benefit not only from the day-to-day knowledge of their individual courtrooms (including but not limited to knowing the tendencies of their Judge, their prosecutors and the other instrumental court personnel) but also from the vast resources that the PD brings to the table (investigators, experts, etcetera) without further expense to the client. I have the greatest of respect for those guys and gals who earn a pittance yet generally try so hard and accomplish so much. That said, there is no substitute for privately retained criminal counsel (although - sadly - there are plenty of snake oil salesman / worthless private attorneys out there). As you have so nicely illustrated, when you retain #HaberPA we pledge - and deliver - to: A) provide honest & realistic litigation objectives; B) quote and honor fair fees; C) always be available & responsive; D) keep you fully informed; and by doing so E) earn your positive client review at the conclusion of the case! Mission accomplished! Don’t look elsewhere!

While on vacation in Miami, I was arrested and charged with a felony battery over a dispute with my soon to be ex wife. Not knowing anyone in Miami I started looking for an attorney and hired one. His name was Jonathan Meltz. I initially paid him $5000 to represent me. We had about two conversations ...over the phone (I was back in Boston then). After three months and a struggle to reach out to him (he would not answer his phone, nor would he return the calls!) I was desperate to find a knowledgeable attorney who could represent me and defend me. My case was not a simple case. It was a felony battery in which the state attorney had secured evidence! I started browsing avvo.com and searches for an other attorney. There I found Michael Haber. I called him on a Saturday evening (around 6pm) and left a voicemail. My call was returned within 30 minutes. After briefly explaining my case, he told me he needed to review the case online and would call me back within the hour. Exactly an hour later, it seemed that he had memorized my case already. My previous attorney had filed absolutely nothing on my behalf. It became evident we needed to act fast as the next hearing was approaching. Since his reviews were all 5 stars I decided to trust him. This was probably the BEST decision I had ever made! He sent all the motions in a timely manner, defended me so aggressively that the district attorney struggled keeping this case going the way they wanted it to. He strategically asked for extensions to give us more time to prepare the case. He threatened to subpoena my ex wife as they were refusing to fly her in to Miami. Yesterday, finally after over a year of struggle, the case was dismissed! I’ll never thank him enough for everything he did!

Dear Jay, Thank you for authoring #HaberPA's 169th Client Review on AVVO. It's not uncommon for me to get calls from people who are (as you were) represented by counsel, yet are sufficiently unhappy with their lawyer that they are shopping for a new legal advocate. When this happens, regardless of my own personal thoughts, I remain neutral on the quality of anyone else's representation. I accept these cases as a clean slate, identifying my own litigation objective from a fixed point in time (regardless of what did or did not transpire before my involvement in the case), strategizing my own path forward and sallying forth independent of any prior action by any prior lawyer. So while I am grateful for your praise, and while I understand that this is your review and that you can (and did) say whatever you wish, I wish that you had not called out your prior lawyer by name. I know Mr. Meltz to be a fine and respected lawyer, and while you and he may have had a bad experience what happened was between you two and really has no place here. That said, I am proud to have earned your praise (equally relieved not to have earned your ire) but I must correct one item from your proffer. I did not strategically ask for extensions in your case. I strategically filed motion after motion which caused the State to seek extension ("continuance") after extension, and that went on for nearly a year until our Judge finally had enough of their shenanigans and forced the State to fish or cut bait (... which resulted in a dismissal of your felony case on the morning of trial). The only regret that I have in your case is that I did not get to fly up to Boston to take any depositions (because I missed out on my beloved namesake - Mike's Pastries - and my absolute favorite pizza at Reginas). Best Results From Michael

I have known Mike Haber since childhood, I follow him on FaceBook & Even Watch his Educating Lawerly Videos On Utube.. I have to say I never would of thought that I would have to hire him as my attorney.. but life Throws us all kinds of Unfortunite circumstances & I guess I am now proof of that.. one... never knows? I found myself in trouble with the law, I was Panic Stricken & Reached out to Mike Haber.. I had Legal issues in 2 Seperate Counties which both were far away from his office.. Great man!

People usually get stressed and confused very easily. Between the costs of defense and dragging out cases for their own personal wealth and the lingo no-one but officers of the court understand puts a bad taste in people's mouths when the hear the word attorney. Especially when you stress the cost ...and when you don't understand something, try charge you for their time to answer it. This man is amazing. Out of his own kindness he helps people with their questions for free on his own personal time. And this man was the only attorney to completely answer my questions. Very detailed. I truly applause this man for helping some of us who couldn't have got through this stressful time alone. Thank you sir! What you're doing deserves a standing ovation!

I don't know if that sounds like a lot, or not, but I assure you (and everyone else) that this has taken a significant deal of time, effort and energy. I answer questions throughout the day, on weekends and while on vacation.
