Dear Susy, Thank you very much for sharing your experience with #HaberPA with the folks. Yours is the second time in recent history that the spouse of a client has taken the time to author and submit a review (in your case #HaberPA's 219th Client Review) so I must be doing something exceptionally correct. That observed, I am well-aware of just how daunting the criminal justice system can be, especially for the uninitiated, and so it's an important part of my job to explain the mechanics to those who need to know, your husband's case being an excellent example. In those initial moments at your home, when your husband was first detained then "cuffed and stuffed", the hands-down most critical thing that you possibly could have done was to call me (a lawyer). You were able to provide me with real time information which I was able to parlay into both a greater understanding of the situation (not only for myself but also so as to be able to explain things to you) as well as into effective, persuasive argument for our impending bond hearing. Your husband had multiple issues. He had picked up a new violent domestic felony, which, on it's own is a significant problem, but, dovetailing it with the fact that he was serving felony probation at the time, the situation was dire. First, anyone on felony probation in FL who gets arrested for a new case is subject to a "No Bond" hold on the prior probation case. While Judges have the discretion to authorize bond for such folks (either at the prosecutor's request or sua sponte) they often deny the same for a variety of reasons (e.g. to sweat the probationer, to make a later plea more likely, to send a message to other probationers, etc.). Still, and although one can theoretically sit in jail for months on end while awaiting a PVH the Judge may, should s/he wish, grant a "Probation Bond". But, when, as was the case with your husband, one is designated as a "VFOSC" (a Violent Felony Offender of Special Concern - which happened in your husband's case simply because he was charged with a felony crime of violence while serving felony probation) then the Judge has no discretion, s/he is statutorily prohibited from granting a bond on the new case and that renders a probation bond meaningless. Fortunately you and I were able to speak and enjoyed free communication over the next 36 hours. My investigative team was able to secure surveillance footage of the actual incident (which was something that the cops either neglected to do or intentionally chose to avoid), you were able to provide me with significant historical context as well as incredible documentary evidence which plainly demonstrated malicious intent on behalf of the "alleged victim" and while your husband had to spend two (2) evenings in jail we were able to convince the Judge to deny VFOSC status and ROR (release on recognizance) your husband. After that the rest was relatively smooth sailing. Even though the prosecutor bought the complaining witness' BS story and filed the bogus new felony domestic charge we had an experienced Judge who gave us the courtesy of a quick "Stand Your Ground" Hearing and within about 6 weeks time your husband was granted statutory immunity, the new case was dismissed and your husband was reinstated to probation. Please believe me when I say to you that I could not possibly have accomplished my job without your generous effort and assistance. In truth your husband has you to thank every nit as much as myself, and I too must thank you (both for your generous client review and for helping me to help your family). Dear Andrea, After 30 years in the criminal defense industry I don't get to experience too manty "firsts", but this (#HaberPA's 215th Client Review on AVVO) is one of those rare, precious moments. You were a crime victim (whom I did not represent in my capacity as a victim's rights advocate; to the contrary I represented your malefactor) who went out of her way to effectively thank me for representing her wrongdoer. If you hadn't so eloquently explained the "why" of this then anyone reading your review (myself included) would likely be perplexed, but you did and for that (and for the review itself) I am grateful. I call #HaberPA a "boutique" law firm because I recognize that each client is an individual, I pay great attention to the details that matter to the client and then I tailor a strategy which I believe to be best suited to accomplishing the client's objective. Sometimes it is purely a "litigation objective" but oftentimes, and surely in this instance, it's more of a global approach, litigation being but one of many components. I do not need to tell you how determined your husband was to preserve his family (to say "at all costs" wouldn't do his passion justice), and, knowing something of him I put my experience to work, called in a support staff, laid out a multi-tiered plan, tasked everyone with their chores and set to work, micromanaging a proverbial ensemble. Sparing you (and the readers) the details, suffice it to say that without your husband's unwavering commitment, dogged determination and time-proven effort all of that would have been a waste of time, money and brain power. I guess what I'm trying to say is that while I will take credit for being "the man with the plan", in the end I was really "the guy behind the guy", as it was your husband who did all of the heavy lifting. That said, while I can tell you how grateful I am for your having taken the time to share your thoughts and feelings with the folks I can't express to you just how happy I am that your family is intact and that your daughter has the best of both worlds under one roof. It is not my job to judge my clients; however, depending upon the case it is my job to assess credibility, be it of persons or items evidence, and then to give my client honest advise based upon my experience. That said, given the nature of your case (a post-disposition return of property which had neither an evidentiary nor a forfeiture hold, to a person who has not been legally "disqualified" by any criteria) there was no basis for me to assess anything; rather, in this instance my job was to gather the necessary facts and documents so as to be able to prepare a legally sufficient motion, electronically file it, serve it on all relevant parties, calendar it for hearing (with sufficient time for all other parties to respond and appear) and then litigate the heck out of it... which we did, successfully. Once a criminal case is closed I consider my former client to be a friend, and so, as in your situation, it's always bitter-sweet when a current friend returns as a repeat client (bitter in that the last place where I'd like to see you is again involved with the criminal justice system yet sweet in that a) by hiring me again you have exhibited your complete confidence in my ability and desire to help you and b) as such, I am ever-honored to have earned that privilege). Still, in this existence one of the few certain existential observations is that life is full of unpredictable events (or, more simply put, "sh*t happens"), and so it came to pass that you became a repeat client. Apart from expressing my gratitude (for both re-hiring #HaberPA and for your current Client Review) the only comment that I am compelled to make about your kind review is that I did neither "made" (in terms of applying any force) nor did I "demand" that you do anything; rather, with your input I established and you agreed to commit to a multi-tiered plan which was designed to levy an effective challenge the charges while also paving the path for responsible, objective mitigation, should the same ever be required. But the true beauty of the plan which I set in place was that it had the added benefits of providing a support system which effectively reduced your risk during the process (which, largely due to CoVid, took a full year to resolve) while both educating you as to how to adopt and incorporate more balanced management and coping skills into your life while concurrently taking proactive measures which indisputably demonstrated your earnest and most heartfelt desire to save your family. You are 1,000% correct when you observe that "In the end I know that I did all the heavy lifting", because you did; moreover, you did so in a completely steadfast, determined and unwavering fashion, and you should be incredibly proud of yourself for your total accomplishments and complete success. Had you failed, on any level at any time in any capacity (noting that there were limitless possibilities for any such breakdown) then we likely would not be having this pleasant discourse. Being easily accessible (by phone, email or on the internet) and always engaging in open, honest, direct and frequent communication with the client are some of the key hallmarks which makes #HaberPA a "boutique" criminal defense law firm and which we absolutely cherish, and so your praise in this regard is most gratifying. But we also treasure our initial and heartfelt desire to come to understand the Client and her/his situation, to adopt the Client's interests as our own, to identify and secure realistic litigation objectives and to quote and honor reasonable fees (in writing), which we also accomplished in your case. As no one knows who you are and so as to add some context so that the folks understand the "what" of your case, you were charged with Grand Theft of $29,353.64 in the form of accepting a variety of overpayments from FL-DCF. You were cash strapped and apart from a financial inability to repay that sum you also disagreed with the dollar amount claimed by the State. Understanding your inability to defend yourself against an opponent with unlimited resources (e.g. you could not afford to hire a forensic accountant, much less to finance a trial) and your stated desire to negotiate a quick plea which did not involve jail, we committed ourselves to work together at vetting the 1,000 or so pages of discovery that the State provided in an effort to chisel the amount down as much as possible and secure - at worst - a term of probation with a withhold of adjudication (no conviction). But, as it turned out, our "rapid investigation" turned into an almost year long email and telephone battle with DCF which resulted in an admission by the State that you had been over-billed by $20,900.92 and that your actual debt was $8,452.72. During this year you were able to ferret away a few bucks and I was able to convince the State to permit you to prepay $3,500.00, thus dropping your debt to $4,952.72, an amount which was under the $5,000.00 threshold for diversion. You are now enrolled in diversion with the only ("only") conditions being repayment of the $4,952.72 in no less than 6 months time (i.e. once the $4,952.72 is repayed then the State will dismiss the case and you can expunge it from your record, although this cannot be done is less than 6 months time), with no community service hours, no classes, no other strings attached. Even though it took both more time and effort than we agreed I did not hesitate in honoring the original fee that was quoted, and in your instance (i.e. knowing something about you, your family and your situation) I am especially happy to have been able to go the extra miles. I am thrilled for you in terms of your case status, I am most gratified by your sharing such kind words with the folks and I look forward to expunging your case sometime in the next 6-12 months.
