As a Boston resident and non-U.S. citizen on a Student Visa, I faced significant concerns when I was unexpectedly charged with a felony while on vacation in Miami. Dear Anonymous, Thank you so much² (² as 1, your exceptionally well-written, heartfelt words are heartwarmingly accepted & 2, as you didn't ID yourself I can share more about your case than I could if your identity were known). You were arrested on Felony Shoplifting charges while visiting The 305. With neither a clue as to how to navigate the Criminal Justice System nor whom to hire you did that which so many others in your situation do, to wit: you turned to the internet for direction & found me amongst untold numbers of other lawyers. As you explained it to me, it was my literal hundreds of 5-Star Client Reviews (yours now being # 257, thank you again) coupled with my detailed responses to each & every one of those Reviews (precisely as I am doing here & now) that prompted you to reach out. After that (& noting that you spoke with several other Miami based criminal defense lawyers) it was the fact that I "engaged in numerous discussions with me via phone, text, Zoom, and email" (which we did, as you were arguably overly concerned) coupled with my follow-through by having "always taking the time to patiently and thoroughly address my questions" which proved to you that I was the "right" attorney to assist you (& also that at #HaberPA we not only "talk the talk" but we "walk the walk"). That said 1 of the things that I initially noticed on your Arrest Report / Probable Cause Affidavit was that you were born outside of the US & were thus a foreign national (dual aside alert: first, Miami-Dade County is NOT a sanctuary / haven, both as such & a matter of protocol ICE is notified each & every time that a non-US citizen is booked into our Jail & second, as Jack Reacher famously, accurately & regularly opines, "details matter", & #HaberPA is ever attentive to details). Because of this during our initial consultation we discussed your immigration status, your prospective intentions & how your arrest & case resolution may significantly effect the same. You advised that you were legally in the US on a Visa & that you had a pending application for Canadian citizenship for which you had hired a Canadian immigration lawyer. As #HaberPA is a "boutique" Criminal Defense Litigation Law Firm (aside alert: to us "boutique" means that we make ourselves easily reachable by phone, email or on the internet, we practice open, honest, direct & frequent communication & we take a "global" view and approach toward representation - e.g. we take the time to consider the client's unique personal circumstances by coming to understand you & your situation, adopting your interests as our own, identifying & securing realistic litigation objectives, quoting & honoring reasonable fees in writing & thereafter rapidly investigating & preparing your case for whatever resolution may come, preferably the 1 that we identify as our "primary litigation objective" but if not then our secondary or even tertiary goals) I offered to assist as I may, suggesting that you put your Canadian Immigration Lawyer and I in touch sooner than later. I suggested that you do so in writing (in 1 email to both of us) so that it'd be clear that you'd knowingly waived the otherwise sacrosanct confidentiality of your Attorney-Client Privilege & authorized your lawyers to freely speak with one another about our respective cases in your common interest. In your particular instance I wound up spending nearly as much time with your Immigration Lawyer as I did in working on your criminal case (a fact that I didn't predict beforehand), still that was a courtesy which I was happy to provide without any additional cost (& is yet another example of #HaberPA's boutique nature). We were able to rapidly accomplish precisely that which we set out to do & you're well on the way to both righteousness & Canadian citizenship. Dear Barbara, Thank you for your kind words in the form of #HaberPA's 256th 5-Star Client Review on AVVO! Because your son chose to identify himself in his equally thoughtful Client Review & as anyone reading this response could likely do the math & figure out his identity for themselves (yes, I know that I just did the math for them but it matters not as...) I can't risk discussing anything that could possibly violate the sacrosanct confidence that your son & I share. I can, however, address non-confidential matters between you & I (i.e. a parent who retained me on behalf of her child & who happened to disagree with my recommended litigation objective / goal) by replying directly to your review. As I explained in my reply to your son, lawyers have an ethical obligation to serve the client in multiple capacities (specifically "as an advisor, advocate, negotiator & evaluator") but sometimes we need to improvise & serve as choreographers who compose the sequence of steps & moves for a performance (in this case litigation), but the key here is that these professional mandates are intended "to serve the client", not the client's parent, spouse, sibling or whomever may happen to foot the bill for legal services . This is something that I made clear to both you & your son from the get go, first via conversation & then again in the retainer agreement that we all signed (your son as the client, you as the guarantor of fees & me as the advisor, advocate, negotiator, evaluator & choreographer). In fact this is the exact language: "Attorney has been retained by Client’s mother. Although Client’s fees are being paid by his mother both Client and his mother expressly understand and agree to the proscriptions as contained in Rule 4-1.8(f), R.R.F.B. (i.e. that although Client consents to a third party paying his fees and costs, such third party is not the Client and cannot in any way interfere with the Attorney-Client relationship). Client and his mother further understand that any and all information relative to the representation of Client remains protected by the rules governing confidentiality - i.e. Rule 4-1.6, R.R.F.B., such that unless Client expressly waives the same and specifically authorizes Attorney to freely communicate with his mother, or anyone else, then the privilege is intact in regard to any and all aspects of the representation. By initialing here Client expressly authorizes Attorney to speak freely with his mother about his case (______)." In this way we were all clear about our rights, roles & responsibilities during the course of the case. That said, to say that your son's case was "challenging" puts it mildly, but it was even more difficult to conjure a way to get the State to agree to allow your son to enter into Diversion, earn a dismissal & effectively guarantee a "win" while running no risk whatsoever. On an irrelevant albeit a personal, selfish level I would have preferred to litigate & Try the case (not only because I became a Criminal Defense Lawyer to be in Court, arguing cases in front of Juries, dissecting the State's cases, cross-examining their witnesses & proverbially dogfighting over the admissibility of evidence but also because above & beyond the flat pretrial fee I charge a separate "per diem" / daily trial fee & so by resolving the case without a Trial I'm effectively costing myself both intellectual pleasure & pecuniary profit) but it was not in your son's interests for me to do so, not if I could manage to structure a path to victory without unnecessary risk & cost. Had diversion proved unattainable then I guess both you & I would've been happier (i.e. you'd've seen "a different approach" and I'd've benefited both professionally & financially) but in the end I was also a de facto parent to your son, serving "In Loco Parentis" & I was looking out for both he and you (his liberty & your money). BEST LAWYER EVER - EASY PROCESS & NO JAIL TIME

I was facing 5 years minimum. Michael got me into a pre trial diversion program and had the charges dismissed in as little as 6 months. He is a precise and aggressive lawyer. Dear Okeilo, Thank you very much for your kind words & sincere 5-Star Client Review (#HaberPA's 255th here on AVVO). A part of me wishes that you hadn't identified yourself so that I could have discussed the facts & circumstances of your case (which were fascinating - aside alert for the folks: although individual clients are generally interesting, sadly, after 33+ years in the Criminal Defense Litigation business, "fascinating" isn't a word that I get to use often to describe cases as most run the gamut from "mundane" to "routine") but it is what it is & I'll do my best to share what I can without disclosing any confidences or otherwise violating the sanctity of the attorney-client relationship. The Rules of Professional Responsibility state: "As a representative of clients, a lawyer performs various functions. As an adviser provides a client with an informed understanding of the client’s legal rights and obligations and explains their practical implications. As an advocate, a lawyer zealously asserts the client’s position under the rules of the adversary system. As a negotiator, a lawyer seeks a result advantageous to the client but consistent with requirements of honest dealing with others. As an evaluator, a lawyer acts by examining a client’s legal affairs and reporting about them to the client or to others." In your case I was tasked with serving in all of those capacities plus one more, to wit: a "Choreographer" (i.e. I had to "compose the sequence of steps and moves" designed to convince a Prosecutor to offer you diversion), but let's step back for a moment & take a bird's eye view of the Criminal Justice System. When Police make an arrest (any arrest of anyone for any crime - here in The Sunshine State anyhow) they are (or should be) convinced that Probable Cause exists to believe that person X committed crime Y in their jurisdiction, & when it comes to felony arrests (like yours) as a condition precedent to booking you into a Jail (which is mandatory in all Florida felony cases) they must swear out a Probable Cause Affidavit which explains "the why" of their belief. After that a Prosecutor (who presumably knows more about the law, Rules of Criminal Procedure & Rules of Evidence than your Arresting Officer) is tasked with reviewing & reassessing the case as a "Minister of Justice". I like to think that most Cops & most Assistant State Attorney's are conscientious & honorable but the fact is that most ASA's view the Officer as Moses descending Mt. Sinai & her/his PCA as the tablets containing The 10 Commandments, etched by the hand of G-d (in other words, many more times than not the State rubber stamps the Police version of events without question or concern), & that's precisely what happened in your case. As a consequence of the time that you & I spent together, our collective attention to detail & the evidence / proof that we were able to generate I was equipped to fulfill all of my ethical duties to you (i.e. to be an advisor, advocate, negotiator & evaluator), & with assists from my dependable Private Investigator & ardent Forensic Psychologist (i.e. "our team") I was able to choreograph (again "compose the sequence of steps and moves" designed to convince a Prosecutor to offer you Diversion), a resolution that the State had not envisioned at the outset (again, you were arrested by a proverbial Moses after an allegorical G-d's command) but which you & I had identified & targeted as our "primary litigation objective". Of course I had to prepare you for the very real possibility (probability even) that we might not be successful & that if we weren't then you'd need to decide whether or not to accept the best Plea Bargain that I could broker or to bunker down & prepare for Trial (which is part of my ethical mandate) but none of that was necessary as "Plan A" panned out in your case. We could not have asked for a more perfect resolution!!!

My son is a law student at U. of Miami. He is still on my auto insurance policy because he is in school. While stopped in front of a police car at a redlight in Miami, the officer used a scanner to randomly check my son's license plate. The state system erroneously indicated that he was an uninsured... driver and was driving with a suspended license, which nothing could be farther than the truth. Because the charges were for a misdemeanor crime, the officer could have arrested my son right then and there, but believed him when he assured the officer he was fully insured. I, myself, am a lawyer and understand that a matter like this, if not handled properly, could delay or inhibit my son being admitted to the Florida Bar. I was panicked! Attorney Michael Haber, my friend from law school, "saved the day." He easily and quickly analyzed the situation, and diligently and precisely performed everything he represented my son for and got all of the charges TOTALLY DISMISSED. He accomplished this through both his knowledge of criminal and traffic laws. In fact, he disposed the case against my son without my son even having to appear in court. Attorney Haber understood just how serious this was to me for my son. He told me exactly what to expect and was 100% "on the ball" getting from me the evidence he needed to win. Dear Rob, Thank you for your kind words in the form of #HaberPA's 251st 5-Star Client Review. I'd be remiss were I not to point out that your son, who's both a most responsible young man & thus a tribute to you & his Mom, submitted a prior (#249) 5-Star Client Review, & while he did so anonymously your (kind to me but perhaps not so considerate of your son) inadvertently called him out; but as he did nothing wrong, & in any event his were not the "charges of the century", I suppose that there's no harm & thus no foul. That said you & I met in 1988 as "1Ls" at "Harvard South Campus" (i.e. Nova University Law School) & we've been friends for 35+ years. After law school you moved to central Florida & started a lucrative PI / Personal Injury practice whereas I remained in SoFlo (specifically in The 305) plying my trade as a Criminal Defense Litigator. While we don't get to see one another nearly often enough we've maintained contact & our friendship has blossomed into one which incorporates mutual professional admiration & respect. As I'm sure is the situation whenever a PI client entrusts you with her/his case (& therefore possibly her/his economic future), so too is it a source of pride each time that a client bestows upon me their confidence by affording me the privilege of being responsible for their liberty. That said this holds especially true whenever a parent effectively gives me "custody" over their child's liberty, & even more so when that parent happens to be an attorney. It goes without saying to you but is important for the benefit of the folks who read this to know that it's far easier for a lawyer to locate another lawyer for representation (be it for themselves, a loved one or a client) than it is for civilians, many (if not most) of whom have no base of knowledge from which to select the right attorney. Personal recommendations are always both a welcomed & valued referral source, but back in the day when you & I began our respective professional journeys the most common method for locating a lawyer was to literally "let your fingers do the walking" & peruse the "Yellow Pages". Nowadays the physical aspect has tracked technology & evolved into "type your query, click your mouse & let your eyes peruse the pay-for-click Google hits", which is a far more perilous path than the extinct Yellow Pages. This is so as while legit, honest, ethical, diligent lawyers exist in the digital universe in order to find them you have to parry your way through a relentless stream of phony, manufactured, "would-be" choices, particularly those who either possess tech-talent sufficient to create the persona that they wish to be seen (like a modern day Wizard of Oz) or those who are slick enough to hire some tech-savvy miscreant who'll paint the picture on the lawyer's behalf. In this light that's a main reason why reviews like yours (& your son's) are so meaningful (to wit: They convey to potential clients real world experiences, impressions & valuations which can be considered & factored into the hiring calculus). I suppose that some venal lawyers post "scam" reviews (in fact & without naming names I know for certain that some are that unscrupulous) but anyone who reads enough of a given lawyer's Client Reviews will likely see for themselves which are genuine & which are, well, BS. Before I finish I want to add one more thing: As a lawyer you were absolutely correct to recognize that even an innocent, trivial matter like your son's comes with what we in the Criminal Defense industry refer to as "collateral consequences" (i.e. a "Scarlett Letter"), & that especially when it comes to matters such as professional licensing (be it with The Florida Bar or elsewhere) the "ripple effects" can be damning, ergo the need for competent & comprehensive representation.
