Reliable, knowledgeable, compassionate, professional Lawyer

I was lucky for being referred to Mr. Haber from the beginning of my defense. The first time we met, it was all about trust, especially in those dark moments of life, when I did not clearly know what was happening to me and how I could get back to normal life. Mr. Haber truly explained things with co...nfidence and at my level of understanding. “Sometimes it’s just like being in a rip current without the need to swim against waves” he well said with a confidence in his plans for defense while I was very worried and stressed at first. Soon I realized my case was in good hands when Mr. Haber was working on it. His reassurance despite the uphill battle was huge and his connection in any steps was a relief. Mr. Haber is approachable and professional. Now by describing the post dismissed case status as a glorious moment, I know a reliable, knowledgeable, and compassionate, professional lawyer, and just like how a patient cured from cancer goes back to their doctor, I go back to him if needed. There are no worries though unless and until the cancer comes back. And even then, Mr. Haber is determined to have solutions for success. As always, he does not leave his clients alone in these stressful moments of life. The best way I can describe a case of a wrongful accusation, being dismissed at hearing is like how a patient that has suffered from cancer and uncertainties around cure and treatments receives the brilliant news of a complete remission. It’s like that moment of life when doctors hear: “You mean I’m cured of an evil cancer? It’s gone?” This is a feeling you cannot easily describe due to being overwhelmed with happiness pursued by fear. The happiness for the success to prove innocence in a position of defense when in reality, I was the victim of a manipulative person. The pursuant fear is like a potential relapse in the mind of a patient that has just recovered from cancer after some inevitably damaging and curing chemotherapy. The fear of continuous harm and reputation damage by this person could be very devastating. We sometimes compare doctors to angels when recovered from a serious illness. But I think lawyers like Mr. Haber who go above and beyond are incomparable to angel or doctors because they can even save doctors when no other doctor can do so. Bottom line, In the darkness and despair when you may wish time would go back, it may be enough for a client to pursue the lights shed on their case by a great lawyer as Mr. Haber, which is the key to go back to a normal life.

Dear Anonymous, I can't thank you enough for your amazing review. As I know that you're literally in "the cancer profession", as you (Mr. / Ms. / Mrs. / Dr.?) are Anonymous & in light of your references to cancer / oncology I'll share what I believe to be a few relevant, interesting anecdotes with the folks. First, many of my would be (& actual) clients either have a preexisting or acquire a base of knowledge about their own legal situation by the time that we first speak. While most understand the limitations of what they either know or think that they know, there are "The Others" (shout out to "Lost") who believe that they either know "better" or more than I, & when that happens it's nothing shy of maddening. The silver-lining to that is that I've both come to recognize & apply this to myself, so, for instance, when I recently consulted an orthopedic surgeon about incessant shoulder pain my research allowed me to both follow much of our discussion & to ask relevant questions without overstepping & effectively being "Dr. Haber" who got his M.D. from "Internet U". That said in discussions with potential clients I often "use" doctors, albeit usually referring to myself as a "would-be Facebook / Internet Doctor" as I imply that while it's a good thing to do research & know something about your own situation there's a solid basis for the adage that "a little knowledge is a dangerous thing" (i.e. regardless of how diligently I may study my own medical concerns in no way does that license me as a doctor). Second, & in a very real legal-to-medical sense, Criminal Defense Lawyers are basically "legal oncologists", proverbially being akin to doctors with specialized training in diagnosing and treating "legal cancer"; & it's not a stretch to make a legit analogy of Criminal Prosecution to Cancer (i.e. both can be a "death sentence", albeit one, mine, usually only in a figurative sense). The point is that precisely like oncologists no one in their right mind wants to "need" to retain Criminal Defense Counsel; rather it's almost always done both in reaction to (as opposed to proactively) & out of a Darwin-esque sense of self-preservation & necessity. Finally, noting that some are "better" at it than others, very much like doctors, lawyers (at least those who actually care about the client & the cause) must develop a "bedside manner", & this takes us to your situation. Not only was this incident you first interaction with the criminal process but, being foreign born, raised & only recently admitted to the US (on a student Visa as a medical researcher) you were also culturally unaware of the nuances of dealing with Police. Thus, after you were physically abused by your ex-boyfriend (who went & filed a police report against you the following day, likely because he feared you doing so first) & the Cops showed up asking questions, rather than explaining to them what had happened (i.e. that you were attacked & acted in self-defense) you chose to clam-up & say nothing, just as you'd've had this occurred in your native Middle Eastern Country, given the cultural & misogynist nature existing there. Naturally the Police Officers who responded to your home had no way to know any of that, you didn't tell them & so they did what they thought was appropriate given the complaint & your lack of any defense thereto. Fortunately you were able to provide me with a great deal of information, not only about you & your mind-set but also about your ex & his mentality (including many social media posts, text messages & other undeniable facts which all but proved that he was a sadistic troglodyte), which I was then able to proffer to your Prosecutor, wield to your advantage & use to ultimately secure a "No Action" / Dismissal at your Arraignment (even over your ex's insistence that he wanted you prosecuted). Not to be an ingrate but, like Gregg Allman "I'm no Angel"; still I care & I'm elated to know that it shows. Wishing you all of the best! MAH/Esq. #HaberPA

Dear Ashley, Thank you very much for your kind words in the form of #HaberPA's 247th Client Review on AVVO. Since you didn't fully identify yourself, & as, per "MyNameStats" dot com, "Ashley" is the 172nd most popular given name in the USA (estimated at 373,715), I'm confident in my ability to share something about your case without violating client confidence & privilege. But before I do so, & not withstanding your legitimate criticism of the PD(s) who initially represented you, I want to be clear that I have the greatest respect for Public Defenders, most especially those here in The 305. Contrary to popular opinion it's not easy to get hired, much less to remain employed as a PD. It's an oftentimes thankless job that takes brains, ethics & effort, & attorney's who aren't fully committed to the cause simply don't last (not under The Honorable Carlos J. Martinez's watch anyhow). While it's inexcusable that you were never sent copies of the discovery / evidence in your case (which is truly as simple as forwarding to you emails sent to your lawyer by a Prosecutor), much less ever consulted about any of it, I'm sad to report that there are far too many privately retained Criminal Defense Lawyers out there who not only routinely epically fail in that precise way (aside alert: a lawyer's failure to keep a client informed about the status of the case is one of the most frequent grounds for attorney discipline by The Florida Bar), but in some ways it's arguably more painful when you're essentially paying someone to violate The Rules of Professional Conduct ("lawyer ethics") & to effectively commit legal malpractice at your expense (both financially & in actual point of fact). I know this to be true as a good portion of my clients come to me just as you did, after having been superficially "represented" by snake oil salesmen who took their money & then proceeded to recklessly botch the case, ergo my ability to quickly instruct you as to "how to receive my documents". Getting back to you & your case, once you were in possession of your discovery you forwarded it to me & from there we quickly got to work, together, as a team & just as the attorney-client relationship is intended to perform. Once I understood the State's theory of it's case against you (you were charged with Trespass & Battery) & the plea offer that had been extended (to wit: a "withhold of adjudication" with probation & a bevvy of special conditions) I outlined the various alternative paths forward & of those I identified you chose as "Plan A" beating down the State in an effort at securing Pretrial Diversion / PTD which you weren't offered as the victim refused ("Plan B" was a Trial, wherein we would - bad pun warning - proverbially beat your victim into submission & expose him for the lying crybaby that he was). I began to pound your Misdemeanor Prosecutor with Motions to Compel missing materials (which turned out to include several surveillance video & audio files) which we received & reviewed & which disclosed that we had no defense to the Trespass but that there was a good, triable case for the Battery (aside alert: reviewing discovery is critical as had those videos not been tendered then we would not have know the strength of the most damaging charge against you). Armed with that information I began plea negotiations which started well (we had a conscientious young ASA on the case) but which quickly broke down when that ASA was reassigned & we got a new disinterested Prosecutor. I ran the case up the flagpole, making it an issue with the State Attorney's Office & over the course of 6 or so weeks I ultimately convinced the Chief of County Court Prosecutions to agree to PTD, & even to throw in "Early Termination" as a bonus. In the end it took less than 4 (not 5, sorry) months, start to finish, to get you the resolution that you hoped for & have now secured. Honest and knowledgeable attorney

In 2020, at age 17, I was pulled over and cited for Running a Stop Sign (an infraction) and Knowingly Driving on a Suspended License (a criminal traffic offense). I was going through a rough time and failed to deal with the citations in a time, a Bench Warrant and a Driver License suspension were i...ssued by the Court. i moved out of Miami and attempted to deal with the issue by myself by getting the criminal traffic case reset for Court and paying the infraction. By paying the infraction i was convicted and received points and, unfortunately, when i once again failed to appear on the DWLS case another Warrant issued. Now in 2024 I became a more mature and responsible young man who wanted to clear my name and secure a valid license, I wisely went to my father for help. my dad knew Mike and called and asked me to help me. Mike then researched the procedural history of your case and immediately filed a Motion to Set-Aside the Bench Warrant. Within a matter of a few days that was accomplished. the warrant was vacated) and Mike secured a 60 day extension of time so as to afford me an opportunity to secure a valid Driver License. Mike, then filed a Motion to Vacate the Conviction in the infraction case (so as to remove the points from my driver history) , provide you with the information that i needed to secure a valid DL and tasked me with doping the same, which i accomplished in a matter of about 2 weeks time. Once i provided Mike with my valid DL Mike filed a Notice of Compliance and set the matter for hearing. Before hearing on the criminal traffic case occurred the infraction Motion was heard, successfully litigated and the points were removed from my record. Today the criminal traffic case was heard and the State dismissed the charge, leaving me and your driver history righteous and giving me a new start without a criminal record. Dear Alex, Thank you very much for your detailed, procedurally spot-on analysis & gratuitous mea culpa (in the form of #HaberPA's 245th Client Review on AVVO). As you've given the folks more information about your case than I would have chosen to do (which is your privilege, literally, not mine - as, knowing that you chose to identify yourself, absent your express permission I would be bound by attorney-client privilege to maintain confidentiality & I would thus have been limited in what I could have disclosed) rather than expounding on the facts and circumstances of your case instead I'll focus on the learning opportunities that your case presents to the folks (& there are several). I suppose the most logical starting point would be to observe that sh*t happens in life (aside alert: contrary to Hollywood legend Forrest Gump didn't invent that phrase during his cross country run in 1979, upon which he embarked after Jenny had exploited him for sexual favors & then left him in the wee hours of the morning) & how we choose to deal with that sh*t can sometimes be more important than the sh*t itself. Here, had you 'fessed up to Pops & asked for his help upon receiving the citations (1 of which was an infraction with a worst case scenario of points being assessed to your DL but the other was a Criminal Traffic offense which carried not only the possibility of Jail time, Probation and Fines, but, far more importantly, & most especially for young people who are just embarking on the fantastic journey called "life" but really for anyone, a permanent Criminal Conviction and Scarlet Letter on your non-erasable Driver Record) then while you may have gotten a well-earned chiding what you would have avoided was a Warrant (or in your case 2 Warrants), points or the concurrent & inconvenience aggravation of having to deal with this mess years after-the-fact & amidst a time crunch. (Second aside alert: You're lucky that you got to deal with the Warrant on your terms because you could have just as easily been taken into custody, thrown in a cage and had to face a Judge in another County with Extradition as a possibility, & please believe me when I say that that would've seriously sucked.) Next, your father directed you to someone (me) who knew the procedural hurdles like the palm of his (my) hand, & that knowledge is what allowed me to assist you in a rapid, precise & flawless fashion. Again I ask for a leap of faith in believing me when I say that the only thing that blows more than screwing up your own situation is hiring "the wrong guy / gal" (i.e. paying someone who screws things up in your stead). Following that last point & as Jack Reacher sagely says: "Details matter!" It'd (generously) be arrogant, haughty, pompous & pretentious of me were I to fail to point out that "but for" your paying meticulous attention to my many instructions (which is painfully obvious to anyone who reads your Client Review as it pretty much tracks everything, soup to nuts) all of it would've been for naught. You could've easily blown off any or all of my directives, tried to cut corners or take shortcuts but you didn't; instead you diligently, faithfully & perfectly treated my mandates with the respect that they deserved. Some might attribute that to Darwinism but I attribute that to humility & maturity, which are 2 characteristics that any young person must develop should they want a happy, productive life & to be a responsible member of society. Finally I'd be remiss were I not to point out that while some things in life are inexcusable & incapable of being fixed far more things are forgivable & repairable if ("if") you have the guts to face & tackle them head on. While I wish that you'd've done so immediately the way things shook out you learned a valuable life lesson, & in hindsight you managed to do so at little personal cost. Dear Anonymous, Noting that my forename is "Mike" not "Marc" (but also that both are 1 syllable, 4 letters words including 3 consonants & 1 vowel), I want to thank you for your kind words (in the form of #HaberPA's 233rd AVVO Client Review). As you've not identified yourself & as I am well aware of who you are, I will share more about your situation with the folks so that they understand the dynamics of what led you to author this client review. You were arrested & charged in a Drug Trafficking Sting Operation. While you were pretrial detained your family hired another lawyer to represent you in the substantive case, for which you agreed to a plea deal involving probation. After serving ½ of your probationary term you found & reached out to me to assist you in securing Early Termination. (I should note that you contacted me because you were not satisfied with your original lawyer, an attorney whom I know, respect & who, from my review of the case file, in fact had done an excellent job - as an aside you went from being arrested for Cocaine Trafficking, Conspiracy to Traffic in Cocaine, Possession of Cocaine, Possession of Marijuana & Possession of Unlawful Proceeds from a Financial Transaction to receiving probation & a Withhold of Adjudication for Possession of Cocaine & Unlawful Proceeds from a Financial Transaction with all other charges Nolle Pros'd / dismissed by the State... a disposition which, all things equal & admittedly not being intimate with the facts & circumstances, is impressive... but I digress...) Anyhow, I discussed your situation with you (most especially determining your understanding of the status of your conditions of probation, i.e. what you knew / believed to have been completed & what was outstanding), I had you provide me with your POs contact information, explained that I needed to verify everything that we had discussed & that as soon as I was certain that your case was ripe for Early Termination I would prepare, file, calendar & litigate the Motion to ET Probation (aside alert: before making representations to the Court, & as President Ronald Reagan famously said, I "trust but verify"). After first securing then reviewing your disposition / sentencing documents & having a conversation with your Probation Officer I discovered that there were both outstanding obligations (court costs) & an issue with regard to your Community Service Hours. With your assistance (i.e. you promptly zero-balanced your case with the Clerk of Court & you provided your PO with proof of compliance with the CSHs), we straightened everything out & then proceeded. During the course of my representation you were Cc'd on all of my various correspondences, filings & emails (i.e. with your PO, the State, the Court, etc.) & within a few weeks time we had successfully applied for & you were granted the relief sought. Due to your own diligence you are now a free man (my role was, admittedly, "de minimus" as you were the one who had to "walk the walk", & you did so, in both a flawless & responsible fashion, thus arming me with all of the tools that I needed so as to get the desired Court Order). For the further benefit of the folks (but also as "props" for you) probation is not "easy" to survive. It is properly viewed as a a gift from an "Indian giver" in the form of a proverbial noose with just enough rope for a probationer to hang her/himself. The State knows that where one violates the hammer drops hard, the deck is stacked in their favor, the alleged violator has extremely limited rights (far fewer than in the substantive case) & most all Violations Of Probation are a veritable "slam dunk" for the State. You accepted that burden, acted prudently & dutifully, did not VOP, complied with all conditions & special conditions & as such you literally set yourself up for success. A Needle in a Haystack

In a world where you are not familiar with; you need someone to help you out. Nowadays people try to take advantage of you and the lack of knowledge you might have in that particular field. When you finally find an honest, knowledgeable person with a winning mentality; it’s like finding a needle in a... haystack. I found that in Michael Haber and company. My case was a situation where I was beaten up by a few guys. Even though I defended myself I left there with a big gash on my head, a few bruises and a wrongful arrest. The police officer took me to the hospital to get stiches and then to jail. All I could think about was why was I in this situation and the reason that continued to pop into my head was I did not call the police and the other people did and lied to the officers. After 18 hours in TGK I was able to bail out. Then the search began. I spoke to a couple of people that mentioned a few attorneys, but I didn’t feel comfortable with them until my cousin mentioned Michael Haber. He told me that Michael was a strategic person that gets results. I asked him for Michael’s number and I called him right away. I left him a message and within 5 minutes I received a call from Michael himself. I explained my situation and he made sure that my information was accurate. He told me he didn’t want to be blindsided. If everything was like I told him, it was a clear Stand Your Ground case. It felt like right after we hung up the phone he started to work. It also felt like I was his only client. He gave me some homework so I can understand what he was talking about. He asked me to see some videos which really helped me out personally. To make a long story short, I won my case with exactly what Michael said from day one; Stand Your Ground. Dear Anonymous, Thank you so much for your Client Review (#HaberPA's 227th on AVVO), but thanks even more for submitting it as "Anonymous" (as I can now talk freely about your case with the folks). You were wrongfully arrested by inexcusably poorly trained police officers (unsurprisingly from Hialeah, insert rolling-eyes emoji here) and, worse yet, you were disgracefully prosecuted by the Miami-Dade County State Attorney's Office. How do I know this? Three ways: 1) I have sufficient skill, experience & training to recognize a Stand Your Ground / SYG case when I see it, 2) I conducted both a proverbial autopsy of the State's case & my own independent defense investigation and 3) after preparing, filing, calendaring, noticing & litigating a Motion seeking Statutory Immunity your Judge threw out this case faster than last month's garbage. When called to a crime scene police are supposed to inquire, more specifically they're expected to conduct a competent examination of the facts and circumstances & thereafter to draw reasonable conclusions. In your case, as you were already gone from the "Locus in Quo" (the crime scene) when they arrived, the cops simply interviewed the complaining witness (the alleged victim) & called it quits. While we would subsequently document the facts that there were at least 5 other civilian witnesses (eyewitnesses) present & functional video surveillance equipment, the cops interviewed none of them & they didn't even think to look at the digital recording of the actual events, much less to impound and preserve it as evidence. Worse yet is the fact that when the cops get it wrong the State Attorney, a Prosecutor, is expected to conduct a diligent review, quite literally serving as a "check valve" & to "No Action" / "Nolle Pros" / dismiss bad arrests. You retained #HaberPA shortly after arrest, well before Arraignment & we got to work fast. We identified the witnesses &, while we couldn't issue a subpoena for the digital footage we sent a "Spoliation Letter" to the pre-filing Assistant State Attorney as well as serving both the business owner & the the Registered Agent with the same. What was requested was footage starting one hour before & ending one hour after the incident; what was received was 34 seconds, 34 seconds which showed you beating on the aggressor. (As an aside the State was unable to get the video into evidence as we objected on two grounds: First, "The Rule of Completeness" & second "Chain of Custody". The incident both clearly began well before the video started & ended well after the video concluded & thus, the cherry-picked portion was incomplete and misleading. Further, the alleged victim testified that the cops viewed the video when they were on scene & only asked for that limited portion but the cops debunked that by stating that they never saw, much less impounded, any video footage whatsoever.) The bottom line with your case was that you were legitimately on the premises of a business to conduct business, the owner of that company & you have had an ongoing dispute over services, the day before the incident you were there & left as the business owner had literally charged at you & was held back by several of his own employees while you fled. Your return the following day was to collect your property in the hope of avoiding the business owner but he came at you again, this time being held back by no one. As he's got 4-5" and 40-50 lbs. on you, coupled with the fact that the 3 guys who had held him back the day before were now behind him rather than holding him back, you quite literally stood your ground. He took a beating but so did you (you earned 6 stiches in your forehead and a permanent scar). As the footage would have shown, he was the aggressor & you were the victim. The cops & the Prosecutor got it wrong but the Judge got it right & I am proud to have been instrumental in securing immunity for you and restoring your good name. Thank you again!
