First DUI

I was referred to Mr. Haber from a great friend/Police officer and was told he’s the best for my DUI case so i called and set an appointment. We meet for breakfast and at first the way he came across was rough but then i realized as an attorney you have to a certain demeanor. First DUI and Michael wa...s a straight shooter didnt beat around the bush and told me what may happen or we’ll happen. He was able to enroll me in a program that will drop my DUI to a reckless driving with no points. He also helped me redeem my gun that was impounded the night i was arrested. I thank you for your professionalism, time, and effort you put towards my case. Yes i will recommend Michael to anyone that ask for an attorney that needs his services. Dear Jamal, I want to thank you very much for taking the time to author and submit #HaberPA's 198th Client Review on AVVO, and I want to take a moment to touch on a few of your observations. First, over the course of my nearly 30 years as a criminal defense lawyer I have both come to respect and have earned the respect of many police officers. When a member of the law enforcement community thinks enough of my ability to refer her / his loved ones to me I consider that to be the highest of honors. Second (both unfortunately and respectfully), from a defense perspective your case was a dog with fleas. Not only knowing the officer who referred you to me but also being quite familiar with your arresting officer (noting that they work for different police agencies), once I read the initial police report I was pretty certain that we had a difficult case on our hands, I was even more convinced of this after you and I met and were able to discuss it in more detail and after receiving and reviewing the State's evidence I was all but positive that we were going down like the Titanic . As you suggested (albeit in different words) I don't believe in blowing sunshine up a client's pant leg, so right from the get go I told you precisely what I thought, but we also agreed to take the time to examine the totality of the facts and circumstances (not just what we had in the moment), and once confirmed we acted quickly to make lemonade from lemons so as to secure the best possible result for you given the situation. That said and done, you are now well on your way to earning a dismissal of the DUI charge and I have complete confidence that you will do so and will come out of this better for it. Third, the gun... When you were taken into custody for DUI your vehicle was - as most all are - towed from the scene and to a lot. You had your gun in the car at the time and the police, properly, secured the firearm and issued you a property receipt for the firearm. You were not charged with any firearm offense, the gun had nothing to do with the case, there was no legal impediment to your getting the gun back (i.e. you were not disqualified from owning, possessing or carrying a firearm as a result of your DUI arrest and you have a valid CWP) and all we needed was a Court Order so that the PD could release the weapon to you, but the Judge threw a monkey wrench into the machinery, refusing to issue the Order. It took 3 appearances and a lot of arguing before I secured that Court Order, but we finally got it and you were ultimately able to collect your property. Finally, so as to accommodate your schedule our first meeting occurred on a weekday morning and at a local deli, and I could not have been more pleased. I'm always happy to meet as conveniently as is possible to the client, especially if a good meal is involved. My only regret is that I couldn't find a factual, legal, procedural or substantive mechanism by which to beat your case, but as the adage goes, "you've gotta play the hand you're dealt". Thank you again Jamal. I'll be monitoring your situation and will be thrilled when you complete your program and the dismissal is entered into the record. Gratefully, MAH/Esq

Just simply amazing!!

I found myself in a very hard and difficult situation and sadly I picked up a DUI charge earlier this year. I was very fortunate to have found Mike, like I said he is just simply amazing! along with the DUI charge the cops of course through other things at me that Mike was able to have dismissed fo...rr me thankfully, In the end I did as he said and he obtained for me the best possible outcome considering my overall condition. Dear Olga, Thank you very much for your kind words (in the form of #HaberPA's 195th Client Review on AVVO). I won't expound on the facts of your case but so that the folks have some context I need to give them some background. Your case, like most criminal cases, was tough, but your particular circumstances made it significantly more difficult than many others. The cops made a lot of very serious allegations against you when you were arrested for DUI, DWLS-Knowingly, Possession of Marijuana, Possession of Paraphernalia, Resisting Arrest without Violence and Disorderly Intoxication. None of this was digitally preserved on dash or body cam and so there was no independent way to either prove or deny their claims, but the cops made sure to back up their charges by bringing in numbers instead - 6 police officers - all of whom doubled-down on the other's testimony. Making matters worse for you was your prior criminal history which included another DUI (this was your 2nd, albeit outside of 5 years so there was no mandatory jail time), 2 prior convictions for separate Possession of Marijuana charges (as well as a 3 separate withhold's for the same offense) and prior convictions for both Resisting Arrest and Disorderly Intox (also with other withhold's for the same offenses). Perhaps needless to say this combination of variables made defending you exponentially more difficult. Still, when there's a will there's a way and with experience comes knowledge, and in your case I employed all of my wisdom and my relentless will to beat the State down and at least afford us some positive bargaining power. But I can't take all the credit and happily give you a positive assist for flawlessly following my instructions by securing your Medicinal Marijuana Card and valid THC Rx, providing me with and authorizing me to use all the materials that I requested and for, during the several months that it took to erode the State's determination to slam you, not deviating at all from our plan. Without your cooperation and determination my efforts surely would have fallen flat and we would likely have fared significantly worse. In the end there was no beating the DUI but the State ultimately agreed to dismiss all 5 of the other misdemeanor charges and so you received nothing more than the rock bottom "2nd outside of 5" DUI penalties. I truly wish that I could have beaten all 6 of your charges, and I'm gonna go on the record and say that I abhor having to eat any charges but, to paraphrase Meatloaf's "2 outta 3 'aint bad", in your case beating 5 outta 6 'aint bad. Thank you for taking the time to share your experience with #HaberPA with the folks, I am grateful for the props and I wish you and yours all the best of happiness, health, luck, prosperity and success for the New Year 2020 and thereafter. Michael Haber, an attorney you can trust

Just 8 month ago this would of been way too embarrassing for me to admit but looking back I have to be completely honest about what happened I was arrested on 4th DUI. My third DUI happened less than 5 years earlier and I was still enrolled in a DMV program trying to earn back my drivers lisence at t...ime after bonding out of jail I called a police officer friend of mine and he told me that I needed to call Mike Haber. I did and mike met me the same day he ask me a lot of questions. He was patient and thorough and he listened,but then he shocked me with my reality I didn’t want to believe how much trouble I was in - mostly because I was in denial - and honestly in that moment I was not thrilled with what mike told me he said that I had an alcohol problem that I probably had underlying mental health issues and no matter what I definitely had a going to prison problem but mike also assured me that everything was manageable if I followed his plan mike told me that unless I got lucky with some screw up by the police then my only shot at avoiding jail was to agree to spend 90 days in an inpatient substance abuse program he explained that this wasn’t only a strategic for court but that if I took it seriously then it could also save my life. Again honestly looking back on that conversation I was far from thrilled but then again I was also in denial so I went home talked to my wife and my police officer friend and realized a few things I had 3 different lawyers represent me on my other DUIs but not one of them thought or talked like mike none of them even considered my life outside of court and none of them was referred to me by a cop so I called mike back and agreed to go check out the facility that he had recommended long story short I spend 90 days in rehab then another 45 in an intensive outpatient program I am- to this day - in follow up treatment and mike was 100% correct not only did he kept me out of jail but he also put me in the right place to understand the reasons for my alcohol addiction and how to maintain my sobriety in the end mike was right about everything whenever I called him he always told me to stay focused on my sobriety and treatment and to let him worry about court it took me 8 month but my case is closed I am not in jail and sober mike performed and I can’t thank him enough if you need a criminal lawyer and want one who you can trust then don’t hesitate to call Mike Haber!

Dear Anonymous, Grammatical errors not withstanding your (#HaberPA's 178th AVVO) Client Review was outstanding. It is obvious that you gained incredible insight, understanding and an appreciation for your situation, and it is equally apparent (as well as most appreciated) that you've given me credit for both having steered you in the right direction and considered your legal and personal needs. As a lawyer I'm ethically bound to perform several functions (see Chapter 4 of the Rules regulating the Florida Bar, specifically Professional Conduct), namely serving as an "adviser, advocate, negotiator and evaluator", and this is what i did in your case. I took a global view, put together a plan and (at times struggled to have) kept you focused on the only objective of consequence, to wit: keeping you out of jail / prison. It wasn't just the facility that I chose for you (a dual diagnosis facility specifically structured to deal with both substance abuse and mental health issues) or even the private forensic psychologist whom we employed (and who's significance cannot be understated) or even my knowledge and negotiating skills, but, most importantly, it was your own provable, steadfast and unwaivering commitment to amenable and meaningful participation in all aspects of your treatment protocol (over an extended period of time) that carried the day... so props and kudos to you, because in the end it was you who kept yourself out of a cage. I Made the Right Call!

When his daughter Jean died Mark Twain wrote, “Possibly I know now what the soldier feels when a bullet crashes through his heart.” Sadly, as a parent I too can now relate. Late last year I received a call from a police officer friend who told me that my son had rear ended a stopped police car, i...njuring a police Sergeant in the police car and critically injuring his girlfriend who was the passenger in my son’s car. She was trapped inside of the vehicle and while it was on fire she was carried out of the driver’s side. The firey car crash was clearly captured on police dash cam video, my son’s blood was taken and it turned out that he was very intoxicated at the time. Not knowing what to do I turned to a trusted attorney friend who strongly recommended me to Mike Haber. I called Mike and the very next morning he and I met, and then together we went to the hospital to see my son. Mike interviewed my son with a surprising amount of knowledge and empathy. He understood our shock, emotions and also the immediate need to address the underlying issue of alcohol abuse. (Sadly, this disease runs in my family, having gotten me too, although I’ve been sober for more than 40 years.) To simultaneously help my son with both his substance abuse and psychological and emotional issues (and as it turned out it was also a strategic tool for the case) Mike recommended inpatient treatment immediately after discharge from the hospital at a dual diagnosis facility. He explained that my son would spend 3 months inpatient, then step down to a halfway house and finally would come home and participate in intensive outpatient treatment. By structuring a plan to help my son on both personal and professional levels it was apparent that Mike genuinely cared about my son’s interests both outside and inside of the courtroom. But Mike’s strategy didn’t end there. As the case progressed we brought on experts to help build a defense (a forensic toxicologist for blood evidence issues, an accident reconstructionist for crash evidence and a forensic psychologist for mitigation). I honestly wasn’t sure why Mike insisted on all of this but I quickly found out the why of it. The State Attorney had no empathy at all for my son. Because of my son’s high blood alcohol content, the injury to the police Sergeant and the severe injury to my son’s girlfriend they refused to offer anything less than nearly 6 years in prison, and this is when the fight started in court. Mike and his partner started filing motions and set our experts loose to challenge the State’s evidence, and then I finally understood that our experts - the team that had Mike created - were really important to the motions that Mike was filing. Because of Mike’s strategy and his relentless efforts, after 8 grueling months my son was able to avoid a trial and a possible 7 year prison sentence by agreeing to serve 364 days in jail. Mike’s efforts got the State to make this offer, and now that it’s all said and done I honestly believe that Mike Haber saved my son’s life. I don’t wish it upon anyone but if at some future time you have one of Twain’s “bullet in the heart” life experiences that leaves you in a legal conundrum then let me pass on the recommendation that worked so well for my family: Call Mike Haber. (I should also mention that Mike always - ALWAYS - responded to our calls, texts, emails, etc., even when he was out of the country on vacation with his family.)

Dear Michael, Yours, (#HaberPA's 170th Client Review) is the most well-written, comprehensive and flattering client review that I recall receiving, so much so that I really have nothing to add (which, if you look at my historical comments is, I think, a first). I hate to see a client serve time but, as you pointed out, the evidence in this case was simply overwhelming, and, in the end, I too believe that we (yes, you and your wife helped me greatly) might well have saved your son's life. Your boy is fortunate to be alive, he is very lucky that his girlfriend is alive and also that the Sergeant was not also seriously injured. There is life after jail, we have given him the tools that he needs to carry on and now I only hope that he has the strength of character that his father has to be able to maintain his sobriety.
