Dear Anonymous, Thank you very much for authoring #HaberPA's 202nd Client Review on AVVO! I am grateful for your kind words and have a few observations to make about about your situation. 1) You are lucky that your PO gave you solid advise. Many a probationer asks their PO legal questions (e.g. seeking early termination, converting or avoiding community service hours, permission to move or travel) without realizing that POs have two basic responsibilities, to wit: to supervise and to violate. There are precious few POs who step outside of that box and offer advise, much less are willing to actually "help". While on probation you should remember that your PO is the boss of you but your Judge is boss of your PO and so when you want something modified or terminated then the person you should turn to is your lawyer (who, if it is #HaberPA, is always there to help you to accomplish your lawful objective). 2) Right now, during Covid, Courts - criminal court anyhow - are basically closed with only emergency and the must fundamental of matters being addressed. Still, with the right facts and circumstances, even during a pandemic skilled and experienced counsel (again such as #HaberPA, which has just under 30 years of criminal defense litigation experience) can get things accomplished. 3) Maintaining records is clutch, and because you had your sentencing documents handy and were able to put me in touch with your PO you armed me with the tools that I needed to get the job done. 4) From your initial consultation with me (a telephone call which was followed by a FaceTime discussion and several emails during the course of one afternoon) until the time that we received a signed Court Order successfully early terminating your probation, precisely one week had passed, but three of those days were me waiting to receive a response to any of my repeated telephone messages and emails to your PO and two of those days were a Saturday and a Sunday. So, in reality, it took less than 48 hours for me to locate and reach the correct Assistant State Attorney, to provide them with proof positive of your eligibility for early termination, to secure the government's permission (in writing) to submit an Agreed Order, to prepare the appropriate paperwork, to transmit it to the Judge and in turn to receive the executed, filed and clock-in Court Order. And that is precisely how #HaberPA works... clean, efficient and, as you indicated, for "a fair fee". Congratulations on regaining your freedom. Dear Jamal, I want to thank you very much for taking the time to author and submit #HaberPA's 198th Client Review on AVVO, and I want to take a moment to touch on a few of your observations. First, over the course of my nearly 30 years as a criminal defense lawyer I have both come to respect and have earned the respect of many police officers. When a member of the law enforcement community thinks enough of my ability to refer her / his loved ones to me I consider that to be the highest of honors. Second (both unfortunately and respectfully), from a defense perspective your case was a dog with fleas. Not only knowing the officer who referred you to me but also being quite familiar with your arresting officer (noting that they work for different police agencies), once I read the initial police report I was pretty certain that we had a difficult case on our hands, I was even more convinced of this after you and I met and were able to discuss it in more detail and after receiving and reviewing the State's evidence I was all but positive that we were going down like the Titanic . As you suggested (albeit in different words) I don't believe in blowing sunshine up a client's pant leg, so right from the get go I told you precisely what I thought, but we also agreed to take the time to examine the totality of the facts and circumstances (not just what we had in the moment), and once confirmed we acted quickly to make lemonade from lemons so as to secure the best possible result for you given the situation. That said and done, you are now well on your way to earning a dismissal of the DUI charge and I have complete confidence that you will do so and will come out of this better for it. Third, the gun... When you were taken into custody for DUI your vehicle was - as most all are - towed from the scene and to a lot. You had your gun in the car at the time and the police, properly, secured the firearm and issued you a property receipt for the firearm. You were not charged with any firearm offense, the gun had nothing to do with the case, there was no legal impediment to your getting the gun back (i.e. you were not disqualified from owning, possessing or carrying a firearm as a result of your DUI arrest and you have a valid CWP) and all we needed was a Court Order so that the PD could release the weapon to you, but the Judge threw a monkey wrench into the machinery, refusing to issue the Order. It took 3 appearances and a lot of arguing before I secured that Court Order, but we finally got it and you were ultimately able to collect your property. Finally, so as to accommodate your schedule our first meeting occurred on a weekday morning and at a local deli, and I could not have been more pleased. I'm always happy to meet as conveniently as is possible to the client, especially if a good meal is involved. My only regret is that I couldn't find a factual, legal, procedural or substantive mechanism by which to beat your case, but as the adage goes, "you've gotta play the hand you're dealt". Thank you again Jamal. I'll be monitoring your situation and will be thrilled when you complete your program and the dismissal is entered into the record. Gratefully, MAH/Esq

Dear Anonymous, Thank you so much for your generous Client Review (#HaberPA's 199th on AVVO). Since no one knows who you are I can comfortably elaborate a little to provide context to the folks. You, like many others, were baited by an undercover female police officer who had flagged you down, engaged you in provocative conversation and blocks away, after you had left the scene with nothing but an alleged dialogue, you were popped by waiting sting operation "take down" team members. This case was a true "he said / she said", meaning that the only evidence in the case was testimonial (i.e. there was no recording of the alleged discussion - which is the essence of the crime) and there was no proof that you were "predisposed" to commit the crime (i.e. you had no prior criminal history). Because of this I was 99.999% confident that we had a winner on our hands (over nearly 30 years I have tried many cases precisely like yours and in all that time I have not yet lost one) and as such I was eager to proceed to trial. However, due to your professional licensing you were simply not willing to risk a loss at trial, you needed a guaranteed dismissal and as confident as I was about our odds at an acquittal I could not ethically "guarantee" you a win. Because the case was a 100% factual dispute there was no viable motion to suppress and as the cops had both scripted and coordinated their story there was no feasible motion to dismiss so instead, and at your direction, I brokered the best deal possible, to wit: The State permitted you to confidentially take a 1 hour AIDS class online, to show proof of having gotten an AIDS test and 30 days afterward they agreed to (and did) dismiss your case, which we will now expunge. For me there's nothing quite like the feeling of having the Clerk publish a verdict and utter the words "not guilty" but this was not about me it was about you, you achieved the result that you wanted (albeit not how I would have preferred to have done so), I know that in the end all that mattered to you was securing a dismissal and so I am both pleased and happy for your success.
