Dear Jamal, I want to thank you very much for taking the time to author and submit #HaberPA's 198th Client Review on AVVO, and I want to take a moment to touch on a few of your observations. First, over the course of my nearly 30 years as a criminal defense lawyer I have both come to respect and have earned the respect of many police officers. When a member of the law enforcement community thinks enough of my ability to refer her / his loved ones to me I consider that to be the highest of honors. Second (both unfortunately and respectfully), from a defense perspective your case was a dog with fleas. Not only knowing the officer who referred you to me but also being quite familiar with your arresting officer (noting that they work for different police agencies), once I read the initial police report I was pretty certain that we had a difficult case on our hands, I was even more convinced of this after you and I met and were able to discuss it in more detail and after receiving and reviewing the State's evidence I was all but positive that we were going down like the Titanic . As you suggested (albeit in different words) I don't believe in blowing sunshine up a client's pant leg, so right from the get go I told you precisely what I thought, but we also agreed to take the time to examine the totality of the facts and circumstances (not just what we had in the moment), and once confirmed we acted quickly to make lemonade from lemons so as to secure the best possible result for you given the situation. That said and done, you are now well on your way to earning a dismissal of the DUI charge and I have complete confidence that you will do so and will come out of this better for it. Third, the gun... When you were taken into custody for DUI your vehicle was - as most all are - towed from the scene and to a lot. You had your gun in the car at the time and the police, properly, secured the firearm and issued you a property receipt for the firearm. You were not charged with any firearm offense, the gun had nothing to do with the case, there was no legal impediment to your getting the gun back (i.e. you were not disqualified from owning, possessing or carrying a firearm as a result of your DUI arrest and you have a valid CWP) and all we needed was a Court Order so that the PD could release the weapon to you, but the Judge threw a monkey wrench into the machinery, refusing to issue the Order. It took 3 appearances and a lot of arguing before I secured that Court Order, but we finally got it and you were ultimately able to collect your property. Finally, so as to accommodate your schedule our first meeting occurred on a weekday morning and at a local deli, and I could not have been more pleased. I'm always happy to meet as conveniently as is possible to the client, especially if a good meal is involved. My only regret is that I couldn't find a factual, legal, procedural or substantive mechanism by which to beat your case, but as the adage goes, "you've gotta play the hand you're dealt". Thank you again Jamal. I'll be monitoring your situation and will be thrilled when you complete your program and the dismissal is entered into the record. Gratefully, MAH/Esq

As I'm confident that you can't be identified I am comfortable sharing a little bit about the nature of your case with the folks. You, a condominium unit owner, were served with a temporary restraining order by the unit owner who lives directly above you in your building. Over the course of 2+ years you had made repeated noise complaints against him with the condo association, the management company and even the local police department, none of which were able to effect the non-stop late night disturbances. The injunction came in response to your having confronted the unit owner directly, after which he went to the Courts seeking protection. While #HaberPA normally does not get involved in civil disputes I agreed to serve as your advocate in this instance, and yes, we were successful. Regardless of the nature of the case or the client when #HaberPA accepts the responsibility of representation the following language is included in each and every one of our retainer agreements: "I want to thank you once again for your confidence in my ability to assist you during this difficult time. I want to remind you that if you A) do what you are supposed to do when and how you are supposed to do it, and B) if you do not do things that you are not permitted to do during this interim period, then you will be just fine and, soon enough, this will be a distant memory. I also want to reassure you that my goals in your case are three-fold: 1) To perform precisely as I have promised, 2) to always be available to you and 3) to earn (by way of #'s 1 and 2) your positive client review at the successful conclusion of your case." And so it has come to pass that you heeded our advise, I lived up to my expectation and, accordingly, "I have earned "your positive client review". Thank you again for trusting #HaberPA to live up to our obligation and also for honoring your word when we performed as expected. Dear Olga, Thank you very much for your kind words (in the form of #HaberPA's 195th Client Review on AVVO). I won't expound on the facts of your case but so that the folks have some context I need to give them some background. Your case, like most criminal cases, was tough, but your particular circumstances made it significantly more difficult than many others. The cops made a lot of very serious allegations against you when you were arrested for DUI, DWLS-Knowingly, Possession of Marijuana, Possession of Paraphernalia, Resisting Arrest without Violence and Disorderly Intoxication. None of this was digitally preserved on dash or body cam and so there was no independent way to either prove or deny their claims, but the cops made sure to back up their charges by bringing in numbers instead - 6 police officers - all of whom doubled-down on the other's testimony. Making matters worse for you was your prior criminal history which included another DUI (this was your 2nd, albeit outside of 5 years so there was no mandatory jail time), 2 prior convictions for separate Possession of Marijuana charges (as well as a 3 separate withhold's for the same offense) and prior convictions for both Resisting Arrest and Disorderly Intox (also with other withhold's for the same offenses). Perhaps needless to say this combination of variables made defending you exponentially more difficult. Still, when there's a will there's a way and with experience comes knowledge, and in your case I employed all of my wisdom and my relentless will to beat the State down and at least afford us some positive bargaining power. But I can't take all the credit and happily give you a positive assist for flawlessly following my instructions by securing your Medicinal Marijuana Card and valid THC Rx, providing me with and authorizing me to use all the materials that I requested and for, during the several months that it took to erode the State's determination to slam you, not deviating at all from our plan. Without your cooperation and determination my efforts surely would have fallen flat and we would likely have fared significantly worse. In the end there was no beating the DUI but the State ultimately agreed to dismiss all 5 of the other misdemeanor charges and so you received nothing more than the rock bottom "2nd outside of 5" DUI penalties. I truly wish that I could have beaten all 6 of your charges, and I'm gonna go on the record and say that I abhor having to eat any charges but, to paraphrase Meatloaf's "2 outta 3 'aint bad", in your case beating 5 outta 6 'aint bad. BUT (caps intentional) #HaberPA can (and will) address (and seek redress for) any improprieties which may have occurred before we became involved, ensure that you are treated fairly from that point in time and forward, and then move Heaven and Earth to vindicate you (by beating or mitigating your case) and restore your good name (in some cases, like yours, by expunging the matter from all publicly accessible records). #HaberPA has had many "taglines" over the years (e.g. "from traffic to trafficking", "it's all about reasonable doubt", "UPx2" [lawyer-up and shut-up], etc) but as veteran criminal defense counsel (with 28+ years of criminal defense experience) we also provide a de facto public service by "schooling rookie cops [and prosecutors]", leaving them with proverbial Ph.D.s at the conclusion of a case (and thereby, hopefully, helping them to be better at their respective jobs). Dear Anonymous, Thank you so much for taking the time share your experience with #HaberPA with the folks (in the form of our 192nd AVVO Client Review). There is never a "good" or convenient time to be arrested, but in your case the timing was absolutely tragic (e.g. in fresh familial grief and right before the holiday season where that pain is especially strong). Moreover the circumstances were preposterous. While your arrest was technically lawful the situation was both capable of simple explanation and of resolution without arrest (or at least it could have been so had you been stopped by a veteran municipal cop instead of a State Trooper with an inferiority complex). Regardless, there's an old law enforcement adage that says "you might beat the rap but you won't beat the ride", and that age old aphorism proved true in your case. You hired #HaberPA within a few days of your arrest, we promptly stitched together an irrefutable packet of materials for the filing prosecutor's consideration and took the unambiguous facts to the State Attorney after which the criminal charges (a felony and a misdemeanor) were "no actioned" (dismissed) at your Arraignment a mere 3 weeks after your arrest. We still have to deal with the 3 traffic citations that the nasty Statie tacked on and gave to you, but, compared to the criminal charges (and in light of their dismissal) these are proverbial hiccups (and you can rest assured that I'm looking forward to that cross-examination). That said I'm always proud to receive kudos for my attentiveness in receiving, reviewing and expeditiously replying to phone calls, texts and emails (that being one of the hallmarks of #HaberPA's "boutique" status) and for swiftly accomplishing the Client's litigation objective (even where doing so this rapidly ends up costing me legal fees because I beat the case before I got a chance to beat up on the case :-); and once again I am grateful for your kind time in authoring and submitting your review.
