Arrested for Domestic Violence - Misdemeanor Battery after argument with fiancée

I had an extremely stressful experience when I was arrested and charged with Domestic Violence Battery following an incident at my condo with my fiancée. According to the police report, my fiancée told officers that I had been out drinking with friends and that, when I returned home, an argument esca...lated from verbal to physical after she did not want me to leave. The report stated that I slapped her on the left side of her cheek. The police ultimately arrested me, and I was taken away in handcuffs and booked on a Domestic Violence Battery charge. I chose not to make a statement to the police. After bonding out, I knew I needed an attorney who could help me understand what I was facing and what my options were. After reaching out to Michael Haber, I immediately felt that I was in good hands. What really stood out to me was that he took multiple calls with me before I had even signed a retainer agreement or paid him anything. He genuinely took the time to listen to what happened, understand my personal circumstances, answer all of my questions, and explain how the process worked. I never felt rushed or like he was simply trying to get me to sign up as a client. Once I officially retained him, he obtained the police report, went through the details of the incident, and we had several conversations about the case and the different ways it could potentially be resolved. He was honest with me throughout the process, explained what to expect, and helped me make an informed decision about how to proceed. Having a domestic violence charge hanging over your head is an incredibly difficult experience. There is so much uncertainty and stress, especially when you are dealing with the possibility of serious consequences from something that happened in your personal life. Having an attorney who is responsive, approachable, and genuinely willing to take the time to help makes a huge difference. I always felt that Michael had my best interests in mind. In the end, my case was dismissed, which was obviously the outcome I had hoped for. I am extremely grateful for his work and for the way he handled everything from our very first conversation to the final resolution. I would absolutely recommend Michael Haber to anyone who finds themselves in a similar situation. Beyond being a knowledgeable and capable attorney, he is someone who genuinely cares about his clients. The fact that he was willing to spend so much time helping me before he had even received a retainer says a lot about the kind of person and attorney he is.

Dear Anonymous, Thanks for submitting your kind words (#HaberPA's 281st 5-Star Client Review on AVVO) namelessly, thus allowing me to freely discuss your case with the folks so they may learn something from your situation. In so doing I need to talk about the nature of Domestic Violence cases, to wit: They suck from start to finish. The parties are almost always emotionally involved so whether it's something trivial (e.g. like in your case, allegedly coming home impaired) or more significant (e.g. discovering lipstick or perfume where it shouldn't be or finding racy images or text messages) arguing comes easy, & once an argument is triggered it's common for words, tone & 'tude to quickly boil over. Whether it gets physical or not if it starts and ends there then it can stay in "la familia"; but the moment the Cops get summoned (be it by one of the parties, a cohabitant, a nosy neighbor, etc.) things are sure to spiral out of control. This is so as when Police Officers respond to a DV dispatch they always (each & every time) do so in defensive, self-protection mode, & because of this at least one party is getting Arrested. Maybe once a long time ago some well-intentioned Cop believed the parties who told her/him that things got ugly but it's cooled off, they're okay, they don't want or need help, they're sorry the Officer's time was wasted & Officer Friendly negligently left, only for things to flare up again but this time someone was seriously injured or killed. That's called "Police Civil Liability" &, like sticking a finger in a pot of boiling water, the lesson is forever learned the first time around. So, if The PoPo are summoned in DV mode then no matter what someone is going for the ride. Yes aberrations are possible but these are DV "Universal Truths" that you can pretty much take to the bank, & because of this the best preventative advise that can be offered in these situations is this: Rather than choosing to #SYG consider opting to #GTFO. (Otherwise stated: If you reasonably believe - much less know - that a domestic argument is about to start then leave & let enough time pass for things to cool down before returning. Yes you may have the right - & you may even "be in the right" - to stay, but if you leave then the argument can't happen, not then & there anyhow. Yes, there may be Hell to pay later, but passions also tend to cool over time & even if you really screwed the pooch then you can likely involve an intermediary to help, but even if not you'll have avoided coming into contact with Officer Unfriendly.) Your mistake here was that you stayed. Had you turned around & walked out the door the minute that your fiancé got in your grill then while she may have gotten more pissed off & you may have had to crash on a friend's couch it still would've been The Four Seasons as compared to Miami-Dade County's TGK Pretrial Detention Center (plus you'd have avoided all of the unavoidable nasty Collateral Consequences that flow from Arrest & booking). I'm not suggesting that it's always avoidable or that things will work out better if you choose to bolt, but I am saying that if you disappear yourself before words, hands or objects start flying then the overwhelming odds are that you won't get 'cuffed, stuffed into a Squad Car & perp-walked through a Sally Port into a Jail. Some may question your choice not to explain yourself to the Cops in the moment but I say "bravo". Absent Exculpatory Evidence (e.g. surveillance video or independent witnesses) they were likely to believe her over you & as such you were likely going down anyhow, so why arm the government with a statement that can be used against you? Better to #UPx2 ("Shut-Up and Lawyer-Up") & let your Criminal Defense Lawyer safely do the talking for you, just as you & I did & look how it worked out! I'm sorry you went through this but I'm grateful for your sharing your experience with the folks (& also that you & your fiancé have reconciled). Gratefully, MAH/Esq. #HaberPA

Exceptional Representation and Guidance

Going through the court system can feel like being caught in an overwhelming rip current. There are countless unfamiliar steps to navigate and critical details to consider. Before talking to Mr. Haber, I felt like my life was falling apart and had no clue what to do next. During our first meeting, M...r. Haber used the metaphor of a rip current to explain how he would guide me safely back to normal life. Even though I was initially too anxious to fully process everything, his words came true. Not only is Mr. Haber a confident and exceptional defense attorney, but also he is a wonderful educator and very approachable. He knows exactly how to cut through the noise and get straight to the point. His patience, grace, and deeply ethical approach are truly admirable. Having trusted him twice, I highly recommend him to anyone.

Dear Anonymous, Thank you for authoring your kind words (#HaberPA's 280th 5-Star Client Review) covertly so I can discuss your case with the folks & so that your lesson may serve as their lesson; but, before I get there I'll explain my "rip current" analogy. I use this as a way to illustrate how "knowledge & preparation" can be the literal difference between life & death (e.g. when you're suddenly caught up in a rip current). If you don't know then a rip current is a strong, narrow stream of water (usually about 50' wide) that travels quickly (usually 1-2' per second), perpendicular to shore, along the surface, cutting through breaking waves like a river running outward. As they often appear in shallow water they unexpectedly knock you off your feet, causing disorientation & instantly dragging you along the ocean floor out toward sea. Those caught in a rip current are either composed (i.e. they understand of the dynamics & the physics of the phenomenon & are thus prepared to deal with it) or they panic (i.e. they thrash, flail & otherwise fight the rip current). The composed (i.e. "the prepared") are able to use their brain as opposed to their brawn, knowing that calmness will prevail (e.g. doing nothing expends no energy) & maximize their odds at reaching shore alive (aside alert: when caught in a rip current you have to briefly cede control - usually +/- 30 seconds) whereas the hysterical (i.e. "the unprepared") are likely to rapidly tire, significantly diminishing their odds at making it back to shore alive with each terror-filled second. If you think of "The Criminal Process" as you would a rip current then your knowledge & preparation (which I'll explain to you in detail) will likely be the difference between you living a miserable, paranoid life or your life being as close to normal as possible during the course of your Criminal Case (which can take weeks, months or even years). That said you & your spouse were in a toxic relationship with constant arguing, relentless emotional abuse & occasional minor physical altercations. On the evening of your Arrest you had run out of the house, locked yourself in your car & called the Police, advising as to your location & reporting that your spouse had committed an act of Domestic Violence against you. Law Enforcement promptly appeared, you were separately interviewed, after hearing both sides of the story The PoPo unexpectedly came to the conclusion that it was you who were "the aggressor" & so it was you, not your spouse, who was 'cuffed, stuffed into a Squad Car, perp-walked through a Sally Port into a Jail & booked. Aside alert: In this Client Review you said "Having trusted him twice" because several years ago I had represented you in a DV Case with another person, although in that case you were treated by The Boys in Blue as the victim so I served as your Victim Rights Advocate & made sure that the Prosecutor respected your wishes. Having been "the victim" before & knowing that despite the fact that you'd again been victimized you, quite understandably, couldn't wrap your brain around "the why" of your Arrest (i.e. this situation was as foreign to you as a rip current is to the uninitiated). As such & as I did above with regard to defining a rip current, I painstakingly explained The Legal Process to you, from why you were Arrested (which, frankly, boils down to simply being that in every DV Investigation someone is getting Arrested, be it because there's Probable Cause that supports the Arrest or simply because no sane Police Officer will leave both folks on scene & risk a flare up where someone is seriously injured or killed, thereby exposing themselves to a claim of Police Negligence) to the many ways that it could conclude. In the end your spouse cooperated (albeit with the help of independent counsel, ergo my "deeply ethical approach") & your case was dismissed. For your kind words I thank you again & wish you all the best moving forward. Fondly, MAH/Esq. #HaberPA

Hello Thomas & thank you for your entirely unexpected 5-Star Client Review, which is concurrently #HaberPA's 279th Client Review on AVVO & is also a misnomer. It's a misnomer because Thomas is not & has never been a client of mine; rather I responded to a question that he posted on AVVO in late September of 2023 & since then Thomas has periodically sent me direct questions via AVVO's email option (7 of them by my count), the most recent of which was today (ergo how I was able to associate his name with this review). Anyone who's read any of my Client Reviews knows (or should know) that my protocol is to author detailed, thoughtful responses to those who took the time to share their professional experience with me & that I do so both as a grateful courtesy to the client & to offer guidance to the readers. That said I'm not going to detail the point of any of Thomas' questions; rather, in addition to thanking Thomas I'm going to take this opportunity to make a generic statement about how I view AVVO & my years of participation. As to the former, I see AVVO as a platform for folks to seek generic ("generic" not case specific) information about their respective legal issues from a variety of participating attorneys, & in that way it's the legal system's functional equivalent of any of the many no-cost "Ask a Doctor" websites. Just like those medical platforms responses can be wonderful sources of generic information but they're also extremely limited & for that reason "answers" (which I personally refer to as "responses") can range anywhere from helpful to misleading to inaccurate to outright hurtful. Noting that I won't speak to any other practice area when it comes to Criminal Defense Litigation charges can & do recur (i.e. different folks routinely suffer the same charges) & some questions are sufficiently generic as to be responsibly answered online (e.g. "process" queries or inquiries about certain Rules) but it's a Criminal Defense "universal truth" that each case & every client are uniquely sentient, they must be treated accordingly & any Criminal Defense Lawyer who fails to treat them as such does a disservice to all (ergo Thomas saying: "Always gave the truth even if I didn't like the answer."). Because of this I'd say that it's nearly a 50/50 split between any of my 42,893 (to date) responses being "responsive" & therefore "liked" by the Asker versus my either redirecting the Asker to her / his lawyer (aside alert: the only thing that amazes me more than the number of represented folks who actually seek case specific advise from random lawyers on the internet is the number of AVVO participating lawyers who, as I see it, choose to play "Monday Morning Quarterback" to a lawyer of record & offer irresponsible answers) or to locate a local lawyer & have a meaningful, responsible & confidential consultation, & the difference is stark. When one seeks a consultation at #HaberPA I'm able to take a "Global Approach" to that individual Client & her/his distinct case, I make it a point to come to understand the Client & her/his specific situation, I'm able to adopt the Client's interests as my own, identify & secure realistic litigation objectives & then quote & honor reasonable fees (in writing) but on AVVO I don't have that luxury (in other words I'm limited & my responses must necessarily, & ethically, reflect those limitations, which can & often does result in "dislikes"). Still, even with that limitation a lot of "good" comes from AVVO (albeit again mostly with regard to generic, answerable questions) & so I'll continue to happily donate a great deal of time participating, be it by offering honest responses to questions (again 42,893 to date) & responding to emails or phone calls from AVVO Askers. Be it Thomas or anyone else please know that you're always welcome to ask me anything & while I promise to respond to you I can't guarantee that you'll "like" my response. Ty again Thomas. Respectfully submitted, MAH/Esq. #HaberPA

Amazing lawyer

I’m extremely grateful for the help and dedication my lawyer showed throughout my case. I got caught up in the wrong crowd while riding my e-bike with some neighborhood friends, and what could have been a very stressful situation was handled professionally from start to finish. He took the time to... understand my situation, created a clear plan, and worked hard to get the best possible outcome. In the end, my charges were completely dismissed, and I was able to move forward without a criminal record or any impact on my driver’s license. I truly appreciate his professionalism, communication, and commitment to my case. I would highly recommend him to anyone looking for an attorney who genuinely cares about his clients and works hard for them. Thank you for everything!

Dear Alex, Right out of the gate I want to thank you for 3 things: 1) For your kind Client Review (#HaberPA's 278th 5-Star Client Review on AVVO); 2) for not identifying yourself (i.e. "Alex" alone is such a common name that I can comfortably explain the facts & circumstances of your case to the folks without violating either Client Confidentiality or Attorney-Client Privilege); add 3) for the timing of your review which immediately follows the one submitted by your father (# 277) to which the last sentence of my reply was "Hopefully your son will submit his own review so I can explain "the why" of it", thus allowing me to make good on that promise. I also want to make an initial observation about this comment to the folks, to wit: Kinda' like a PSA (Public Service Announcement) this reply is both instructional to the reader & complimentary to Alex as it demonstrates how an otherwise "good kid" (or adult) can make a bad decision(s) that lead(s) to bad things but, if handled properly, it can still work out well. You received a Criminal Traffic Citation for Reckless Driving which simply alleged that you were operating an E-Bike with "one wheel up" on a public road & you were cited for Refusal to Obey a Lawful Command, specifically to stop / pull over when The PoPo lit you up with lights & sirens. For reasons I'll explain below you weren't taken to Jail; rather you were issued a Promise to Appear / Notice to Appear & released from the scene, so no Probable Cause Affidavit / Arrest Report was ever authored. I know the Police version of events because I watched the Body Worn Camera footage which began with you & your E-Bike crashed on the pavement & concluded with the Cops letting you walk away with written citations. The lesson here is that in many (not all) Misdemeanors Police Officers have discretion to either PTA / NTA you or haul your ass off to Jail & in 99 of 100 times the difference maker will be your attitude (be it actual or as perceived by your "Stop Cop"). The BWC in this case clearly showed that while you didn't stop as fast as the Cops would've liked (in fact your stop was a consequence of your having wiped out while trying to get away) once contact was made the Cops were none to happy. Still at all times you were polite, respectful, contrite & deferential to authority. Had you been antagonistic, had a proverbial chip on your shoulder or otherwise been contrary then you likely would've been held in "Contempt of Cop", taken to Jail & suffered all of the indignity, discomfort & costly Collateral Consequences attendant thereto. Another lesson is that by willfully failing to stop after being lit up Alex technically committed the Felony Crime of "Fleeing and Eluding" (which would've mandated booking) but the choice to be mannerly & polite resulted in the exercise of Police Discretion thus avoiding a Felony Arrest, as well as any "Gratuitous Charges" (e.g. Resisting Arrest). The BWC gave me insight into Law Enforcement's mindset (plus the fact that Alex was the only one in a group of E-Bikers who 'd got got) but I also needed to know something about my client, which I learned by speaking with Alex & his father & which was supplemented by providing me with his final Report Card (which reflected a 3.922 GPA), a Certified Funded Trader Certificate which he'd earned during his senior year in High School, "Safe Driver" status with DMV & a lack of Criminal History. That, combined with a proffer that the other E-Bikers were local kids & it wasn't a "Wheels Up Guns Down" street takeover (which everyone but the participants abhor & have no sympathy for), allowed me to prove that Alex didn't deserve the Scarlett Letter associated with a Criminal Traffic Offense for his isolated dumb choice to "Pop Wheelies" with his pals rather than to Day Trade indoors. Being a provably good person pays off, as does following The Golden Rule (i.e. "Do unto others..."). Thank you again & I wish you all the best in life Alex. Fondly, MAH/Esq. #HaberPA

Happy Parent ….

My 18 year old got himself involved with a group of E Bikers riding out one day, and ended up getting a couple of charges. Great kid ,wrong crowd!! I was desperate, started calling friends about what to do, or give me advice . One personal friend I’ve known for over 30 years and has been in Law enf...orcement for around the same time, said I know a guy, call him , his name is Mike Haber. The very next day I called Mike, I gave him the story on my sons situation and on his background. Mike’s initial response was first as a caring father, then he switched to the strategic, aggressive, relentless Defense Attorney that he is . I hired him immediately!! 2 months later, we had a successful day in court , my son has everything discharged and dismissed thanks to this man .. Mike Haber.. If you need a Defence Attorney… Mike Haber is the person . From a Happy Parent

Dear Happy Parent, Thank you for your very kind words (which now constitute #HaberPA's 277th 5-Star Client Review). I want to let the folks know that I recently authored a reply to another person who'd hired me o/b/o a family member (in that case it was a "Significant Other" not a child) which took a deep dive into the ethics of "Third Party Representation" so I'll avoid that here, instead focus on some of the salient points that you mentioned & ask that anyone who's interested in the Legal Ethics aspect of Third Party representation please read #HaberPA's 273rd Five-Star Client Review below. That said I'll start with a philosophical observation: Regardless of race, religion, socioeconomic status or other measure all humans share the same "cycle of life" (i.e. we're all born, ultimately die & if we're true to our own cultures then we share common societal experiences.) At age 60 (soon to be 61) I look back at a time where my life was all birthday parties, then it was "coming of age" events (e.g. Bar Mitzvah / Bat Mitzvah / Quinceañera / Confirmations / etc), then it was weddings, then it was celebrations of birth (e.g. a Bris / Brit Bat / Christening / Baptism) & now it's funerals (welcome to reality). With that in mind it shouldn't be surprising that my professional career (which will turn 35 in October, 2026) has seen the same sort of "social evolution". On the day that I was set loose on society by The Florida Bar I "hung my shingle" as a private Criminal Defense Lawyer & in order to learn how to do what I had dreamed of doing I began by serving as a Special Appointed Public Defender. My early career was spent in Juvenile Court & Misdemeanor Court & when I was sufficiently skilled I tackled Felony Court. It wasn't long before I was Court Appointed as a SAPD to more serious crimes (e.g. Burglary, Robbery, etc) & inside of 10 years it was mostly Drug Trafficking & various Homicide cases. As I gained more experience & exposure I developed a private practice which allowed me to transition to "a better class" of clientele (e.g. folks who could afford to actually pay for the substantial justice that I facilitated), say "Adiós" to serving as Court Appointed Counsel & create a truly boutique Criminal Defense Litigation Law Firm. Apropos of my "cycle of life" observation there came a time where I began routinely representing the kids of my own friends & contemporaries (usually for [bad pun warning] "minor crimes"). Having a 21 year old son of my own for the past 2 decades each time that I've done do so I've silently thought to myself "but for the grace of God there go I" & while I treat all of my clients in a "boutique fashion" (e.g. like an old school family doctor) I'm especially attentive when a parent entrusts me with their child's Criminal Record (& possibly their liberty). In your son's case this was doubly true as you were referred to me by a mutual friend who happens to be a Police Officer & whenever a Cop refers my services to someone whom s/he cares about (as here) it's even more meaningful. (Aside alert: I met our mutual friend about 25 years ago in a Cocaine Trafficking Case where I accused his Police Department of negligently vetting & supervising a Confidential Informant which resulted in my client's legal Entrapment & after peppering them in a Motion to Suppress he & I forged a close, personal friendship which continues to date, proving that Defense Lawyers both battle with Police & Prosecutors & can concurrently forge respectful relationships outside of a Criminal Courtroom.) In your son's case Cops wrongly equated him with other "Wheels Up Guns Down" asshats & treated him accordingly; but when we proved that he had a 3.9 GPA, earned a Funded Trader certificate & was an otherwise "Safe Driver" (to their credit) they quickly came around & gave him a pass. Hopefully your son will submit his own review so I can explain "the why" of it but in the interim I thank you once again for your trust. Fondly, MAH/Esq. #HaberPA

"I endorse this lawyer. I first met Mike about 20 years ago when I was a Special Prosecutor in the Narcotics Unit at the Miami Dade State Attorney's Office. He was and still is a hard working and knowledgable attorney, who fought for his client then and still does today. He has always been honest, fair and ethical. He is always fighting to achieve the best possible results for his clients. When I left the Miami Dade State Attorney's Office to start my private practice, I maintained my relationship with him and he and I would consult each other on some of our individual cases. "I endorse this lawyer. Attorney Haber in my opinion is an attorney that is truly for the people. I have followed him for a few years now, and remain inestimably impressed with both the amount of knowledge he has in criminal law and also the amount of knowledge he gives to anyone in need of legal guidance. Attorney Haber has a way of breaking down complex legal concepts into very understandable pieces that can be easily digested by someone not so familiar with legal phrases and wording. To have the career he has and the number of years he has dedicated to this craft and still be willing to help out the community at large at a second's notice is what I feel makes him a continual asset and resource to both the legal community and the state of Florida."

One needs to look no further than his Avvo guides and YouTube info videos to see that Mr. Haber is able to boil complex legal issues into terms that non-attorneys can understand. This rare and important skill allows Mr. Haber to more effectively communicate with juries to deliver favorable results for his clients. If I, or someone I cared about, was ever in trouble in the Dade County area, I would not hesitate to seek out Mr. Haber for representation."

"I endorse this lawyer. He is extremely knowledgeable about all areas of criminal defense. When other attorneys do not know how to resolve an issue, Mr. Haber always does . His clients love his aggressive demeanor that surely puts the Assistant State Attorneys he works with at a disadvantage. This area of law is constantly changing and you can bet Mr. Haber keeps up with all of the changes. I can't think of another lawyer I would recommend for criminal defense in Florida."

Avvo Rating

Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.

What determines Avvo Rating?
  • Experience & background Years licensed, work experience, education
  • Legal community recognition Peer endorsements, associations, awards
  • Legal thought leadership Publications, speaking engagements
  • Discipline Disciplinary information may not be comprehensive, or updated. We recommend that you always check a lawyer's disciplinary status with their respective state bar association before hiring them.
