I had a fairly minor accident in the winter that resulted in a first-offense DUI charge in Clark Co. I had never before been arrested for anything in my life. I'd never had an encounter with the law more complex than a moving violation. Needless to say, the experience was anxious and intimidating. I ...had almost no idea what to do or expect. In late January 2016, I was arrested for driving under the influence. At 55 years old, and having never been in a situation like this before, the circumstances were very overwhelming to say the least. The arrest, booking and processing, a night in jail, my car towed and impounded, posting bail, pho...ne calls to family and work, impending court appearance, all of it was too much to handle at one time. Not fully recognizing the immensity of what was about to begin, and never before having to do so, finding an attorney to represent me was not a part of my thought process. After bond was posted and I was released, paying the bail bondsman was the first step. It was there that that I was handed two business cards for attorney representation. I was told that securing an attorney would be a wise decision to make. That’s when I called Andrew Wheeler. With my court appearance scheduled for the following day, Andrew made time to immediately meet with me and discuss my situation. He listened closely to the events that got me to this point, and outlined what I should expect going forward with regards to the criminal and civil proceedings. All the criminal and civil discussion was very foreign to me, but what caught my attention was his 10 years, and 1,300 cases, of exclusive DUI defense. To me that meant expert, and I asked Andrew to represent me. The very next day he was by my side at my first court appearance, and to this day I have not regretted the decision. Personally, I didn’t think I had a chance of avoiding a DUI conviction. But at the time, I didn’t realize Andrew’s commitment to the best interests of his clients or his personal conviction to reviewing all the specifics of his client’s case. Through his determined efforts and attention to detail, he uncovered a procedural error in the booking process video he viewed. He presented his findings to the prosecuting attorney, and what clearly appeared to be a “Gross Misdemeanor” DUI conviction (maximum 364 days in jail and a $5,000 fine), was negotiated down to a “Simple Misdemeanor” Negligent Driving in the 1st Degree (maximum of 90 days in jail and a $1,000 fine). Not only was the charge reduced, through Andrew’s excellent work, the Simple Misdemeanor judgement resulted in a reduced fine fee, one day of work crew, two years of unsupervised probation, and most importantly, no loss of driver’s license. Through the entire process Andrew kept my best interests his priority. He was diligent, informative, communicative and professional. I was never left with the feeling of “what’s next” because his timely direction was always clear and concise. I followed all of his recommendations and directives as they were communicated to me, and throughout the process Andrew Wheeler earned my respect and admiration.
