I dont really agree with your answer but so be it. I cant afford to pay off 30,000. It was my dads loan and in his name but given to me. I dont feel I should have to pay for something I did not know I was getting
Thank you for your kind review. Keep in mind that this wasn't a legal consultation and you really need to take the trust document to a lawyer where it can be reviewed and see if there is a way to have the trust estate pay for the lien. For others reading this out of context, the issue was whether this person had to reimburse the trustee of his deceased father's trust when the trust stated that this person should get his father's fifth wheel but the fifth wheel was encumbered by a secured loan. The trustee paid off the loan so that the fifth wheel could be transferred to the asker without a secured debt but now wants to be reimbursed. Asking questions on Avvo is not intended to be the equivalent of getting a legal consultation and should never be considered a legal consultation. The responses on Avvo are nothing more than educated guesses as to the solution. One must be prepared to followup with an actual legal consultation with a lawyer in their office before one takes action. I stated to this asker, that one has to look at the language of the trust document, to see if there was some provision for making the trust responsible for paying off the secured debt and not the recipient. Absent a specific trust provision, I thought that the recipient was given the fifth wheel subject to the secured lien, and since the trust paid off the lien, the recipient needs to reimburse the trust. There is no way to do a proper consultation and review important documents on Avvo. That is why the exchange on Avvo is never more than an educated guess. But what really needs to be done here, if the recipient wants to see if they have another solution, is they need to bring the trust document to a lawyer's office and have an in office legal consultation. It is important to keep in mind that Avvo only provides a forum to get ideas as to what the law is, and what the solution maybe, but it is no substitute for sitting down with a lawyer in a lawyer's office and reviewing all the pertinent legal documents.
