Stay far away from this lawyer!!!

Mr Fraley was very unprofessional, every meeting that we had, he wasI on the phone or eating improperly at his desk. I paid him $3823.00 to file a Chapter 13. I gave him and his staff every document they ever requested and he failed to even review the information. Our first meeting with the judge,... Mr. Fraley didn't attend, he sent one of his assistants who was late and had not filed the proper paper work. The judge was upset and reprimanded the lawyer in front of everyone. I was devastated and immediately called Mr. Fraley, he failed to return any of my calls. I began to start receiving letters from the Trustee, threatening Motion to Dismiss, due to the failure of Fraley not submitting a plan. Two days before our actual court date, Mr. Fraley, sketched out a rush Chapter 13 plan, which was $2200 a month, which I told him several times what I could afford. When I expressed again, that I could not afford such a monthly payment, he told me that I need to go and get a second job at Taco Bell! And if I didn't like the way he handled things, that I need to seek out another lawyer and he would not refund my money. I left in tears and my Chapter 13 case was dismissed. This happened last year and I'm finally able to address the situation with the Bar and moving forward to get a refund. This lawyer stressed me out. So please everyone, listen to Cathy and I, were telling the truth.

The statements made by this former client are completely incorrect, and her experience shows why it is so important that you be honest with your attorney. She was not honest with us when we represented her, and she is not being honest now. When she came to us for help nearly two years ago, she told us that she was current on her first mortgage, and needed help with her other debts. We discussed filing a Chapter 13 reorganization, because it would allow her to strip off her second mortgage and discharge her unsecured debts. After we prepared the case, and she signed under penalty of perjury that everything was correct, we discovered that she had been lying about the first mortgage; in fact, she was over $13,975.40 behind on the mortgage payments. As a result, the only way she could have her plan approved by the Court was to include the mortgage payment, the arrears, and a hefty fee (for the trustee to pay the ongoing mortgage) into her plan. This resulted in a payment of approximately $2,200 per month. I agree that this was not affordable for her, and I explained to her that the only way she could make it work was to get a second source of income. Even a job at Taco Bell or McDonalds would have worked, as she alludes to above. Once we discovered that she was actually behind on her mortgage by a significant amount, we tried contacting her lender, and giving them permission to talk to her directly about loan modification. Around this time, the client stopped responding to our requests for information. We kept running up against deadlines because of her non-responsiveness. Our file on her case is literally filled with unanswered emails from our office, stating, for example, “It is vital that you contact our office immediately so that we can complete what we need to do to save your case.” This client stopped cooperating, probably because she realized that because of the false information she gave us, she was now in a plan that could not succeed. I have a very high success rate in Chapter 13 cases because I do not put clients in unworkable plans. If I had known that this client was lying about her mortgage being current, I never would have recommended a Chapter 13 plan. I give a 100% effort for my clients, and I do not appreciate this client blaming us for a bad situation that resulted from her lying to us and the Court and hoping no one would notice. One final note: if you need an attorney in a three-piece suit to satisfy your ego, I’m not your man. I offer my clients snacks, coffee, and soft drinks during their appointments, and we often spend several hours discussing their situation, even before they hire us. I have occasionally been known to share a bowl of popcorn with my clients during a consultation. I believe that my clients and I are a team, and I am not going to stick my nose in the air to suit somebody’s idea of “professional.” I understand that this leaves me open to snarky comments about making small talk and eating in the office, but my goal is to make my clients comfortable and treat them with respect, rather than sit on a high horse and talk down to them. If not having my nose in the air is unprofessional to some people, I am happily guilty of that charge.

One year later BK still isn't filed

My experience with Mr. Fraley wasn't as outstanding as the others. I spent $5,300.00 for his services. I completed everything necessary to file in April of 2009. I'd go in for appointments and he'd sit at his desk eating popcorn and talking about everything but the BK (mainly politics). We were tr...ying to Modify our home loan and I'd called his office to see what I should do as he kept putting me off. Finally, when I had 2 days to complete my paperwork for the modification I called and told the receptionist that I needed to know that day. She told me to fax over the paperwork for him to look at, even though I'd already got the paperwork to him when I'd first received the Modification. He didn't look at it. He had one of helpers look at it and tell me that I could do whatever I wanted to do with it. Finally, in February of 2010 I called his office to find out when he planned on filing. I was told that I'd have to redue all of the paperwork that I'd already done back in April of 2009. My husband and I decided that we'd made a bad choice in selecting an attorney, and decided to fire him. We drove down to his office to pick up our files and we were told that we could come back in 3 days. We came back in 3 days to pick up our files we received our files but, were not refunded any of the $5,300.00. I phoned his office to inquire when we would have our money returned and was told that we are not entitled to a refund as the contract states non-refundable. I tried to talk to Gary himself , but was never allowed to. I explained that I paid him the money in good faith that he would represent us in our BK. I had to file a compaint with the Bar association and we settled for 1/2 the money back. I would have taken it further because that was unethical what he'd done to us, but I had to get some money to get it filed as our creditors were hounding us. When I first met with Gary I told him that we'd have to file a Chapter 7 because I didn't think that we would be able to make the payments on a 13. He quoted us $9,000.00 a month payments. I told him that if I could afford $9,000.00 a month payments that we wouldn't have to file BK. I kept insisting that we could not garuantee that we could even make that much every month as well as live. When I voiced my concerns he'd tell me that we would have to take a means test. He kept telling me this and come to find out a means test only take a couple of minutes. When we got our files back everything showed that he was going to file a Chapter 13. It was obvious that he had no intention of filing anything but a 13. We would have been in trouble as there was no way we have even made that kind of money a month. I guess that everything happens for a reason because, we were fortunate enough to find another attorney much more professional that did it for almost half of what he charged. I would not recommend Gary Fraley to my worst enemy.

"Client" Cathy posted a long but very false and misleading statement to which I have the right to answer. She does not tell the truth. Her & husband hired us to do a Chapter 13 bankruptcy reorganization AFTER the plan payments had been calculated at their FREE CONSULTATION. They said they could do the plan. They did not qualify under bankruptcy law to file a Chapter 7 at that time. They were not pressured in any way to hire us when they came in. After we were hired they set appointments and he would not appear or they would not show up or they would not bring in information requested. We would get calls with legal questions that had nothing to do with bankruptcy law. After being hired to do the Chapter 13 bankruptcy and were trying to get them to provide information to us, we were then told they decided to wait because they wanted to do a home loan modification first. She makes it sound like we were supposed to do something with the loan modification. We did not look at her papers because we were not hired to do that. I had no obligation to her to review her loan modification and she was told that. It is not the field I practice in. That was up to them to decide if they wanted to do it. We were also told that they wanted to wait because they were doing some deal with their bail bond business and another business promoting fights. We cannot file when the client refuses to cooperate with providing information or tells us that they don't want to go forward. They never provided the information about their business that they agreed to do when they hired us. A year later she decided that maybe she wanted to do a bankruptcy. Then she got mad because what information that we had received from her was now a year out of date and useless to prepare the documents required by law and she would need to give us the new information. We never got the business records that were promised. When her husband set still another appointmemt (which turned out again to be about something other than bankruptcy) and did not show up again, I told her that he would not be able to set more appointments with me without putting a deposit down that would be refunded if he showed up. I told her that I was not willing to have them waste my time that I could spend on clients that were willing to be responsible and cooperate like they agreed to when they contracted with me. That is when she came in without an appointment, screamed and cursed at my staff and talked trash to potential clients in our waiting room. She demanded her file immediately. We told her it would have to be photocopied first. Had she called a day ahead we could have had it available but I have to keep a copy to provide information to the State Bar if false accusations were made against me. As you can see here, that was a good thing I did. She was told to leave or we would have the police remove her. My staff politely told her that we would have her file ready at a reasonable time that was as fast as it could be prepared. I was not going to have my staff work over a weekend for her. Every time I or my staff had contact with her she was always complaining. I have NEVER been reproved either publicly or in private by the State Bar. In 32+ years the State Bar has never found a basis for a complaint. The State Bar would not grant me my Certification as a Bankruptcy Law Specialist nor would they approve State Bar Legal Education Credits for the bankruptcy seminars I teach if I did not have an absolutely spotless reputation with the Judges, Trustees and members of my profession. When they had the TRUE facts they closed their file and deemed it nothing but a fee dispute. I did start to arbitrate the fees but finally decided to give her part of the fees we had ALREADY EARNED twice over back simply to get rid of her. Anyone can complain. That does not make the complaint true. Look at the other reviews by my clients and you will see that this is a bad apple client not a bad apple attorney.

Great Bankruptcy lawyers

Fraley and Fraley was the best firm to use for a bankruptcy--all of the staff were very kind and helpful with this very personal and somewhat humiliating process. Mr. Fraley prepared me fully for every potential question and gave great advice on how to handle creditors. He also gave some really goo...d suggestions on how to rebuild credit. The firm kept me fully up-to-date on all proceedings and made sure I had completed all forms, submitted all the documents and completed the online required courses. My analyst was exceptionally good. He very kindly responded to all of my questions and when I was feeling overwhelmed he gently responded in an understanding manner.
