Didn’t want it to come to this

It is unfortunate that this alleged client wants to post under “Anonymous.” As such, I can hardly respond to their situation directly or otherwise. Additionally, without “Anonymous” giving me permission to discuss their specific case, I am required by law to respect their attorney/client privilege. They are welcome to give me their name or case number and authorize me in writing to respond to the allegations here. Somehow I doubt that "anonymous" will do so. What I can do is discuss the general issues and how they are handled in my office. First, I am unaware of any case with “several dismissals” in our office other than people who come in with multiple prior cases that they filed on their own. Second, “His staff misinformed us as did Gary, this is indisputable… we were due in court and we’re advised that our hearing was continued when it wasn’t.” I see absolutely no reason we would tell a client that a hearing was continued if it wasn't. That would make no sense. There are only 2 possibilities I can think of. One would be if a motion to dismiss the case was filed by the Chapter 13 Trustee. Usually this is because the debtor is not making the plan payments, not providing documents to the trustee or is not doing what the plan required. Trustee’s motions to dismiss normally require a written response to be filed 2 weeks before the hearing. If it is not, than the court will take the matter off calendar (not continue it) and issue a dismissal order on the date of the hearing whether or not the attorney or the debtor appears. In fact, the Judge would not even hear the matter. Often we will send out motion documents and request that the client immediately contact us. Despite explaining the urgency of responding to us, some clients feel that they do not have to do anything and they can just show up for a hearing. The only other possibility I can come up with is that there was a continued "creditor's meeting." Some clients only come in at the very last second due to an emergency like a foreclosure, repossession or levy. An emergency “skeleton” case is often filed. The client must provide the rest of the information to us to complete bankruptcy documents. If the client does not do so the rest of the documents cannot be filed. When the allowed time runs, the case will always be automatically dismissed no matter what is done. Yes, my staff will tell the client that there is no purpose going to a hearing or creditor’s meeting if the case is being dismissed, because there isn’t. If it is a motion to dismiss, the Judge will remove it from the Court hearing calendar the before the hearing. That is not telling the client that the order on that hearing is not going to be issued dated the same day as the hearing. They have already sealed their fate. Going to the hearing would not have saved their case. They think that since there is an order that day that the hearing actually happened which is incorrect. “Anonymous” likely does not understand the difference between those concepts. Third, there is a saying “no good deed goes unpunished.” I will often reduce my fees or offer to help the client with another case for free even if the dismissal the consequence of their non-cooperation. If it was for some reason our fault that the case was dismissed, I would certainly refile the case for free. I always do whatever is needed to make things right. It sounds like that was offered to “Anonymous” in this case and it was turned down. Finally, I am regularly in my office as I have been for the last 41+ years. I am certainly not hard to find. I invite “anonymous” to contact my office. We can set a phone appointment if “anonymous” does not feel comfortable to meet with me face to face. I can then pull the file and see what actually happened. Otherwise, I wish them the best.
