I have been in the criminal defense field for just over 16 years.  I have been licensed for 13 of those years.  

 

My first job, during my first year in law school, began with the First District Apppellate Project.  Here, I was extensively trained on the in's and out's of writing successful appeal (Appellate Opening Brief).  How to look for issues on any case and how to put together a convincing argument.  I have since applied this knowledge and have handled at least 100, criminal and traffic, appeals with a great success rate!  I have also written and filed writs, both to the Appellate DIvision and the California Court of Appeals, on many of my cases.  I hope to one day get the right case in front of the Supremes.

 

After working at the First Appellate District, I worked at the California State Public Defenders Office.  I believe it is here where I truly learned about passion for your case.  The office focused on doing appeals for those convicted and sentenced to death.  I spend quite a bit of time on an inmate who killed three people.  It was this experience that taught me why it is that we (Criminal Defense Lawyers) do, what we do - always a topic of debate at the dinner table.

 

I left the appeals area to focus on being a trial lawyer.  I wanted to be on the trenches where the initial battle took place.  I ended up volunteering as an intern at the San Francisco Public Defenders Office.  After all I was raised in San Francisco and knew the streets pretty well.  Here, I interned with several Deputy Public Defenders and wrote countless Motions to Suppress, 995 motions as well as researched countless legal issues for the deputies.  I also assisted in trial work from start to finish.  The main lesson I got from working at the SFPD was, the cold reality of how the system, at the trial level really works.  It is nothing like what you see on TV. 

 

My last employment as an intern was at the Alameda County Public Defenders Office.  Here I was assigned many duties including the initial intake of the accused. Again, I gained great courtroom experience and extensive training on all aspects of a criminal case, but the biggest lesson here was caring about the people you defend!  They were not files or numbers, as many of the Judges and Prosecutors saw them.  They were people wanting to be heard, and whether you like it or not this is what OUR Constitution affords them.

 

After passing the bar, I began working as at the Santa Cruz Public Defender's Office.  I worked here for a total of two years and conducted at least 18 jury trials with a high success rate (I think I lost two).  I received in-office weekly training pertaining to all aspects of a handling a criminal case. I was also sent for training at the Western Trial Advocacy Institute (run by Gerry Spence and considered to be the top trial school in the country) in Wyoming for  an extensive week long trial work training.  I left the Santa Cruz Public Defender's Office feeling confident that I now possessed all the tools necessary to competently and aggressively represent private clients.

 

After leaving the Public Defender positions, I opened several offices and have been in private practice ever since.  Every day, and in every case, I use the knowledge acquired at my previous jobs as well as the knowledge acquired I acquire on a daily basis. I continue to improve my skills and knowledge by attending countless seminars on every issue you can think of.  I am one of a handful of Attorneys trained in the performance of Field Sobriety Testing approved by the National Highway and Traffic Administration.  I never stop learning, and if I did I would retire immediately since I would be doing a great disservice to my clients.  I consider my self one of the lucky few who loves what I do.  I love the daily challenge; I love the fight; I love winning; but most importantly, I love helping people.

Great professional lawyer
I was referred to Francisco by a friend and she is also a lawyer but in a different field. So here is my story. I got 2 DUI'S back to back in less than 30 days, those were my 2nd and 3rd strikes in 2 different counties, I thought that was it I'm going to jail for at least 6 months to a year. When I met Francisco, he explained to me everything to a single detail what could happen if I go to court with out a defense, so the judge would put me in jail till my next court day unless I bail myself out. I was freaking out cause my job, my life were on the line. So make this story short, Francisco's assistant and I went to a first court day to face the reality, right away the DA wanted to put me in jail cause it was my 3rd strike in that county, Francisco's assistant negotiated the bail with a judge and set a trial date, at the same time we were dealing with my 2nd strike in different county. Francisco was very professional and detail oriented I enjoyed watching him work in a court room and the night before the trial day we would talk about the case for hours to make the professional move in a court room, he even brought a professional phlebotomist to court trial to prove a point. Francisco and I were going to trial courts for over 18 months and finally the 3rd strike he gets it dropped. I was shocked cause I thought wet reckless was my best chance. For the 2nd strike Francisco was very creative and thinking out of the box how to prove a point to the judge and he did get my case dismissed. Francisco is my lawyer for life and will recommend him to my friends and family members. Thank you so much Francisco you really helped me out a lot.

BEST OAKLAND DUI ATTORNEY IN THE WORLD!
I was arrested for an Oakland DUI last year and I was devastated because of the effect it would have on my employment and immigration issues. I looked around and interviewed many Oakland DUI Attorneys and finally met with Attorney Rodriguez and I liked the way he explained the law and took his time to explain all issues involved. I ended up hiring him on the spot. As the case progressed, Mr. Rodriguez took his time with it and explained the tactics from the start. He never promised a result but did promise to do all he could to dismiss the case against me. The case lasted almost two years, but in the end he did what he promised! The case was dismissed. This was a DUI with a BAC above the legal limit. If you ever get a DUI and want a great DUI Attorney to help you, I would highly recommend Attorney Rodriguez. His office is right across from the Oakland Court house and he is the BEST!

Recent client for DUI
Although I know better, as we all do, I made the incredibly stupid mistake of drinking and driving. Of course I freaked out- I, like everyone else, have so much at stake/ learned my lesson/ blame the jerk cop, okay... Stupid, stupid mistake. Francisco is simply the most knowledgeable attorney I could have asked for. After I was done beating myself up, he told me everything that was going to happen, point-by-point, which calmed me down enough for me to pull myself together. Once things are less confusing, and you have a game plan, you stop being terrified of what's happening, and start regaining control over this mess. Then, he held my hand through every step- from dealing with the DMV, to defeating the case against me in court. It's been a couple months since trial, and my charges have been dropped, and we're working on appealing the DMV points. I think the best thing that came out of my experience with Francisco is that what had began as one of the most regrettable follies of my life eventually became one of the more empowering things I've had to go through. Of course I couldn't have done it without Francisco's calm demeanor and confidence. Very happy and excited for anyone who reads this review and decides that they are going to be proactive about what could be a giant mess, and hires Francisco to do so.

speeding ticket victory!
I got a speeding ticket. My customary MO is to bite the bullet, eat the fine, take the point, move on with my life - and take a bitter pill. But this last speeding ticket? Oh hellllllll no! Absolutely not. No way. I decided to get a lawyer and fight this travesty of justice. Lucky for me, I did - Francisco ROCKED IT! Having never hired a traffic ticket attorney before (refer to my aforementioned MO), I scoured the internet, researched a few local, legal, bulldog, smartiepants options, and settled on Francisco. We spoke on the phone, I told him about the case, he requested a flat fee, and sent me a link to his site to upload my paperwork. Easy peasy. Between my hiring him and my court date, he requested several continuances on my behalf - he didn't tell me about these, but they were part of his strategy. On the fateful day, Francisco met me at the San Mateo Central Branch courthouse, and we discussed my case again (poor guy left my case file at his office, but that didn't phase him ONE BIT!) and he presented my legal options to me. I selected the option of proceeding with the trial, even though we both observed that the judge was being especially hard on defendants, and *especially* accommodating to officers. But it turns out I was in good hands - Francisco handled the case like a pro! He was fearless, informed, assertive, thorough and decisive - I think I was most impressed with how open-minded and flexible he was during my court appearance regarding the multiple strategies he could employ to try to win this case for me. He knows the law, knows how to win, can't be fazed, is easy to talk to, and is, above all, SUCCESSFUL. He achieved the near-impossible - he won me a not-guilty verdict from (what I think was) a very biased judge. Now, to be completely honest, Francisco isn't the most proactive communicator - I had more than a few unanswered emails and voice messages. But if you want to win in traffic court (and isn't that the point?!), I highly recommend Francisco. I hope I never need him again, but I'm glad he's there if I ever do.

Highly recommended!
I used three other lawyers for my tickets before him and found him to be the best. He was recommended by a friend that used his colleague (now a judge) to repeatedly win or get no-point charges for his speeding tickets over a decade ago. I used him for my tickets in San Mateo and San Francisco Counties. Thanks to him, my driving record is clean without ever needing traffic school, at very reasonable cost. The best way to communicate with him is by phone. He is quick to reply to voice messages. However, he lags with email. It sometimes took over a week for response there without a follow-up call. Since 2010, he got a ticket dismissed and won one that went to trial. Unfortunately, the one that went to trial did leave a point on my record. The county cleric office sent the paperwork to me instead of to him, and I did not contact him in time to keep a point from my record. It is annoying that he didn't notice first. Because it was a mistake from their side, he explained that it was not too late to go to trial. When the point was mistakenly left on my record, Francisco went the extra mile to contact the DMV and ensure that it was removed for my insurance. He also got my DUI case (.06) and a couple other false charges dismissed. It was expensive (over $2K) but worth knowing that I was going to be taken care of to prove my innocence, rather than worried that by myself I'd be in trouble for injustice. He met me at my home the day after I was held, took my full account, assured me with many points for his argument on my side, and kept me apprised of the case's progress. I highly recommend him and will use him again.

AWESOME!!!
I received a 2 point / 10 year $1285 traffic ticket. HE GOT IT DISMISSED!! He has many years of experience. If you are like me and have a class A license you cant afford to take chances. You need someone who knows the laws and is a wizard in court. I highly recommend you use his service. He is AWESOME!!

Highly Recommended Lawyer
I tried fighting a ticket by myself and lost. I was pretty well prepared but like they say in the movies, "if you go to a gun fight with a knife, you're gonna lose". Mr. Rodriguez is my big gun. He have represented me 3 times now and has never lost. I highly recommend him!!!! Kelly

Francisco is the go-to guy if you have any traffic violations. He took my traffic case last minute (due the week after) as well as a second ticket that I received on Christmas of 2010 and took care both of them for me. He is easy to get ahold of, returns calls and emails in a timely manner. He's a very educated man who shares his knowledge with you, even if you don't ask - he tells you what he's doing every step of the way and why hes doing it. Not only did he win both of my tickets, I now have a greater knowledge of the judicial system and why it is important for citizens to fight their tickets. ONE SOLID DUI DEFENSE ATTORNEY!
I feel privileged to write this recommendation for Francisco Rodriguez. I hired Mr. Rodriguez to represent me on a DUI case on which I was facing enhanced charges due to a prior conviction. Mr. Rodriguez worked with me directly throughout my entire case and fought for me like crazy from day one. I couldn’t have asked for a more involved and concerned attorney. He answered all of my questions and never made me feel like I taking up too much of his time. Additionally, he answered every call I made to his office, or returned every phone message I left for him on his personal cellphone. In the end, Mr. Rodriguez was able to get the District Attorney to reduce my enhanced DUI charges to an EXTREMELY favorable result. Mr. Rodriguez is hands down the best DUI lawyer in the bay area. BEST TRAFFIC ATTORNEY IN THE BAY AREA!!!!
Francisco helped me out on a speeding over 100mph ticket. He was extremely informative and had lots of expert advice. Although the police officer ultimately did not show at court, it was obvious that Francisco was more than prepared to fight for me with his extensive knowledge of the traffic law. If you're going to court, YOU MUST GET A LAWYER. I stayed and viewed a few other cases and most cases without lawyers got processed fairly quickly with a guilty verdict. Defendants were just not properly prepared for what happens.

great attorney
I used Mr. Rodriguez to defend me on a criminal case. It was a very serious offense and I was convinced I would do jail time. I met with several attorneys before I chose Mr. Rodriguez. I chose him base on his knowlege and the time he took to walk me through the possible outcomes for my situation. He made me feel confident that he knew what he was doing and knew his way around the legal system. Considering my charges I am amazed that somehow, someway Mr. Rodriguez was able to get me NO jail time! I have a fine, classes, community service, but NO jail time. This was not a first offence and for him to be able to get me out of serving time in jail was no easy feat. He is worth every penny we paid him. I would recommend him to friends and family if they are ever in need of legal counsel. Thanks so much Mr. Rodriguez you are "THE MAN".

Knowledge, Experience, and Conscientiousness
Francisco represented me in a DUI case that went to trial; I was very impressed with how he protected my rights in court. He presented the strongest possible defense in the face of some tough evidence and I was pleased with the result; the case is still pending. This is my first ever experience with law enforcement and the court system, needless to say I was intimated and knew to be out of my depth. Francisco listened to the details of my situation and was able to jump in right away; you can just tell he knows the law/system and is a strong advocate for your rights. He thoroughly explains the strategy and all available options/possibilities for your specific case. I feel comfortable in my conversations with Francisco and have great faith in his ability to pursue the best possible solution to a difficult case. I highly recommend him as a DUI lawyer; having said that, I hope to never have to use his services again but if (God forbid) I did, I would definitely ask him to represent me again.

Hands down the best traffic attorney in the Bay Area
So in 2009, I received 3 traffic tickets; 2 speeding and 1 stop sign. Francisco already beat out 2 the two speeding tickets (1 by trial by dec. and the other by actually appearing in court) and we are pending on the stop sign ticket. He clearly and patiently explained his entire plan of attack and how he was going to win against the courts and he did just that and won. He knew the ins and outs of the system, the minor details that we normies wouldn't know, he knew everything that would work to win. He kept me up to date on how everything was going, was always available by phone or promptly returned my emails. Overall, Francisco is the best of the best when it comes to these types of criminal cases. I was extremely lucky to have found him and would recommend him to everyone. He has an extremely high success rate and after talking to him about the tickets and sensing the honest passin, I was already confident that I was in good hands and on the road to winning all my cases. Of course, nothing is ever guaranteed but with Francisco, your chances of winning are the best they will ever get short of knowing someone in the police force. Because of this, I will not have 3 points on my record and I will not have to sell my left kidney to pay for my insurance rates. I just wished I knew Francisco when I got my 100+ speeding ticket going down the 5 in 2002. Joe
