4 - Driving while under the influence of alcohol (DUI) is deemed a lesser charge due to only being "under the influence," compared to driving while intoxicated (DWI), which is a higher level of impairment (intoxicated) based on a high alcohol level.
5 - Although recreational use of marijuana is now legal, driving "under the influence" of marijuana is still illegal (VC 23152(f)). Like alcohol, it is legal to use marijuana, but it is not legal to drive if you are impaired by the marijuana.
6 - An aggravated DUI means that there are factors about the DUI arrest that make it worse than a normal DUI charge, such as having prior DUI convictions, a high level of alcohol, reckless driving, having children in the car at time of arrest, etc.
Felonies are the most serious type of DUI charge. They are punishable by state prison and major fines. Defending a felony DUI charge requires an experienced DUI defense attorney.
8-Having a DUI conviction may make it hard for a person to rent a car. For example, if your probation requires driving a car with an ignition interlock, then a car rental company probably does not have that type of car. Insurance can also be an issue.
9- What jobs you can get with a DUI depends on the employer. Jobs that require Driving are likely more difficult to get due to insurance issues. A DUI conviction can negatively impact one's career, more so if a person has a commercial driver license.
10 - DUI "Per Se" refers to an illegal level of alcohol in a person's blood at the time of driving. VC23152(b) makes it a crime to drive a motor vehicle with a blood alcohol concentration of 0.08% or higher. Being under the influence is not the issue.
11- The costs associated with hiring a DUI attorney can vary, but the real cost of not hiring an expert DUI attorney can be staggering in the future. The old saying: "good lawyers are not cheap, and cheap lawyers are not good" rings very true.
12 - When you get arrested for a DUI in California, there are two independent proceedings that are going to happen: First, the DMV will try to suspend your driver license; second - the Court will try to punish you for breaking the law.
13- a DUI conviction stays on your driving record for 10 years for purposes of using the prior to aggravate a new DUI arrest; a DUI conviction can stay on your criminal record for much longer - even permanently, unless you have the conviction expunged.
14 - Field Sobriety Tests are tools that an officer uses out in the field to help him/her form an opinion if a driver is under the influence of alcohol or drugs. Whether or not Field Sobriety Tests are accurate is another question.
15- How much jail can one expect for a DUI conviction? It depends on a number of factors, such as what was the alcohol level, prior DUI convictions, as well as the circumstances surrounding the DUI arrest, and is it a misdemeanor or felony.
16 - What happens in Court when arrested for a DUI? The prosecutor's goal is to punish the offender. The Court proceeding gives the accused person the opportunity to contest the charges. You need an expert DUI defense attorney to defend you.
17 - Will a DUI show up in a background check? Absolutely - which is reason enough to fight a DUI arrest. A DUI conviction can affect your ability to advance your employment opportunities.
18 - What are the costs associated with a DUI? From having your car impounded, the cost of having a suspended license, license reinstatement fees, costs of alcohol classes, court fines, etc. There are several factors that go into the true cost of a DUI.
19-How do I get a DUI dropped? Getting arrested for DUI does not mean you are guilty of a DUI. If your goal is to try to get a DUI dropped, then you have to fight it. To fight it, you must have an attorney that is an expert in defending DUI cases.
20- Do you need a DUI lawyer? It depends what your goal is. If you are looking to fight your charges, you need an expert to defend you. If you want to plead guilty, you can hire a cheap lawyer to help you fill out plea documents or just do it yourself.
21 - What are the penalties for a DUI? Penalties for a DUI conviction vary a greatly depending on (1) whether you have prior DUI convictions, (2) whether you are being charged with misdemeanor or felony DUI, (3) and the facts of your particular case.
22- What is a DUI conviction? A DUI conviction means that a person has been found guilty of the crime - driving while under the influence of alcohol or a drug, or driving with a blood alcohol concentration of .08% or more. Either the person plead guilty
23- On average, the liver takes one hour to metabolize one ounce of alcohol. For most people, one ounce of alcohol will produce a .015% BAC. Thus, if a person has a .15% BAC, it will take about 10 hours to remove that from the body and return to zero.
24- The most important right you have is to remain silent and not answer any questions. You must produce your driver’s license, car registration, and proof of insurance. Other than that, you have no obligation to give the officer any information at all.
25 - Breath testing tries to determine a person's blood alcohol content by measuring the amount of alcohol in one's breath. Blood testing tries to determine how much alcohol or drug a person has in his blood. Both breath and blood testing have flaws.
26 - VC23152(f) makes it illegal for a person to drive a motor vehicle under the influence of a drug. A drug includes marijuana, prescription medication, or illegal drugs. It does not matter whether the drug is legal, or that you have a prescription.

Mr. Barba is an amazing attorney. I’ve had previous attorneys in Los Angeles represent me but they do not compare to the work ethic and dedication Attorney Manuel Barba has for his clients. Mr. Barba, along with his team, provided me with a sense of comfort from the moment I decided to hire him to represent me. I primarily chose Mr. Barba because of his Forensic Scientist-Lawyer background and was able to see firsthand his experience and how knowledgeable and effective he is in trial because of that. After reading about Mr. Barba’s successful representation of DUI cases, I decided to proceed with his services. I’d like to thank Mr. Barba for saving my future and keeping me away from serving jail time. I was facing a very serious and difficult DUI felony with violation of probation from a previous DUI. Mr. Barba was a great no nonsense attorney, he always told me the truth about everything that I was facing, he never gave me false hope but he was always on top of my case advising me what was happening, what to expect and when to appear and not appear. Worth the Money!
Mr. Barba represented me in a DUI case that lasted over 2 years. He was highly recommended to me by a former CHP officer. He was very attentive to the small details in the handling of the case. The case went to trial and Mr. Barba presented the defense with the utmost diligence and confidence. He walked me through every phase of how a trial works beforehand and explained our defense and the reason why the arrest should be contested. One thing I really appreciated was that he was not over-confident. He was not eagerly optimistic or dreadfully pessimistic. Mr. Barba always talked to me objectively about the facts of the case and laid out the plan. I was acquitted of all charges.

This case is yet another example of an incorrect analysis of the blood sample by the crime lab. The process of gas chromatography is not a precise science and must be done correctly if the results are to be accurate and reliable.

amazing DUI Lawyer
If you're looking for an experienced and knowledgeable DUI attorney, look no further than Mr. Barba. He handled my case which ended up lasting over 2 years. He looked over my case with a fine tooth comb and discovered many flaws that I would have never picked up on. We decided to go to trial which ended up lasting over a week. In trial Mr. Barba fought hard and brought the absolute best expert witnesses in to testify on my behalf. He was able to completely discredit the arresting officer and get my first count a NOT GUILTY verdict. His witness who spoke about the problems with my blood sample was amazing, and had some of the jury members shaking their heads at the DA. In the end, I was given a not guilty verdict on the first count (a first time DUI has 2 separate counts), and a hung jury on the second count. Of course the DA wanted to retry my case to save her bruised ego, but Mr. Barba and his team was able to talk her down into giving me a plea bargain of a wet reckless!! Overall, I would highly recommend hiring Mr. Barba if you ever find yourself in the unfortunate situation of a DUI. He will find every possible flaw with your case and use that to get you a lesser sentence or even a full dismissal. My only critique would be that I would have preferred more communication from the office. I would often have to call to inquire what happened at a court date that I didn't need to attend. The office does send letters after each court date with the pertinent information, but an email or phone call would be preferred to get the information right away so I don't have to wait 2-5 days for my letter to come in to see when my next court date will be. Overall - HIGHLY RECOMMEND

Attorney Manuel Barba has not only excellent legal skills but a full understanding of the science related to the toxicology and forensics necessary to argue competently for a defendant with DUI charges. He is calm and methodical when working thoroughly to challenge the DA's data and makes it easy for the jury to understand and comprehend the nuances of breath and blood results, how they were obtained, tested and interpreted. His strong presentation of the laws, rights of the defendant to good science and how the testing lab failed to meet those requirements resulted in a jury that was engaged in really questioning the validity of the numbers. Attorney Barba fights with two swords- legal and scientific.
