Business Man, Not a Lawyer

I will apologize in advance if this seems longwinded but I take the reviews we receive very seriously and I believe that anyone reading this review should hear our perspective so that an informed assessment can be made. I strive to provide legal services that are caring, personal and effective, and, I appreciate this person’s review to ensure we continue to do so. We work with literally hundreds of new clients every year and I will not deny that occasionally a client does not see eye-to-eye with the court system or my view of a case; or both. I work hard to help a client understand how his or her fact situation aligns with the law or the way a particular judge applies the law. Sometimes it is hard for a client to accept some of the realities. Client personalities are interesting, especially in family law. Most times, if a person did not believe in his or her actions or perspective, he or she would not have acted as they did. As such, it can be difficult for someone to internalize how and why his or her actions do not align with the laws that govern a divorce or parentage case. This creates animosity in that person, which makes him or her feel that everyone is against them and is very difficult to overcome. Unfortunately, this person posted anonymously, which makes it nearly impossible to understand the situation and determine how we could have assisted the client better (assuming this is a real client) or prevent the same dissatisfaction in future clientele. However, by the title and comments that are made, I get the sense that the issues really stem from the financial burden of the person’s legal matter. There is an interested personality that we encounter as lawyers in that some clients have a belief that lawyers are obligated to share in the financially responsible for the client’s case. I will not deny that we have an obligation to provide a cost-benefit analysis of the case and ensure the fee structure is reasonable, but a client is the one responsible for deciding the overall direction and cost of the case. I believe that being a lawyer is a very noble profession as we work to resolve complex legal problems that can affect a person’s daily life. However, it is still a job and a means to support our families and the families of those that work for us. When I hear something to the effect of “business man, not a lawyer” or “his bills are more important to him”, it makes me understand the true nature of how the relationship broke down. Those words, or words to that effect, mean that a person felt that I (or any other attorney) should continue to provide legal services without being paid. This concept is astounding given that I know most any employee would stop working for his or her employer if they did not receive a paycheck or two. However, this type of personality expects that a lawyer should continue to work without being paid for months or even years. When this occurs, yes, I have to be more of a business man then a lawyer and concentrate our resources on those cases where the client is paying for our services, especially since my family and the families of my employees are counting on my financial support. If the business man in me did not come out to address this situation, there would be no business to provide assistance to the 300 plus clients we service on an annual basis. It is unfortunate that this reviewer did not provide any identifying information so that I could address the specific concerns this person raises. This review has troubled me for sometime as I pride myself on maintaining a good, open, and upfront relationship with my clients and have never experienced anyone with the alleged concerns. As such, I have reviewed all of my client files to see if I could determine the identity of the reviewer. My only conclusion is that the anonymous poster was not a client at all, but rather, the ex-boyfriend of one of my clients. I take these reviews very seriously as my reputation and character are incredibly valuable to me. As such, I feel that I must respond to this review and provide some facts for future viewers so that an informed decision can be made. This reviewer makes allegations that support my belief for the following reasons: 1) The reviewer alleges that his custody case lasted 3 years. First, I have never represented anyone in a custody matter for 3 years. Second, the Illinois Supreme Court has mandated that the courts resolve all custody matters within 18 months unless good cause is shown. As such, an attorney is not in the position of being able to delay a case merely for financial gain. 2) The reviewer alleges that he/she was charged $50,000 for my services in the custody case. If a custody decision actually took 3 years, the actual cost would probably closer to $150,000, not the alleged $50,000, which is not an uncommon amount for a contested custody case. In any initial consultation, I always inform a potential client that a custody fight could easily cost upwards of $75,000-$100,000. 3) I do not have (and did not have) any clients that owe(d) $50,000 for a custody matter. Any cases that I worked on while I was at my prior firm and that still have (had) an outstanding balance are owed to my former firm. I am not collecting on such balances and could not be offering any alleged discounts. The partners of that firm would have been the only ones that could have authorized any type of discount to this “reviewer”. 4) I have never offered anyone anything for a review or testimonial, let alone have the audacity to offer someone a measly $200 after incurring the alleged $50,000 in fees. 5) I have represented someone for 3.5 years now, which was a case that started as a custody matter, and the client’s ex-boyfriend has made these very statements to me in failed attempts to rattle me while in court. In fact, the ex-boyfriend was making these comments during the same time that the “review” was posted. The fortunate part is that I have stayed with this client even though my personal and professional reputation and character have been attacked in order to ensure that the client is always protected against such abusive conduct. Unfortunately, I am unable to obtain any verifying information to identify a “reviewer” even when it is believed that the person is impersonating an actual client; and, the only suggested remedy is to leave a reply.
