I was under Background Investigation. I did a consult with Tully Rinckey and they connected me with Dan Meyer, the national security partner in Washington, D.C. Dan worked from his experiences as a security manager in the Middle East, Federal executive, and intelligence officer, to prepare me. He identified the security concerns, and we went to work on the sf86, making the best case for no adjudication. Got the word about eight months later, I am done, and through the Background Investigation. All set. We had the strategy right. I am very excited. Great job TR ! Thanks, Dan !”
In chatting with my attorney, Dan Meyer, I realized my Statement of Reasons did not fall in the most common categories of security concerns. My job offer with a major Federal agency was on the line, due to Guideline E, Personal Conduct and Guideline M, Misuse of Information Systems issues. Dan laid out a strategy; he doesn’t believe in little pokes and stokes of the security process; our mitigation packet was thorough, complete, and huge. Did the trick, and now at work with the agency of my choice. Thanks TR ! Thanks Dan !
Federal employment practice includes all aspects of whistleblower protection, security clearance adjudications, and public trust reviews. Mr. Meyer was the first Whistleblower Protection Ombudsman for the U.S. Department of Defense.
Mr. Meyer began his Washington legal career at the Federal Communications Commission followed by five years of work at private firms working the Telecommunications Act of 1996, the Cable Communications Policy Act of 1984, and other statutes.
Mr. Meyer has advised agency heads, senior leaders, supervisors, managers and employees on ethics questions for 19 years.
23 years
After service in the United States Navy during Operations Desert Shield and Desert Storm, I went to law school in the Middle West and then returned to Washington, D.C. to practice communications law. Leaving the technical side of that field, I focused on libel and defamation law and public employee rights to report wrongdoing in the workplace. Our Federal employees caretaking the environment were my primary focus through to 2004. I then returned to Federal service to set up the modern whistleblowing programs for the Defense Department and the Intelligence Community. The work was exhilarating. My skills in Federal Employment Law were honed and I picked up new insights as a National Security lawyer focused on oversighting of the security clearance adjudication process, 2004 to 2018. In 2018, I returned to private practice on Connecticut Avenue, using the experience of the previous quarter century to continue helping our Federal workers. Home is Upstate New York, where I came of age at Ithaca, New York and received my collegiate education at Cornell University. My husband and I live in western Maryland, close to both our families. In my spare time, I grow tomatoes, cucumbers, a variety of herbs and spices, and green beans. I tend to be a dog-person, but am courteous to cats.

Thank You Mr. Meyer
I was under security investigation, and was feeling pretty pressured. I found my way to Tully Rinckey’s website and the consult process. They assigned my case to national security partner, and former Intelligence Community IG staff member, Dan Meyer in the Washington, DC Office. Dan has supervised security offices in his career as a Federal senior official. He put everything in context; he taught me respect for the polygraph process and gave me guidance on the investigation. Everything closed out, and I am good to go. Thanks Dan; thanks TR!

Successful reconsider of Contractor TS fitness assessment non-eligibility
Dan helped me to successfully overturn an agency finding that I was not eligible for contractor fitness as part of my first time, TS clearance application to a federal agency (non-IC, non-DOD).
I was delighted that my case was assigned to Dan. He was knowledgable, prompt in responding, and provided confidence during the stressful process. He structured an impressive written response package on my behalf, including declarations and evidence from myself (on which he advised me) and an extensive legal brief including relevant case history.
As a result, my request for reconsideration was successful and I received my clearance within 6 weeks of submitting it.
The concerns that Dan helped me to mitigate were under guideline B; I am an overseas-born, dual national with foreign family, financial (not extensive/not business) and military service history. The other country is a very close U.S. ally.

Thank You Mr. Meyer
Thank you to Mr. Meyer! I had a Guideline F, Financial Considerations, proceeding before the Defense Office of Hearings and Appeals. I sought out Tully Rinckey and they assigned Dan Meyer, a national security partner working out of the Washington, D.C. Office, to represent me. Mr. Meyer is a former security officer and knew exactly where to point me in the evidence collection and hearing process. After I got the evidence together, Dan did the legal brief and represented me at the hearing, doing the examination and defending the cross examination. My decision is in, and we won. I would highly recommend Mr. Meyer and his firm.

Fed workplace
“I was the victim of mobbing and bullying in the work place. As a disabled veteran, I was staring at a Notice of Proposed Removal. Tully Rinckey PLLC put their Diversity, Equity, and Inclusion (DEI) subject matter expert on the case. Dan Meyer, a partner in the DC Office, put together not only a great written reply, but dominated the hearing as well. The mobbers and bullies were routed. My removal was downgraded to a one-day suspension. Thank you Dan Meyer, thanks TR !”

Best in the business!!
Finding legal representation isn't hard. Finding someone who cares, has the legal knowledge, experience and character that Daniel Meyer possesses is hard to find. There could not have been a better individual to represent me during my legal process. He's direct, honest, and actually cares. Daniel Meyer had the foresight and was able to predict the legal problems I would encounter before they were apparent. He helped me navigate troubled waters and ensured a legal victory. I was facing a pile on of various detractors in the workplace mobbing and bullying me with wrongful allegations. The matter was serious enough to threaten my professional license. Dan Meyer, the national security partner in the DC Office, reviewed the file and developed a two-prong defense. The bullying employees found them under review by an Inspector General; Lachlan was assigned to defend my professional license. I came through with my professional prospects, intact. To get things done, get Tully Rinckey!

Five Star Mitigation
I came to Tully Rinckey with a Yankee White rejection. Dan Meyer, the National Security partner in Washington, D.C., was assigned to help me. Dan worked from his experience as a Federal executive, Naval officer, and former White House staff, to prepare me as I prepared the evidence.
If I needed clarification about anything, Dan would always respond to my emails, and my calls, and provided straight answers. This helped in a great way.
Unfortunately, while having too many projects going on I lost track of an important piece of information, and also ran short of time. So, we did not win at the first level review.
For the second round, I obtained additional evidence and the missing information. Dan reviewed the evidence again, suggested a new approach, and we won the second appeal. Dan was focused on something that was not obvious from the official paperwork: different executives make the decision at different levels. He considered the best strategy and advised me, and now I can focus on beginning the next phase of my cleared career.
Thank you for doing a great job and contributing to my success, Dan and TR.

Great Experience
Thanks to Tully Rinckey! Facing a Statement of Reasons from the Department of Energy, I did a consult with Tully Rinckey. National security law expert, Dan Meyer, who used to oversight the Department of Energy when he was an intelligence officer, was given my file. Dan organized us for the response, and guided me in collecting the evidence necessary to mitigate the Office of Security’s concerns. Dan’s legal brief was the capstone to the filing. We had to wait for what seemed like an eternity, but I just received word I am back on the job. Thank you to Dan Meyer and the folks at Tully Rinkey!

Intelligence Professional
“I work in the Intelligence Community, and got brought in by Security for an interview. Not waiting for a Statement of Reasons, I contacted Tully Rinckey to armor-up, quickly. They assigned former Intelligence Officer Dan Meyer to the file. Dan and I chatted, he worked up a proactive strategy to hit the investigation head on. We got ready to fight, and Dan sent in his Notice of Appearance to the security specialists who interviewed me. Case close; am approved and SCI-eligible. I am keeping TR on my contact list; essential for all in the Community.”

Great legal team
“I called Tully Rinckey after getting a proposed adverse action. They assigned the Washington D.C. Federal Employment Law team to the project, with Michael Goldstein and Lachlan McKinion in the lead, supervised by Dan Meyer, their national security partner. They worked seamlessly on my challenge, and I got myself out of my old job and safe in a new job, moving my career forward. Thanks to Tully Rinckey; and thank you Mike, Lachlan and Dan!”

Good Experience
I hired Tully Rinckey PLLC to manage my security profile as I transitioned from one cleared job to another, at a different agency. Dan Meyer, the national security partner in the Washington DC Office, analyzed my liabilities for me, ran a review of the relevant Adjudicative Guidelines, and got me ready for the new sf86 and background investigation. He actually went further than my security profile, and advise me on how to communicate with Security and how to make me more compliant with the way Security Offices think about applicants. We were able to close the file early Security granted reciprocity and transferred my clearance without a review. I am keeping TR’s number handy for the reinvestigation in a few years!

Excellent Legal Guidance
I hired Tully Rinckey to assist me with an OIG investigation. Daniel Meyer in the Washington DC Office was the attorney selected for my case. He was professional, punctual and very responsive to all requests and questions. With such a short deadline to respond to the OIG investigator, Daniel was very prompt and assertive in providing legal guidance and conducting research. I was able to conduct the OIG interview feeling confident and knowledgeable about my rights as a government employee. The OIG investigation resulted in nothing be substantiated and was therefore closed. I would have never been able to achieve these results without Daniel.

Precise, accurate guidance and advice
I hired Tully Rinckey to avoid a long, drawn out suitability review. Dan Meyer in the Washington DC Office researched the factors I might trigger, and provided advice and assistance in completing my application forms with precise, accurate, and well directed information. I did not have to undergo a full review with a response; the initial review is done, I am suitable, and excited to start my internship !

BIG WIN AND CLEARANCE GRANTED!
The question always comes up, do you represent yourself in a security clearance proceeding, or do you get a lawyer? I did both, and I can say getting my file to Tully Rinckey put the ball over the goal line. Great win at the Defense Office of Hearings and Appeals; thanks to Dan Meyer in the Washington DC Office and the entire TR national security team!

SOR
I had a statement of reasons response and hearing before the Defense Office of Hearings and Appeals to navigate. After an online search, I contacted Tully Rinckey Law Firm. The Firm assigned Dan Meyer, the Managing Partner of the DC Office, to my case; Dan prepared me, helped concentrate my testimony, and clearly explained the process. I felt like Dan and I were able to work like a team to prepare the necessary responses and paperwork. His experience gave me confidence that I was working with a professional who was looking out for me. I am waiting for the case to finish up at the Personnel Security Appeals Board, and Dan has been with me all the way. Thanks Dan and the staff at TR!

Intelligence Community Appeal Victory!
Late last year, I received a Statement of Reasons from an Intelligence Community Element (ICE), effectively ending my career. No one in my network had any experience with something like this, so I felt aimless. I contacted several attorneys and firms before consulting with Dan Meyer. I chose to retain Dan and his firm, Tully Rinckey, because of his tremendous experience in the niche field of Federal Employment Law and his knowledge of relevant case law. Without giving out privileged information, Dan described other successful cases he and his firm has won for eligibility for access to classified information that were similar to mine. In addition, the specific security concerns in my case required someone with significant understanding and commitment to Diversity, Equity, and Inclusion (DEI). Dan was that man; having served openly as queer in both the Defense Department and on the staff of Director of National Intelligence James Clapper, he put me at ease. I was relieved I was not alone and my case was not a “unicorn”. He said my case was winnable, even though winning an appeal at an ICE is notoriously difficult. He made sure that I knew all of the steps of the appeal process and what I should expect and what was expected of me. He managed to expertly balance the government’s security concerns with his knowledge that the Intelligence Community can be overly cautious in regard to DEI matters. He was firm, almost stern, at times, noting that everyone must conform to the security norms once they are on the inside; at the same time, I didn’t have to change who I am to maintain a security clearance. All this culminated in a stellar showing during my appearance before the appeals panel. I just got word, I am “eligible”. I am beyond excited to continue my career and I wholeheartedly recommend Dan Meyer and his team!

SEAD-3 Delayed Reporting
I contacted Tully Rinckey with a self-report challenge; I was significantly overdue in a SEAD-3 report to my Security Officer. Do not wait for your next sf86! TR assigned my file to Dan Meyer, a national security partner in the Washington DC Office. I told Dan I was deploying; he kicked the matter into over-drive. I am off on my next assignment, the matter is reported, and the Security Officer has indicated I am fine with him. Thanks, Dan! Thanks, TR!
