Expunged!
I received my expungement letter from the local court today, about a year after being charged with DUI. The process went down exactly how Richard told me it would during one of our initial phone conversations. I completed ARD in just six months, had no job repercussions, and the state medical board chose not to pursue action against my license regarding this first offense. In three more months, the ignition interlock will be removed from my car and this will all be behind me. I apologize to Richard, as I may have taken out many stresses of the DUI process on him, but he was always able to calm me down and provide reassurance via email, text, or a phone call. Thank you Attorney Hark!

This Allentown client was charged with a DUI, refusal, and was subjected to a health care board investigation. The final order of the full medical board dismissed the case. IT IS OVER. WE WON. This COVID-related DUI, PennDOT license refusal, and ARD impairment prosecution started from Pennsylvania's health care boards zero tolerance impairment policy. This client was never impaired. PNAP and the PHMP and the PA PHP could not prove it. The prosecutor could never prove it. Fight your case every day. Never admit any impairment. Erie, York, Pittsburgh, Scranton, Philadelphia, Media, Lancaster Lehigh nurses protected our community during COVID. Do not let the health care boards mess up your hard earned license. call me.”

Board review after reckless driving conviction / 8 Years later complaint to board anonymously of "not reporting"
First I would like to say that at a time when I had little hope and was being pressured by the board to join PDMP even without a DUI conviction Richard alone offered me hope. But let me say he did not just offer hope, he delivered results. Initially I went through a board review that Richard helped me navigate flawlessly. He was a rock when I needed it. I was unprepared as a recent residency graduate for board inquiries, but Richard got me fully licensed and practicing within months of the initial inquiry. As if that wasn't enough, years later he also successfully helped me address a false report that I did not report the initial issue to the board. An anonymous report was filed against me. And of course the board initiated an inquiry. Richard swiftly reached out and handled the issue with a board investigator who was no doubt not on my side. Following that encounter handled all my correspondence with the state attorney for the board who fairly ruled that I had been completely transparent previously. If you need representation Richard is by far your man. He is worth every penny I promise.

The enforcement environment has ramped up even more after COVID. Now the Board is playing catch up and prosecutors are filing petitions for DUI's from before COVID. Never admit or give any information to any investigator. DO NOT CALL PNAP OR THE PHP OR PHMP. Call me to discuss your DUI and its affect on your professional license. It does not matter where your DUI or work is. I handle cases all over Pennsylvania -- Erie, Pittsburgh, Philadelphia, Scranton, Lancaster, York, Lehigh, Reading, Bucks, Berks, Chester, State College. I won my case thanks to Richard!
I contacted Richard after I was falsely accused at work of being impaired. I worked as a RN at a rehabilitation center. The company I worked for knew I had been in PNAP in the past ( and successfully completed it). I was working 4 people short during COVID and the error that occurred had nothing to do with substances or alcohol. No one was harmed in the incident and it was only myself and a pregnant nurses aide for 22 patients. I participated in the examination and had to meet with an examiner from the Board of Nursing for an hearing. After 3 years, I just found out I won my case!!! I couldn’t have done it without Richard. He is an excellent attorney with a very clear plan with principle, persistence, and plenty of preparation. Because of him I won’t lose my current job and my home. Please reach out to him before you sign any paperwork with PNAP! It is well worth it to have him in your corner. Thank you so much again Richard!!!

This client had a very long drawn out case that we won twice!!. The Hearing officer dismissed the case in a proposed adjudication. The final order of the full Nursing Board accepted that decision with its own reasoning and dismissed the case. IT IS OVER. WE WON. This COVID-related impairment prosecution started from Pennsylvania's health care boards zero tolerance impairment policy. This client was never impaired. PNAP and the PHMP and the PA PHP could not prove it. The prosecutor could never prove it. Fight your case every day. Never admit any impairment. Money well spent
Richard is extremely professional, always on time, and has great communication skills. He has a way of calming your fears and also has some great stress-relieving tactics. Not only is he a wonderful lawyer, but he is a phone call away offering great advice. He knows the Board of Nursing like the back of his hand and has extreme knowledge in handling multiple DUI situations. If you find yourself in a pickle, call Richard.

Professional license/ DUI/ PA state
Richard Hark is straight with no chaser. He kept it real, and his sense of humor was a comfort through a very stressful process. He laid out explicit instructions on how to build a bulletproof portfolio to protect my professional license. I was impressed with how accesible and responsive he was throughout our interaction. He was fair, understanding and reasonable, and I can’t thank him enough for the work he did to prepare me for the worst.

Nursing license/DUI
It’s hard to find a lawyer that is familiar with the State Board of Nursing and the traps of PHMP/PNAP/DMU. Richard Hark knows all their language and holds the keys to release the locks on our licenses. I wish I had consulted with him before I signed my initial order or spoke a word to their case managers. I’m sure the ten years I was imprisoned in their “voluntary” recovery program for a DUI would have been over within a year or two. From the beginning he cut through the bs, simply told me what I needed to do, immediately responded to my questions several times a week and resolved my issue before my hearing date. I am finally free from the Board’s program with no restrictions on my license. Richard gets the job done and saved my career. I will forever be grateful.

My web site says is first and the loudest. DO NOT SIGN ANY PHMP OR PNAP paper work until you call me. This client finally found my website, called me and we fixed and ended the nightmare that PHMP had created around the license. Drugs, percocet, alcohol, opiates create these problems. Call me from Johnstown, Crawford, Allegheny, Radnor, West Chester, Wilkes-barre. Lets talk about your case.

Professional License Defense Attorney
Richard Hark was the lawyer I chose to represent me against bogus allegations and demands made by the state board which had me lose two years of income. After doing thorough research I came across his website and was beyond impressed and knew instantly I needed him to represent me. Not only was he beyond an expert in telling me step by step the process to clear my name and gave me the push I needed whenever I became afraid or had doubts about my ability to get reinstated full and clear without any restrictions - period! There is no other attorney in the state that can do what he does with the proven methods he has to help professionals like myself get back to our careers in record time and I am forever grateful that I had the blessing of him as my representation! If you are facing any threat to your professional license he is the ONLY CHOICE work putting your faith in. He even would go out of his way to call and text me to make sure I was doing ok and If I was not getting him the info he needed in the time he demanded of me- without his commit to helping me and encouraging me- I never would have cleared my name and regained the ability to further my career.

Many of my health care clients wish to remain anonymous. This client's family circumstances created havoc in her professional life that took substantial effort undoing. Consistent and patient planning, preparation, and client meeting made her case a success. Her license is restored. She can work. She is still the professional she always was. Thanks for letting me help. If you live in Altoona, Erie, Scranton, Pittsburgh, Philadelphia or out of state in California, Texas, Florida and have a health care license issue from Pennsylvania, call me to discuss.

Excellent Attorney to handle licensing issues
I hired Richard on 2 separate occasions. I was in a lot of trouble with the PA Board of Nursing and there is NO WAY that I would have been able to deal with my situation without Richard's help. I was crippled with fear and ready to voluntarily surrender my license. Richard calmed me down, redirected me, gave me hope, and then he got to work. My case took years to resolve and Richard was with me every step of the way. I had an investigator from the Board of Nursing relentlessly trying to interview me (VERY intimidating). Richard shut that down immediately. My case required a hearing to be held in Harrisburg that Richard was with me for. He did a GREAT job at the hearing, took charge of the 3+ hours it took, and I felt like he was a REAL fighter for me. I served out a suspension (that was justified) and continued with the process with drug testing, going to meetings, counseling, and eventually an assessment with a PHMP assessor. Rich prepared me for the assessment, and it went great. Together, we were methodical with the approach to my case, and compiled a bunch of evidence in my favor to present to the board in my petition to reinstate my RN license. At the end, my license was reinstated to unrestricted, non-probationary status. I CAN'T BELIEVE that he pulled that off for me. That NEVER, EVER would have happened if I did not have Richard's guidance. 5 stars is not enough to give him with my case. If anyone from the PHMP, PNAP, board investigators, ANYONE requesting anything from the board of nursing tries to contact you, DON'T RESPOND. CALL RICHARD!

William's issue were extensive but solvable. Patience, diligence, and William following my advice allowed him to fully realize his license reinstatement. I have a plan, process, and path forward for every suspended licensee. It does not matter that I am in South Eastern Pennsylvania and William lives in Pittsburgh. I represent clients from many states and all over Pennsylvania. Erie, Lancaster, York, Luzerne, Scranton, Philadelphia are just a few locations where my client's live. Thank you for letting me help you William.

Richard and his assistant Jessica were very kind and caring and answered all my calls and questions in a timely manor. I would 100% recommend Richard with no hesitation!

Never thought I would practice again!
Richard mixed no words when explaining the rigorous process of reinstating my professional license and prepared me for the process. His confidence and proven track record reassured me, and the payment plan made my life manageable while waiting for my professional license to be reinstated.
Response from Richard Hark May 15, 2023
I routinely handle petitions to reinstate nursing, pharmacy, medical, osteopathic, or any other Pennsylvania health care license. Convictions cause health care license suspensions. Missing board ordered psychiatric evaluations result in health care license suspensions. I have a plan that I execute with many clients. Gary's story is similar to many clients -- he moved out of state and didn't get the notice for the evaluation, or had a conviction that caused the evaluation that he missed. But he didn't give up on his nursing license. While he was living out of state, we worked out a payment plan and I set out getting his documents together and getting his life in order to present to a PHMP approved expert, who approved concluded he is safe to practice. Call me to help you with your health care license reinstatement.

Can’t say thank you enough to Richard and Jessica for how much they did for me. I am truly grateful. I am a RN who was in a bad way mentally due to medication issues which in turn lead to 2 DUIs and 2 refusals. I found Richard on line to help with my nursing license. I was so nervous to call but so glad I did. He is very knowledgeable in every way and shows in everything he does. PNAP is very intimidating and Richard knows exactly how to handle them. As far as the 2 DUIs , I had a lawyer whom didn’t do much, just a waste of money so I turned everything over to Richard and so glad I did. He is well worth the money. Being from the coal region it is said that Schuylkill county is the worst county to get caught doing anything. My advice is to get out of the surrounding area if you need a lawyer. So happy I found Richard Hark. He got 1 DUI dismissed and the second DUI changed to a general impairment, He also won the Penn Dot refusal appeal and beat the nursing board impairment investigation. He beat the schuylkill county state police. He is my Mr. October. Thank you from the bottom of my heart and my family also thank you. He is truly a blessing. I can’t imagine my life now if he wasn’t my attorney. A Grateful Coalcracker Girl

Wow, Mr. October.....that is a compliment. Donna's various matters are similar to everyone else's. A single DUI creates many problems. Two in three weeks because of medication creates huge issues. Each one then needs to be handled, unraveled, and managed. It took time with Donna. Each DUI, each refusal, a Commonwealth Court appeal, and Nursing Board case. She worked the entire time. She drove most of the time. She lives in Schuylkill County. I drove up there 5 times. I drive to Scranton, Lebanon, Montour, Lehigh, Bethlehem, Lancaster, Adams and all places in between these towns and Philadelphia. Today I am in West Chester and Media. Call me with your questions.

Words just aren’t enough to thank Richard and Jessica for how much they changed my life. After a car accident on personal time in January of 2022, I was charged with a DUI. Even being in nursing for almost 20 years, I had no clue about how much this was going to change my career. I can’t say I ever knew anyone in similar circumstances. So after I self reported to the nursing board, I was quite shocked when I received the letter from PNAP about participating in their voluntary recovery program. I blindly went into the evaluation and it turned into a mess. I packed up my office and was ready to walk out of the only career I have ever known. I searched and searched online, and everything brought me to the law firm of HARK & HARK. I called and immediately received a call back from Richard. He was able to explain things very clearly and talked me off the ledge, telling me to continue to work. I almost gave up everything. I know I don’t have the type of personality to put up with what the conditions of VRP, for the mandatory 3 years, were. It made no sense that they didn’t take into account that I had no other disciplinary action ever and this was my first DUI. So I spoke with my family and within a day, agreed to have Richard handle my case. It was the BEST decision I ever made. Richard was able to provide so much information and guidance about what to expect of the mental/physical evaluation. He is a tell it like it is, no BS kind of guy and that was everything I needed at the time. We developed a plan, and even when I struggled to follow it completely, he only looked forward. I have a complicated medical history, I know the information that was being thrown at him was probably mind boggling. But the day I went to meet with the board appointed psychiatrist, he had me feeling confident and reminded me that I controlled the conversation. That morning I received a confidence building text from Richard, reminding me that this was doable. Yesterday, I received the most fantastic news from Richard; that I had won my case and would not be prosecuted over the allegations. Upon reading this, I immediately burst into tears, as did some of my coworkers. They have been on this rough, windy road with me all the way. And I have Richard to thank for everything! And Jessica is so kind and understanding. I am so happy I walked into this with this team on my side! If you EVER find your license in jeopardy, CALL RICHARD! He truly is a life saver! In more ways than one. You will be in very competent hands. Thank you Richard and Jessica! It has been quite the journey. And I’m glad it’s over! Thank you, thank you thank you! Hire Richard! He knows what he’s doing!

The last two reviews show how scary these cases are for my clients. Similar to you they have been charged with a crime and they have a health care license. Osteopathic, pharmacy, medical or nursing board licensees are all treated the same. Do not fall for the PHMP, PHP. PNAP, SARPH lies, letters, threats. These programs are not the boards that license you. These entities juts scare everyone. Hire your own lawyer to protect your license. DO NOT TRUST THESE CASE WORKERS, THE POLICE OFFICERS, YOUR JOB MANAGERS OR SUPERVISORS. DO NOT SELF REPORT TO THE PHMP AND GO TO THEIR EVALUATION. IT IS A MESS AND IT WILL MESS UP YOUR LICENSE.

First and foremost if you ever receive anything in the mail regarding your license please call a professional! I received a bogus DUI while not under the influence just because my car had a smell which put my nursing license was in jeopardy. I was less than a year shy of graduating and becoming a registered nurse when I was notified that I could not attend school. PNAP diagnosed me with cannabis use disorder, was on my heels and wanted thousands of dollars yearly to attend with job restrictions. I finally had enough and contacted Richard. He walked me thoroughly through the process. I was a nervous wreck and he was very patient with me and prepared me for the journey. I 1000% recommend him as a license defense lawyer.

Thanks CJ for the great review. More importantly, thanks for searching the internet, finding my webpages, and calling me to ask questions. PHMP and PNAP sends misleading and scary letters to licensees. Every new client tells me they thought the PHMP was the Board and they had to comply with this initial evaluation. THIS IS WRONG. As my website says, DO NOT SIGN ANY DOCUMENT UNTIL YOU TALK TO AN ATTORNEY. DO NOT RELEASE YOUR MEDICAL RECORDS. My clients in Erie, Pittsburgh, Scranton, and Lancaster have read my website, call me, and we stop the abusive PNAP process. Call me to talk about your case.

I have clients in Clearfield, West Moreland, Scranton, York, Dauphin, Philadelphia, Media, West Chester, Lancaster. Zoom, MS Teams, Facetime allow my clients and I to meet, discuss, and prepare. I am always prepared. I fight every case to make sure the Commonwealth proves their case, brings the witnesses to court, and make sure they have the evidence. Many times they don't. Do not sign PNAP, PHMP document before talking with me. Do not admit to impairments. DO NOT DO NOT DO NOT TALK WITH ANY PNAP, PHMP CASE WORKER. Call me to discuss your case.

Healthcare workers legal expert!
I met Mr Hark in January of 2021. I am a registered nurse with 23 years. I was fired by my employer due to narcotic abuse allegation. I called him and he returned my call almost immediately. I was nervous wreck. He was patient and very calming. He came up with and action plan to resolve this matter with the Board of nursing. I felt very after talking to him. He led me step by step through a stressful process. I unfortunately complicated matters by acquiring a DUI. This dui was one of several have acquired over the years. I called him and thus he assured me that we could get thru the dui too. He handled situations with the utmost precision and dedication. He was able to get my DUI reduced to a lessor offense and I served 5 days on house arrest. It could have been worst because the DUI was considered a second offense and a refusal case. On top of everything else, I obtained a charge of driving while suspended DUI related. He was able beat the driving while suspended. It was reduced to a lower charge. No jail time and no extended suspension. He was at the Board of nursing hearing with me, We went over what the possible question the board may ask of me, We are still awaiting for the outcome. No matter how it turns out. He has done everything necessary for a positive outcome. I am sure he will do the same for you.

Every potential client seeks counsel to not just advise but also handle the legal issues. As a nationally recognized health care attorney, my clients have complex issues that need to be won, not just managed. At every turn, James knew how I was going to handle the case, wheat he needed to do, and we prepared extensively for the issues of that day. I let him know the best or worst outcome so that when I won on every issue he understood the importance of our success. James' case is similar to every one of my clients; a health care professional in Pennsylvania or NJ with multiple ongoing legal issues that will effect employment and his license. I am privileged to work on Pennsylvania, Harrisburg, Scranton, Chester, Adams, Montgomery County. Every day I talk with my clients, work through their issues and counsel them. I appreciate James' review and the opportunity to help him. I am proud of my work, his appreciation, and my reputation. Thanks James.

Richard Hark did a phenomenal job handling my case. If you find yourself facing disciplinary action, I recommend calling him. He prepared me for the interview and provided the tools I needed to navigate the process. I was skeptical at first about not undergoing the employer/recommended PNAP program, but Richard was the voice of reason. He guided me every step of the way. I am thankful I called him first and allowed him to assist me. Don’t sign anything until you talk to him. Jessica is awesome. Don’t rush and get the best legal advice — which is Rich Hark!!

Michelle called me very upset. We slowed down, talked, and she expressed the issues of her case. I was able to ask her some simple questions that took very little time. I then laid out a map of what could and what would happen and how we would prepare. We prepared and we were able to close the case. I always say we because my clients are always integrally involved. DON'T SIGN ANYTHING FROM PNAP, SARPH, THE PHMP. DO NOT CALL THEM, DO NOT ADMIT ANY DRUG USE, THEFT, IMPAIRMENT, OR MENTAL HEALTH ISSUES. What you tell them they will use against you. call me.

Rich saved my life and my sanity to say the least. With the utmost patience, compassion and pertinent experience, he has been continuously supporting me through a total nightmare. At the beginning of my nursing career, I fell for the PNAP tricks in the past, while not even working or facing a legal offense. I received an anonymous complaint without the guidance of Rich. This is the biggest regret of my life. After dealing with injustice of the PNAP program in the past, I felt my life and career were totally over. I couldn’t bare the thought of going back into this program. Additionally, I felt extreme panic and fear when I received a 1st offense DUI with a refusal during a very unique period of time in my life. This time, I didn’t waste my time. I called Rich on a Sunday evening and he immediately answered, took his time to collect my information and we immediately started to prepare. Thus far, I received the minimum sentence of ARD without a drivers license suspension. Mind blowing success to say the least! In light of the overwhelming achievements we already have made together, he properly prepared me and even attended the MPE for my nursing license, for which I am wildly optimistic about winning too. He was very direct, always available, and keeps me calm and level headed. Rich was very clear on the legal issues, the health care license issues I was confronting, and how to proceed in a timely and orderly process. He has been and continues to be available via email, phone calls or texts. Stop searching the internet and hire Rich if you are facing any health care licensing or legal issues. HE CARES AND HE IS SIMPLY THE BEST, BETTER THAN ALL THE REST! Do not hesitate to hire him. Your license is worth it. Your career is worth it. Rich is worth it!! I cannot express my appreciation and gratitude enough! Hire him. I am soooo glad I did! 5 Stars is not enough, he deserves all stars in the galaxy!

The Best
Mr. Hark saved my medical license and my sanity. I was convicted of a first time DUI last year. With utmost patience, empathy and compassion, Mr. Hark supported me through a terrible ordeal. He explained all the “legalese”, worked cooperatively with my DUI lawyer (who did not grasp the ramifications for my licensure), and helped prepare me for a possible defense at the Board of Medicine. He was incredibly responsive and always available to answer my questions and allay my anxiety. My case will not be prosecuted and is now closed thanks to his diligence and guidance. I will be forever grateful for all his hard work.

I help doctors, pharmacists, nurses, CRNP's, physician assistants, psychologists, and any other health care professional with the licensing and impairment issues. It does not matter where you work or live. If you had or have a Pennsylvania license, The Pennsylvania health care boards are watching. This Pennsylvania doctor lived in New Jersey. My clients live in Erie, Lancaster, Scranton, Media, Danville, or Harrisburg. Some live in Ohio, Florida, Vancouver, Texas, Arizona. Call me to help protect your license.

Very helpful
Richard helped me handle my NCLEX application. When I was younger, I had gotten into some trouble and needed to report the situation to the board of nursing before being granted permission to sit for the NCLEX. Richard helped me navigate the situation and my case was successful. I highly recommend him!

I help aspiring doctors, pharmacists, nurses, CRNP's, physician assistants, and/or psychologists, get their licensing and avoid the NJ -- RAMP and PA -- PHMP impairment monitoring programs. The Pennsylvania and New Jersey health care boards review back at least ten years for prior criminal and alcohol use issues . It does not matter how old is that old DUI. If you want a license from NJ or Pennsylvania nurse, osteopathic, medical, or counseling the Boards are seeking impairment evaluations. Call me to help secure and protect your license.

"I have known Richard Hark for years and he is an outstanding attorney. While he handled criminal defense matters for many years, he has shifted his practice focus to administrative law where he assists professionals (nurses, doctors, lawyers, etc) when they are being disciplined by their respective licensing board. This is usually as a result of contacts with the criminal justice system or drug/alcohol problems. Despite the shift in practice, the outcomes are the same. I have seen him successfully fight the most serious criminal charges and I now refer professional clients to him when their criminal case overlaps with their professional license. He has become extremely skilled in a very sensitive area where clients' livelihoods are on the line. This is no easy task but Richard's combination of legal smarts, common sense, and empathy for his client's plight make him a perfect fit. I strongly endorse Mr. Hark."
