Physical Therapist

I was pulled over for DUI and qualified for the ARD program. The lawyer I used did not tell me anything about reporting my DUI. He told me to just not worry about it I researched a voluntary recovery program. This is an extensive self reporting program involving weekly drug tests, not being allowed ...to work in private practice and have to have all interviews and changes in employment authorized. I started reading about how harsh the program was and got nervous and thought about a change of career. I found Richard on google the morning before my interview for the program. He convinced me to cancel it and met me that afternoon. He has a very specific method requiring at least 10 steps including arrest records, Getting voluntary drug tests, referrals from coworker and so on. He also got all of my records from my primary physician and psychiatrist . The good news was that my case was completely dismissed and closed by the state PT board. I believe a large reason was because they have heard from Mr. Hawk many times and he is know for winning his cases. He was worthy every penny.

So thankful for this attorney!

I am a RN who faced a complaint to the BON. I was terrified. I had a missing, wasted narcotic. I got the dreaded letter and packet from PNAP. I knew I didn’t divert a pill. I made the smartest move and called RIchard. He called me immediately and advised me what to do. I felt confident just talking t...o him. His reassurance and “we got this” attitude instilled faith in me. I knew I hired the right attorney. During this ordeal some incidents arose that prevented me from getting a job. I represent nurses in Erie, Pittsburgh, all over western Pennsylvania as well as the eastern part of the state. I handle every client matter with the same caring, concern, and diligence. The PHMP/PNAP trap is getting trickier and the case workers more deceiving. The consequences of taking their bait and going into the PHMP for no good reason are worse than ever. The case workers file petitions to suspend and revoke nurse's licenses for any or no reason. Medical conditions causing missed drug tests are now a basis to suspend you license. Stay out of the program. Call me, as Kelly did, to help stay out of the PHMP and protect your license. Kelly, thanks for letting me help.

Pharmacist - Richard Saved My License

I am a pharmacist that got a DUI in Florida in 2008. I successfully completed 2 of 5 years monitoring in Florida before I reciprocated my license to PA in 2014. When I signed on with SARPH/PHMP in 2014 to complete my monitoring in PA not only did they not give me credit for my 2 years monitoring in ...FL but they added additional years to my 3 year contract for no apparent reason. I had passed every random screen (over 155) and never missed a check in! As many health professionals know, the PHMP can be ruthless and just plain unfair. Believe me, I spoke with 5 or 6 other attorneys to help me and they all said that they could do nothing for me because they "feared" that making a case against what the PHMP and Board of Pharmacy say would be a waste of time and money. Richard was very receptive and positive from the beginning. He was always supportive when things looked dark and always promptly returned my calls and emails. Richard took my case all the way through to the PA Commonwealth Court of Appeals! He wrote up a brilliant brief arguing my case and spoke eloquently before the Appeals Court during the Oral Arguments. Richard won the Appeal for me and now I am getting my license off probation and back to unrestricted status and more importantly I am getting my life back. I consider Richard not just a next level attorney but also my friend.

Michael helped me hit his case out of the park. Kevin Knipe and the PHMP's oppressive, over bearing treatment of licensees is on full display in this case. The PHMP and Knipe lost. The Commonwealth Court saw Knipe's behavior for what it was -- illegal, oppressive, and a violation of the Pharmacy Board Act. Michael worked really hard to stay compliant in the PHMP program. The PHMP rewarded him with more expenses, more stringent requirements, and no loyalty or care for his well being. The Commonwealth Court call this a capricious disregard for the fact and evidence in the case. Let me fight your licensing board for you.

A Great Attorney

I am a mental health nurse and work more hours than I should. A year and a half ago, I made a huge stupid mistake and got a DUI. In a panicked state I called the nursing board to make them aware. I was immediately sent a letter regarding the VAP program. The letter stated, they wanted me to go into t...he VAP program on a temporary basis (only 3 months). In that time, if I did exactly as they said I would be free and clear. So, I continued. I saw a therapist weekly (sometimes more), I had to go for random drug tests that cost me a small fortune, I did EVERYTHING they asked. After the 3 months my therpaist released me stating I did not have an impairment. My drug tests were clean. However, this was not enough for them. They were not satisfied and wanted me to go into full program. They wanted me to go into an inpatient rehab, quit working for 6 months, continue therapy, and continue random drug testing. My anxiety and stress level went through the roof. I am not making excuses for my DUI, by any means, but my life had been In turmoil for about a year. My mother passed away, my marriage fell apart after he cheated, and my father was in a car accident paralyzed. I was trying to make it on my own for the 1st time in my life and now I was going to lose the last thing that meant something to me, my career. After a few days of crying, I knew I could afford to go through this program. Who was going to pay my bill? How was I going to survive? I started looking for new jobs outside of the nursing career. I googled what other nurses did in this process. And that's when I found Richard Hark. I read all of his review. I read his blogs about the VAP. I figured, I had no choice but to call him. Even though our first conversation was through tears, he calmed me down. Explained what we could do, made no promises of course, but told me that he would be by my side through the entire process. I hired him that day. I forwarded him everything that I jad received so far. He called me frequently to check in. When he contacted the nursing board in my defense, they set up an evaluation with one of their MDs to determine the level of my impairment. He coached me through this meeting. He even took the time to call me the morning of to make sure I was Ok. I wasn't, but he made me laugh, which in turn calmed me down. Today, I got the email that the MD said I did not have an impairment. It has been a long year and a half. I have been on pins and needles waiting for an answer. It's over. I would hire Richard Hark again if needed. He was professional, courtesy, understanding, and he listens. He understands the importance of a professional license because he holds one as well. However, he understands we are human and make stupid mistakes. I thank God I stumbled upon his blog. Without him, I would not be able to continue my passion. I am forever greatful.

RN DUI

I have been an RN in Texas for 6 years. Unfortunately got a DUI a few years back, but had no reproductions with the Texas BON. 4 years after the DUI, I moved to Philly. Little did I know that the PA BON would put me through hell and back, treat me like a RN who stole narcotics and require me to get a...n evaluation by a psychiatrist THEY hired (seems wrong right?). After much panic and depression, I luckily decided to do some research and came across Richards website. DO NOT agree to or communicate with the PHMP or PNAP unless you have a lawyer by your side! After I hired richard, it was 100% worth it. We got an evaluation from a more reasonable psychiatrist and the board approved that report about 4 weeks later and issued my license (after 8 months of bullshit). Don't get tricked into letting them exploit you and wrong you. Hire a good lawyer to represent you. Richard was great. Very responsive, knowledgeable (especially with the PA BON) and committed to help me get my license.

This awesome client's case is a perfect example of a licensee facing an "application case". She has a license but wanted licensure in Pennsylvania. She received a "conditional denial"; go get a PHMP assessment and maybe we will give you a license.
