Best outcome possible

I am an lpn in Pennsylvania and I’m great at what I do. Due to a moments lapse in judgement I received a DUI and thought that my career was over. Although my DUI was completely separate from the work I do as nurse the program the nursing board wanted me to go through was extensive, humiliating and ...costly. I had made the decision to do their program because I thought it was the only option I had that would allow me to retain my license. Before I committed to the program I came across reviews online and could not find a SINGLE review that gave credence to the programs success. Instead I found horror stories of people who had to deal with not being able to work for years, while paying out of pocket for the extensive monitoring, lab work and constraints placed on them. In one of those reviews I came across a comment concerning the help that Mr. Hark had provided someone in a similar situation as mine. After speaking with him I made my decision and hired him. Mr Hark was patient,confident and knowledgeable and guided me through every step of the process. The nursing board dropped all inquiries and decided against a formal complaint. During the time that this was in the process, I retained my right to work which helped to reduce the stress of an already stressful situation. My name will not be permanently placed on a website that can be accessed by the world, and I can think about furthering my education within the nursing field. For a period of time I thought that none of that was possible but with Mr. Hark’s assistance it was a reality. I highly recommend before anyone in this situation signs any papers or agrees to any program recommended by the nursing board they speak with Mr. Hark’s office. I don’t know that I would be a nurse today if I hadn’t.

PA RN License and DUI

I was arrested for a DUI – first offense. I have been an RN for many years and had never had my RN license disciplined, been arrested or convicted for a crime. I received a letter from the PA Bureau of Professional Affairs – Professional Health Monitoring Programs. The letter informed me that I had b...een referred to the Voluntary Recovery Program (VRP) because the Department of State received information indicating that I was charged with a DUI. The letter stated that I had five days to contact the Pennsylvania Nurse Peer Assistance Program (PNAP) to make arrangements for an evaluation. The Draconian tone of the letter inferred that I was an alcoholic and needed treatment. My DUI was an isolated incident. I agree that it was irresponsible but it occurred on my personal time. I would never compromise the safety of my patients. There are stringent terms and restrictions for anyone who agrees to participate on the VRP. If one enrolls in the VRP, you cannot administer controlled substances, work in a critical care unit (ER, ICU, cath lab, etc), work as an agency nurse or a supervisor. Random drug tests are required at one’s own expense. Use of any product containing alcohol products including alcohol-based hand sanitizer is prohibited. Mandatory attendance at support groups is required. The usual time frame that one is enrolled in the VRP is at least three years. I almost signed the VRP form and mailed it. I was going to allow someone from the state evaluate me. My gut feeling told me that this was not a good idea. I searched the web, read blogs and reviewed multiple attorney websites. I contacted Richard Hark, Esq. He returned my call immediately. He explained what was going to happen. I chose Richard to represent me and that was one of the best decisions of my life. Richard always returned my calls, text messages and emails. If he was too busy, he told me when he would contact me and he did. His admin, Jessica, is wonderful. He has proven himself over the past 5 years to myself and my family.

Helped protect my nursing license

I am a registered nurse, and was charged with a first time DUI last May. I immediately worried for my nursing career and that I would lose my job or be able to work in the department in which I have worked in for 10 years. I searched for lawyers and came across Attorney Hark, and it honestly was th...e best thing I could have done to begin this dreadful process. I inquired online about my case to his office and within 10 minutes I received a personal call from his cell phone inquiring about my case. He was very direct and optimistic. He has a strong background in dealing with issues with the nursing boards, and knows the "traps" the state will try to get offenders into the nurse monitoring program. He handled my case very well, gave me great advice what to do and I felt I could trust him immediately. Over the next few months I followed his advice and things went very smoothly. I was able to meet with him prior to my required "mental" evaluation and he prepped me very well as to what to expect at the appointment. He even offered to attend the appointment if allowed by the psychiatrist. He was always very willing to receive my multiple phone calls to his personal cell phone regarding my case even when he had to pull off the road just to call me back. He will fight tooth and nail for your license. He has done this for many professionals, just read the reviews. If you are dealing with a DUI charge or any charge that can affect your personal license, he is the one to call. He is well worth the price to protect your career for the rest of your life. I could not be more grateful for all that he has done. My evaluation is complete, and I am lucky and happy to say that I have no penalty against my nursing license, and I owe that to Mr. Hark!

Don't risk you license hire hark

I am so glad that I found Richard Hark: When I received a letter informing me that I was being investigated for a complaint against my nursing license. I was nervous, scared, apprehensive, and also ready to do everything they wanted me to do in the letter. Because I knew I hadn’t done anything w...rong and was ready to do everything they asked to prove my innocence. My mother went online and looked up PA licensing attorneys and came across Richard’s name and read his blog about licensing issues and how the investigators try to trick you into doing and saying things you shouldn’t to try to prove your innocence. We were very impressed with his knowledge of the State Board of Nursing, the PNAP, and the things the investigators will say and do to get you to incriminate yourself whether you’ve done anything wrong or not. I'm so glad I contacted Richard instead, he explained to me exactly what I needed to do and why I needed to do it. He took his time with me, going through every step of the process, and I cannot thank him enough for everything that he did for me, as a result I never missed a day of work. The day the State Board asked me to go in, for a meeting, I was supposed to be meeting with one investigator, and my attorney was supposed to be allowed to be there via cell phone. However, they ended up trying to trick me and having someone completely different there and refused to allow my attorney to call in as had previously been agreed upon. He told me to get up and leave, so I did. This is just one of the tricks the investigators tried: they tried to call my cell phone, they sent emails directly to me, trying to intimidate me, Richard was there and told me how to handle all of it. I could not have done this without him and I encourage anyone thinking about doing this without a lawyer to think again. Don’t risk your nursing license, the investigators are not on your side, but Richard Hark is.

This client hired me right away. Having read my blogs, she knew not to talk to anyone and get an attorney. The facts were both horrific and ridiculous. Strategically, we set upon a plan then executed that plan. The Nursing Board attorney understood there was no case against my client, regardless of the facts. Again, great client, following my counsel, making the correct decisions with my advice, made all the difference in this case. She did not try to handle the case herself, mess it up, then end up before the Nursing Board. She hired me and her case was closed with no prosecution. Good job!!!!!
