Poor Experience with Attorney Dan Blinn

Since this reviewer decided to post anonymously and is not someone who we accepted as a client, I cannot be certain who wrote this. But, I believe that I know who it is. It is true that I had agreed to accept this person's case, and we provided her with our standard form of fee agreement. That agreement provides that our fees are based upon the value of the work that we perrform and that they are recoverable only if we recover from the business that violated the consumer protection laws. This is standard language in all of our agreements, and every lawyer (known to me) that regulary handles consumer cases uses similar language. This reviewer sent an email in response and asked if we would do the case for a percentage of the recovery. She also indicated that she was not willing to proceed if we required her to sign that agreement. We do not generally handle cases on a percentage basis, because the value of the time required to handle a consumer case frequently exceeds the value of the claim. That is not a problem for the consumer, because the business violating the law is required to pay the fee under most consumer protection laws. I expained this to the reviewer, and she responded that she was not in agreement. She also stated that she believed that the firm had wacted deceptively by stating that we handled cases on a contingent-fee basis and that we took advantage of vulnerable consumers. We disagree with that accusation, of course, because our fee agreement is contingent - it just isn't based upon a percentage of recovery. Since the reviewer was not willing to proceed under our agreement, we sent her a letter confirming that we were nto handling her case. Several weeks later, the reviewer contaced us again and asked if I was willing to discuss taking her case. At that point, I did not think that she and the firm were a good match, and I informed her that we were declining to handle her matter. It is understandable that the reviewer is frustrated that she went through our evaluation process and that we were not willing to handle her case. The sad reality is that our firm is contacted by thousands of consumers every year. We are not able to represent everyone. When deciding whether to accept a case, we consider several factors. The most important factors are whether it is the type of case that we handle and whether the case has sufficient merit to proceed. There are other factors, including whether we think it likely that there will be problems interacting with the client during the course of the case. Mutual trust and respect are essential to a productive attorney-client relationship. As the many positive reviews from our clients attes, we enjoy such a relationship with the vast majority of our clients.

I am sorry that you are upset that you were not able to speak with me personally. Every year, approximately 2,500 consumers contact me by phone or email looking for assistance. It simply is not possible for me to represent all of them, and it is also not possible for me to speak with every one personally. When you first contacted us about 3 years ago, you were unable to find some of your documents, and that is why were were not able to assess your situation at that time. When you contacted us again recently, I did review your situation, and I determined that it was past the deadline to bring a claim relating to your lease. Dora, however, had identified a separate issue relating to your second transaction. That was the claim that we suggested you might pursue in small claims court. It sounds as if we may not have communicated clearly to you that this other claim was subject to a longer statute of limitations - which is why we suggested that you might pursue it in small claims court. I apologize for that miscommunication. In any event, we do appreciate that you contacted us for guidance in your claim against a car dealer..
