Description: Our client, C.E. was pulled over in King County by a Trooper for the Washington State Patrol. In the trooper's report, he cited the only reason for the stop was C.E.'s truck "crossing over the white fog line by about one-half the truck's width, for about 4 seconds." We challenged the reason for the stop based on Washington State case law that recognizes brief, momentary, and minor deviations from the lane lines will happen from time to time and, without more, such imperfect lane travel will not constitute a valid stop. At the pretrial motion hearing, a King County District Court Judge agreed with our reasoning and dismissed C.E.'s DUI outright.
