Description:Defendant charged with trafficking in marijuana (over 30 pounds), possession of controlled substance and possession of paraphernalia. Facing a three year minimum mandatory prison sentence with an exposure of up to 30 years. Confession obtained. Facts: Police intercept box of marijuana shipped to Defendant's address at FedEx facility using a drug dog. Police open package, confront Defendant, obtain confession and consent to search residence, search residence finding more marijuana and items related to packaging and sale. I filed a Motion to Suppress all evidence and the confession based on fact that no warrant was obtained, drug dog training and certification not proven, and confession coerced after illegal detention. Motion was set for hearing but before argued the State Attorney dropped all charges.
