Marcie Gardner is devoted to the vigorous representation of adults and juveniles accused of all types of crimes, ranging from complex murder cases to simple traffic tickets (and everything in between!). As one of the few attorneys in the area with extensive experience in both adult criminal and juvenile delinquency defense, her practice’s dual-focus has also led Marcie to develop a unique expertise representing students facing public school expulsion hearings. Through her juvenile practice, Marcie learned that very few attorneys were familiar with the ins and outs of the California Education Code. Because expulsions are occurring with increasing frequency, Marcie felt compelled to learn these procedures to help her juvenile clients outside of the courtroom. Marcie also helps clients clean up any convictions on their criminal record (expungements, certificates of rehabilitation and petitions for factual innocence).

 

Marcie has been a lawyer since 1997. After receiving honors for graduating in the top 5% of her UC Davis law school class, Marcie became an associate at the Los Angeles office of the prestigious law firm Kirkland & Ellis LLP. There, Marcie was involved in cutting-edge, complex civil litigation. Her practice was geared to defense of corporate clients. Marcie balanced out her career with pro bono cases, including guardianship matters, litigating an inmate’s federal civil rights jury trial and assisting with the investigation and drafting of a habeas petition for a death row inmate.

These pro bono matters reminded Marcie that her true passion was to fight for people whose liberties were at stake. While grateful for the high-caliber legal work she experienced at the civil firm, Marcie felt her career would be much more satisfying if she could help people facing the prospect of jail or prison rather than working on cases where company profits were the bottom line. Marcie turned her efforts back to criminal defense, the field which she fell in love with after her first high school mock trial competition at age 16.  During law school, she worked for the Federal Public Defender’s Office, the Sacramento Mediation Center, and the Prison Law Office.  For the latter, Marcie advocated for administrative relief for prisoners across the state who suffered many types of injustices while incarcerated. Thus, in 2003, Marcie formed a Rancho Cucamonga-based criminal defense partnership with another attorney. For seven years, Marcie worked tirelessly on behalf of hundreds of clients. Marcie represented adults and juveniles facing criminal prosecution in all types of cases.  She also represented students facing expulsion proceedings in San Bernardino, Riverside and Los Angeles counties.

In 2011, Marcie opened her own law office, still based in Rancho Cucamonga. Just as before, Marcie practices adult criminal and juvenile delinquency defense work. Marcie accepts each case understanding that it is not just a "case" for her clients - it can be a potentially life-changing, nerve-wracking experience for each client. For clients who want or need to go to trial, Marcie pursues a "no stone unturned" defense. For clients who prefer to resolve their cases before trial, Marcie attempts to find creative solutions while keeping her clients' priorities in mind.

Finally, Marcie’s ties to this area are deeper than her law firm practice. She graduated from the University of Redlands with a degree in political science in 1994, having co-founded the University’s first Mock Trial program and leading it to national recognition. A firm believer in community service and outreach, Marcie founded and became the first President of ieLAW – the Inland Empire Legal Association of Women. ieLAW is a 501(c)(3) organization dedicated, in part, to advancing the interests of women in the community. In just a few years, ieLAW has sponsored numerous events to help struggling members of this community. For example, ieLAW has hosted holiday parties at a local shelter for abused or runaway teens, mock trials at disadvantaged elementary schools, and organized food drives for the needy. Marcie and this organization were featured in The Inland Empire Magazine in 2010.

 

Several years ago, Marcie developed a volunteer organization for students at a local elementary school, which she still spearheads to this day. Through this group, Marcie has assisted students in a wide variety of community projects, such as: writing holiday cards to soldiers; donating Halloween candy to charitable groups; funding a sick child’s wish through the inspiring Make-A-Wish Foundation; gathering hundreds of needed items for the Inland Valley Humane Society; donating hundreds of books, DVD’s and stuffed animals for hospitalized children; and donating over 800 pairs of shoes to the Haiti earthquake victims. Moreover, Marcie is a Board Member of a local Educational Foundation.  

 

These experiences have fostered a sense of compassion in Marcie which has carried over to her law practice to the benefit of her clients.

Excellent Attorney on Challenging Cases. Professional, Caring, and Effective.
Our family retained Marcie Gardner to represent our Mom when she was arrested for our Dad’s mercy killing. This was an extremely complicated and challenging case for the best Attorneys out there. The DA charged our Mom with First Degree Murder. Dad was in a Nursing Home, almost completely non-responsive, and probably had weeks to live. Mom has always been an upstanding, caring person who has always gone out of her way to help others at her own expense. She has been helping Dad stay at home for decades since his disability started and always put his health before hers. She has many medical issues of her own, and is an extremely fragile Diabetic. When Dad passed away, the Police questioned Mom and she made a very damaging statement to them. In the beginning, we were not even aware that the Police were considering Dad’s death as a crime. We thought he had passed away of Natural Causes. They simply stated that they needed to ask Mom some questions. Mom’s statement combined with other evidence gave the Police cause to arrest her and charge her. We contacted Marcie after researching Criminal Defense Attorneys and reading so many positive reviews online about her. We talked to another Attorney who was significantly more expensive and not as seasoned in this type of challenging case. Marcie took the case and never looked back. She is well respected by the courts and DA office as an excellent Attorney. Marcie was always understanding, caring and patient with Mom despite often having to explain many things multiple times to make sure she understood. She never sugar coated anything and always gave multiple options. She took the time to make sure that everyone in the Family understood the options, along with the pros and cons. Over the course of 9 months trying to get the best possible outcome for Mom and the entire Family, there were several curve balls that came up from the DA. Marcie took them in stride and adapted without blinking an eye. When Mom was having serious episodes of Low Blood Sugar, Marcie went above and beyond getting the court to provide a court order to West Valley Detention Center to ensure that her medical needs were being met. Even though the Court doesn’t have jurisdiction over the jail, it was enough to get the Jail’s attention and start taking her Diabetes more seriously. West Valley consulted with her Diabetic Doctor to make sure that her Diabetes was being handled appropriately. The end result of this case was getting a reduced plea for Voluntary Manslaughter with 3 Years. That was the lowest possible term for Voluntary Manslaughter. Marcie went through extensive lengths of providing additional mitigating information and meeting with the DA to try to get the lesser charge of Involuntary Manslaughter. In spite of Family talking with the DA directly (multiple times) and Marcie putting together the best possible argument for reducing the plea (meeting face to face with the decision makers), the DA’s office was not willing to go any lower on the plea. Unfortunately, many times the DA’s decisions are driven by Politics and they don’t want to appear “soft” regardless of how many mitigating factors you put in front of them. Even though it was absolutely the only option that we would have short of taking it to trail, I could tell that this outcome bothered Marcie personally and she truly cared about Mom. She was doing everything possible to try to get Probation so she could be released. Because of Mom’s health issues, anything over 3 years had a very strong possibility of her not living to see freedom due to her Diabetic challenges. With 3 years, at least there was light at the end of the tunnel. Marcie’s costs were significantly lower than many other Attorneys. We would whole-heartedly recommend her to anyone who is in need of a Criminal Defense Attorney. We wish the circumstances of meeting Marcie were different - but in spite of that our Family not only considers her an excellent Attorney, but also a Friend.

Felony theft and posession
I was facing felony charges of grand theft and possession of stolen property. My family and I never had to deal with accusations or court proceedings of any kind before. Unfortunately, we went through two other attorneys who were incompetent (in my opinion) before finding Marcie! From the beginning Marcie was committed to defending my cause working late nights and weekends with me. We forged a solid partnership and shared lots of information as we built up our defense. Marcie's experience and expertise is unmatched in my opinion. Ultimately, after a year and a half and a trial the charges were dismissed and I am able to begin moving forward with my life. Marcie's representation rates are more than fair for her level of commitment and experience. Thank You Marcie for your professionalism and believing in my innocence. domestic violence
I was falsely accused of domestic violence, and was really worried this was going to ruin my life. I searched for a lawyer talking with many,decided on Marcie,and am so glad I did. She chose the right strategy,worked hard, and had both my charges dismissed. She was always thorough explaining to me what was going on, and always put my mind at ease. sexual assualt (3minors)
My case was one of extreme challenges. numerous counts, charges and plaintiffs . I felt I had no chance of proving these accusations were false but I had to fight. Marcie took on the challenge and never looked back. She stood by me and for me, every step of the way through two trials. She was always honest and when we would hit a stumbling block, she never sugar coated anything. we worked as a team and I was involved in the decision makings every step of the way. She kept my family sane which in itself, I'm sure, was a great chore. The only promise she ever made to me was that I would get the very best defense she had to give and that she would be open and honest through out the entire process . I received this and much more. No question was so insignificant that she did not take time to explain and she always returned calls from my family in a timely manor as my family nor I ever had dealings with legal issue of this type or magnitude. Knowledgeable and approachable!
Marcie represented our son who was charged with possession of marijuana while he was in college (20 yrs old). Marcie met with him, was able to explain what he could expect , kept us informed with his permission (we live out of state), and did a great job representing him in court. Whenever any of us had questions, Marcie was able to answer them quickly and clearly. I highly recommend hiring her!

Great Accessible Lawyer
Marcie was the best decision our family made. Kept us informed of every and all details. Marcie was always available and didn't play phone tag with her. She gave us all the options available and went from there. She called or emailed us before she went to court. Hit and Run misdemeanor was dropped to an infraction.

Excellent lawyer
Marcie Gardner is a very knowledgable attorney who worked hard for me to have my case resolved in the best way possible. Mrs. Gardner worked very hard for me and kept me informed the entire way through out my case. She did a great job to get my misdemeanor battery dropped to an infraction because she was able to prove to the DA/ prosecutor evidence relating to my case. Trespassing Cases
Ms. Gardner handled a very challenging set of circumstances exceptionally well. She represented more than 10 college students who were charged with criminal trespass while on a hiking excursion. Several of the students were not U.S. citizens, which further complicated the matter. Ms. Gardner's diplomacy with the sheriff, district attorney, and the court were all superb. Thanks to her exceptional legal research and skills, the matter was satisfactorily resolved for every student involved. I highly recommend Ms. Gardner for any criminal matter with the highest degree of confidence.

Ms. Gardener is the nicest lawyer I ever spoke to over the phone. I never met her, but she provided all the informations I needed to resolve the case without hiring her. When I offered to compensate her for the hours she talked to me over the phone, she told me "don't worry about it, that is what she does". She recommended me to use public defender to help me since it cost me more to hire her. It turned out she was right. I will recommend her to anyone who needs help. A Second Chance from a Compassionate, Dedicated Attorney
FINDING HOPE: I never imagined getting into trouble with the law, but the unthinkable happened when two cops showed up out of nowhere and decided to search my friend and me, finding a firearm for defense, registered but without a CCW permit. Against all odds, I was in the wrong place at the wrong time, but in finding Marcie I was given a second chance, and upon the fourth pre-trial hearing my case was dismissed with a motion to suppress. Terrified from the beginning at the possible consequences of my mistake, I consulted with numerous lawyers, many with outrageous fees for a misdemeanor who were eager to attain my business with inflated promises. I was drawn to Marcie through Avvo and her website, called her, and from the start she was straightforward, honest, knowledgeable, reasonably priced, and confident to handle my case. She enabled me to take one step at a time, take every precaution, and pursue all options to dismiss my case, or at least reduce the consequences. RELIABLE & RESPONSIVE: Throughout six anxiety-ridden months, Marcie responded to each email and call with great consideration, care, and timeliness. To be honest, she treated me as you would expect an attorney to treat a family member who’d gotten into trouble; but, unlike in My Cousin Vinny, she knows the law, and wields its power deftly, cogently, and skillfully. There wasn’t a single time I doubted her ability, and she was always one step ahead, ready to pursue the best course of action. Much of the time she must have felt more like a therapist than a lawyer, always easing my nerves, doubts, and inquisitive mind, but she never expressed irritation or aloofness. My case always felt like her priority in dozens of emails and phone calls every step of the way, during which she remained composed and confident, yet direct with me and our options. TACTFUL & THOROUGH: My case was dragged on through several hearings due to the DA having trouble in gathering info from officers, the case detective, and so forth. During this time, Marcie gained continuances so that I would not be convicted without proper documentation, which never turned up. As it turns out, the DA was unable to discover any evidence, besides what the officers claimed, to support the search and seizure of my firearm. Marcie was extremely thorough in communicating with the DA on this matter, with whom she worked effectively. With the fourth pre-trial hearing around the corner and still no evidence, Marcie told the DA that she would file a motion to suppress for dismissal. The DA agreed, stating she would not oppose the motion, call officers in, or pursue the matter further. I can only imagine how effective Marcie’s communication must have been with the DA for such an ideal outcome. Had the case not been dismissed in ten minutes at the last hearing, she was prepared to negotiate with the DA on the next best scenario, having discussed with her the importance of my case’s outcome to my future. Thankfully, my case was so strong that the judge dismissed it immediately at the fourth hearing. A SECOND CHANCE: Overall, Marcie has given me a second chance and a way to prevent this mistake from lasting a lifetime and affecting my career, where convictions fall under great scrutiny. She was a professional attorney with knowledge, compassion, and power; a caring individual with genuine concern for me and my case; and a friend who, with the final dismissal, hugged me and urged me to stay in contact as I continue on what will be a much brighter future thanks to her perseverance, skill, and dedication. I recommend her unconditionally for any legal matter one might regrettably encounter. And now the police officer who stopped me has to live with the fact that a judge recognized his poor police work, which will reflect negatively on his duty to protect and serve, not to search and seize. With Marcie, justice undeniably prevails.

Great Defense Attorney in the Inland Empire
Super friendly and personable. She helped me get my case reduced and dismissed, and made me feel comfortable even though it still is an embarrassing and shameful mistake of my past that I will never let happen again. Marcie Gardner helped my brother get out of prison after serving 19 years in a California State Prison
my brother had been sentenced to 25 years to life on the three strike law, once the law had over turned, i started my search for a criminal Lawyer. I spoke with many, and I wasn't really satisfied with the ones I had talked to. Marcie Gardner is Exceptional!
Our daughter, an Honor Student, was facing expulsion after she consumed Rx medication, thinking it was an over the counter ibuprofen. She had never been suspended and was now facing expulsion. Needless to say, our Family didn't know where to turn! We decided to fight the school district's decision and we won! All charges were dropped and she returned to school. Marcie was far cheaper than the online referrals that we researched. (They wanted $5,000 up front fee just to get started). Marcie was easy to talk to and she prepared us well for what we were about to face. We'll always be grateful to Marcie.

highly recommended
I had a case pending but needed to move out of the state; a friend had recommended Marcie to handle the case and I am so glad to have had her on my side! Now living on the other side of the country I was very stressed about getting my case dismissed to move on with my life. She kept me informed of all my options every step of the way!
