Excellent Attorney on Challenging Cases. Professional, Caring, and Effective.

Our family retained Marcie Gardner to represent our Mom when she was arrested for our Dad’s mercy killing. This was an extremely complicated and challenging case for the best Attorneys out there. The DA charged our Mom with First Degree Murder. Dad was in a Nursing Home, almost completely non-respons...ive, and probably had weeks to live. Mom has always been an upstanding, caring person who has always gone out of her way to help others at her own expense. She has been helping Dad stay at home for decades since his disability started and always put his health before hers. She has many medical issues of her own, and is an extremely fragile Diabetic. When Dad passed away, the Police questioned Mom and she made a very damaging statement to them. In the beginning, we were not even aware that the Police were considering Dad’s death as a crime. We thought he had passed away of Natural Causes. They simply stated that they needed to ask Mom some questions. Mom’s statement combined with other evidence gave the Police cause to arrest her and charge her. We contacted Marcie after researching Criminal Defense Attorneys and reading so many positive reviews online about her. We talked to another Attorney who was significantly more expensive and not as seasoned in this type of challenging case. Marcie took the case and never looked back. She is well respected by the courts and DA office as an excellent Attorney. Marcie was always understanding, caring and patient with Mom despite often having to explain many things multiple times to make sure she understood. She never sugar coated anything and always gave multiple options. She took the time to make sure that everyone in the Family understood the options, along with the pros and cons. Over the course of 9 months trying to get the best possible outcome for Mom and the entire Family, there were several curve balls that came up from the DA. Marcie took them in stride and adapted without blinking an eye. When Mom was having serious episodes of Low Blood Sugar, Marcie went above and beyond getting the court to provide a court order to West Valley Detention Center to ensure that her medical needs were being met. Even though the Court doesn’t have jurisdiction over the jail, it was enough to get the Jail’s attention and start taking her Diabetes more seriously. West Valley consulted with her Diabetic Doctor to make sure that her Diabetes was being handled appropriately. The end result of this case was getting a reduced plea for Voluntary Manslaughter with 3 Years. That was the lowest possible term for Voluntary Manslaughter. Marcie went through extensive lengths of providing additional mitigating information and meeting with the DA to try to get the lesser charge of Involuntary Manslaughter. In spite of Family talking with the DA directly (multiple times) and Marcie putting together the best possible argument for reducing the plea (meeting face to face with the decision makers), the DA’s office was not willing to go any lower on the plea. Unfortunately, many times the DA’s decisions are driven by Politics and they don’t want to appear “soft” regardless of how many mitigating factors you put in front of them. Even though it was absolutely the only option that we would have short of taking it to trail, I could tell that this outcome bothered Marcie personally and she truly cared about Mom. She was doing everything possible to try to get Probation so she could be released. Because of Mom’s health issues, anything over 3 years had a very strong possibility of her not living to see freedom due to her Diabetic challenges. With 3 years, at least there was light at the end of the tunnel. Marcie’s costs were significantly lower than many other Attorneys. We would whole-heartedly recommend her to anyone who is in need of a Criminal Defense Attorney. We wish the circumstances of meeting Marcie were different - but in spite of that our Family not only considers her an excellent Attorney, but also a Friend.

Felony theft and posession

I was facing felony charges of grand theft and possession of stolen property. My family and I never had to deal with accusations or court proceedings of any kind before. Unfortunately, we went through two other attorneys who were incompetent (in my opinion) before finding Marcie! From the beginning ...Marcie was committed to defending my cause working late nights and weekends with me. We forged a solid partnership and shared lots of information as we built up our defense. Marcie's experience and expertise is unmatched in my opinion. Ultimately, after a year and a half and a trial the charges were dismissed and I am able to begin moving forward with my life. Marcie's representation rates are more than fair for her level of commitment and experience. Thank You Marcie for your professionalism and believing in my innocence. Ms. Gardener is the nicest lawyer I ever spoke to over the phone. I never met her, but she provided all the informations I needed to resolve the case without hiring her. When I offered to compensate her for the hours she talked to me over the phone, she told me "don't worry about it, that is what sh...e does". A Second Chance from a Compassionate, Dedicated Attorney

FINDING HOPE: I never imagined getting into trouble with the law, but the unthinkable happened when two cops showed up out of nowhere and decided to search my friend and me, finding a firearm for defense, registered but without a CCW permit. Against all odds, I was in the wrong place at the wrong... time, but in finding Marcie I was given a second chance, and upon the fourth pre-trial hearing my case was dismissed with a motion to suppress. Terrified from the beginning at the possible consequences of my mistake, I consulted with numerous lawyers, many with outrageous fees for a misdemeanor who were eager to attain my business with inflated promises. I was drawn to Marcie through Avvo and her website, called her, and from the start she was straightforward, honest, knowledgeable, reasonably priced, and confident to handle my case. She enabled me to take one step at a time, take every precaution, and pursue all options to dismiss my case, or at least reduce the consequences. RELIABLE & RESPONSIVE: Throughout six anxiety-ridden months, Marcie responded to each email and call with great consideration, care, and timeliness. To be honest, she treated me as you would expect an attorney to treat a family member who’d gotten into trouble; but, unlike in My Cousin Vinny, she knows the law, and wields its power deftly, cogently, and skillfully. There wasn’t a single time I doubted her ability, and she was always one step ahead, ready to pursue the best course of action. Much of the time she must have felt more like a therapist than a lawyer, always easing my nerves, doubts, and inquisitive mind, but she never expressed irritation or aloofness. My case always felt like her priority in dozens of emails and phone calls every step of the way, during which she remained composed and confident, yet direct with me and our options. TACTFUL & THOROUGH: My case was dragged on through several hearings due to the DA having trouble in gathering info from officers, the case detective, and so forth. During this time, Marcie gained continuances so that I would not be convicted without proper documentation, which never turned up. As it turns out, the DA was unable to discover any evidence, besides what the officers claimed, to support the search and seizure of my firearm. Marcie was extremely thorough in communicating with the DA on this matter, with whom she worked effectively. With the fourth pre-trial hearing around the corner and still no evidence, Marcie told the DA that she would file a motion to suppress for dismissal. The DA agreed, stating she would not oppose the motion, call officers in, or pursue the matter further. I can only imagine how effective Marcie’s communication must have been with the DA for such an ideal outcome. Had the case not been dismissed in ten minutes at the last hearing, she was prepared to negotiate with the DA on the next best scenario, having discussed with her the importance of my case’s outcome to my future. Thankfully, my case was so strong that the judge dismissed it immediately at the fourth hearing. A SECOND CHANCE: Overall, Marcie has given me a second chance and a way to prevent this mistake from lasting a lifetime and affecting my career, where convictions fall under great scrutiny. She was a professional attorney with knowledge, compassion, and power; a caring individual with genuine concern for me and my case; and a friend who, with the final dismissal, hugged me and urged me to stay in contact as I continue on what will be a much brighter future thanks to her perseverance, skill, and dedication. I recommend her unconditionally for any legal matter one might regrettably encounter. And now the police officer who stopped me has to live with the fact that a judge recognized his poor police work, which will reflect negatively on his duty to protect and serve, not to search and seize. With Marcie, justice undeniably prevails.
