Unresponsive when it counts

I had to hire Carrie Hurtik to help with a BK. I hired her through my legal insurance at work. At the first consultation, I explained my situation and told her I needed to keep my car an to NOT include my car in the BK. She told me that she would just reaffirm my loan with the bank. After the BK wa...s all finalized and discharged, I noticed on my credit report that my car WAS included in the BK. I therefore wrote to her office to inquire about it but received no response. I called and left a message. I wasn't sure exactly what happened or how it all works so I let it go for a month or so thinking it was really ok. I finally called the bank to see what they knew. According to them, I did, in fact, file bankruptcy on my car because they never received the paperwork they would've needed. Luckily, my bank allows you to keep your car after filing BK as long as you keep making payments. Since I've never missed a payment, my real concern was if my payment happened to be late just one day, they could come take my car back. And to make things worse, I wasn't getting any credit for making my payments. If/when I try to buy another car, they won't see my good payment history. I again followed up with another set of calls and another email. When I finally got a hold of Carrie she argued with me about it and blamed it on the bank, saying they never sent the paperwork back. From my perspective, I really didn't care who's fault it was. I just wanted it fixed. Knowing how important it was to me in the beginning and how I expressed my feelings up front, I felt she should've made sure it was done correctly. Finally after several emails back and forth, I had to convince her to do the right thing and re-open my file. When she finally did, it was too late. The only reason I didn't give her a one star rating is because she let me pay the filing fees in payments.

I have practiced Bankruptcy Law since 1999, I always strive to do a good job for our clients. I do an initial consultation with the client prior to preparing the petition and after the petition is complete I review the petition with the client to ensure I have all creditors and everything is correct. This client was advised that it is not possible under the Bankruptcy Code to not list a debt you owe. All Debts must be listed. This was explained to him more than once. Additionally, the debtor has the right to reaffirm or not and in most situations would still be able to keep the vehicle if they continue paying the loan on the vehicle. Timing is important if a reaffirmation agreement is to be filed the client must sign prior to a discharge. This client did not always respond quickly and a reaffirmation agreement was not signed. However, I reopened the case and paid for the filing fees of $335.00 to do so, as the client wanted the reaffirmation agreement. Banks do not always send the reaffirmation agreements timely as well, but I not only allowed the client to pay a filing fee that was only $335.00 in payments over several months due to his situation, but reopened the case to file a one and paid an additional filing fee. However, the Judge has the right to allow a reaffirmation or not. In this situation, the Judge denied the motion as the Judge did not believe it was in the debtor's best interest to sign a reaffirmation agreement. All of the debtor's debts were discharged and he received his Discharge and Final Decree. I never argued with the Client, I merely advised him how the process worked, because he did not like the response he was angry. I am sincerely sorry that the client feels the way he does, but I attempted to contact him several times with no response and even though I explained the process he is not happy and does not understand. I do not want a client unhappy, but I did everything I was hired to do.
