Criminal Defense 35%

I have always been on the side of defending the accused - in trial, on appeal, and on post conviction habeas corpus (11.07) matters. I personally handle all my cases & answer my phone. I'll discuss the case and potential fees with you over the phone and be honest and frank about your situation. I don't play games with clients trying to extract money like many lawyers.

35%
Domestic Violence 35%

I see a LOT of these cases. They often have "buyer regret" involved - the complainant later wishes police were not involved & desires to recant / "drop charges". In Harris County there is no dropping charges AND if the complainant recants, the case is reassigned to a special division of prosecutors whose job is to try to get a conviction without the assistance of the complainant. These are emotionally charged & what most of us think of as hearsay can be admitted. Hire a lawyer ASAP.

38 years

35%
Sex Crime 15%

I have handled many cases in which folks were charged with sexual assault, and in particular, sexual assault of children. These are very emotionally difficult cases & very time consuming. People should NEVER talk to police if they are being investigated with any offense, and especially this type. Police are NOT trying to truly investigate because if a child makes an allegation, there WILL be charges in 99% of the cases. Hire a lawyer early is your best defense (& talk to no one but your lawyer.)

38 years

15%
Violent Crime 7%

This is a general descriptor but I handle cases involving allegations of violence including a variety of assaults - against family members, fights, child abuse, murder, sexual assault, etc. 29 years of experience with all types of violent crimes.

7%
Child Abuse 5%

These cases are difficult for families. Oftentimes CPS is involved and there may be family members on opposite sides on the issue. The State usually comes down very hard on these, even when it is a marginal case.

5%
Credit Card Fraud 3%

More and more we are seeing these charges, and some times more along the lines of gift cards being found by employees who later use them. I'm very bothered by this type of charge especially when the "owner" cannot be identified. Never work with police - hire a lawyer to help you. Police are NOT trying to help you out - ever.

Blatant neglect of client as court appointed public defender

I have an ongoing case in court that will eventually end up being dismissed. I will screenshot the text messages I've sent to Ms. Henley to prove how blatant her disregard is for those the court appoints her to represent. It saddens me to realize that their must be countless amount of people who have... been literally neglected by Ms. Henley. If i did not come from a strong, industrious family there could have been a possibility that I would be serving a lengthy sentence for a crime i did not commit. Ms. Henley literally treated me like a bar code and would not give me any time to speak on what my options are. Instead she had the audacity to play the victim and say i was being abusive by merely following up on the case she has reset. I have asked Ms. Henley to request for the production of the documents and was abruptly told to hire my own lawyer. This is not acceptable and i am willing to take this where it needs to go to ensure no one else is represented in Texas by a public defender who is callous and has no empathy or compassion for her clients.

*EDIT: Since I responded to this comment, this client hired a lawyer and was sentenced to 100 days in jail for this offense. I was appointed to represent this client on a Class A misdemeanor charge of burglary of a motor vehicle that he got while on felony probation for robbery. After I was appointed to the BMV and while awaiting discovery (the items of which he complains that I requested but didn't receive during representation), he got arrested again on a resisting arrest charge. As a result, his bond was revoked on his BMV and he bond forfeited by leaving court without resetting on the resisting charge. He then contacted another lawyer who does appointments and told her that he was appointing her to represent him - but it does not work that way at all. The court appoints lawyer - and not while they are on the run with pending warrants. There is not a lot a lawyer can do for a client who repeatedly gets arrested and has warrants. The abusiveness was that his contacts to me were always in the evening and on weekends, including the weekend I was spreading my mother's ashes on my sister's grave after her death. He is right - his behavior is completely unacceptable and no lawyer deserves to be treated the way he thinks he should be able to treat a lawyer just because he is not paying for it. The court released me from representing him. He currently has 2 outstanding warrants and I've been informed that the State plans to file to revoke his felony probation. And he is lying when he says I told him to hire a lawyer to obtain discovery - I had not yet received the discovery on the case when he got arrested again. It was not a time to decide on options when I had not received discovery. (And notice that he posts as "anonymous". Because he knows that he has not fully shared the truth.)

Lack of follow up and investigation

We'd hired Cynthia Henley in regard to domestic dispute. After we paid, we really had no follow up with Cynthia. As a matter of fact, we had to repeatedly follow up with her to ask questions / ask her to dig deeper into issues. She repeatedly showed up 1-2 hours late every time we had a court date.... In our dispute, there wasn't enough evidence to continue the case forward, it should have been dismissed a long time ago. But Cynthia did nothing to try to resolve the issue. As a matter of fact, rather than try follow up on the lack of evidence, to talk to the opposing lawyer, to negotiate on our behalf - she literally did nothing. Once we called her to ask what was being done to our case, she had the nerve to lie and tell us that she was sick the entire weekend and was not able to do any work. She was not sick, her Facebook profile showed she was actually out on the town. Her only tactic (in our court case) was to keep resetting the court date. By her resetting the court date, it also worked in her favor as she continued to get money every month. We ultimately got tired of her antics and found a competent lawyer. He was able to get the court case dismissed with a few weeks. He didn't try to stall the court or us. He actually dug into the evidence and pointed out to us and the opposing lawyer that there wasn't enough evidence to continue the case. Had Cynthia done her job, our court case would have been dismissed a year before it actually was. At the end of the day, if you're going to be paying a lawyer to represent your court case, they should investigate what evidence there is or isn't, they should follow up with you and the opposing attorney, they should provide clear cut answers on what the status of your court case is and they should never give you excuses on how busy they are or show up hours late for your court case. You are paying them to do their job. You are not paying them to hear excuses about why they can't do their job.

Highly Recommended and Professional

With Cynthia as my lawyer, I was able to get "no bill" for my case. She is professional, understanding, and very knowledgeable of the law. She listened to my case entirely during the free consultation and after I hired her, she immediately set an appointment to discuss the next thing to do. With h...er expertise in law, the truth prevailed and the grand jury dismissed the case as "no bill". I was charged with aggravated assault with deadly weapon. I defended myself against a dangerous person but ended up being the one with a case against me. Using an unbiased approach, Cynthia presented the facts and the grand jury saw that it was a case of self-defense. The duration of this case was 3 months. After the facts were presented, the prosecutor realized that he was defending a mentally ill person. After many attempts to contact his client to verify the truth, the prosecutor also realized that it was indeed a case of self-defense. From the first meeting, I could already tell that Cynthia is a down to earth person who is passionate about helping others. I am lucky to have come across her on this AVVO website and hope that this positive review will also help others in finding her.

No Show

I called Ms. Henley with a problem i had gotten into. We met a few times and discussed my case. She even assured me that she would handle it and take care of me. I thought I had everything taken care of. Then the day of my court, I am waiting for my lawyer, Ms. Henley, to arrive and she is a no-show!...! I called her several times and at the last moment she answered saying she is not showing up!! Extremely UNprofessional and inconsiderate! It was my first time and so naturally I was very nervous and completely dependent on her. As my lawyer I would have expected her to at least give me a heads up she's not going to be able to make it, but instead she waited till after the court meeting to let me know! Needless to say, I dropped her. I would NOT recommend her to anyone! You never know if she will show up or not!

Despite my complaint and flagging to AVVO that this is a false posting that should be investigated, nothing has been done. I consider this posting to be libelous at best. I challenge the poster to come forward for further discussion.

Quite possibly the most knowldgeable, caring lawyer in Texas

Cynthia believes in rehabilitation, knows the system, offers advice on confusing situations, and is an absolute godsend. When the lawyer for my father started slacking I came to Avvo for advice. She provided a through answer to the question, responded to a very long email I sent, and took the time to... explain to me the ins and outs of the case, as well as recommend ways to ensure the best possible outcome. I was absolutely blown away by her kindness and helpfulness. I won't hesitate to recommend Cynthia to anyone who needs legal defense in Harris County. She's one of a kind!

Very nice comment and I appreciate it. I enjoy answering questions for people God gave me the opportunity to help via the education my parents paid for, and I hope that I am serving Him by helping others.
