I do not recommend this law firm
I used this law firm in 2005 for a traffic violation and when I just tried to renew my license this year (2010) I found that they had NOT taken care of the ticket even though they gave me a pink slip that said it was taken care of. Now I have to fight to get it taken care of, and they are completely...
We are human, and we occasionally make mistakes. When we do, we admit it, and we try to do whatever we can to make things right. But there was no such mistake in this instance. We promised to handle this client's ticket, which we properly did, but an administrative collection fee of $30 (called an "omni fee") was added as a result of this client allowing the ticket to fall into warrant status prior to hiring us. We immediately posted a bond to lift the warrant, and later handled the ticket itself in court. Unfortunately, there is no legal defense (at least none that I am aware of) to these so called administrative "omni fees". And there certainly isn't a legal defense that could be legitimately pursued for less than the $30 cost to pay the fee itself. These fees aren't criminal in nature, so warrants are never issued for non-payment, but the government will not renew a driver's license until the fee is paid. So they pretty much always get their money - eventually. When we get hired on a ticket that has a $30 omni fee attached to it, we offer to forward the $30 fee to the omni fee collection agency at no charge to our clients if they give us the money to do so. Otherwise we instruct them how to pay the fee on their own. But I certainly don't pay the $30 out of my own pocket, anymore than I would do the jail sentence myself should a client of mine be unfortunate enough to be convicted of a more serious crime. We explained all of this to this client, but she didn't like what we were telling her, and wanted us to pay her $30 omni fee out of my own pocket, which we wouldn't do. We had nothing to do with that fee - there is NEVER anything that we can do with these fees. The client just has to pay them (or not get their driver's license renewed.) We have handled over 80,000 traffic citations since 1985, and in doing so, have never once been cited by the Texas State Bar for professional misconduct. So notwithstanding this client's complaint about having to pay the $30 omni fee before the state would renew her driver's license, we feel that we do a pretty good job on these matters. I am very sorry that the government made her pay them $30 before they would renew her driver's license, but there was absolutely nothing I could do about it. (You can't please everyone, no matter how hard you try.) - John Gioffredi
