We were able to sue the creditor back in this case. FDCPA cases are strict liability where if a client violates the code the recovery is almost guaranteed. In this case the creditor was happy to dismiss his claims. I would have preferred to collect $$$ from the creditor but this client just wanted to go home and have some peace of mind. Often we can cure problems with a negotiated settlement. In an FDCPA case filed in bankruptcy court the client has a minimum recover of 1000 dollars often giving the client a free bankruptcy. Sometimes the creditor needs an attitude adjustment. In this case the creditor brought a knife to a gun fight and quickly exited the case.

What makes us happy is when we can take the burden from their shoulders. We try to show them how to budget and the way out of their problems. Sometimes we get clients that refuse to change beliefs or patterns of behavior that keep them stuck in poverty and overpaying creditors and bad loans that should never should have been made in the first place. Bankruptcy is not something to be ashamed of. Instead it is a fresh start on a new budget often after a tragic event in life. Overcharged and ignored
I had a free consultation with Mr. Thompson after first meeting I felt that I could move forward with him. We spent a part of the of my time talking about general things. That meeting should have been free. I asked Mr. Thompson to request the court for an extension or delay at least a 10 days for...
A foreclosure was filed by a contractor after Ms. Mitchell refused to pay. Their attorney refused to settle due to Ms Mitchell's broken promises to pay and claims the contractor didn't do the work, didn’t do quality work and talking to them in a degrading manner. She hired us. She said she needed 10-30 days to get a loan to pay off the debt. We got her 90. We worked at least 4-5 hours drafting, filing and arguing a motion, wrote letters, and made phone calls and charged her 500 dollars. We did our work perfectly and obtained over and above the results she requested. She felt entitled to a refund, wanted us to do additional work for free and spoke to us in the same degrading manner she did with the contractor. We have since allowed her the opportunity to find another attorney.
