I’m sorry to hear you were disappointed with my services. I wish we could have attempted to resolve this last year, but I was unaware of how you felt about your experience in court. One of the problems with public comments is it is difficult if not impossible for me to respond directly due to the ethics rules governing confidentiality. I cannot speak online about the details of any case or explain how I recall your experience during the plea. Sometimes a first offense charge can be reduced or dismissed, but not always. It depends on a variety of factors, such as how bad or not-so-bad the actual behavior was, how strong or weak the evidence is, the police officer’s opinion as to how the defendant treated the officer, the police officer’s wishes as to what should happen in court, the prosecutor’s understanding of these factors, the prosecutor’s mindset or approach to this type of fact pattern, and of course the judge’s view of the case presented in court. Each of these factors must be taken into consideration. The decision of whether to accept a plea offer or reject it is always made by the defendant. A defense attorney can only advise you as to the strengths and weaknesses of the case and my opinion as to whether the offer is a good option. Because the courtroom can be a scary place, people sometimes get too nervous to speak in court. Sometimes people have questions they forgot to ask or did not completely understand earlier, or forgot was already explained to them. When that happens in front of a judge, the judge will sometimes allow the attorney and defendant to speak with each other right there in the courtroom. A judge will also sometimes let the lawyer and her client go out into the hallway for a more private conversation without the pressure of being watched and waited for. I can understand why you would interpret that as anger or annoyance, but it was more likely a way of making sure you had the opportunity to have your questions answered so you could make a truly voluntary and intelligent decision regarding what option was best for you in that moment. I regret that I obviously was not able to meet your goals in this case. I wish I had known when we were in court how you were perceiving things. We probably could have waited a little longer before entering the courtroom to give you the additional time your post suggests you needed to speak with me. Because your post says the case was last year, I cannot do anything to change the court hearing’s outcome, but I would be happy to discuss it with you further in a private setting.
