Our firm only accepts clients that are having trouble dealing with bills or unwanted telephone calls. I am Board Certified in Consumer Bankruptcy Law by the American Board of Certification. Messages violated the Fair Debt Collections Practices Act. Defendant ordered to pay maximum statutory damages plus attorney's fees.
In re Hannon, 421 B.R. 728 (Bankr. M.D. Pa 2009)
Creditor ordered to show cause as to why it should not be sanctioned for failing to timely amend the claim. Court forwarded opinion to U.S. Attorney and U.S. Trustee for their determination as to whether a violation of 18 U.S.C. sec. 152(4) had occurred.
