Speeding ticket

I received a speeding ticket, along with other violation ticket, saw the great reviews in this website, and decided that I didn't want to risk going to court by myself, and hired the lawfirm. Maybe I was not as lucky as everyone else. I actually did a walk-in, and spoke to the gentleman in the fron...t desk, he saw my tickets, and without any further questions proceeded to make a document , where I was pleading guilty to the speeding ticket. I was asking questions, and he seemed annoyed, telling me, that I had to plead guilty to one of the violations to actually negotiate getting the speeding ticket to be a 2 points violation. Anyways, the lawyer that I "spoke" to did not even bother to help me understand why if I was paying over $500 I was pleading guilty. He just proceeded to tell me to sign the papers, and that was about it. Lesson learned, never again. Really felt like I just gifted them my money.

I have no clue as to whom this person is and I would encourage them to call me so that I can get more details and, if I do, will amend my responses herein. The criticism is so disjointed that I am going to have to do the best I can to interpret the complaint comments to give an adequate response. First off, it is an impossibility for us to "make up documents" without talking to and consulting with the client. We cannot create a file without input from the client. We need their name, address, phone number, e-mail address, as well as the details on what they were charged with doing (i.e., "speeding...fail to signal...reckless driving, etc.0). So we had to have interacted with the person. What I believe his main complaint is that he did not understand one the documents that he was signing, which is the authorization to appear and plea. This is the document a client must sign and have notarized if they do not want to personally come to court with us. It has certain language in it required by the state. The language must give us the ability to plead our client guilty to SOMETHING. The language reads as follows: "I hereby authorize Palumbo & Associates, PC to appear in my stead on my behalf and enter a plea to a reduced offense." In other words, we resolve most cases by plea bargain, in that we negotiate with the prosecutor to plea our clients guilty to a REDUCED OFFENSE. For example, our client is charged with a 6 POINT SPEEDING we plead them guilty to a 0 POINT WINDOW TINT. A plea bargain avoids the risk of being found guilty and having a large fine and insurance increase by paying a small fine on a violation that does not trigger insurance increases. In his review, the reviewer on the one hand claims that he felt he was being compelled to pleading guilty as charged, yet on the other adequately describes that we explained to him the plea bargaining process. He then said that the lawyer he spoke to "did not even bother to help me understand why if I was paying over $500 I was pleading guilty." To retain us only takes signing two one page documents. We explain these documents all day, every day, to dozens of people whom are normally on the phone. To claim that we did not answer all of his questions and explain the documents to him while he was in our office strains credulity beyond its breaking point. From the comment it is hard to tell if this person is a current client. If he or she is I encourage them to call us we are happy to re-explain the paperwork and the process. Moreover, while I appreciate everyone's business I do not need a client who is suspicious of our commitment to them. In addition, a client can relieve a law firm at any time. So I would encourage this person that, if they are not satisfied with our representation to contact us and discharge our firm as their counsel. Palumbo and Associates Save the Day!

Driving from New Jersey to Connecticut to visit a terminally ill friend , I got a speeding ticket in New York. I had already lost money taking time off work and paying for gas and tolls to drive through 3 states to see my friend just one last time before he passed. That was expensive enough, but we... all know speeding tickets ding your insurance 3 yrs on top of the ticket cost in states that share info. Who can afford that? But to take another days pay off plus gas and tolls to go out of state to court to try to fight a ticket that I likely wouldn't win cause I don't have much familiarity with tickets... how was that anything but more expense with little chance of it even being useful? Either of those choices just dug me deeper financially. I needed help. I saw good reviews for Michael Palumbo and decided to contact the office. Mairead Twohig and I corresponded via email and Mr. Palumbo himself answered my call, my questions, and my concerns. From the way he spoke I could tell he was very experienced with tickets like mine so I felt confident that although another law office might be able to do as well, it was unlikely anyone knew more and could do better . I also liked his polite, straightforward manner and his honesty about reasonable expectations. And although he must have to explain the same things over and over to new clients, he was still patient with my questions and careful to explain things while staying mindful of time. We're all trying to cram 28 hrs into 24. I sent in the necessary documents and payment feeling that I had made a good choice and I prepared to wait however long it took for the final outcome. Only a couple months later I received a letter... I had to keep reading it over and over cause it wouldn't sink in... DISMISSED! :) They got my ticket dismissed! Holy Moly! No fine, No insurance increase, no time off work, no paying any gas and tolls, no driving to another state to court. I said it once- Its possible there's another law office that can do as well, but there's probably not one that can do better. :) Experience counts. And their experience counted for me. When I needed help, Palumbo and Associates Saved the Day! :)

Waste of TIme

I consulted with this attorney based on a a speeding ticket for allegedly going "approximately 65 mph in a posted 35 mph zone". The officer made a visual estimation and noted on the ticket that the speed was approximately 65 mph. The officer also candidly admitted at the traffic stop that he could no...t confirm his visual speed estimate with a radar because he did not have one in the vehicle that he was driving. So, the only evidence was the officer making a visual estimate of the speed with nothing to confirm or corroborate it. I asked Mr. Palumbo during the consultation with him whether I should defend the case or try to reach some type of resolution since it was essentially the cop's uncorroborated visual estimation versus my denial, and Mr. Palumbo stated, verbatim, "I don’t have time to answer theoretical hypothetical questions. The lawyer you hire will answer all of your questions." It was a WASTE OF TIME consulting with an attorney who flatly says to potential clients that he "dont have time to answer theoretical hypothetical questions." This demonstrates only that he wouldn't even have time to represent the client and would essentially be taking their money. Mr. Palumbo is NOT the attorney to retain for speeding and traffic tickets, his advertisement of what he can do for you is not only laughable but a complete joke if not an outright misrepresentation.

Thank you for this review! It really does give me the opportunity in response to showcase and highlight the services we provide actual paying clients. People who read my response can learn a lot about traffic ticket defense, the purpose of an initial phone consultation, and the value of the services we provide. As anyone can see this person did not even retain us. Which calls into question the credibility of his opinion. He is not giving an honest opinion about the services we provide, but trying to hurt our reputation. However, all it does is make us stronger. This reviewer couches himself as a "potential client." Nothing could be further from the truth. First off, he never even called our office. This communication occurred through an online forum where I gratuitously answer basic legal questions for people. He asked a question, I answered it, he asked a follow up question, I answered it, and then he asked very technical and specific questions in the hypothetical. I then told him what he wrote above. By the nature of his questions it was obvious that this person had no intention of hiring us. He was trying to commit intellectual larceny to pick my brain on how to represent himself. My legal knowledge is my inventory of intellectual property. That, in addition to my legal acumen, legal acuity, and reputation is what I sell. While I am happy to answer basic legal questions either in an initial phone consultation or via an online forum, I am not bound to answer every legal question that shoots through ones grey matter. I am happy to provide focused information about the nature of the charges, the problems a finding of guilty can cause, the nature of the services we provide, and what would be a reasonable outcome of the case should you retain us. We need to discuss those issues so that you can make a decision as to whether or not it would be worth it, in your case, to retain our office to fight the ticket on your behalf. However, like I said, this guy never so much as picked up the phone and called, and did not ask questions online in good faith. Rather, he was seeking a written legal treatise of step by step instructions on how to represent himself in court. Again, that is the inventory of which I sell to paying clients. If someone wants to represent themselves in court they have that right. However, they should not expect a professional lawyer to give them step by step instructions on how to do it. When one represents themselves they must do their own legal research to understand the law and process. Myself and my team provide a yoeman's service to our clients. I don't recall

Mr. Palumbo spoke to me regarding my case ,improper turn, and explain to me that since nyc traffic court don't let you plea deal on the ticket his strategy would be to postpone the case for 18 months so the points on the ticket would be ready to be erased and will not go on my record and if we l...ost the case at the worst I would pay the fine , unfortunately for me, he totally forgot his strategy went to court on 12/20/2018 lost the case and his memory because after I called regarding the case he stated that he never told me that he will postponed the case for that long . definitely not the best in the market

Mr. Mancuso you can have your own opinion but not your own facts. As I told you repeatedly in no way did I state that I would postpone the case for a minimum of 18 months, and in no way did I state that the points would be "erased" and will not go on your driving record. My firm is a boutique law practice and I have been doing this a long time. As told you, and as I tell EVERYONE who consults us and asks about points, points and convictions are NEVER erased from a driving record. EVER. Your driving record is there permanently and there is a permanent, lifetime driving record that the NYS DMV maintains on you. If you, or anyone that sees this does not believe me, you can requisition your lifetime driving record from the NYS DMV and see what I am saying by going to this link: https://dmv.ny.gov/get-my-own-lifetime-driving-record. What you are confused about, and where you get the 18 month period from, is that there are LOOK BACK periods for certain things. We discussed that the 18 month look back comes into play if you accrue too many points within an 18 month period then the NYS DMV fines you more above and beyond the court fine, called an "assessment," and if you hit 11 points in 18 months then the DMV suspends your license. Anyone who sees doesn't have to take my word for it. This information is on the DMV's web site here: https://dmv.ny.gov/tickets/pay-driver-responsibility-assessment and here: https://dmv.ny.gov/tickets/about-nys-driver-point-system. THIS is what I explained to you and the reason why we adjourn the case for AS LONG AS POSSIBLE. At NO TIME did I guarantee a minimum 18 month adjournment. I never do that nor can I do that, and if anyone wants to vet me out on that simply call our office and ask anyone you speak to from my office if we can guarantee a minimum 18 month adjournment. We will tell you that we cannot. The NYC traffic court system is unlike the rest of the state in that there is no plea bargaining. A plea bargain is where an attorney negotiates with the prosecutor to avoid a trial and reduce the charge by pleading your client guilty to a charge that has no impact on his insurance rates and driving history and carries a small fine. Inasmuch as a motorist cannot do that in NYC, the motorists must take every case to trial. As in anything, you win some and you lose some. Any lawyer that tells you he wins 100% of his NYC traffic trials is lying, and if he is not lying then he has to be paying people off. It's IMPOSSIBLE to win 100% of your cases in that court, or any court for that matter, unless you do 1 trial, win, and retire. While Mr. Mancuso claims that we are "not the best in the market," what he fails to tell you is that in 2016 we represented him in a court in upstate NY (our law firm covers the entire state), and negotiated a plea from a 4 point speed to a zero point parking ticket. That was the absolute best deal that we could have gotten for him. I reviewed my client reviews from around that time frame (Nov. of 2016 - Jan. 2017) and it is quite apparent to me that at that time he did not leave me a 5 star review stating that we are the "best in market," even though we got him the best possible result. So this is the source of this negative review - someone who, after we did the best possible job anyone could ask for did not leave a positive review, but when they were disappointed an outcome which is to a large degree beyond our control, point fingers and blame, claims we consulted on things we never said and which anyone can look up at the DMV's web site as untrue, and claims that we are "not the best in the market." If you have a traffic ticket you need handled plea, by all means, go to the links I provided and vet out what I am explaining for yourself.
