Not Guilty on DWI with .17 Breath Test

Case Conclusion Date: 09.19.2012

Practice Area: DUI & DWI

Outcome: NOT GUILTY

Description: My client was charged with DWI and (unfortunately) agreed to take a breath test, blowing a .17. With nothing to lose, I set the case for trial. After three years and 8 resets, we finally got our day in court. The officer failed to appear at trial for the fourth time, and the judge forced the DA to go forward without him. Without any evidence that my client even operated a motor vehicle, she had no choice but to find my client Not Guilty.
